HomeMy WebLinkAboutResolution 99-R-22 FROM : SEMINOLE COUNTY BCC/CM PHm~E NO. 3309503 Feb. 19 1999 09:28AM P2 RESOLUTION NO. 99-R- 22 SEMINOLE COUNTY, FLORIDA THE FOLLOWING RESOLUTION WAS ADOPTED BY THE BOARD OF COUNTY COMMISSIONERS OF SEMINOLE COUNTY, FLORIDA, AT THEIR REGULARLY SCHEDULED MEETING OF FEBRUARY 9, 1999. WHEREAS, on August 31, 1998, Seninole County (County) and Time Warne~ Communications (TWC) entered into an Agreement (Agreement) relating to the provision of a local government/education access channel (Channel) by TWe as required under Section 55.61, Seminole County Codei and WHEREAS, pursuant to both Section 5 of said Agreement and Section 55.61(0.) (1) of the Seminole County Code, the allocation and use of the Channel provided by TWC is to be determined bv t.he seminole County Board of County Cornmissionersi and ~ WHEREAS, pursuant to Section 6 of said Agreement, the County agreed to provide each municipality within Seminole County, Florida, the Seminole County Community College, and the Seminol.e County School District the opportunity to participate in and provide programming for the Channel, with each governmental entity being responsible for its own progrililiming, all costs associat.ed therewith, and any appropriate portion of the costs associated with operation of the Chalu~el, and WHEREAS, the County has developed Operating Policies, Operating Procedutes, and production Standards for the Channel which include a provision for the submittal of programs for air::'ng bv eligible organizations that are appropriate and conform to t~chnical and production standards; and WHEREAS, an inter local agreement that would establish the Seminole Television Council has been endorsed by the SelllinoJ.e County School District and the following cities: Casselberry, Lake Mary, Oviedo, Sanford, Winter Springs; and WHEREAS, the Seminole Television Council would assist J..n the creation, financing, programming, and management of local government and public educational cable television progrillffiuing for Seminole County and its residents; and WHEREAS, the Board of County Commissioners strongly supports and encourages the efforts of School Board, and Community College in pooling order to achieve savings in the production educational programming; and of Seminole County the municipalities, their resources in of government and 1 FRCIl'l : SI::I'!l t~ULt: UJUt'-1l Y J:::UjCI'] t-'HUI~t: t'-1U. ..:l..:lId:!~Id..:l reb. 1:! 1:!~:! 09:29AM P3 WHEREAS, the County believes that the allocation of a portion of the time available on the County's Channel to the Seminole Televi~ion Council subject to the County's Operating Policies, Operat~ng Procedures, and Production Standards would provide the best method of implementing Section 6 of the Agreement between the County and TWCi NOW, THEREFORE, BE IT RESOLVED BY TEE BOARD OF COUNTY COMMISSIONERS OF SEMINOLE COUNTY, FLORIDA, THAT; (1) The Board of County Commissioners of Seminole County hereby approves the attached Operating Policies, Operating Procedures, and Production Standards for the Channel. The County Manager or his/her designee shall have the authority to amend said Operating Policies, Operating Procedures, and Production Standards as needed. (2) In order to provide each municipality within Seminole County, the Seminole County Community College, and the Seminole County School District the opportunity to participate in and provide programming for the County's government/education Channel, as required by Section 6 of the Agreement between the County and TWC, the County will allocate a portion of the programming time available on the County's government/education Channel to the Seminole Television Council for its use subject to the County's operating policies, Operating Procedu~es, and production Standards. (3) The time allocated to the Seminole Television Council shall be, at a minimum, twenty-eight (28) hours per week, with such hours being between the hours of 8 A.M. and 10 P.M.. The County will periodically evaluate the amount of time allocated to the Seminole Television Council in order to determine whether the amount of time allocated 'should be decreased or increased, provided, however, that the minimum allocation of twenty-eight (28) hours per. week shall not be reduced. Determinations as to the amount of time allocated, Operating Policies, Operating Procedures, Production Standards, and other matters relating to the Channel shall be made by the County Manager or his/her designee. 'l'he recommendations of the Seminole Television Council on t~e allocation and other matters relating to the Channel shall be considered by the County Manager or his/her designee. (4) In the event the amount of tinle allocated to the Senlincle Television Council is not fully utilized by the Seminole Television Council, the County will use the time as it deems appropriate. (5) Although neither a member of the Seminole Television Councilor a signatory of the interlocal agreement establishing the Seminole Television Council, the County shall designate a liaison to attend meetings of the Seminole Television Council. 2 FROM : SEMINOLE COUNTY BCC/CM PHOt--lE NO.
