HomeMy WebLinkAbout1981 10 07 Minutes MINUTES OF COUNCIL OF LOCAL GOVERNMENTS IN SEMINOLE COUNTY October 7, 1981 The regular meeting of the Council of Local Governments in Seminole County was held on Wednesday, October 7, 1981, in Seminole County Courthouse, Sanford, Florida. 1. CALL TO ORDER The meeting was called to order at 7:45 PM by Chairman Owen Sheppard. Present were: Commissioner Dolores Vickers-Altamonte Springs Mayor Owen Sheppard-Casselberry Mayor Walter Sorenson, Pat Southward-Lake Mary Deputy Mayor June Lormann-Longwood Councilman David Brashears-Oviedo Commissioner Ned Yancey-Sanford Commissioner Sandra Glenn, Barney Buettner-Seminole Deputy Mayor John Torcaso-Winter Springs County 2. APPROVAL OF MINUTES Motion made by John Torcaso, seconded by June Lormann to approve the minutes of the meeting of September 3, 1981. Motion carried unanimously. 3. TREASURER'S REPORT June Lormann reported a present balance of $75.38 in the regular checking account, with $604.24 in the savings account, including $4.24 interest earned. 4. OCCUPATIONAL LICENSING-City and County Commissioner Glenn noted Florida Statute gives both counties and cities the right to collect Occupational License fees(FS 205.032 and 205.042). She further stated there had been a 1980 Amendment to the local Occupational License under Chapter 205, concerning the increase that could be made. Southern Bell had sued the County con- cerning same. Mayor Sheppard pointed out that cities and county are both claiming the same jurisdiction. The city of A1tamonte uses the license when it does its area fire inspections. Commissioner Glenn commented that the county has the appropriate Resolution enabling them to collect the fee. Copies of FS 205.032 and .042 distributed. John Torcaso questioned if there had been any test cases in court on this issue; no, there have not. The only instance known of by Commissioner Glenn was when A1tamonte hotels and motels were appro- ached for city licensing, and complained they had already purchased same from the county. It was speculated this might be something for State legislators to research. David Brashears indicated some Oviedo Page Two 4. OCCUPATIONAL LICENSING-City and County (cont'd.) citizens might be hurt by the "double fee" system. Sandra Glenn commented it is a source of income that the State has seen fit to give municipalities and counties to run their operation; maybe mobile homes procedures should be looked into, she added. The Occupational License Supervisor for the county, explained the county is not aggressively pursuing unlicensed operators, but that they are brought out as the result of a computer printout system. It was clarified that counties and cities statewide are giving the fee standard treatment. Duval handles it like a charter county. Mayor Sheppard stated Casselberry would not be challenging the fee system as set out by Florida Statute as he sees it as a source of revenue for the cities. As requested by John Torcaso, Barney Buettner will do a printout for Winter Springs. 5. CITY REPORTS Altamonte Springs No report. Casselberry Discussion of a Code Enforcement Board case underway. Emphasis was made on notifying out-of-state owners of renters' violations on their property. It was clarified the CEB was meant to alleviate the State Attorney caseload, and is only for cities. Further discussion. It was also added that some cases can go to the Citizens Dispute Board. Lake Mary No report. Lake Mary has elected to join Altamonte and Casselberry' in their tax suit against the county. Kelton & Associates out of Deland have been recommended to represent Casselberry. Procedure would be to do a 2-3 month audit of the county, then take findings back to cities to ascertain if a suit is viable. Cost could run to $20,000 for par- ticipation by 4 cities. Longwood favors so-doing, but questions the expense that would be involved. Those present were reminded that, even if the ci ties win the sui t, no money wi 11, corne back, it is jus t to save the taxpayers money. Suggestion was made that the State legislators might pursue on behalf of the cities. After further discussion, Mayor Sorenson commented that if a 1/4 mill tax differential is involved, it will more than pay for the cost in one year; he concurred with David Brashears that the county should be asked to participate in the study. Longwood No report. Oviedo They have installed their new council members this week; the Assistant Administrator has resigned. Page Three 5. CITY REPORTS (cont'd.) Sanford Ned Yancey stated they are pleased with their new fire truck, which can reach everywhere but the Bram Towers. Seminole County The Board had asked Commissioner Glenn to present the concept of the cities and county having a Fire Training Officer; are there presently duplicated services? Could all entities save money by having a train- ing session at S.C.C. or another location? All are following the same code and training, anyway. The Board is interested in having a co- operative effort, and asks that all cities check with their councils on the possibility. It could be done in shifts of some kind, maybe 4 times a year, with all participants having a say in the choice of a Training Officer. The item will be revisited at the next meeting of CALNO. Winter Springs VFW broke ground Saturday, to be completed at month-end, on North Edge- mon and Sunshine Park. Sertoma Club will build restrooms for Sunshine Park. Barnett Bank will break ground October 15, on S.R. 434 and Moss Road. Future elections were discussed. Winter Springs is in the pro- cess of buying a water-sewer company, looks pretty good, deal to be consummated at the end of the month. Mohawk Village is going to use septic tanks, it was confirmed. Fourdee has broken ground and will be in operation in two years, looking to 2,000 personnel. Commissioner Glenn gave a brief overview on the proposed Florida Power KV Transmission Line to run north to south through Florida. Mayor Sheppard announced the next meeting of CALNO will be November 4, 1981, at 7:30 PM, City of Winter Springs. Meeting adjourned at 9:30 PM. sk
