Subject: County Road Maintenance Responsibilities
Dear Chairman Kirchoff:
As you are no doubt aware, the City has had some concern
over the division of maintenance responsibilities which
has resulted from recent actions of the legislature in
transferring responsibility for the maintenance of those
portions of the County road system which lie within the
corporate limits of the City to Seminole County. The
most recent of these actions has created some indecision
as to who should be properly charged with the maintenance
of turfed areas which are not integral to the paving
system itself. The City Commission in its meeting of
August 6th, considered the attached memorandum which I
had prepared for Mayor Floyd. We were pleased to have
the assistance of Commissioner Glenn of the Seminole
County Commission who was most helpful and understanding
and made constructive suggestions which should assist us
in resolving this matter.
The City Commission approved basic recommendations as
outlined in my memorandum that the City of Altamonte
Springs and Seminole County enter into a maintenance
agreement as authorized by Section 335.04(4) of the
State Statutes. Our goal would be to clearly define
maintenance responsibilities in such a way that the
County performs such maintenance on its road system
within the City as is traditionally performed by other
maintenance activities such as D.G.T. on the portions
of their systems which also run through the City.
Specifically, the County would accept the responsibility
for the mowing of grassed areas between the edge of
pavement and the right-of-way line with such frequency
as would be compatible with reasonable expenditures
of funds while maintaining reasonable levels of
maintenance. In return the City would recognize the

County's legitimate concern over the use of the right-
of-way for various utility activities and a desire to
maintain some level of access control from properties
within the City which access the County maintained
paving system.
Acting upon a suggestion by Commissioner Glenn, the City
Commission also approved a concept that the negotiations
between Seminole County and the City of Altamonte Springs
run parallel to similar discussions conducted within
the framework of the Council of Local Governments in
Seminole County. This has the potential for producing
a standard form of agreement between Seminole County
and each of its municipalities which would require only
minor modifications to meet the local problems of the
individual cities. I am prepared to initiate these
conversations with select members of your staff and will
arrange for participation by the City in the deliberations
of the Council of Local Governments in Seminole County.
In an effort to spur these discussions on to conclusion
I have directed the City forces to maintain the medians
on Palm Springs Drive, which were a particular sore point
with our citizens and business establishments, on an
interim basis in anticipation of an early execution of
an appropriate agreement between the City and the County.
