Dear Senator Stone:
The Administrator has asked me to respond to your letter of July 28, 1980,
your File Number Z0205160026~ on behalf of Mr. N. C. Floyd, Sr., Mayor of
Altamonte Springs, Florida, who expresses concern over the recent legislation
which requires the imposition of a surcharge on donated Department of Defense
(DOD) surplus personal property.
Section 764 of the DOD Appropriations Act of 1980, Public Law (P.L.) 96-154,
enacted December 21, 1979, provides that DOD costs of care and handling
of donated property must be recovered by application of a charge on such
property. The provisions of thi~ law do not apply to surplus personal
property which is generated by Federal civil agencies.
Based on Section 764 of P.L. 96-154, the General Services Administration
has issued a Temporary Federal Property Management Regulation whereby DOD
is required to recover the costs of care and handling of surplus personal
property under its control. This regulation provides that the costs of
care and handling be specifically attributable and allocated to the items
of property transferred for donation. Where such costs are incurred they
shall be billed by DOD to the appropriate State Agency for Surplus Property
or the designated donee.
Our regulation further provides that DOD shall maintain information on all
billings and collections of care and handling co~ts.
Please be assured that we will work closely with DOD during the implementa-
tion of the law in an endeavor to minimize the effect on the States and the
donation program participants.
