HomeMy WebLinkAbout1979 01 10 Minutes MINUTES OF MEETING OF COUNCIL OF LOCAL GOVERNMENTS IN SEMINOLE COUNTY The regular meeting of the Council of Local Governments in Seminole County was held on January 10, 1979, at the Altamonte Springs City Hall at 7:30 p.m. The meeting was called to order by Chairman Robert French. Present were: Commissioner Harry Jacobs - City of Altamonte Springs Councilwoman Barbara Christensen - City of Casselberry Mayor Walter Sorenson - City of Lake Mary Mayor June Lormann - City of Longwood Commissioner Edwin o. Keith - City of Sanford Commissioner Robert French - Seminole County Commissioner Sandra Glenn - Seminole County Mayor Sorenson moved that the minutes of the meeting of December 6, 1978, be approved as written; seconded by Commis- sioner Keith, and motion carried. The Treasurer, Mayor Sorenson, reported a balance in the treasury of $344.85. SEMINOLE COUNTY AMBULANCE SERVICE Gary E. Kaiser, Director of the Seminole County Department of Public Safety, gave a presentation to the Council of the cost comparison conducted by the County at the request of the Commis- sion on the proposal of Herndon Ambulance Service for a renewal of its franchise agreement which will expire on September 30, 1979, and the cost of the County operating an ambulance service. The purpose was to inform the cities before the public hearing to be held on January 16. A copy of the information distributed is attached. Commissioner French relinquished the chairmanship to the new Seminole County representative, Commissioner Sandra Glenn. ELECTION OF OFFICERS The following officers were elected for the year 1979: Chairman - Seminole County (Commissioner Sandra Glenn) Vice Chairman - City of Longwood (Mayor June Lormann) Secretary-Treasurer - City of Lake Mary (Mayor Walter Sorenson) Seminole County Attorney Nikki Clayton was recognized as a member of the audience. MINUTES OF MEEcNG OF COUNCIL OF LOCAL GO""l-{NMENTS IN SEMINOLE COUNTY Page 2 January 10, 1979 DIRECTION TO TAX EQUALIZATION COMMITTEE Bo Simpson, Chairman of the Tax Equalization Committee, requested direction from the Council as to the responsibilities of the Committee because of the cases on this matter that have been brought in court. His background information included: It has been determined that legislative action cannot be taken to this State to deal with double taxation because of the many differ- ences within the counties of duplicated services, which is the key to double taxation. It has also been determined that the work must be done within each county toward an end, which the ultimate equalization of taxes will not reflect a statewide level because of the differences in the populations ratiowise of municipalities as opposed to unincorporated areas. The city budgets are needed only to determine those areas of duplicated services because there cannot be double taxation without dupli- cation of services but there can be duplication of services where double taxation does not exist. The State has mandated that there must be a meeting between municipalities within the county and the governing body of the county to reach a point not of discussion but of tax equalization or double taxation. Mr. Simpson pointed out that the only prerogative at this time is to deal with ad valorem taxes under state statutes and as ruled by the courts in order to reach a bottom line which would say that taxes of the county and the municipalities could be reduced. He said that the courts have ruled that you cannot have retroactive refundable taxes, and that it would be 1981 before anything could be done about relief from double taxation unless action is taken this year. Mayor Sorenson moved that the Council request the Tax Equaliza- tion Committee follow the outline presented by Mr. Simpson for the study, including dealing only with ad valorem taxes, and an analysis be made of departments or divisions regarding their specific services or activities and the degree to which they are funded by ad valorem taxes. Motion seconded by Commissioner Jacobs and carried. It was the consensus of the Council that since the appointed representatives of the Committee are more knowledgable, that the Committee should be given general direction to arrive at a percentage type situation, identifying areas in their opinion where there is possibility of a duplication of services and double taxation does exist but that specific direction remain in control of the Committee. The Committee would be in constant communication with the Council as they progress in their report and would present to the Council their findings for consideration and distribution to the entities. Mr. Simpson noted that during the course of the study he would be interested in trying to establish areas which need to be recommended to the Legislative Delegation to be changed. , MINUTES OF MEI NG OF COUNCIL OF LOCAL GO .tNMENTS IN SEMINOLE COUNTY Page 3 January 10, 1979 REPORTS Altamonte Springs - Commissioner Jacobs requested support of the Council on the Center Street project which is an alternate traffic route for State Road 436 to parallel State Road 436 between Palm Springs Drive and Montgomery Road which would relieve the traffic problem on S.R. 436. Altamonte Springs would like to have this project given high priority in terms of receiving federal aid. The procedure for this is to request the Metropolitan Planning Organization to suggest that Altamonte Springs become a candidate for federal aid and to suggest a priority that this project would be given. Commissioner Jacobs agreed to obtain statistics and map for each member. and this matter would be put on the agenda for discussion at the February meeting. City of Casselberry - no report City of Lake Mary - no report City of Longwood - no report City of Sanford - Commissioner Keith requested comments from other members on the problem of enclaves. It was agreed to place this item on the agenda for the February meeting. Seminole County - no report City of Winter Springs - no representative present City of Oviedo - It was suggested that that a letter be sent by the Secretary or that the Chairman contact the City of Oviedo regarding the Council.
