REQUEST: Public Works Department/Utility Division Requesting Authorization to
Execute Supplement #2 to Amendment 35 for Consulting Engineering
Services
PURPOSE: The purpose of this Board item is to request authorization to execute Supplement
#2 to Amendment 35 - Construction Administration Services for Reclaimed
Water Improvements with Conklin, Porter & Holmes Engineers, Inc. at a cost of
$67,425.00.
CONSIDERATIONS:
This supplement is needed to provide construction administration services for the
Reclaimed Water Improvements to the East Water Reclamation Facility. The City does
not have the staff for full construction administration and this service has been
historically contracted out. The scope of work includes preconstruction and progress
meetings, shop drawing review, change order preparation, pay request processing,
resident project representative services, electrical sub consultant services, record
drawings, and DEP certification of completion.
The contractor for this project is proposed to be Encore Construction Company of
Altamonte Springs with a low bid of$I,065,400.00. The scope of work for the
construction project includes replacement of the chlorine contact chamber, a new transfer
pump station, a new distribution pump station, installation of transfer and distribution
piping within the plant site, removal of one storage pond, and the relining of the second
pond to create a reject storage pond.

FUNDING:
The project construction costs and construction administration costs are included
in the 1997 Utility Construction Fund budget (3630-56310) at a total estimated cost of
$1,500,000. Ifthe construction contract and construction administration contract are
approved, the total authorization would be $1,239,365 which is within budget. The funds
for the construction administration will be expended within 240 days of execution.

RECOMMENDATION:
It is recommended that authorization be given for the execution of Supplement No.2 to
Amendment 35 for Construction Administration Services for Reclaimed Water Improvements
with Conklin, Porter & Holmes Engineers, Inc. at a cost of$67,425.00 payable from the 1997
Utility Construction Fund line code (3630-56310).
IMPLEMENTATION SCHEDULE:
This work will be completed within 240 days of execution. It is estimated funds
will be expended by September 30, 1997.

and Inspection Services
This supplement is made and. entered into this day of
1997, by and between the City of Winter Springs and Conklin, Porter
and Holmes - Engineers, Inc.
WHEREAS, the CITY and ENGINEER have previously entered into an Agreement for
the ENGINEER's professional services (Amendment No. 35); and
WHEREAS, the CITY and the ENGINEER shall refer to Amendment No. 35 herein, and
desire to have it incorporated by reference; and
WHEREAS, the CITY and the ENGINEER now wish to modify and add specific items to
Amendment 35
NOW THEREFORE, in consideration of the mutual promises and covenants contained
herein and given one to the other, the sufficiency of which is hereby acknowledged, the parties
agree as follows:
I. SCOPE OF WORK
The scope of work has been agreed to by the parties, and is attached hereto and
incorporated herein, by reference, as EXHIBIT 1. Terry M. Zaudtke, P.E., DEE,
Senior Vice President, has been designated as Project Manager for this project, by
the ENGINEER.
II. FEE
The fee has been agreed to by the parties, and as attached hereto and'incorporated
herein, by reference, as EXHIBIT II.
III. TERM
The term of this Supplement shall be for ten (10) months from the date of final
execution by the City.
IV. ENTIRE AGREEMENT
This supplement supersedes all previous authorizations, agreements, or
representations, either verbal or written, heretofore in effect between the CITY and
the ENGINEER that may have concerned the matters covered herein, except that
this Supplement shall in no way supersede or amend Amendment 35 or other
authorizations except as specifically provided herein. No additions, alterations, or
variations to the terms Of this Supplement shall be valid, nor can the provisions of
this supplement be waived by either party, unless such additions, alterations, or
waivers are expressly set forth in writing in a document of import equal to
Amendment 35 or the Supplement, and duly executed.

SUPPLEMENT No.2
ENGINEERING SCOPE OF SERVICES
A. ADMINISTRATION OF CONSTRUCTION SERVICES
The construction phase will commence with the award of the construction contract and will
terminate upon written approval of final payment by the ENGINEER on the construction
contract. During the construction phase, the ENGINEER will provide administration of
construction services. Contract duration is 240 days.
1) Advise and consult with the OWNER and act as his representative as provided in
the General Conditions of the construction contract. The extent and limitations of
the duties responsibilities and authority of the ENGINEER as defined in said
General Conditions shall not be modified without the ENGINEER's written
consent.
2) Conduct a preconstruction conference. Conduct all monthly progress meetings
(eight anticipated).
3) Make periodic visits to observe the progress and quality of the executed work and
to determine, in general, if the work is proceeding on time and in accordance with
the Contract Documents. ENGINEER will not be required to make exhaustive or
continuous on-site observations to check the quality or quantity of the work under
this item; he will not be responsible for the construction means, methods,
techniques, sequences, or procedures for the safety precautions incidental thereto;
his efforts will be directed toward providing additional assurance for the OWNER
that the completed project will substantially conform to the requirements of the
Contract Documents, but he will not be responsible for the Contractors' failure to
perform the construction work in accordance with Contract Documents; and during
such visits and on the basis of his on-site observations as an experienced and
qualified design professional, he will keep the OWNER informed on the progress
of the work, will endeavor to guard the OWNER against defects and deficiencies
in the work of the C0'ltractors, and may disapprove or reject work as failing to
conform to the Cont]' .:t Documents.
4) Check and approve shop drawings, diagrams, illustrations, brochures, catalog data,
schedules and samples, the results of tests and inspections and other data with the
contractor is required to submit, but only for conformance with the design concept
of the project and compliance with the information given in the Contract
Documents; assemble maintenance and operating instructions, schedules,
guarantees, bonds and certificates of inspection required by the Contract
Documents.
5) Prepare routine change orders.
6) Issue all instructions of the OWNER to the contractor; he may as the OWNER's
representative, require special inspection or testing of the work (whether or not
fabricated, installed or completed); he will act as interpreter of the terms and
conditions of the Contract Documents and judge of the performance thereunder by
the OWNER and the Contractor and will make decisions on all claims of the
OWNER and the contractor relating to the execution and progress of the work and
all other matters and questions related thereto; but the ENGINEER shall not be
liable for the results of any such interpretations or decisions rendered by him in
good faith.
7) Based on his on-site observations as an experienced and qualified design
professional and on his review of the contractors' applications for payment and
supporting data, determine the amount owing to the contractor and approve in
writing payment to the contractor in such amounts; such approval of payment to
constitute a representation to the CITY, that is an expression of the ENGINEER's
opinion, based on such observations and review, that the work has substantially
progressed to the point indicated and that, to the best of his knowledge, information
and belief, the quality of the work is in accordance with the Contract Documents
subject to an evaluation of the work as a functioning project upon Substantial
Completion and to the results of any subsequent tests called for in the Contract
Documents and to any qualifications stated in his approval), but by approving an
application for payment, the ENGINEER shall not be deemed to have represented
that he has made any examination to determine how and for what purposes the
Contractor has used the monies paid on account of the Contract Price or that title
to any of the Contractor's work, materials, or equipment has passed to the CITY
free and clear of any liens, claims, security interests or encumbrances. Such
representation shall at no time be considered as a legal obligation of the
ENGINEER.
8) Participate in a pre-final inspection to determine if the project is substantially
complete with puncWists of items to be corrected (if applicable) and a final
inspection to determine if the project has been completed substantially in
accordance with the Contract Documents and that the contractor has substantially
fulfilled his obligation thereunder so that the ENGINEER may approve, in writing,
final payment to the contractors.
9) The ENGINEER shall not be responsible for the acts or omISSIOns of the
contractors, any subcontractor, or any of the contractors' subcontractors, agents,
or employees or any other persons performing any of the work under the
construction contracts, or of others.
10) Furnish the OWNER a set of reproducible record drawings for the construction
contract showing those changes made during the construction process, based on the
marked up prints, drawings and other data furnished by the contractor and/or the
OWNER to the ENGINEER and which the ENGINEER considers significant in
accordance with Section 01300 of the Contract Documents. Prepare certificates of
completion for FDEP.
11) Furnish three (3) additional copies of reports, permits, and of drawings and
Contract Documents for use by the contractors in performing their work.
D. CONSTRUCTION QUALITY CONTROL TESTING
All quality control testing will be performed by the contractor in accordance with the
documents.
E. RESIDENT PROJECT SERVICES
Limited, part-time Resident Project Representative Services, supplementing CITY
personnel activities, shall be provided for the project.
1) The duties and responsibilities and the limitations on the authority of the Resident
Project Representative shall be set forth and shown in the Contract Documents and
included herein as Exhibit B.
2) The ENGINEER will provide Resident Project Representative Services based on
a 240 day construction contract and schedule. It is estimated that total hours of
service will be required at key points during the construction cycle. This service
includes provision of observation of work for compliance with Plans and
Specifications on more or less a continuing basis (but not full-time) as construction
proceeds; notification of the contractor of non-compliance; observation of materials
at their source or in the job site; and provide a record of the contractors activities
throughout the construction, including notations on the nature and cost of any extra
work or changes ordered during construction; however, the ENGINEER is not
responsible for the performance of the construction contract by the contractor. One
part-time Resident Project Representatives will be directed to provide for the
construction contract by the ENGINEER in order to provide more extensive
representation at the project site during the construction phase is authorized by the
CITY.
3) Through the additional on-site' observations of the work in progress and field
checks o( material and equipment by the Resident Project Representative, the
ENGINEER will endeavor to provide further protection for the CITY against
defects and deficiencies in the work, but the furnishing of such resident project
representation shall not make the ENGINEER responsible to find or note all
discrepancies in the work nor for the contractors failure to perform the construction
work in accordance with the Contract Documents. These additional on-site
observations and other services of the Resident Project Representative are
supplementary to the periodic visits and other services provided.
4) CITY personnel will work with the RPR and report on a regular basis their
observations. Project inspection will be a cooperative effort between the
ENGINEER and CITY.

Dear Mr. Zaudtke:
We are pleased to submit our revised proposal for general services during construction for the above
project. Our services shall be for the electrical work shown on our contract documents and shall
consist of the following:
Task 1 - Shop Drawing Review
. Review and approve (or take other appropriate action in respect of) Shop Drawings and samples, the
results oftests and inspections and other data which each Contractor is required to submit, but only
for conformance with the design concept of the Project and compliance with the information given

in the Contract Documents (but such review and approval or otner action shall not exceed to means,
methods, sequences, techniques or procedures of construction or to safety precautions and programs
incident thereto); and receive and review (for general content as required by the Specifications)

Task 2 - Issue Clarifications
Issue all instructions of OWNER to Contractor(s); issue necessary interpretations and clarifications
of the Contract Documents; have authority, as OWNER's representative to require special inspection
or testing of the work; act as initial interpreter of the requirements of the Contract Documents and
judge of the acceptability of the work thereunder, and make decisions on all claims of OWNER and
Contractor(s) relating to the acceptability ofthe work or the interpretation of the requirements of the
Contract Documents pertaining to the execution and progress ofthework. The ENGINEER shall
render all interpretations or decisions in good faith and in accordance with the requirements of the
Contract Documents.

Task 3 - Site Visits
Make visits to the site at periods appropriate to the various stages of construction to observe, as an
experienced and qualified professional, the progress and quality of the executed work of
Contractor(s) and to determine in general ifsuch work is proceeding in accordance with the Contract
Documents. Prepare trip reports to document observations made during these inspections.
ENGINEER shall not be responsible for the means, methods, techniques, sequences or procedures
of construction selected by Contractor(s) or the safety precautions and programs incident to the work
of Contractor(s). ENGINEER's efforts will be directed toward providing a greater degree of
confidence for OWNER that the completed work of Contractor(s) will conform to the Contract
Drawings, but ENGINEER shall not be responsible for the failure of Contractor(s) to perform the
work in accordance with the Contract Drawings. During such visits and on the basis of on-site
observations, ENGINEER shall keep OWNER informed of the progress of the work, shall endeavor
to guard OWNER against defects and deficiencies in such work and may disapprove or reject work
failing to conform to the Contract Documents.
Task 4 - Startup
BEC will make available a project representative to visit the construction site on a periodic basis
during project milestones and critical work. BEC reserves the right to request additional
compensation, should construction extend beyond the Substantial and/or Final Acceptance periods
except for delays resulting from acts or omissions of the Consultant.
The above work will be performed on a lump sum basis of$9,860.00. A detailed cost breakdown
of job tasks is provided on the following page. Our fee will be billed at monthly intervals. Travel
to and from the site and other direct costs are included in the overhead rate and will not be billed as
a separate .line item.

at their source or in the job site; and provide a record of the contractors activities
throughout the construction, including notations on the nature and cost of any extra
work or changes ordered during construction; however, the ENGINEER is not
responsible for the performance of the construction contract by the contractor. One
part-time Resident Project Representatives will be directed to provide for the
construction contract by the ENGINEER in order to provide more extensive
representation at the project site during the construction phase is authorized by the
CITY.
3) Through the additional on-site observations of the work in progress and field
checks of material and equipment by the Resident Project Representative, the
ENGINEER will endeavor to provide further protection for the CITY against
defects and deficiencies in the work, but the furnishing of such resident project
representation shall not make the ENGINEER responsible to find or note all
discrepancies in the'work nor for the contractors failure to perform the construction
work in accordance with the Contract Documents. These additional on-site
observations and other services of the Resident Project Representative are
supplementary to the periodic visits and other services provided.
4) CITY personnel will work with the RPR and report on a regular basis their
observations. Project inspection will be a cooperative effort between the
ENGINEER and CITY.

Dear Mr. Zaudtke:
We are pleased to submit our revised proposal for general services during construction for the above
project. Our services shall be for the electrical work shown on our contract documents and shall
consist of the following:
Task 1 - Shop Drawing Review
. Review and approve (or take other appropriate action in respect of) Shop Drawings and samples, the
results of tests and inspections and other data which each Contractor is required to submit, but only
for conformance with the design concept of the Project and compliance with the information given
in the Contract Documents (but such review and approval or otHer action shall not exceed to means,
methods, sequences, techniques or procedures of construction or to safety precautions and programs
incident thereto); and receive and review (for general content as required by the Specifications)
maintenance and operating schedules and instruction, guarantees, bonds and certificates of inspection
which are to be assembled by Contractor(s) is in accordance with the Contract Documents.
Task 2 - Issue Clarifications
Issue all instructions of OWNER to Contractor( s); issue necessary interpretations and clarifications
of the Contract Documents; have authority, as OWNER's representative to require special inspection
or testing of the work; act as initial interpreter of the requirements of the Contract Documents and
judge of the acceptability of the work thereunder, and make decisions on all claims of OWNER and
Contractor(s) relating to the acceptability of the work or the interpretation of the requirements of the
Contract Documents pertaining to the execution and progress ofthework. The ENGINEER shall
render all interpretations or decisions in good faith and in accordance with the requirements of the
Contract Documents.

Task 3 - Site Visits
Make visits to the site at periods appropriate to the various stages of construction to observe, as an
experienced and qualified professional, the progress and quality of the executed work of
Contractor(s) and to determine in general ifsuch work is proceeding in accordance with the Contract
Documents. Prepare trip reports to document observations made during these inspections.
ENGINEER shall not be responsible for the means, methods, techniques, sequences or procedures
of construction selected by Contractor( s) or t~e safety precautions and programs incident to the work
of Contractor(s). ENGINEER's efforts, will be directed toward providing' a greater degree of
confidence for OWNER that the completed work of Contractor(s) will conform to the Contract
Drawings, but ENGINEER shall not be responsible for the failure ofContractor(s) to perform the
work in accordance with the Contract Drawings. During such visits and on the basis of on-site
observations, ENGINEER shall keep OWNER informed of the progress of the work, shall endeavor
to guard OWNER against defects and deficiencies in such work and may disapprove or reject work
failing to conform to the Contract Documents.
Task 4 - Startup
BEC will make available a project representative to visit the construction site on a periodic basis
during project milestones and critical work. BEC reserves the right to request additional
compensation, should construction extend beyond the Substantial and/or Final Acceptance periods
except for delays resulting from acts or omissions of the Consultant.
The above work will be perforined on a lump sum basis of $9,860.00. A detailed cost breakdown
of job tasks is provided on the following page, Our fee will be billed at monthly intervals. Travel
to and from the site and other direct costs are included in the overhead rate and will not be billed as
a separate line item.
