REQUEST: Public Works Department Requesting Authorization to Execute Supplement 2 to
Amendment 64 - Construction Administration Services for Tuskawilla (Main
Street) and Hickory Park Grove Boulevard with Conklin, Porter & Holmes
Engineers, Inc.
PURPOSE: The purpose of this Board item is to request authorization to Execute Supplement 2 to
Amendment 64 - Construction Administration Services for Tuskawilla (Main Street)
and Hickory Park Grove Boulevard with Conklin, Porter & Holmes Engineers, Inc. at a
cost of$44,871.00.
CONSIDERATIONS:
This supplement is needed to extend construction administration services for the
construction of Main Street and Hickory Park Grove Boulevard and the associated
infrastructure. The project is needed to fulfill the City's obligation under the Schrimsher and
IDC Calhoun developer agreements. The scope and complexity of this project coupled with
reductions in City technical staff the last several years necessitates the use of a consultant to
provide adequate project oversight.
This supplement is needed for the additional 16 weeks of construction that will occur
due to weather related time extensions. The original scope of construction administration
services in Supplement No.1 was approved on January 14, 2002 at a cost of$121,605. The
scope of work includes daily inspections, shop drawing approval, change order preparation,
regulatory certi~cations and construction administration estimated at 4 hours per day. The
cost for supplement #2 is $44,871. This expense is eligible for reimbursement from the One
Cent Sales Tax Renewal funds.

FUNDING:
The funding source for this project expenditure of $44,871 is the 2002-2011 One-Cent
Sales Tax funds from Seminole County. The funds for this project will be expended over the
next 120 days.
RECOMMENDATION:
It is recommended that authorization be given to execute Supplement 2 to
Amendment 64 - Construction Administration Services for Tuskawilla (Main Street)
and Hickory Park Grove Boulevard with Conklin, Porter & Holmes Engineers, Inc. at a
cost of $44,871.00 payable from the One-Cent Sales Tax Funds from Seminole
County.
IMPLEMENTA TION SCHEDULE:
The scope of services will be completed within 120 days of approval.

This Supplement NO.2 to Amendment No. 64 is made and entered into this day of
, 2003, by and between the City of Winter Springs, a Municipal Corporation
(hereinafter called the OWNER) and CPR Engineers, Inc., a Florida Corporation (hereinafter called
the ENGINEER), doing business locally at 1117 E. Robinson Street, Orlando, Florida, 32801.

WHEREAS, the OWNER and the ENGINEER have previously entered into an Agreement for the
ENGINEER'S professional services for construction administration services (Supplement No.1); and
WHEREAS, Supplement No. 1 was approved, authorized by the Commission; and
WHEREAS, additional services are required for additional construction work and time, construction
administration and inspection services; and
WHEREAS, the OWNER and the ENGINEER now wish to further modify and add specific items to
Amendment No. 64;
NOW THEREFORE, in consideration of the mutual promises and covenants contained herein and
given one to the other, the sufficiency of which is hereby acknowledged, the parties agree as follows:
I SCOPE OF WORK
The scope of work has been agreed to by the parties, and is attached hereto and
incorporated herein, by reference, as Exhibit 1. Mr. Terry M. Zaudtke, P.E., Chief
Operating Officer, has been designated as Project Manager for this project, by the
ENGINEER.

FEE
The fee has been agreed to by the parties, and is attached hereto and incorporated
herein, by reference, as EXHlBIT II.

ENTIRE AGREEMENT
This Supplement No. 2 to Amendment No. 64 supersedes all previous authorizations,
agreement, or representations, either verbal or written, heretofore in effect between the
OWNER and the ENGINEER that may have concerned the matters covered herein,
except that this Supplement shall in no way supersede or amend Supplement 1 and
Amendment No. 64 or other authorizations except as specifically provided herein. No
additions, alterations, or variations to the terms of this Supplement shall be valid, nor
can the provisions of this supplement be waived by either party, unless such additions,
alternations, or waivers are expressly set forth in writing in a document of import equal
to Amendment No. 64 or Supplement 1, and duly executed.
IV. TIME OF COMPLETION
This Amendment will be completed and run with the construction schedule timeframes.
The revised construction completion date is February 19, 2003.

*One individual will be assigned as the Resident Project Representative on a full time basis. He/she will be billed
at the rate of Construction Field Rep. II. However, it is not planned for a Resident Project Representative to be
present full time at the site nor at all times while the contractor is working. Therefore, there may be contractor
work which will not be observed. The Resident Project Representative will provide additional periodic visits and
observations to those provided under the Administration of Construction Phase. It is also anticipated that the
City staff will keep a close eye on the project and be in communication with the Engineer as required.
