Authorization
REQUEST: The Public Works Department I Stormwater Division Requests City
Commission Authorization to enter into an agreement to the First
Amendment to Interlocal Agreement Providing Joint Funding for the
Watershed Atlas between Municipalities and Seminole County.
PURPOSE: The purpose of this agenda item is to request authorization to enter into an
agreement to the First Amendment to Interlocal Agreement Providing Joint
Funding for the Watershed Atlas between Municipalities and Seminole
County .
CONSIDERATIONS:
This agenda item is needed to continue funding the maintenance of the Watershed Atlas.
The City Commission previously approved on October 23, 2000 an interlocal between Seminole
County and the Municipalities within Seminole County that provided for the development and
maintenance of a Watershed Atlas. The original Agreement was for three years with two one-
year optional renewals, with an initial cost share of $10,000 and an annual maintenance cost share
of$5,000. The First Amendment to the Interlocal Agreement will extend the term of the original
Agreement indefinitely at an annual maintenance cost of $5,000 subject to a right of termination.
The Watershed Atlas is a water resources web site which provides educational and other
useful information to both citizens and professionals. Information available from the Watershed
Atlas includes items such as water quality hydrologic data and near-real time meteorological data,
which proved to be extremely valuable during the 2004 hurricane season. The Watershed Atlas
also fulfills the requirements of the County's federally mandated National Pollution Discharge
Elimination System (NPDES) Stormwater Permit, of which the City is a co-permittee.

FUNDING:
The annual cost share of $5,000 per City remains the same as per the original Agreement.
The funding source ofthe $5,000 is in Line Code 3800-54693 of the Stormwater Utility Budget.
RECOMMENDATION:
Staff recommends that authorization be given to enter into an Interlocal Agreement with
Seminole County and the other Municipalities in the first Amendment to Interlocal Agreement
providing Joint Funding for the Watershed Atlas.

address is P.O. Box 950700, Lake Mary, Florida 32795-0700, the CITY OF OVIEDO, a
Florida municipal corporation, whose address is 400 Alexandria Boulevard, Oviedo,
Florida 32765-0159, the CITY OF SANFORD, a Florida municipal corporation, whose
address is P.O. Box 1788. Sanford, Florida 32772-1788, the CITY OF WINTER
SPRINGS, a Florida municipal corporation, whose address is 1126 East State Road
434, Winter Springs, Florida 32708, and SEMINOLE COUNTY, a political subdivision of

WIT N E SSE T H:
WHEREAS, the parties entered into an Interlocal Agreement dated November
29, 2001 which provided for the development and maintenance of the Seminole County
Watershed Atlas (hereafter the "Original Agreement"); and
WHEREAS, the term of the Original Agreement was for five (5) years with two (2)
one-year optional renewals; and
WHEREAS, the parties wish to extend the term of the Original Agreement
indefinitely, subject to a right of termination.
NOW, THEREFORE, in consideration of the mutual covenants, agreements and
promises contained herein and other good and valuable consideration, the receipt,
adequacy, and sufficiency of which are hereby acknowledged, the parties agree as
follows:
Section 1. Amendment to Section 10 of the Original Agreement.
Section 10 of the Original Agreement is hereby amended to read as follows:
Section 10. Effective DatefTermfTermination. .em This Agreement shall
become effective upon full execution by the parties hereto. Unless othen:Jisc
terminated by agr()omont of the parties, this Agr.eoment shall r-emain in effeot for five (5)
years vJith two (2) one year optional renevmls.
(b) The term of this Agreement shall be indefinite. subject to the right of the
parties to terminate as stated in subsection (el followina.
(c) Anv party may terminate its participation in this Agreement upon written
notice provided no later than June 1st of anv Year. the tef'(nination to be effective as of
the following October 1st If the CounJv is the party terminatina its participation then this
Aareement shall be of no further force or effect as of October 1st followina the notice of
termination. If any City terminates its participation th~n this Aareement shall remain in
full force and effect as to the remainina oarties.
Section 2. Except as herein modified, all the terms and conditions of the
Original Agreement remain in full force and effect.
IN WITNESS WHEREOF, the parties have caused this Agreement to be
executed by appropriate action of the governing body and by the appropriate officals
thereof.
