REQUEST: Public Works Department Informing the City Commission of the Agreement
with Capital Green I, LLC (Doran) Relative to Issuance of Building Permits,
Certificates of Occupancy and Transportation Impact Fee Rates.
PURPOSE: The purpose of this agenda item is to inform the City Commission of the
Agreement with Capital Green I, LLC (Doran) Relative to Issuance of Building
Permits, Certificates of Occupancy and Transportation Impact Fee Rates.
CONSIDERA TIONS:
Section of the 9-386.8 provides for an Independent Impact Fee Calculation of the
Transportation Impact Fee if an applicant believes that the impact of the development on
the municipal collector road network will be less than presumed in the code. Section 9-
178 provides for a written agreement if a building permit is desired prior to the installation
and acceptance of required improvements,
The developer submitted an independent transportation impact fee study, which
proposed the use of two adjusting factors, Trip Internalization Factor and Mode of
Transportation Factor, resulting in a reduction of the transportation impact fee, Our
consultant, CPH Engineers, Inc., reviewed the study and agreed to an impact fee reduction
of 15%.
In addition, the current impact fee rate table has higher rates for larger retail
projects. Staff agreed with the interpretation to not aggregate the individual buildings for

purposes of calculating impact fees, This resulted in an additional reduction of 15.8%
than if the buildings were aggregated based on the buildout project size.
The agreement incorporates the transportation impact fee reduction and the
requirements that need to be fulfilled in order for the developer to receive the building
permit and also the certificate of occupancy,

AGREEMENT
AN AGREEMENT ENTERED INTO THIS THE 28th DAY OF
FEBRUARY 2002 BY AND BETWEEN THE CITY OF WINTER SPRINGS
AND JAMES DORAN COMPANY RELATED TO THE ISSUANCE OF
BUILDING PERMITS, CERTIFICATES OF OCCUPANCY AND IMPACT
FEE RATES.
Pursuant to Section 9- I 78 of the City Code, completion of the following items will be
necessary for the issuance of a building pemlit and certificate of occupancy for the Publix
building portion of your company's Town Center project in the City of Winter Springs.
Section I - Site Development Requirements for.Building Permit
· Satisfactory completion of all corrections to building plans as directed by
Building Division.
. Payment of Impact fees and water and sewer connection fees.
· Stabilized access for accessibility of Police, Fire and other city vehicles.
Section II - Site Development Requirements for Certificate of Occupancy
. DEP water certification for the proposed water lines.
· The approved Publix fire sprinkler system shall be operational prior to stocking of
combustible materials.
· Completion of all Phase IA improvements including paving, striping, signage,
sidewalks, curbing, landscaping, DEP sewer certification, and FOOT driveway
acceptance.
· For DEP sewer certification, provision of a two-year warranty, maintenance bond,
and bill of sale.
· As-builts provided to City Engineer for final inspection including letter of
certification from the Engineer of Record.
· ' Successful completion of final inspections as required by the Building Division.
· Final approval from Community Development Department, Public Works/Utility
Department, Police Department and Fire Department of all improvements.
· Site improvements accepted by the City Commission.
· All aforementioned. Requirements must be completed two weeks prior to
scheduling Commission approval.
