REQUEST:
City Manager requesting Commission approval of a supplemental appropriation to
fund Impact Fee and Concurrency Ordinances related to the new Comprehensive
Plan and to authorize the City Manager to enter into a contract with Land Design
Innovations to perform the work.
PURPOSE:
This Agenda Item is needed to fund development of an updated Concurrency
Ordinance and Impact Fee Ordinances consistent with the new Comprehensive
Plan.
CONSIDERATIONS:
On November 26, 2001 the Commission approved transmittal of a new
Comprehensive Plan to DCA.
Revisions to the City's Concurrency Ordinance Number 2001-39 are required to
implement the provisions of the plan and to bring the City's Concurrency
Ordinance into compliance with Florida Statutes Chapter 163.
Additionally, the City's Fire, Police, and Recreation Impact Fees also need to be
updated to be consistent with the projects approved in the Capital Improvements
Element ofthe new Comprehensive Plan.

We have negotiated a contract with Land Design Innovations, the firm that
prepared our new Comprehensive Plan in the amount of$14,200 as follows:
Park Impact Fees 2,800
Police Impact Fees 2,400
Fire Impact Fees 2,400
Concurrency Ordinance 6,600
FUNDING:
It is recommended that a supplemental appropriation of$14,200 be added to Line
Code 1510-53180 Community Development Planning Consultant Services from
General Fund Reserves.
RECOMMENDATION:
Staff recommends that the Commission approve a supplemental appropriation of
$14,200 from General Fund Reserves for Community Development Line Code
1510-53180 to fund the above referenced studies and authorize the City Manager
to enter into a contract with Land Design Innovations to perform the work.

Attached is a copy of our revised scope of services and fee schedule to complete the above
referenced services. At the request of the City, we have eliminated the preparation of an impact fee
study for schools. In addition, we have broken out the fees associated with the impact fee studies for
each of the individual public services. Please note that a $1000,00 savings is experienced when the
impact fee study is done for all the public services listed in the scope as opposed to doing each on
an individual basis. If you have any questions or concerns, please do not hesitate to contact me.

SCOPE OF SERVICES
CONCURRENCY EVALUATION SYSTEM AND IMPACT FEE ASSESSMENT STUDY
LD I would be honored to prepare the framework for a concurrency evaluation system for
implementation by the City of Winter Springs in conjunction with land development activities within
the City. Our approach for developing a concurrency evaluation system would be consistent with
the requirements of the Florida Statutes and the Florida Administrative Code. LDI will prepare the
systems framework; outline the evaluation timetables, submittal requirements and the applicable
applications and forms as required for implementing the evaluation system. LDI will prepare a
concurrency system which addresses the minimum level of service standards for si..'{ public service
facilities: potable water; sanitary sewer; solid waste; drainage; transportation; and parks and
recreation. Concurrency assessment for schools, fire and police facilities can be conducted as an
optional additional-'service. The intent of the system will be to assess the impact of proposed
developments upon the above listed si..'{ public facilities such that no development order is approved
which results in a reduction in level of service below the adopted level of service standards set by the
City of winter Springs. Preparation of the concurrency evaluation system will include LP A meetings,
staff and community workshops, public hearings and preparation of public agenda items.
In addition, LDI will prepare a study for the assessment of impacts fees for these six public facilities.
This study will include the necessary research and projections required to support the assessment of
the individual impact fees.
LDI will work diligently to gather data and related information with minimal staff involvement.
LD I will be committed to meeting the project schedule to allow the Community Development
Department appropriate review time for all phases of the. project, prior to submission to the
Planning Board and City Council for public hearings and for final approval.
The specific proposed tasks for preparation of a concurrency evaluation system are identified below.
Concurrency Evaluation System
1) Research all applicable requirements of the Florida Statues and the Florida Administrative
Code.
2) Schedule, organize and hold a staff workshop to review concurrency related staff concerns
and comments.
3) Prepare the framework for the implementation of a currency evaluation system. Framework
shall include the following:
. A written Concurrency Management Section for inclusion in the City of Winter
Springs Land Development Code;
. Preparation of the applicable concurrency applications and forms (Concurrency
Verification Letter, Concurrency Encumbrance Letter, Concurrency Reservation
Certificate);
. Determination of a concurrency evaluation process and timeline;
. Identification of concurrency exempt projects;
· Recommendations for a concurrency encumbrance and reservation process with
specific time frames for expiration and assessment and payment of the required
reservation fees;
· Recommendations for maintaining and updating a public facilities capacity tracking
system.
4) Schedule, organize and hold a community workshop to review the proposed concurrency
evaluation system and to field questions and/or comments from the public.
5) Preparation of public agenda item.
6) Attendance at LPA and Commission meeting(s).
Impact Fee Assessment Study
Additionally, the following tasks will be performed in aSSOCiation with the determination of
applicable impact assessment fees for transportation, fire, police, and parks and recreation facilities.
Determination of impact fees for potable water, sanitaty sewer, and reclaimed water can be provided
as an optional service.
1) Review current City procedures with respect to impact fee assessments for the above listed
public facilities.
2) Meet with City staff to determine concerns and adequacy of current fee assessment policies.
3) Preparation of a study outlining the proposed impact fee assessment rates with supporting
documentation for transportation, fire, police, and parks and recreation facilities.
4) Schedule, organize and hold a community workshop to review the proposed impact fee
assessments and to field questions and/or comments from the public.
5) Preparation of public agenda item.
6) Attendance at LPA and Commission meeting(s).
FEE SUMMARY
Concurrency Evaluation System
LDI will perform the above list task items under the scope of services for a lump sum fee not to
. exceed $6,600.00. Additional services or optional elements for this scope of services will not be
performed without written approval form the City of Winter Springs. Staff and community
workshops, LP A and Commission meeting attendance, and revisions to the concurrency evaluation
system shall be provided on an hourly basis per the attached fee schedule.
Impact Fee Assessment Study
LDI will perform the above list task items under the scope of services for a lump sum fee not to
exceed to amounts listed below. Additional services or optional elements for this scope of
services will not be performed without written approval form the City of Winter Springs. Staff and
community workshops and LP A and Commission meeting attendance shall be provided on an
hourly basis per the attached fee schedule.
