Re: 2005 Hurricane Clean Up
Dear Mr. Greco:
In an attempt to avoid some of the confusion that arose last year around the clean up of
hurricane debris, we are writing to clarify our understanding of our obligations to collect
hurricane debris pursuant to the terms of our Franchise Agreement with the City of
Winter Springs.
During and immediately following a hurricane, we will use our best efforts to continue to
provide residential and commercial solid waste, yard trash and recycling collection in
accordance with our obligations set out in the Franchise Agreement. Depending upon the
severity of the impact of a hurricane, for example, to the extent that roads are impassable
or residents fail to containerize their waste and deliver it to the curb side or commingle
their recyclables with other waste, we will contact you to discuss the appropriate steps to
be taken to address these issues and their impact on our service.
If following the hurricane, we experience higher hours and/or weights for our residential
waste and recycling collection, because for example, the waste is not containerized or
waste and recyclables are commingled, we will notify the City immediately and will bill
the City at the rate of $90/ hour for all hours in excess of those incurred on average in the
immediately preceding 2 months, plus the incremental disposal costs incurred by us.
Ordinance No. 537 defines "Yard Trash" as "vegetative matter resulting from yard and
landscaping maintenance" To the extent that the hurricane results in vegetative debris, we
will bill for all hours incurred in connection with the collection of this debris at the rate of
$90/ hour, plus our disposal costs. If you require us to provide collection services on
days in addition to our regularly scheduled days, we will also bill you for providing this
service at the rate of $90/ hour. If, in order to provide this additional service, we are
required to bring in equipment not usually used in servicing the City, we will bill you at
the cost we incur for the use of the additional equipment plus operating costs. The hourly

rates quoted in this letter reflect our actual cost of providing the additional services set
out above.
In order that we can respond immediately to your requirements in the event of a
hurricane, we will require a pre-approved purchase order for the completion of the work
described in this letter on the terms set out above.
If you have any questions or concerns regarding our billing practices, please let me know.
We look forward to continuing to work with you to minimize disruption to our service in
the event of another active hurricane season.
