REQUEST: It is requested that the City Commission approve the attached
"Engagement for Pension Attorney Services" and authorize the City Manager to execute.
PURPOSE: This agenda item is offered to inform the City Commission about steps
taken to retain a new pension attorney, and to request approval of a services agreement with a
preferred candidate, as recommended by the Pension Board of Trustees.
CONSIDERATION: On June 11, 2001, the Commission endorsed rankings of
pension attorney candidates, and authorized contractual negotiations with the first-
ranked candidate. The attached "Engagement for Pension Attorney Services" results
from those negotiations, which were conducted on behalf of the Board of Trustees by the
Director of General Services and the City Attorney.
The Board of Trustees, at its regular meeting of July 31, 2001, voted to recommend
approval by the City Commission.
FUNDING: No additional funding required, other than already budgeted.
RECOMMENDATION: Staff and Board of Trustees recommend approval of attached
services agreement, and authorization for City Manager to execute.

Re: Engagement for Pension Attorney Services
Dear Mr. DeMarie:
This will confirm my firm's engagement to act as pension attorney to the City of
Winter Springs. Lewis, Longman & Walker P.A. would be pleased to provide pension
attorney services in accordance with the following terms:
I will act as the firm's primary attorney and contact on pension matters. However,
from time to time other firm attorneys and staff will work with me to provide requested legal
services in a cost-effective manner. Our services are provided and billed on an hourly basis.
Shareholder's services are billed at the rate of $210.00 per hour; associate attorneys are billed
at the rate of $175.00 per hour; and paralegals and law clerks working under my supervision
are billed at the rate of $90.00 per hour. Travel time to and from pension-related meetings
will be billed at one-half the normal hourly rate, up to a maximum of four hours of travel time
(two billable hours) on any day, except that there will be no charge for travel time for the first
meeti ng I attend each year.
In addition to our fees, our bills will include charges for disbursements for items such
as photocopies, travel (necessary transportation, lodging, and meals), courier services,
telephone charges, etc. There will be no charge for fax transmissions. A summary of these
charges is enclosed. I would be pleased to discuss a maximum limitation on travel-related
expenses in connection with this engagement.

Our bills will be sent out on a monthly basis, and we will expect payment of each bill
within 30 days following receipt. It is my understanding that the City will be responsible for
paying my firm's bills. If any bill is not paid in full within 30 days following receipt, a finance
charge of one percent per month (12% per annum) will be added to the outstanding balance.
If these arrangements meet with the City's approval, please have the appropriate City
official sign and date a copy of this letter and return it to me. If you would like further
information about me or the terms outlined in this letter, please call me. I look forward to
working with you and the City of Winter Springs.
