REQUEST: Community Development Department, Land Development Division, presents to
the Commission a proposed Encroachment Agreement to allow an existing
swimming pool and also to allow the construction of a six (6) fOQt by forty (40)
foot wood deck (as an adjunct to the existing swimming pool) and a pool screen
enclosure to be located on a public easement.
PURPOSE: The purpose of this agenda item is to present to the Commission a proposed
Encroachment Agreement which would allow an existing swimming pool and to
allow the construction of a six (6) foot by forty (40) foot wood deck (as an adjunct
to the existing swimming pool) and a pool screen enclosure to be located on a
public easement. The property is 10Gated at 1069 Chokecherry Drive (Oak
Forest).
APPLICABLE CODE
Sec. 6-219. Yards
(a) No pool (excluding surrounding patio) shall be located closer to the side yard
property line of the lot, parcel or piece ofland upon which such pool is located
than the distance required by the zoning ordinances of the city for side yards in the
zone in which the property is located, plus three (3) feet, not less than ten (10) feet
from the rear property line; nor shall any part of the pool structure within and
including the coping intrude upon any easement.
FINDINGS: ]. It was discovered during the title search/opinion for the sale of the subject
property that the swimming pool encroached into a public utility, namely a fifty
(50) foot drainage and utility easement located to the rear of the property at
] 069 Chokecherry Drive.

2. A search of City archives did not reveal an easement vacation for the property
located at 1069 Chokecherry Drive.
3. A permit to build the swimming pool (shown in the easement area) was issued
in June 1994.
4. The City has taken the position that it did not wish to vacate public easements
and that it would grant encroachment rights with the option to nullify if needed.
RECOMMENDA TION:
It is recommended that the Commission approve an Encroachment Agreement,
not to exceed fifty five (55) feet by twelve (12) feet.

We have submitted the paper work neccessary to grant usage on our property for a pool
screen and deck area. We respectfully request that you draw up the paperwork needed to
provide our Title Company. This will give us full title insurance. Our title is being held
at: Central Florida Title Company/320 West Sabal Palm Place, Suite 100/Longwood,
Florida/32779. Please send them the appropriate letter as well as a copy of that letter to

Existing Pool Encroachment Into Drainage .Easement
On the "plat of survey" for this lot, received May 11, 1999, the rear lot line of this lot is
platted to the approximate center of Little Lake Howell Creek. The fifty (50) foot
"Drainage & Utility Easement" at the rear of the lot, combined with the same for the lots
abutting the rear of Lot 178, provides for a one hundred (100) foot wide path for Little
Lake Howell Creek.
On the "plat of survey", it shows an existing pool and deck that encroaches approximately
six (6) or seven (7) feet into the fifty (50) foot "Drainage & Utility Easement" at the rear of
the subject lot. SEE ATTACHED "PLAT OF SURVEY" To my knowledge there is no
variance or easement vacation to allow the encroachment of the existing pool and deck into
the easement.
It is my recommendation that no vacation of any portion of the fifty (50) foot "Drainage &
Utility Easement" take place. Instead, I recommend that the City grant a variance or
"permission" only to allow the continued encroachment of the existing pool and deck, as
shown on the "plat of survey". No new construction would be allowed in the encroached
portion of the "Drainage & Utility Easement". The City would retain the right to require
the removal of any encroachment into this easement, with proper legal notice given to the
property owner.

Dear Mr. & Mrs. Avery:
Time Warner Communications has reviewed your request for a vacate of utility and
drainage easement described as:
Lot 178, Oak Forest Unit Two-B, according to the Plat thereof, as recorded
in Plat Book 26, Pages 85 & 86, of the Public Records of Seminole County,
Florida.
and more specifically described as:
The western most twelve (12) feet of the rear fifty (50) foot easement leaving
the eastern most thirty:eight (38) feet of the fifty (50) foot to remain an Utility
Easement.
Time Warner Communications has "No Objection" to this partial vacate as described.

Dear Mr. And Mrs. Avery:
The Utility/Public Works Department has no objection to vacating up to 25 feet of the 50
foot rear utility and drainage easement. We would not support the vacation of the 5 foot
side easements or the remainder of the rear drainage and utility easements. Other
individuals and/or utilities with input may differ in the amount of easement vacation they
will support.
The drainage ditch at the rear of your property is actually known as Little Lake Howell
Creek which can at times flow at a substantial rate. The rear easement is needed to
perform maintenance on the channel when blockages occur.
The Land Development Coordinator for the City, Don LeBlanc, can coordinate the
easement vacation process once a consensus is reached. If you have any questions,

ENCROACHMENT AGREEMENT
THIS AGREEMENT, BY AND BETWEEN THE CITY OF WINTER SPRINGS,
FLORIDA, a Municipal Corporation (hereinafter referred to as "CITY" and ALAN and MARY
ANN AVERY, (hereinafter referred to as "OWNER") dated \1 ~ day of) 6=('n:m~E R.. , 1999.
WHEREAS, OWNER holds fee simple title to the following described real property in
Winter Springs, Florida, to wit:
Lot 178 Oak Forest Unit Two-B, according to the Plat thereof recorded in Plat Book 26,
Pages 85 & 86, Public Records of Seminole County, Florida; and,
WHEREAS, OWNER purchased a home on said Lot 178, Oak Forest Unit Two-B
which has a swimming pool encroaching into a public easement, which public easement is
owned by the CITY adjoins Lot 178 as described herein, and OWNER desires to further
encroach into this public easement by adding a six (6) foot by forty (40) foot wood deck in said
public easement; and
NOW THEREFORE, in consideration of the mutual promises and covenants set forth
herein, the parties agree as follows:
1. The CITY agrees to grant the OWNER a license for the existing swimming pool
and the construction ofa six (6) foot by forty (40) foot wood deck to be located
on the public easement as described herein and that said swimming pool and
wood deck will create an encroachment onto a public easement that is owned by
the CITY and OWNER may keep the swimming pool and wood deck on the
public easement for as long as the OWNER abides by the terms of this agreement
or until revoked by the CITY. This use of public easement granted by the CITY
shall not constitute a waiver of any rights in and to the public easement affected,
nor shall it be deemed as acquiescence to a claim of adverse possession or of
prescriptive easement by the OWNER.
2. The OWNER agrees that they shall maintain the easement and the swimming
pool and wood deck as described but not expand the encroachment from what is
described on Exhibit "A" of this Agreement (described as the encroachment area).
The total encroachment area is to be an area approximately fifty five (55) feet by
twelve (12) feet.
3. The OWNER agrees that they shall, at their expense, remove the encroachment
swimming pool and wood deck or part thereof, from the public easement,
including any improvements thereon within thirty (30) days of receipt of written
request by the CITY for such removal. Such removal shall only be required upon
a finding by the City Commission of the need for the encroachment area for a
specific public purpose advanced by the CITY by resolution.
4. That the OWNER agrees that the covenants herein shall bind themselves, their
heirs and assigns, and said covenants shall run with the land.
5. That the OWNER agrees to contact their insurance company and require a rider
be added to their insurance policy with a certificate furnished to the CITY
showing the swimming pool and wood deck as herein described.
