Home My WebLink About2023 04 24 Regular 501 - Discussion on Fee Waiver for Pam Carroll PavilionREGULAR AGENDA ITEM 501 CITY COMMISSION AGENDA | APRIL 24, 2023 REGULAR MEETING TITLE Discussion on Fee Waiver for Pam Carroll Pavilion SUMMARY Commissioner Colangelo noted during the April 10, 2023 City Commission Meeting that she was approached by organizers of the Faith and Blue Community Day about use of the Pam Carroll Pavilion and the potential of waiving associated rental fees. The current Park Fee Schedule is in Resolution 2019-20 (attached). The Pam Carroll Pavilion is a large pavilion with the following associated fees: Non-Resident Rental Fee $82.50/4-hour block Refundable Deposit $200.00 The City Commission has the sole authority to make a determination about waiving fees. RECOMMENDATION Staff recommends the Commission discuss the request for a fee waiver and determine if a waiver should be granted. 110 RESOLUTION NO. 2019-20 RESOLUTION OF THE CITY COMYUSSION OF THE CITY OF WINTER SPRINGS, FLORIDA, UPDATING AND REVISING THE SCHEDULE OF FEES FOR PARKS AND RECREATION FACILITY USES AND ACTIVITIES; PROVIDING FOR REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; SEVERABMITY AND AN EFFECTIVE DATE. WHEREAS,the City is granted the authority;under Section 2(b),Article VIII, of the State Constitution,to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City Commission has the authority to establish fees pursuant to section 166.201,Florida Statutes; and WHEREAS, the City Commission desires to revise the fees for the City's Parks and Recreation facility uses and activities; and WHEREAS,the City Commission of the City of Winter Springs finds that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY,FLORIDA,AS FOLLOWS: Eection 1. Recitals. The foregoing recitals are deemed true and correct and are hereby fatly incorporated herein by this reference. Section 2. Fees Established. The City Commission hereby adopts the fee schedule set forth in Exhibit"A," attached hereto and fully incorporated herein by this reference. Section 3. Repeal of Prior Inconsistent Resolutions. All or inconsistent resolutions adopted by the it Commission, or parts of prior resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Severability. If any section, subsection,sentence,clause,phrase,word,or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction,such portion shall be deemed a separate,distinct.and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Effective date.
