decree of a court of competent jurisdiction, such
unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, para-
graphs or sections of this Code.

Sec. 1-14. Altering Code.
It shall be unlawful for any person in the city to
change or amend by additions or deletions, any
part of this Code, or to insert or delete pages, or
portions thereof, or to alter or tamper with such
Code in any manner whatsoever, except by ordi-
nance or resolution or other official act of the city
commission which will cause the law of the City of
Winter Springs, Florida, to be misrepresented
thereby. Any person violating this section shall be
punished as provided in section 1-15.

Sec. 1-1b. General penalty; continuing
lations; violation as public nui-
sance; attorneys' fees and costs.
(a) Whenever in this code, or in any ordinance
oI resolution of the city, or rule, regulation or
order promulgated by any officer or agency of the
city under authority duly vested in him of it, any
act is prohibited or is declared to be unlawful, or
the doing of any act is required or the failure to do
any act is declared unlawful, and no specific
penalty is provided for the violation thereof, the
violation of any such provision of this code or any
such ordinance, resolution, rule, regulation or
order shall be punished by a fine of not more than
five hundred dollars ($500.00). Each day any
violation of any of the provisions of this code or
any such ordinance, resolution, rule, regulation or
order shall continue, and shall constitute a sepa-
rate offense.
(b) In addition to the penalties hereinabove
provided, any condition caused or permitted to
exist in violation of any of the provisions of this
Code or any such ordinance, resolution, rule,
regulation or order shall be deemed a public
nuisance and may be abated by the city as pro-
vided by law, and each day that such condition
continues shall be regarded as a new and sepa-
rate offense.
(c) In addition to and supplemental to any
other provision of this Code, the city shall be
entitled, as a prevailing party, to recover reason-
able attorneys' fees and costs incurred in any
legal proceeding brought by the city to enforce
any provision of this Code through all appellate
proceedings.

ALCOHOLIC BEVERAGES
Sec. 3a Definitions.
(a) For purposes of this Chapter 3, the words
and phrases used in this Chapter 3 that are also
defined in the beverage laws of the State of
Florida shall have the same meaning provided by
said beverage laws.
(b) Unless otherwise defined in the beverage
laws, the following words and phrases when used
in this chapter shall have the following meaning:
(1) Public place: Any public street, park, al-
ley or sidewalk, any parking area or pri-
vate street open to the public, or outside
of any building containing an establish-
ment open to the general public located
within the City of Winter Springs.
(2) Open container: Any container of alcoholic
beverage that is open or from which the seal has
been broken.

Sec. 3-2. Location of business engaged in
sale prohibited near church or
school.
(a) No business proposing to engage in the sale
or serving or allowing the consumption of alco-
holic beverages (alcoholic beverages defined as all
beverages containing more than one (1) percent of
alcohol by weight) shall be allowed to locate
within two hundred (200) feet in an airline [a
straight line] from any existing church or a public
or private school operated for the instruction of
minors in the common branches learning, relat-
ing to pre -kindergarten through grade 12 with
said distance being measured from building to
building at their closest points.
Whenever a vendor of alcoholic beverages has
procured a license certificate permitting the sale
of alcoholic beverages and, thereafter, a church or
school shall be established within two hundred
(200) feet of the vendor of alcoholic beverages, the
establishment of such church or school shall not
be cause for the discontinuance or classification
as a nonconforming use of the business as a
vendor of alcoholic beverages.
(b) Interpretation of"church property." A church
is a facility primarily intended for the purpose of
conducting organized religious worship services

and permitted accessory uses. Church property,
as used in this Part, is the ground or land upon
which a church and its permitted accessory uses
are located and which is in ownership or lease
control of the church on the property.
(c) Interpretation of "school property." The word
"school" as used in this Part shall mean any
public, private or parochial institution conducting
and offering to minors a course of general or
vocational education and mental training. School
property, as used in this section, is the ground or
land upon which a school and its permitted acces-
sory uses are located and which is in ownership or
lease control of the school on the property.

Sec. 3-3. Alcoholic beverage vendors in the
town center.
In those areas zoned Town Center Zoning
trict or Greene Way Interchange Zoning District,
a variety of densely developed land uses are
encouraged in the area and the restrictions set for
in section 3-1 shall not apply.

(a) For the purpose of this section the follow-
ing definitions of terms shall control:
Bottle club shall mean any place or establish-
ment where:
(1) A product or article for consideration is
sold, dispensed, served or provided with
the knowledge, actual or implied that the
same will be or is intended to be mixed,
combined with or drank in connection or
combination with an alcoholic beverage
for consumption on the premises.
(2) A bottle club does not include a social,
fraternal or civic association or organiza-
tion which only occasionally or intermit-
tently provides facilities for on -premises
consumption of alcoholic beverages by its
members and their guests and is not
registered to sell alcoholic beverages. Nor

elude or prohibit the operation of private
clubs as defined in F.S. § 561.20(7)(a).
Alcoholic beverage shall mean and include all
beverages containing more than one (1) percent of
alcohol by weight.
(b) All bottle clubs shall be prohibited from
operation within the corporate limits of the city
(c) This section shall not be construed to affect,
nor is it intended to affect, those places or estab-
lishments whose hours are established or con-
trolled pursuant to F.S. § 562.14 or other city
ordinance pertaining to hours of sale, hours of
consumption.
(d) Any person or agent thereof who violates
any of the provisions of this section shall be
punished by F.S. § 162.09 and section 2-61(6) of
this Code. Wherein, it so stipulates that a violator
may be ordered to pay a fine not to exceed two
hundred fifty dollars ($250.00) for each day the
violation continues past the date set for compli-
ance.

(a) It shall be unlawful for any person to drink
or consume alcoholic beverages, or possess an
open container, in a public place in a manner that
creates or contributes to a danger to the public
peace, health, safety and welfare, or disturbs the
comfort and repose of the citizens in close prox-
imity.
(b) At the time a citation is issued for a viola-
tion of section 3-7(a), law enforcement shall have
the authority to confiscate and dispose of all
alcoholic beverages in the possession of any per-
sons cited in order to abate the danger or distur-
bance.

Sec. 3-8. Penalty.
In addition to any other legal remedies and
penalties provided by state and federal law, any
person alleged in violation of the provisions of this
chapter may be issued a civil citation which shall
be punished by a fine of two hundred fifty dollars
($250.00), unless specifically provided otherwise
in this chapter.

Sec. 3-10. Nudity prohibited upon alcohol
licensed premises and bottle clubs.
(a) Definitions. When used in this section the

ors are prosecuted. Such violations shall be pros-
ecuted in the name of the State of Florida in a
court having jurisdiction of misdemeanors by the
prosecuting attorney thereof and, upon convic-
tion, shall be punished by a fine not to exceed five

both such fine and imprisonment as provided in

(b) Apartment and condominium buildings.
Apartment or condominium buildings above three
(3) stories in height shall be treated as commer-
cial structures for the purpose of these regula-
tions for television dish antenna or satellite an-
tennas.
(c) Height restriction. The installation of any
television dish antenna or satellite antenna shall
not exceed the height restriction set forth in the
zoning ordinance for that location.

Sec. 6-84. Accessory buildings.
(a) General. Accessory building means a de-
tached, subordinate structure, the use of which is
clearly incidental to, customarily associated with,

(c) Location. All accessory buildings shall be
located to the rear of the existing buildings line.
(d) Permits. A building permit shall be re-
quired before construction or placement can take
place. No accessory building shall be permitted
prior to construction of the principal building.
(e) Setback requirements. When an accessory
building is attached to a principal structure by a
breezeway, passage or otherwise, it shall become
a part of the principal structure and shall be
subject to the required setbacks of the principal
structure.
(1) Corner setback —On all corner lots the
minimum open sideyard setback shall be
that of the principal building.
(2) Rear yard setback —Shall be a minimum
of six (6) feet.
(3) Side yard setback —Shall be that of the lot
on which the building is to be located.
(4) Easements —If an easement on the lot
where the building is to be located is
greater than that addressed above, then
the easement size shall prevail. No build-
ing shall be constructed or placed on an
easement.
(f) Upon application filed with the city, the city
commission may vary the number, height, and
size requirements set forth in this section or

approve an accessory building on an adjacent lot
by conditional use permit under the following
conditions:
(1) The subject property has a residential
rural future land use map designation
under the city's comprehensive plan.
(2) The applicant submits for review and
consideration a detailed architectural ren-
dering of the proposed accessory building
and a plot plan drawn to scale.
(3) The city commission finds that:
a. The proposed accessory building is
compatible and harmonious with the
principal structure and the surround-
ing land uses and structures;
b. The proposed accessory building will
not adversely impact land use activ-
ities in the immediate vicinity;
c. The height of the proposed accessory
building does not exceed the height
of the principal structure; and
d. The accessory building shall meet
the requirements of the applicable
zoning district including setback and
maximum lot coverage.
(4) An accessory building maybe constructed
on a lot adjacent to the lot on which the
principal building is located under the
following conditions:
a. The conditions set forth in subsec-
tions (1), (2), and (3) are satisfied.
b. Alegal instrument reasonably accept-

public records of Seminole County
that provides that the principal build-
ing lot and the adjacent lot are uni-
fied under common ownership and
that in the event said ownership is
ever separated, the accessory build-
ing shall be removed or a principal
building shall be constructed on the

Sec. 6-85. Screen enclosures.
(a) Definition. For purposes of this section, the
term "screen enclosure" shall mean an enclosure
consisting entirely of screen mesh, except for
minimum essential structural framework re-
quired for its support.
(b) Mesh; load requirements. Mesh sizes shall
not be smaller than twenty (20) by twenty (20)
threads per inch, nor larger than eighteen (18)
threads by fourteen (14) threads per inch. Design
computations and construction details of screen
enclosures shall be supplied with all plans show-
ing that same comply with wind load and live load
requirements of the building code of the city.
(c) Setbacks. The screen enclosure shall meet
all code requirements for front and side yard
setbacks which are applicable to the subject prop-
erty. Notwithstanding any other applicable rear
setback requirement, the screen enclosure shall
not be located any closer than seven (7) feet from

lakefront property, no screen enclosure shall be
located any closer than twenty-five (25) feet from
the shoreline, as determined by the existing or
established high-water control level.
(d) Height. The screen enclosure shall not be
higher than the primary structure on the subject
property, except when the principal structure
exceeds twelve (12) feet. In which case, the screen
enclosure shall be set back an additional two (2)
feet from the minimum setback requirements
contained in subsection (c) for every additional
foot above twelve feet.
(e) Easements. Screen enclosures shall not be
constructed within an easement area, unless the
easement expressly allows said construction.
(f) Screen enclosure modifications. If any por-
tion of an existing screen enclosure is modified so
that it no longer satisfies the definition in subsec-
tion (a), the modified screen enclosure shall meet
all building setback and height requirements that
are applicable to principal and accessory build-
ings for the subject property.

ary from a commercial district but located
in a R-1A or R-1AA single-family dwelling
district may be used as a free parking lot
or lots to service the contiguous and ad-
joining commercial use or uses, provided,
however, that.
a. No advertising signs are erected in
the area.
b. The setback from the front property
line shall be the same as for the
district in which the lot or lots are
located.
c. All automobile parking lots shall be
effectively screened on each side
which adjoins or fronts property sit-
uated in any residential or single-
family dwelling district by a wall,
fence or densely planted compact
hedge. Such wall, densely planted
hedge or fence shall not be less than
four (4) feet in height and shall be
maintained in good condition.
d. No structures shall be erected in
such areas.
(16) Common boundary construed. For the pur-
pose of (15) above, the term common bound-
ary shall be deemed to include all or any
part of a line between a commercial dis-
trict and an R-1, R4A or R4AA single-
family dwelling district, or the separation
of a commercial district from an R-1,
R-lA, and R4AA single-family dwelling
district by an intervening public street,
alley or other way where the parcels in
question lie wholly or partly in a position
directly opposite from each other in such a
manner that in the absence of the public

Except for the temporary parking of vehicles
conducting business on the premises or engaged
in the loading or delivering of materials, no over-
night parking of tractor trailers, cube vans, semi-
trailers and/or cabs shall be permitted on any
off-street parking facility within the city. Vehicles
owned or operated by the business located on the
licensed premises may be parked overnight pro-
vided that they are parked behind the business or,
if sufficient rear lot space is not available, in the
least visible space from any right-of-way and
abutting property. A special events permit may be
obtained for a period not to exceed fourteen (14)
days for the temporary parking of a trailer, semi-
trailer, and/or their cabs for special occasions.
After ninety (90) days, this permit may be re-
newed once during a twelve-month period.

DIVISION 7. DUMPSTERS.
Sec. 9-280. Definitions.
As used in this division the word "dumpster"
shall mean any container which is used for the
collection and disposal of bulk trash, refuse, veg-
etative waste, recyclable materials or other kinds
of waste, and which may be of the open or en-
closed variety, and is typically hoisted onto or
mechanically emptied into a specifically equipped
truck for transporting said waste to a designated
facility. Dumpsters are typically used for multi-
family, commercial, and industrial land uses.

Sec. 9-281. Minimum screening require-
ments.
All dumpsters shall be screened on all four (4)
sides from public view and situated under the
following minimum screening, design, and
locational requirements:
(1) Both sides and the rear of the dumpster
shall be screened by an opaque wall made

of concrete, brick, stone, or other similar
durable material, provided the material
used is compatible with the architectural
design of the principal structure. The wall
shall be at least six (6) feet in height or
the height of the dumpster, whichever is
greater. The wall shall be designed to
permit adequate and reasonable truck
pick-up by the solid waste hauler.
(2) The front of the dumpster shall be screened
by an opaque gate which shall remain
closed at all times, except for trash dis-
posal and pick-up.
(3) dumpsters shall be placed in an area that
is least visible from the public right-of-
way and shall be situated so as to provide

by the solid waste hauler.
(4) Dumpsters shall be placed on a concrete
pad or other impervious surface deemed
suitable by the city.
(5) Restaurants or other commercial busi-
nessesthat discard significant amounts of
food or other materials that decay, pro-
duce offensive odors or liquids, and/or
attract infectious diseases shall be re-
quired to equip the dumpster site with a G
sewer drain and water. The sewer drain
and water source shall be subject to ap-
proval by the city. These dumpster sites
shall be cleaned with water and appropri-
ate cleaning products frequently and as
often as necessary to keep the dumpster
in a sanitary condition.
(6) Landscaping around the dumpster may
be required if deemed necessary by the
city in order to make the dumpster com-
patible with the surrounding neighbor-
hood and the site development.
(7) All new dumpsters shall comply with the
minimum requirements set forth herein
upon the effective date of this division. All
dumpsters existing on the effective date
of this division shall comply with the
minimum requirements set forth herein
by March 1, 2004.

Sec. 9-391. Generally
The city commission hereby establishes police,
Ire, and parks and recreation impact fees under
the requirements of this division. The city com-
mission finds that the Florida Growth Manage-
ment Act mandates that local government plan
comprehensively for future growth and that this
division is consistent with that mandate. In addi-
tion, Section 163.3202(3), Florida Statutes, en-
courages the use of innovative land development
regulations which includes the adoption of "im-
pact fees." Further, new land development activ-
ity generates public facility and service demands
within the city and it is reasonable to require new
development to pay a fair share of the cost of
expanding new public facilities and services at-
tributable to new development. This division is
enacted pursuant to the Florida Municipal Home
Rule Powers Act, Chapter 163, Florida Statutes,
the City of Winter Springs Comprehensive Plan,
and other applicable law authorizing a municipal-
ity to set rates, fees, and charges for new devel-
opment.

Sec. 9-391.1. Levy and purpose.
For the purpose of helping to defray the cost of
new or expanded police, fire, and parks and
recreation facilities and equipment attributable
to new construction within the city limits, impact
fees are hereby levied on new construction within
the city limits in accordance with the provisions of
section 9-391.5, payment of fees, and other provi-
sions of this division. This division is intended to
be consistent with the principles for allocating a

city commission hereby adopts by reference the
report prepared by Land Design Innovations, Inc.
entitled, "City of Winter Springs Impact Fee Anal-
ysis Report for Police, Fire/Rescue and Parks &
Recreation," dated November 2002.

Sec. 9-391.2. Definitions.
Unless otherwise specified herein, the defini-
tions, classifications and uses shall be as set forth
in the City of Winter Springs Land Development
Code.
(a) Building permit: Any building or construc-
tion permit required under the Winter Springs
Building Code, Chapter 6 of this Code.
(b) Fire public safety facilities capital improve-
ments: The land, building, facilities, vehicles and
equipment necessary for the fire department of
the city to provide firefighting and fire protection
services and paramedic services to the citizens of
Winter Springs.
(c) Nonresidential: Includes all land uses not
otherwise specified as residential or exempted as
set forth in this division. This shall include, but is
not limited to, day care facilities, residential care
facilities, nursing homes, boarding houses, home
occupations, educational facilities, libraries, cul-
tural facilities, churches, all commercial uses, all
transient lodging and entertainment facilities ex-
cept those which are temporary in nature, all
automotive facilities and/or structures, all miscel-
laneous business uses and services and all indus-
trial uses.
(d) Parks and recreation facilities capital im-
provements: The land, buildings, facilities, vehi-
cles, and equipment necessary for the parks and
recreation department of the city to provide parks
and recreation services to the citizens of Winter
Springs.
(e) Police public safety facilities capital impr•oue-
ments: The land, buildings, facilities, vehicles and
equipment necessary for the police department of
the city to provide police protection services to the
zens of Winter Springs,

(f) Residential: Includes single-family dwell-
ings, multifamily dwelling units, mobile homes,
accessory dwelling units, accessory residential
structures.

Sec. 9-391.3. Applicability and exemptions.
(a) This division shall apply to all new con-
struction within the city limits except the follow-
ing:
(1) Expansion of a residential dwelling unit
not creating another dwelling unit; and
(2) Remodeling or rebuilding of any struc-
ture; and
(3) Construction under any building permit

(4) Temporary activities and uses including,
but not limited to temporary construction

(7) Construction associated with raising ani-
mals; and
(8) Construction related to agriculture.
(b) In addition, nonresidential development shall
be exempt from parks and recreation impact fees.

Sec. 9-391.5. Payment of fees.
(a) Time of payment. The impact fees required
to be paid under this division shall be paid in
conjunction with the issuance of a building per-
mit, but in no case shall the building permit be
issued until all outstanding impact fees are paid
in full to the city.

(b) Method of payment. Impact fees shall be
paid in cash unless the city commission, at its sole
and absolute discretion, specifically accepts an
in -kind contribution of land or capital facilities for
public use which is reasonably related to the
purpose of the credited impact fee. Credit for any
in -kind contribution shall be on a fair market
value basis as of the date the city commission
accepts the offer of such contribution, The fair
market value of any land accepted as an m4ind
contribution shall be based upon an appraisal of
its highest and best use then allowed under the
cityIs current land use and zoning designations.
The appraisal shall be performed by a certified
appraiser, licensed to do business in Florida,
acceptable to the city. Such appraisal shall be
paid for by the donor. No credit will be granted
pursuant to this section unless the contribution of
land or capital facilities for public use has been or
will be included in the capital asset inventory of
the department of the city for which the impact
fee is imposed.

Sec. 9-391.6. Credits.
In addition to the discretionary credits autho-
rized by the city commission under section
9-391.5(b), an applicant for a building permit
shall be entitled to a credit against future impact
fees assessed pursuant to this division for contri-
butions, dedications, or improvements required
by the city or through agreements with the city as
a condition of any development permit by the city,
and said credit shall be an amount equal to the
fair market value of any contribution of land or
capital facilities for public use. The impact fee
credit and the applicable contribution, dedication,
or improvements must be reasonably related. The
fair market value shall be determined as of the
date the city commission accepts the offer of such
contribution. The fair market value of any land
accepted for credit of future impact fees shall be
based upon an appraisal of its highest and best
use and then allowed under the city's current
land use and zoning designations. The appraisal
shall be performed by a certified appraiser, li-
censed to do business in Florida, acceptable to the
city. Such appraisal shall be paid for by the donor.
No credit will be granted pursuant to this section
unless the contribution of land or capital facilities
for public use was made within the year preceding
the effective date of this division, and the contri-
bution of land or capital facilities for public use

has been or will be included in the capital asset
inventory of the department of the city for which
the impact fee is imposed.

Sec. 9-391,llrstabllsh�ngnt-0f a trust fund.
(a) The impact fees collected by the city pursu-
ant to this division shall be kept separate from
other revenue of the city and a capital expansion
trust fund is hereby created for each impact fee
category created under this division as follows.
(1) Police protection capital expansion trust
fund.
(2) Fire protection capital expansion trust
hand.
(3) Parks and recreation capital expansion
trust fund.
fee trust funds shall be exclusively used only for
the purpose obtained in the title of such fund and
for no other purpose. Expenditures from the fund
shall be specifically approved by the city commis-
sion and shall be limited to the expansion acqui-
sition of capital facilities or equipment made
necessary by the new construction from which the
fees were collected or for principal payments
(including sinking fund payments) on bonds to
expand or acquire such facilities or equipment.
Before authorizing an expenditure from any one
of these trust funds, the city commission shall
determine that:
(1) Such expenditure is for capital facilities
or equipment to be used for the purpose
contained in the title of the trust fund
from which the expenditure is to be made;
and
(2) Such expenditure is made necessary by
the new construction from which such
funds were collected; and
(3) Such expenditure shall result in a benefit
to the new construction from which said
funds were collected.

Sec. 9-391.5. Capital expansion plans.
The city's police, fire and parks and recreation
departments, which are to receive funds collected
pursuant to this impact fee division, shall prepare
and maintain a capital expansion plan for their
respective individual funds which shall be for a
period of no less than one (1) year. Each
department's plan shall be reviewed and ap-
proved by the city commission at least annually
during the budget review process.

Sec. 9-391.9. Refunds.
Refunds of the impact fees paid hereunder may
be allowed upon application thereof, when it is
determined that no construction under a building
permit has occurred, and the building permit
issued for such construction has expired or other-
wise been cancelled.

Sec. 9-391.10. Vested rights.
(a) A developer or successor in interest of land
which has received a building permit may peti-
tion the city commission for a vested rights deter-
mination which would exempt the petitioner from
the provisions of this division. Such petition shall
be evaluated by the city attorney and a recom-
mendation thereon submitted to the city commis-
sion based upon the following criteria:
(1) There exists a valid, unexpired govern-
ment act authorizing a specific develop-
ment for which a determination is sought;
(2) Expenditures or obligations made or in-
curred in reliance upon the authorizing
act that are reasonably equivalent to the
fees required by this division;
(3) That it would be inequitable to deny the
petitioner the opportunity to complete the
previously approved development under
the conditions of approval by requiring
the developer to comply with the require-
ments of this division;
(4) Common law principles of equitable estop-
pel and vested rights set forth incase law.
LAND DEVELOPMENT
(b) For the purpose of this section, the follow-
ing factors shall be considered in determining
whether it would be inequitable to deny the
petitioner the opportunity to complete the previ-
ously approved development:
(1) Whether the injury suffered by the peti-
tioner outweighs the public cost of allow-
ing the development to go forward with-
out payment of the fee required by this
division;
(2) Whether the expense or obligations were
made or incurred subsequent to Novem-
ber 1, 2002, after which day the adoption
of the impact fees required by this divi-
sion was pending; and
(3) Whether the operation of this division
would create an inordinate burden which
would prevent petitioner from making a
reasonable return on his investment.
(c) The city shall not permit the extension of a
building permit beyond the initial time for acti-
vation without the applicant complying with this
division.
(d) If a previously approved development order
or other binding agreement contained conditions
regarding impact fees required by this division
and their designated uses, or contributions to the
capital asset inventory of the respective depart-
ments, the developer or his successor may request
a modification of such prior approvals in order to
bring the approval conditions into consistency
with the requirements of this division.

Sec. 9-391.11. Penalty for violation.
Violation of this division shall constitute a
misdemeanor of the second degree and shall be
subject to penalty pursuant to applicable code
enforcement procedures. Notwithstanding the crim-
inal penalty provided for herein, the city may
obtain an injunction or other legal or equitable
relief in the circuit court against any person
violating this division.

Sec. 9-391.12. Appeal.
Any person aggrieved by any administrative
decision by the city may appeal directly to the city
commission. To file an appeal, an individual must
file an application with the city manager and
submit such information and documentation with
said application as may be required by the city
manager. The city manager shall make a deter-
mination as to the sufficiency of the application.
An application for appeal must be filed with the
city manager within thirty (30) days of any action
taken by the city for which a person is aggrieved.
Any decision of the city commission on the appli-
cation shall be final and subject to judicial review.

development rights of property owners may be
vested with respect to the City of Winter Springs
Comprehensive Plan and the land development
regulations adopted to implement the plan (the

mination of the availability and capacity of public
facilities ("concurrency"), it is the intent of this
article to provide for a fair and equitable process
for the determination of whether a property owner

Sec. 9-402. Vested rights application pro-
cess.
(a) Application for vested rights special use
permit.
(1) Any person claiming vested rights to de-
velop property shall make application for
a vested rights special use permit pursu-
ant to this article. The owner of the sub-
ject property must either sign the appli-
cation or give written authorization for
the applicants to file the application.
(2) An application for a vested rights special
use permit shall be approved and a vested
rights sneris] 1?5P, permit isgnPd if an
applicant meets the requirements set out
in this article. Possession of a vested
rights special use permit shall enable a
permittee to complete the development
approved under such permit up to and
through issuance of appropriate certifi-
cates occupancy, subject to the limitations
set forth in section 9404, and subject to
compliance with such laws and regula-
tions against which the development is
not vested.
(3) Applications for a vested rights special
use permit shall be submitted to the city
manager on a form to be provided by the
city. Such application must be filed within
one (1) year after the later of (1) the
adoption of this article or (ii) the rezoning
of the subject property in order to bring
its zoning into conformance with the land
use designation assigned to the property
by the Comprehensive Plan Land Use
Map adopted on April 27, 1992 (the "plan
adoption date"). Except as provided in
subsections (a)(4) and (a)(5), below, fail-
ure to file an application within the re-
quired period will constitute an abandon-
ment of any claim to vested rights. Judicial
relief will not be available unless admin-
istrative remedies set forth in this article
are exhausted.
(4) If a property owner is absent from the
state during the entire filing period, and
does not have an agent present in the
state during such period, such property
owner may, with documentation sufficient
to indicate a probable lack of notice, be
granted leave by the city manager to file
an application within one (1) year after
the individual's return to Florida.

TAXATION
DIVISION 6. ISSUANCE OF OBLIGATIONS
Sec. 18-85. General authority.
(a) Upon adoption of the final local improve-
ment assessment resolution or final related ser-
vice assessment resolution imposing assessments
to fund, respectively, a local improvement or a
related service, or at any time thereafter, the city
commission shall have the power and is hereby
authorized to provide by resolution, at one time or
from time to time in series, for the issuance of
obligations to fund the project cost or operating
cost thereof.
(b) The principal of and interest on each series
of obligations shall be payable from pledged rev-
enue. At the option of the city commission, the city
may agree, by resolution, to budget and appropri-
ate funds to make up any deficiency in the reserve
account established for the obligations or in the
payment of the obligations, from other non -ad
valorem revenue sources. The city commission
may also provide, by resolution, for a pledge of or
lien upon proceeds of such non -ad valorem reve-
nue sources for the benefit of the holders of the
obligations. Any such resolution shall determine
the nature and extent of any pledge of or lien
upon proceeds of such non -ad valorem revenue
sources.

Sec. 18-86. Terms of the obligations.
The obligations shall be dated, shall bear inter-
est at such rate or rates, shall mature at such
times as may be determined by resolution of the
city commission, and may be made redeemable
before maturity, at the option of the city, at such
price or prices and under such terms and condi-
tions, all as may be fixed by the city commission.
Said obligations shall mature not later than forty
(40) years after their issuance. The city commis-
sion shall determine by resolution the form of the
obligations, the manner of executing such obliga-
tions, and shall fix the denominations of such
obligations, the place or places of payment of the
principal and interest, which may be at any bank
or trust company within or outside of the State of
Florida, and such other terms and provisions of
the obligations as it deems appropriate. The obli-

gations may be sold at public or private sale for
such price or prices as the city commission shall
determine by resolution. The obligations may be
delivered to any contractor to pay for construction
of the local improvements or may be sold in such
manner and for such price as the city commission
may determine by resolution to be for the best
interests of the city.

Sec. 18-87. Variable rate obligations.
At the option of the city commission, obliga-
tions may bear interest at a variable rate.

Sec. 18-88. Temporary obligations.
Prior to the preparation of definitive obliga-
tions of any series, the city commission may,
under like restrictions, issue interim receipts,
interim certificates, or temporary obligations, ex-
changeable for definitive obligations when such
obligations have been executed and are available
for delivery. The city commission may also pro-
vide for the replacement of any obligations which
shall become mutilated, destroyed or lost. Obliga-
tions may be issued without any other proceed-
ings or the happening of any other conditions or
things than those proceedings, conditions or things
which are specifically required by this ordinance.

Sec. 18-89. Anticipation notes.
In anticipation of the sale of obligations, the
city commission may, by resolution, issue notes
and may renew the same from time to time. Such
notes may be paid from the proceeds of the
obligations, the proceeds of the assessments, the
proceeds of the notes and such other legally
available moneys as the city commission deems
appropriate by resolution. Said notes shall ma-
ture within five (5) years of their issuance and
shall bear interest at a rate not exceeding the
maximum rate provided by law. The city commis-
sion may issue obligations or renewal notes to
repay the notes. The notes shall be issued in the
same manner as the obligations.

Sec. 18090. Taxing power not pledged.
Obligations issued under the provisions of this
article shall not be deemed to constitute a general
obligation or pledge of the full faith and credit of
the city within the meaning of the Constitution of
the State of Florida, but such obligations shall be
payable only from pledged revenue in the manner
provided herein and by the resolution authorizing
the obligations. The issuance of obligations under
the provisions of this article shall not directly or
indirectly obligate the city to levy or to pledge any
form of ad valorem taxation whatever therefor.
No holder of any such obligations shall ever have
the right to compel any exercise of the ad valorem
taxing power on the part of the city to pay any
such obligations or the interest thereon or to
enforce payment of such obligations or the inter-
est thereon against any property of the city, nor
shall such obligations constitute a charge, lien or
encumbrance, legal or equitable, upon any prop-
erty of the city, except the pledged revenue.

Sec. 18-91. Trust funds.
The pledged revenue received pursuant to the
authority of this article shall be deemed to be
trust funds, to be held and applied solely as
provided in this article and in the resolution
authorizing issuance of the obligations. Such
pledged revenue may be invested by the city, or its
designee, in the manner provided by the resolu-
tion authorizing issuance of the obligations. The
pledged revenue upon receipt thereof by the city
shall be subject to the lien and pledge of the
holders of any obligations or any entity other than
the city providing credit enhancement on the
obligations.

Sec. 18-92. Remedies of holders.
Any holder of obligations, except to the extent
the rights herein given may be restricted by the
resolution authorizing issuance of the obligations,
may, whether at law or in equity, by suit, action,
mandamus or other proceedings, protect and en-
force any and all rights under the laws of the
State of Florida or granted hereunder or under

such resolution, and may enforce and compel the
performance of all duties required by this part, or
by such resolution, to be performed by the city.

Sec. 18-93. Refunding obligations.
The city may, by resolution of the city commis-
sion, issue obligations to refund any obligations
issued pursuant to this article, or any other
obligations of the city theretofore issued to fi-
nance the project cost of a local improvement, or
the operating cost of a related service, and pro-
vide for the rights of the holders hereof. Such
refunding obligations may be issued in an amount
sufficient to provide for the payment of the pnn-
cipal of, redemption premium, if any, and interest
on the outstanding obligations to be refunded. If
the issuance of such refunding obligations results
in an annual assessment that exceeds the esti-
mated maximum annual assessments set forth in
the notice provided pursuant to section 18-61 or
section 1843 hereof, the city commission shall
provide notice to the affected property owners and
condi,et a public hearing in the manner regv„ red
by Division 3 or 4 of this article.

additional and alternative method for the impo-
sition and collection of assessments and shall be

Each member appointed shall serve as pro-
vided in Chapter 2 of the City Code. Vacancies on
the board may be filled by the commission mem-
ber whose seat number corresponds with the
vacant planning and zoning board seat subject to
commission ratification. If any commissioner fails
to appoint a member within two (2) regularly
scheduled commission meetings after a vacancy
occurs or a term expires, that seat will be filled by
the mayor, subject to the ratification by city
commission. Members shall be subject to removal
from office as provided in Chapter 2 of the City
Code.

the city shall be reimbursed from the city trea-
sury to cover the expenditures naturally and
necessarily incurred by them and that such reim-

The planning and zoning board shall meet at
least once each calendar month at a time set by its

Sec. 20-57. Duties; general.
The planning and zoning board shall serve as
the planning and zoning commission. It shall be
the duty of the planning and zoning board to
recommend to the city commission the boundaries
of the various original zoning districts and appro-
priate regulations to be enforced therein and any
proposed amendments thereto and shall collect
data and keep itself informed as to the best
practices generally in effect in the matter of city
planning and zoning to the end that it may be
qualified to act on measures affecting the present
and future movement of traffic, the segregation of
residential and business districts and the conve-
nience and safety of persons and property in any
way dependent on city planning and zoning. The
board shall recommend the boundaries of dis-
tricts and appropriate regulations. In addition
thereto, the planning and zoning board shall
serve as the local land planning agency pursuant
to the county comprehensive planning act and the
local government comprehensive planning act of
the state and the board shall commence such
duties on the adoption of the comprehensive plan
by the city commission.

Sec. 20434. Authorized commercial vehi-
cles in residential areas.
(a) One (1) commercial vehicle per dwelling
unit may be parked in residentially zoned

not less than a six (6) foot high fence in
such manner that the vehicle is not visi-
ble from surrounding dwellings or the
public right-of-way.
For purposes of this subsection (a), commercial
lettering or signage shall not be considered visible
if said lettering or signage is completely hidden by
a thin opaque magnetic cover. Said cover shall be
installed on the vehicle and shall consist of one
solid neutral color.
(b) A homeowners association as defined in the
Florida Statutes, apartment complex, or mobile
home park may set aside common property, owned
by the association, complex, or park, as an area
set aside for the storage or parking of commercial
and/or recreational vehicles, provided said area is
fenced by an opaque fence not less than six (6) feet
in height that totally prevents the viewing of said
vehicles from surrounding properties and road-
ways.

tricts.
Utility vehicles used to maintain the site of one
(1) acre or more and are adequately screened so
that they are not visible from an abutting prop-
erty or any rights -of -way are permitted; or horse
trailers of any length are permitted within any
parcel of one (1) acre or more within a residen-
tially zoned district that allows horses to be kept
provided that the trailers are not visible from any
rights -of -way or abutting property.

Sec. 20.436. Authorized commercial vehi-
cles —Limited -term parking per-
mits.
(a) One (1) authorized commercial vehicle per
dwelling unit, as defined in section 20434 above
and not to exceed ten (10) feet in height, may be
exempted from the garaging and fencing require-
ments of section 20434 until July 2, 2001, if the
dwelling unit of the owner, user, or caretaker of
the authorized commercial vehicle does not have
a garage or fence capable of screening the vehicle
from view as provided in section 20434 provided
that the owner, user, or caretaker of the autho-
rized commercial vehicle shall have first acquired
from the city a limited term parking permit which
shall be clearly affixed upon the rear window or
rear panel of the authorized commercial vehicle.

b. After a telecommunication tower is
rebuilt to accommodate co -location,
only one (1) tower shall remain on
the site;
(h) Certification of compliance with Federal
Communications Commission (FCC) NIER Stan-
dards. Prior to receiving final inspection by the
Winter Springs Building Department, documented
certification shall be submitted to the FCC, with
copy to the land development coordinator, certify-
ing that the telecommunications facility complies
with all current FCC regulations for non -ionizing
electromagnetic radiation (NIER).
(i) Abandonment.
(1) In the event the use of any telecommuni-
cations tower has been discontinued for a
period of one -hundred eighty (180) consec-
utive days, the tower shall be deemed to
be abandoned. Determination of the date
of abandonment shall be made by the
building official who shall have the right
to request documentation and/or affida-
vits from the telecommunications tower
owner/operator regarding the issue of tower
usage. The telecommunications tower own-
er/operator shall provide all requested
information within ten (10) working days
of a request being made, and failure to so
provide shall be deemed to constitute one
hundred eighty days (180) days of non-use
of the tower. Upon such abandonment,
the owner/operator of the tower shall have
an additional ninety (90) days within which
to:
a. Reactivate the use of the tower or
transfer the tower to another owner/
operator who makes actual use of
the tower; or
b. Dismantle and remove the tower.
With regard to towers that received
special exception approval, ninety
(90) days after dismantling or the
expiration of the two -hundred sev-

enty (270) day period as set forth in
this section, the special exception
and/or variance for the tower shall
automatically expire.
(2) The City of Winter Springs, upon aban-
donment, and at its discretion, may as-
sume ownership of the tower at no cost, or
require the owner to dismantle the tower
at the owner's expense. If the decision is
to dismantle the tower, the property shall
be cleared of all appurtenances and re-
turned to its natural state.
(3) An appropriate surety instrument to as-
sure dismantling costs shall be provided
by the owner prior to a tower construction
permit.

Sec. 20-461. Intent.
The purpose and intent of this specialized
overlay zoning district is to encourage and pro-
vide for enhanced property development within
the S.R. 434 commercial corridor. Some of the
objectives to be attained through the establish-
ment of this district include: enhancement of the
commercial status of the corridor; reduction of
visual distraction through uniform sign criteria;
enhancement of physical appearance through in-
creased landscaping of public and private prop-
erty; provision of architectural design guidelines

Sec. 20-462. Creation.
In addition to, and supplemental to, other
zoning and land development regulation require-
ments heretofore and hereafter, the S.R. 434
Corridor Overlay District includes additional reg-
ulations to promote the orderly development and
redevelopment of the corridor, which shall be
applied through imposition and mapping of an
overlay district. The regulations are in addition to
and not in substitution of the underlying zoning
district regulations which shall also remain ap-

DIVISION 2. GENERAL DESIGN
STANDARDS FOR NEW DEVELOPMENT
AREA
Sec. 20-463. Applicability to new develop-
ment overlay zoning district.
The following design standards shall apply to
the New Development Overlay Zoning District
which includes all properties adjacent to the S.R.
434 right-of-way from Hayes Road eastward to
the easternmost boundary of the City of Winter
Springs with exclusion(s) indicated in Ordinance
No. 675.

Sec. 20-464. Building height.
No building shall exceed fifty five (55) feet in
height. For the purpose of these design standards,
building height shall be measured from ground
level to the highest point of the coping of a flat
roof or the mean height level between eaves and
ridge for gable, hip or gambrel roofs.

(b) The narrowest dimension of a lot adjoining
a road right-of-way shall determine its front for
the purpose of establishing yard requirements.
(c) On corner lots, the front yard shall be
considered as abutting the street upon which the
lot has its least dimension. The rear lot, in this
case, shall be opposite the front yard.
(d) The following structures are specifically
excluded from the setback restrictions:
(1) Steps and walks:
(2) Landscaping and landscape berms;
(3) Planters three (3) feet in height or less; or
(4) Other improvements as may be permitted
under applicable regulations of the city.
The board of adjustment will consider any request
for the placement of such other improvements
within a setback, only after a design review board
review and recommendation. In determining
whether to recommend city consent, the design
review board may consider, without limiting the
scope of their review, the following: (i) the extent
to which any hardship exists that would justify a
variance from the normal setback requirements,
the aesthetics of the proposed improvements
and their visibility from common roads and adja-
cent properties; (iii) the consent or objections of
adjacent property owners; and (iv) the nature and
use of the proposed improvements. It is the owner's
burden and responsibility to provide such infor-
mation and documentation as may be requested
by the design review board in order to justify to
the design review board that the intrusion of
