ARTICLE I. FIRE AND EMERGENCY
MEDICAL SERVICES*
Sec. 7-1. Inclusion in Seminole County's fire
and emergency services MSTU.
The City of Winter Springs hereby consents to
the inclusion of the City of Winter Springs in
Seminole County's Fire and Emergency Medical
Services Municipal Services Taxing Unit ("MSTU"),
pursuant to the terms and conditions agreed to
between the city and county in the agreement for
fire and emergency medical services, effective
October 2, 2008, as maybe amended from time to
time. The city further consents to any ad valorem
tax levy on real and tangible personal property
within the City of Winter Springs by Seminole
County, for the services provided by said MSTU,
in an amount not to exceed three (3) mills annu-
ally.

ARTICLE II. IN GENERAL
Sec. 7-26. Regulation of open-air burning.
(a) No person shall burn outdoors within the
city limits, except in an incinerator, any solid
waste in the form of trash, paper, grass clippings,
leaves, underbrush, felled trees, or other combus-
tible vegetable material without the express per-
mission of the fire department regarding the
location, size and duration of each burning, nor
without constant supervision of each burning
until the last spark of fire is extinguished.
(b) Under no circumstances shall any person
burn any food waste whatsoever at any time
within the city limits.
(c) In the event of a disaster sufficient to
preclude commercial collection of solid waste or
any cessation of such service, the public shall
gather solid waste, excluding food waste, in the

usual manor for pickup at curbside by city owned
or city hired vehicles, to be burned under the
supervision of the fire department at sites desig-
nated by the disaster management coordinator.
During such emergency situations, the public
shall bury all food waste, and such food waste
shall not be burned by the public nor deposited
with other solid waste for collection.
(d) For major land clearing operations, a burn-
ing permit shall be obtained from the fire depart-
ment, providing that all rules and regulations of
such burning comply with both the Florida Divi-
sion of Forestry and the Department of Environ-
mental Regulations. The burn site shall be in-
spected by the fire department prior to the issuing
of any permit. A fee will be charged for such
permits in accordance with the fee schedule adopted
by resolution of the city commission. Said permit
may remain in force for a period not to exceed
thirty (30) calendar days. Burn permits may be
revoked at any time for just cause and the fee
forfeited. Should fire department services be re-
quired to extinguish a permitted burn due to
negligence or other failure on the part of the
permittee(s), a fine of one hundred dollars ($100.00)
shall be levied against the responsible permit-
tee(s).

Sec. 7-27. Regulation of explosives.
(a) No person(s) shall discharge or detonate,
nor allow the discharge or detonation of any
illegal fireworks, as defined by Section 791-01(8),
Florida Statutes, dynamite or any other explosive
at any time within the city limits without the
express permission of both the fire and police
departments.
(b) Permitted public fireworks displays han-
dled by licensed pyrotechnical businesses are ex-
cluded, subject to their obtaining proper permits
anI inspections by the office of the fire marshal.

Sec. 7-28. False alarms prohibited.
It shall be unlawful for any person, either
intentionally or without reasonable cause to sound
a false alarm of fire or hazard from an explosive or
incendiary device, by rousing public alert by call-

ing or shouting or other audible or visible method,
telephoning, setting off a fire alarm box or elec-
tronic signal, failure to repair faulty alarm equip-
ment which activates without adequate need, or
by any other method creating a misleading im-
pression of the existence of present or impeding
danger from fire, explosion or bomb.

ARTICLE III. LOCAL AMENDMENT TO
THE FLORIDA FIRE PREVENTION CODE`'`
Sec. 7-46. Procedure for local amendments
to the Florida Fire Prevention
Code.
In accordance with Chapter 633, Florida Stat-
utes, following public hearing regarding the need
to strengthen the requirements of the minimum
fire safety code the city commission may adopt by
ordinance a local amendments to the Florida Fire
Prevention Code, provided such amendment pro-
vides a higher level of protection to the public
than the level specified in the Florida Fire Pre-
vention Code and that such additional require-
ments will not be discriminatory as to materials,
products, or construction techniques.

Sec. 7-50. Appeal.
(a) Any substantially affected party may test
the validity of the a local amendment by filing a
motion for reconsideration, within thirty (30) days
of the effective date of the ordinance, challenging
the city's compliance with requirements of Chap-
ter 633, Florida Statutes.

(b) The motion for reconsideration shall be
filed with the city clerk, and heard by the city
commission within forty-five (45) days from the
date of filing.
(c) The burden of proof is upon the challenging
party to demonstrate that the enactment of the
local amendment was not in compliance with
Chapter 633, Florida Statutes.
(d) Should the city commission determine that
the challenged amendment was not adopted in
compliance with Chapter 633, the amendment
shall be unenforceable until such compliance is
met. If the city commission determines that the
challenged amendment was adopted in compli-
ance with Chapter 633, the challenger may ap-
peal further to the Department of Insurance,
however, the local amendment will continue to be
enforceable during the appeal process.

Sec. 7-54. Impact fee credits.
The following occupancies shall receive a fire
impact fee credit for the installation of a fire
suppression system installed in accordance with
N.FP.A. 13, 13R, 13D and S.F.M. 4A-45, and as
provided in section 7-60 below:
(1) New occupancy construction which is reg-
ulated by the state uniform fire preven-
tion code shall receive a five -cent ($0.05)
per square foot credit on the fire public
safety facilities impact fee.
(2) New single-family detached dwelling units
shall receive a full credit for the fire
public safety facilities impact fee.

Sec. 7-60. Automatic fire sprinkler systems.
(a) Automatic fire sprinkler systems shall be
required as follows:
(1) Throughout all buildings used for commer-
cial purposes, including but not limited to
offices, mercantile stores, restaurants,
manufacturing, industrial or storage, if

the total square footage is three thousand
five hundred (3,500) square feet or more
regardless of type of construction.
(2) Throughout all hotels, motels, condomin-
iums, apartment buildings, or dormito-
ries, regardless of size or type of construc-
tion.
(3) Throughout all hospitals, nursing homes,
adult congregate living facilities or other
medical facilities, regardless of size or
type of construction.
(4) Throughout all Group "H" hazardous oc-
cupancies, regardless of size or type of
construction, except where the applica-
tion of water might constitute a life safety
hazard or increase the severity of the fire.
(5) Throughout all educational facilities re-
gardless of size or type of construction.
(b) Automatic fire sprinkler systems shall be
installed to the specifications of NFPA 13, Stan-
dard for the installation of sprinkler systems,
most recent edition adopted by the State of Flor-
ida, NFPA 13D, Standard for the installation of
sprinkler systems in one -and two-family dwell-
ings and manufactured homes, most recent edi-
tion adopted by the State of Florida, and NFPA
13R, Standard for the installation of sprinkler
systems in residential occupancies up to and
including four (4) stories in height, most recent
edition adopted by the State of Florida.
(c) All buildings equipped with automatic sprin-
kler systems as required by subsection (b) above,
shall be required to have such systems monitored
by a central station monitoring company installed
to the specifications of NFPA 72, National Fire
Alarm Code, most recent edition adopted by the
State of Florida.
(d) All automatic fire sprinkler systems as
required by subsection (b) above, shall be re-
quired to have such systems inspected, tested and
maintained to the specifications of NFPA 25,
Standard for the inspection, maintenance and
testing of water based fire protection systems,
most recent edition adopted by the State of Flor-
ida. A copy of each inspection report shall be
furnished to the fire marshal's office.
(e) All automatic fire sprinkler systems shall
be installed by a licensed fire protection system
contractor, pursuant to Florida Statute 633.521,
and Florida State Fire Marshal Rule 4A-46.
(f) If an automatic fire sprinkler system is
required to be shut off for any reason, the fire
department shall be notified when it is shut off
anI when it is returned to service.

ARTICLE IV. FIRE HYDRANTS*
Sec. 7-76. Required.
Fire hydrants shall be installed to serve all
developments as prescribed in this article.

Sec. 7-77. Responsibility for provision and
maintenance.
(a) All land development shall include provi-
sion for fire hydrants at the time of development
as set forth in section 9-261. Fire hydrants shall
be furnished and installed entirely at the expense
of the developers.
(b) The utility servicing fire hydrants with
water shall be responsible to maintain and re-
place as necessary all service mains and connec-
tions to the bases of the hydrants.
(c) The city shall assume ownership and main-
tenance of only the fire hydrant itself, at the time
and in the manner specified below:
(1) Hydrants on public streets will be ac-
cepted by the city simultaneously with
acceptance of the public improvements in
the right-of-way involved, after inspection
and approval of the fire chief.
(2) Hydrants on private streets will be ac-
cepted by the city after final inspection
and approval of the improvements to be

Sec. 12-66. Cleaning, repairing vehicles on
roadway.
No person shall stand or park a vehicle upon a
roadway for the purpose of displaying it for sale or
washing, greasing, or repairing such vehicle ex-
cept repairs necessitated by an emergency.

Sec. 12-67. Obedience to signs, markings.
On such streets, highways, or other locations
where parking spaces are officially indicated by
signs or markings, parking shall be allowed only
within such spaces and then only for the times
officially indicated by such authorized signs. It
shall be unlawful for any person to park a vehicle
in any parking space designated by painted lines,
unless such vehicle is parked wholly within the
marked lines.

Sec. 12-68. Use of bus, taxi stands.
No person shall stop, stand or park a vehicle
other than a bus in a bus stop or other than a
taxicab in a taxicab stand, when any such stop or
stand has been officially designated and appropri-
ately marked; except, that the driver of a passen-
ger vehicle may temporarily stop therein for the
purpose of and while actually engaged in loading

or unloading passengers when such stopping does
not interfere with any bus or taxicab waiting to
enter or about to enter such zone.

Sec. 12-69. Loading/unloading zones.
The chief of police is authorized to designate
and to mark loading/unloading zones on the sev-
eral streets of the city, and no person shall stop,
stand or park a vehicle for any purpose or length
of time other than for the expeditious unloading
and delivery or pickup and loading of materials in
any place marked as a loading zone during hours
when the provisions applicable to loading zones
are in effect. In no case shall the stop for loading
and unloading of materials exceed time indicated
on viffn(s).

Sec. 12-70. Mobile homes to be parked in
mobile home parks; exception.
Any person occupying a mobile home for living
quarters in the city shall park such mobile home
in a regularly licensed mobile home park or in an
area appropriately zoned for mobile homes; pro-
vided that mobile homes may be parked else-
where for a period of not longer than three (3)
weeks upon the owner or party desiring to occupy
the same obtaining a permit therefor from the city
commission,

ARTICLE IV. RED LIGHT CODE
ENFORCEMENT INFRACTION
Sec. 12-80. Legislative findings and intentl
purpose.
(a) The recitals (whereas clauses) set forth in
Ordinance 2008-27 are hereby adopted, and fully
incorporated herein, as the legislative findings of
the City Commission of the City of Winter Springs.
(b) The purpose of this article is to authorize
the use of an unmanned cameras/monitoring sys-
tem to promote compliance with red light signal
directives as set forth in this article, and to adopt
a civil enforcement system for red light signal
violations. This article will supplement law en-
forcement personnel in the enforcement of red
light signal violations and shall not prohibit law
enforcement officers from issuing a citation for a
red light signal violation in accordance with non
mal statutory traffic enforcement techniques.

Sec. 12-81. Use of image capture technolo-
gies.
The city shall utilize image capture technolo-
gies as a supplemental means of monitoring com-
pliance with the state laws related to traffic
control signals, while assisting law enforcement
personnel in the enforcement of such laws, which
are designed to protect and improve public health,
safety and welfare. This section shall not super-
sede, infringe, curtail or impinge upon state laws
related to red light signal violations or conflict
v, ith suy ch la, s. The city shall utilize image cap-
ture technologies as an ancillary deterrent to
traffic control and traffic signal violations and to
thereby reduce accidents and injuries associated
with such violations. Notices of infractions issued
pursuant to this article shall be addressed using
the city's code enforcement process and not uni-
form traffic citations or county courts.

Sec. 12-82. Definitions.
For purposes of this article, the following words
and phrases shall have the following ascribed
meaning:
(a) Intersection means the area embraced
within the prolongation or connection of
the lateral curb line; or, if none, then the
lateral boundary lines, of the roadways of
two (2) roads which join or intersect one
another at, or approximately at, right
angles; or the area within which vehicles
traveling upon different roads joining at
any other angle may come in conflict.
(b) Motorvehicle means the meaning set forth
in the definition in Section 316.003(21),
Florida Statutes, or its successor provi-
sion.

MOTOR VEHICLES AND TRAFFIC
(c) Notice of infraction means a citation is-
sued for a red zone infraction.
(d) Ozozzer means the person or entity identi-
fied by the Florida Department of High-
way Safety and Motor Vehicles, or other
state vehicle registration office, as the
registered owner of a vehicle. Such term
shall also mean a lessee of a motor vehicle
pursuant to a lease of six (6) months or
more.
(e) Recorded images means images recorded
by a traffic control signal monitoring sys-
tem/device:
a. Two (2) or more photographs;
or
b. Two (2) or more electronic im-
ages; or
c. Two (2) or more digital images;
or
d. Digital or video movies; or
e. Any other medium that can dis-
play a violation; and
(2) Showing the rear of a motor vehicle
and on at least one (1) image, clearly
identifying the license plate number
of the vehicle.
(f) Red zone infraction means a traffic of-
fensewhereby atraffic control signal mon-
itoring system established that a motor
vehicle entered an intersection controlled
by a duly erected traffic control device at a
time when the traffic control signal for
such motor vehicle's direction of travel
was emitting a steady red signal.
(g) 73•affic control signal means a device ex-
hibiting different colored lights or colored
lighted arrows, successively, one at a time,
or in combination, using only the colors
green, yellow, and red which indicate and
apply to drivers of motor vehicles as pro-
vided in Section 316.075, Florida Stat-
utes.
(h) Ra ffic control signal monitoring system /
device means an electronic system consist-
ing of one (1) or more vehicle sensors,

working in conjunction with a traffic con-
trol signal, still cameras and video record-
ing device, to capture and produce re-
corded images of motor vehicles entering
an intersection against a steady red light
signal indication.

Sec. 12-83. Adherence to red light traffic con-
trol signals.
A motor vehicle in traffic facing a traffic control
signal's steady red light indication shall stop
before entering the crosswalk on the near side of
an intersection or, if none, then before entering
the intersection and shall remain standing until a
green indication is shown on the traffic control
signal; provided, however, the driver of a motor
vehicle which is stopped at a clearly marked stop
line, or if none, at the point nearest the intersect -
roadway where the driver has a view of
approaching traffic on the intersection roadway
before entering the intersection in obedience of a
steady red traffic control signal, may make a right
turn (unless such turn is otherwise prohibited by
posted sign or other traffic control device), but
shall yield right -of --way to pedestrians and other
traffic proceeding as directed by the traffic control
signal at the intersection.

Sec. 12-84. Violation.
A violation of this ordinance (red zone infrac-
tion) shall occur when a vehicle does not comply
with the requirements of section 12-83. Violations
shall be enforced pursuant to section 12-86.

Sec. 12-85. Notice; introductory period.
Until such time the city commission adopts a
resolution advising the city manager to com-
mence enforcement of this article subsequent to
the installation of the traffic control signal mon-
itoring system(s)/device(s), the owner shall re-
ceive a courtesy notice of the violation, unless the
driver of a motor vehicle received a citation from
a law enforcement officer at the time of a red zone
infraction in accordance with normal traffic en-
forcement techniques. Commencing on the date

set forth in the resolution, the city manager shall
commence enforcement of this article and owners
shall be subject to enforcement as provided in
section 12-86.

Sec. 12-86. Review of recorded images.
(a) The owner observed by recorded images
committing a red zone infraction, shall be issued
a notice of infraction. The recorded image shall be
sufficient grounds to issue a notice of infraction.
(b) The city shall designate a person or per-
sons, who shall meet the qualifications set forth
in Section 316.640(5)(a), Florida Statutes, or any
other relevant statute, as a traffic control infrac-
tion review officer. The traffic control infraction
review officer shall review recorded images prior
to the issuance of a notice of infraction to ensure
accuracy and the integrity of the recorded images.
The traffic control infraction officer shall also
verify that the traffic control monitoring system/
devices that captured the recorded images was
functioning properly at the time the recorded
images were captured. Once the traffic control
infraction review officer has verified the accuracy
of the recorded images and functionality of the
traffic control monitoring systein/devices, he or
she shall complete a report, and a notice of
violation/infraction shall be sent to the owner at
the address on record with the Florida Depart-
ment of Highway Safety and Motor Vehicles.

Sec. 12-87. Notice of violation/infi•aetion.
(a) The notice of violation/infraction shall in-
clude at a minimum.
(1) The name and address of the owner;
(2) The license plate number and registration
number of the motor vehicle;
(3) The make, model and year of the motor
vehicle;
(4) Notice that the violation charged is pur-
suant to this article;
(5) The location of the intersection where the
violation occurred;
(6) The date and time of the red zone infrac-
tion;
(7) Notice that the recorded images relating
to the vehicle and a statement that the
recorded images are evidence of a red
zone infraction;
(8) The civil penalty imposed;
(9) Images depicting violation;
(10) The procedures for payment of the civil
penalty and contesting the notice of in-
fraction;
(11) A signed statement by the traffic control
infraction officer that, based on inspection

volved in a red zone infraction;
(12) Information advising the person alleged
to be liable under this section, the manner
and time in which liability as alleged in
the notice of infraction may be appealed
and warning that failure to pay the civil
penalty or to contest liability in a timely
manner is an admission of liability.
(b) The city manager shall have authority to
promulgate the form described herein.

Sec. 12-88. Owner responsibilities.
(a) An owner receiving a notice of infiaction
may, within twenty-one (21) days of the date of
the date of the notice of infraction:
(1) Pay the assessed civil penalty pursuant to
instructions on the notice of infiaction; or
(2) Request an appeal pursuant to section
12-89.
(b) The failure to comply with the provisions of
this section within twenty-one (21) days from the
date of the notice of infraction shall constitute a
waiver of the right to contest the notice of infrac-
tion and will be considered an admission of liabil-
ity.

MOTOR VEHICLES AND TRAFFIC
Sec. 12-89. Appeal to code enforcement
board.
(a) The city's code enforcement board shall
consider appeals under this article. Within twenty-
one (21) days of the date of the notice of infraction,
the owner may file an appeal with the city pursu-
ant to the directions in the notice of infraction. A
hearing on the appeal shall be scheduled for all
appeals.
(b) Upon receipt of the appeal, the city shall
schedule a hearing before the code enforcement
board to occur not later than sixty (60) days after
city's receipt of the appeal request. A notice of
hearing shall be provided to the owner no less
than ten (10) days prior to the hearing, and shall
be delivered via certified U.S. mail to the same
address to which the notice of infraction was sent.
(c) The following shall be permissible grounds
for an appeal:
(1) At the time of the infi•action, the vehicle
was not under the care, custody, or control
of the owner or an individual with owner's
consent, established pursuant to affidavit
as provided in section 12-90;
(2) The motor vehicle driver was issued a
citation by a law enforcement officer, which
was separate and distinct from the cita-
tion issued under this section, for violat-
ing the steady red traffic control signal;
(3) The motor vehicle driver was required to
violate the steady red traffic control
nal in order to comply with other govern-
ing laws;
(4) The motor vehicle driver was required to
violate the steady red traffic control
nal in order to reasonably protect the
property or person of another;
(5) The steady red traffic control signal was
inoperable or malfunctioning; or
(6) Any other reason the code enforcement
board deems appropriate.
(d) The traffic control infraction review officer
shall testify at the appeal. The owner, or his or
her representative, may also present testimony
and evidence.
(e) Recorded images indicating a red zone in-
fraction, verified by the traffic control infraction
review officer, are admissible in any proceeding
before the code enforcement board to enforce the
provisions of this article, and shall constitute
prima facie evidence of the violation.
(f) Unless an affidavit is provided pursuant to
section 12-90, it is presumed the person regis-
tered as the owner with the Florida Department
of Highway Safety and Motor Vehicles or any
other state vehicle registration office, or an indi-
vidual having the owner's consent, was operating
the vehicle at the time of a red zone infraction.

Sec. 12-90. Owner affidavit of non -responsi-
bility.
(a) In order for the owner to establish that the
motor vehicle was, at the time of the red zone
infraction, in the care, custody, or control of an-
other person without the consent of the owner, the
owner is required to complete an affidavit setting
forth the circumstances demonstrating that the
motor vehicle was not in the owner's care, custody
or control, or that of a person with owner's con-
sent. The affidavit must be executed in the pres-
ence of a notary, and include at a minimum:
(1) If known to the owner, the name, address,
and the driver license number of the per-
son who leased, rented or otherwise had
care, custody, or control of the motor ve-
hicle at the time of the alleged red zone
infraction; or
(2) If the motor vehicle was stolen, the police
report indicating the motor vehicle was
stolen at the time of the alleged red zone
infraction.
(3) The following language immediately above
the signature line: "Under penalties of
perjury. I declare that I have read the
foregoing affidavit and that the facts stated
in it are true."
(b) The owner may present an affidavit pursu-
ant to this section, as a defense in any proceeding
before the code enforcement board.

Sec. 12-91. Penalties,
(a) A violation of this article shall be deemed a
noncriminal, nonmoving violation for which a
civil penalty in the amount of one hundred twenty-
five dollars ($125.00) shall be assessed.
(b) As the violation relates to this article and
not the Florida Statutes, no points, as provided in
Section 322.27, Florida Statutes, shall be re-
corded on the driving record of the vehicle owner
or responsible party.
(c) Nothing in this article shall be construed as
prohibiting law enforcement from issuing a cita-
tion for a red light signal violation in accordance
with state law.

Sec. 12-92. Administrative charges.
In addition to the assessment pursuant to
section 12-91, administrative charges in the amount
of the city's actual costs shall be assessed in the
event of an unsuccessful appeal or the necessity to
institute collection procedures.

Sec. 12-93. Collection of fines.
The city manager may establish procedures
and processes for the collection of any penalty or
charge imposed or assessed under the provisions
of this article and may enforce such penalty by
civil action in the nature of debt.

Sec. 12-94. Exceptions.
(a) This article shall not apply to red zone
infractions involving motor vehicle collisions or to
any authorized emergency vehicle responding to a
bona fide emergency.
(b) A notice of infraction may be issued in any
case where the operator of the motor vehicle was
issued a citation for violating state law regarding
the failure to stop at a red light indication.

Sec. 12-95. Additional legislative findings.
The City Commission of the City of Winter
Springs hereby finds that from time -to -time it is
beneficial and desirable for various matters, aris-
ing from the provisions of the city's codes and
ordinances, to be referred to the code enforcement
board to make findings of facts and conclusions of
law; to hear administrative appeals; or to hear
other matters of a similar nature.

Sec. 12-96. Referrals to code enforcement
board.
(a) The city commission has determined that
matters will be referred to the code enforcement
board for a determination, a decision, a recom-
mendation, or findings of facts and conclusions of
law, or any combination thereof.
(b) The rules of procedure relating to a matter
referred to the code enforcement board shall be
set forth in written rules and procedures ap-
proved by the city commission.

PERSONNEL
ARTICLE I. IN GENERAL
Sec. 14-1. Policy, rules and regulations.
The personnel policy of the city shall be ap-
proved and ratified by resolution of the city com-
mission which shall include a system for the
recruiting, selecting, developing and maintaining
an effective and responsive workforce, and shall
include policies and procedures for employee hir-
ing and advancement, training and career devel-
opment, job classification, salary administration,
retirement, fringe benefits, discipline, discharge
and other related activities which is on file in the
city clerk's office. The city manager shall from
time to time amend and update the personnel
policy.

ARTICLE II. OLD AGE AND SURVIVORS
INSURANCE*
Sec. 14-26. Extension of benefits.
(a) hzterzt. It is hereby declared to be the policy
and purpose of the city to extend effective as of
January 11, 1975, to the employees and officials
thereof, not excluded by law, nor excepted herein,
the benefits of the system of old age and survivors
insurance as authorized by the federal social
security act and amendments thereto, and by F.S.
ch. 650 and to cover by such plan all services
which constitute employment as defined in F.S.
§ 650,02, employed in the employ of the city by
employees and officials thereof, except for ser-
vices rendered by elected officials, or services
rendered by part-time employees, and for services
rendered for which the compensation is on a fee
basis.
(b) Exceptions. There is hereby excluded from
this section any authority to include in any agree-
ment entered into under section 14-27, any ser-
vice, position, employee or official now covered by
or eligible to be covered by an existing retirement
system.

co 14-27. Execution of agreements.
The mayor is hereby authorized and directed to
execute all necessary agreements and amend-
ments thereto with the state agency for the pur-
pose of extending the benefits provided by the
system of old age and survivors insurance to the
employees and officials of this city as provided in
this article, which agreement shall provide for
such methods of administration of the plan by the
city as are found by the state agency to be
necessary and proper, and shall be effective with
respect to services in employment covered by such
agreement performed on and after the eleventh
day of January, A.D., 1975.

Sec. 14-28. Contributions.
(a) Withholdings. Withholdings from salaries,
wages or other compensation of employees and
officials for the purpose provided in section 14-
26(a) are hereby authorized to be made, and shall
be made, in the amounts and at such times as
may be required by applicable state or federal
laws or regulations, and shall be paid over to the
state agency designated by such laws or regula-
tions to receive such amounts.
(b) City contribactions. There shall be appropri-
ated from available funds, derived from the gen-
eral fund of the city such amounts, at such tunes,
as may be required to pay promptly the contribu-
tions and assessments required of the city as
employer by applicable state or federal laws or
regulations, which shall be paid over to the law-
fully designated state agency at the times and in
the manner provided by law and regulation.

Sec. 14-29. Records.
The city shall keep such records and snake such
reports as may be required by applicable state or
federal laws or regulations governing the provi-
sions of this article, and shall adhere to the
regulations of the state agency.

Sec. 14-30. Adoption of Title II, Social Secu-
rity Act.
The city does hereby adopt the terms, condi-
tions, requirements, reservations, benefits, privi-

leges and other conditions thereunto appertain-
ing, of Title II of the Social Security Act as
amended, for and on behalf of all officers and
employees of its departments and agencies to be
covered under the agreement.

Sec. 14-31. Custody of funds.
The city clerk is hereby designated the custo-
dian of all sums withheld from the compensation
of officers and employees and of the appropriated
funds for the contribution of the city, and the city
clerk is hereby made the withholding and report-
ing agent and charged with the duty of maintain-
ing personnel records for the purposes of this
artiole.

ARTICLE III. PENSION PLAN
Sec. 14-51. Adopted.
(a) The city does hereby elect to provide for its
employees a pension plan and trust, such plan
and trust to be known as the "Pension Plan for the
Employees of the City of Winter Springs, Florida"
(hereafter referred to as "the plan"). The plan
shall be administered by a board of trustees as
appointed in section 14-52.
(b) The city does hereby approve and adopt the
plan, a copy of which is on file in the city clerk's
office and authorizes the mayor and city manager
to execute the plan on behalf of the city. The plan
may be amended from time to time by resolution
of the city commission.
(c) The cost of the plan shall be paid entirely
by the city fr•orn the pension fund.
(d) The city shall be bound by the terms and
conditions of the plan.

co 14-52. Board of trustees.
(a) There is hereby created and established a
board of trustees consisting of five (5) members
who shall be appointed by resolution of the city
commission. Each commissioner shall have one
(1) appointment to the board. Vacancies in the
board shall be filled by the city commission mem-
ber whose seat number corresponds with the
vacant board seat subject to commission ratifica-
tion, for the unexpired term of such vacancy. If
any commissioner fails to appoint a member within
two (2) regularly scheduled commission meetings
after a vacancy occurs or a term expires, that seat
will be filled by the mayor, subject to the ratifica-
tion by the city commission.
(b) The board of trustees shall meet no less
than quarteriy to review the performance of the
pension plan and conduct such other business as
the board deems appropriate and necessary.
(c) The board of trustees shall administer the
city's pension plans pursuant to the provisions
contained therein as adopted by the city commis-
sion.
