HomeMy WebLinkAboutSeminole County Law Enforcement 2025-2028 Voluntary Cooperation/Mutual Aid Agreement: City/County Traffic Enforcement Unit - 2025 05 12VOLUNTARY COOPERATIONIMUTUAL AID AGREEMENT GOVERNING THE CITYICOUNTY TRAFFIC ENFORCEMENT UNIT - April 1 S, 2025 to April 1 S, 2028. 2025-2028 VOLUNTARY COOPERATION/MUTUAL AID AGREEMENT GOVERNING THE CITY/COUNTY TRAFFIC ENFORCEMENT UNIT The City of Altamonte Springs, Florida The City of Casselberry, Florida The City of Lake Mary, Florida The City of Longwood, Florida The City of Oviedo, Florida The City of Sanford, Florida The City of Winter Springs, Florida The Sanford Airport Authority The Seminole County Sheriff's Office The University of Central Florida Board of Trustees on behalf of its Police Department The Altamonte Springs Police Department, the Casselberry Police Department, the Lake Mary Police Department, the Longwood Police Department, the Oviedo Police Department, the Sanford Police Department, the Winter Springs Police Department, the Seminole County Sheriff's Office, the University of Central Florida Board of Trustee on behalf of its Police Department, and the Sanford Airport Police Department hereby enter into this Voluntary Cooperation Agreement forming the City/County Traffic Enforcement Unit to provide collective countywide traffic enforcement and control services on an as -needed basis according to procedures specified herein. NOW, THERFORE, THE PARTIES AGREE AS FOLLOWS: SECTION I. CITY/COUNTY TRAFFIC ENFORCEMENT UNIT REQUEST AND RESPONSE A. A party to this Agreement may request the assistance of the City/County Traffic Enforcement Unit by notifying the Unit representatives as far in advance as possible that assistance is required for a prearranged routine law enforcement traffic enforcement operation. "Routine law enforcement traffic operations" include, but are not limited to: DUI/impaired driver countermeasure operations, driver checkpoints, aggressive driving and speeding violation enforcement saturations. General Traffic Assistance such as traffic control for events may also be rendered under the Mutual Page 1 VOLUNTARY COOPERATIONIMUTUAL AID AGREEMENT GOVERNING THE CITYICOUNTY TRAFFIC ENFORCEMENT UNIT —April 15, 2025 to April 1 S, 2028. Aid Interlocal Agreement effective August 2024 rather than this Agreement. The requesting agency should send prior notification to the Sheriff, Police Chief, or agency head or their designee of the assisting agency. B. The Sheriff, Chief or agency head, or designee of the agency whose assistance is sought, shall evaluate the situation, the assisting agency's available resources, and shall respond in a manner that they deem appropriate. The decision of the Sheriff, Chief or agency head or their designee shall be final. C. When a "Routine law enforcement traffic operation" organized under this Agreement extends across jurisdictional lines, each party participating is authorized to detain, search, arrest individuals and perform all other functions as if they were inside their own jurisdiction. SECTION H. POLICY AND PROCEDURE A. The resources or facilities that are assigned by an assisting agency shall be under the immediate command of a supervising officer, designated by the assisting agency head. Such supervising officer shall be under the supervision and command of the agency head or designee of the agency requesting assistance. B. Should any violation of Florida Statutes occur during an operation pursuant to this Agreement or if secondary offenses occur which stem from enforcement action pursuant to this agreement, any participating assisting officer, representing his or her respective agency in furtherance of this Agreement, shall be empowered to render enforcement assistance and act in accordance with this Agreement and the law, as if they were inside their own jurisdiction. C. The prearranged "Routine Traffic Enforcement Operations" requiring the use of the City/County/State Traffic Enforcement Unit will be set forth in an Operational Plan developed by the requesting agency in accordance with law, and shall be limited in scope to a specific area of the County or certain roadways or highways that meet the objectives of the Operational Plan. Additionally, each operation shall be for a limited time period, not to exceed seven (7) calendar days. D. Ensuring participating individuals are aware of their responsibilities and limitations, b. Ensuring that participants understand the geographical area boundaries and the duration of the operation, c. Discussing the purpose of the operation, d. Reviewing safety precautions to be implemented, including equipment to be used, e. Assigning any specific duty assignments, f. Establishing the planned vehicle stop sequence (if any), g. Monitoring the event, h. Ensuring that a sufficient number of personnel are present to provide adequate safety, i. Ensuring that participating personnel are aware of the requirements and limitations on their actions and the handling of situations which might arise under the operational plan's implementation, j. Ensuring that operations flow smoothly and if the operation involves a stop checkpoint, that drivers are detained for a minimal amount of time, k. Deciding if conditions require a change in the number (sequence) of vehicles stopped if the operation involves a stop checkpoint, including determining when to terminate the checkpoint, and, 1. Filing an after -action report if required by the requesting agency supervising the operation. SECTION III. POWERS, PRIVILEGES, IMMUNITIES, AND COSTS A. Members of the subscribed law enforcement agencies, when actually engaging in assistance outside of the jurisdictional limits of their respective agencies under the terms of this Agreement, shall, pursuant to the provisions of Section 23.127, Florida Statutes, have the same powers, duties, rights, privileges, and immunities, as if they were performing their duties in the political subdivision in which they are normally employed. Page 3 1 VOLUNTARY COOPERATION/MUTUAL AID AGREEMENT GOVERNING THE CITY/COUNTY TRAFFIC ENFORCEMENT UNIT — April 15, 2026 to April 15, 2028. B. Each party agrees to furnish necessary equipment, resources, and facilities, and to render services to each other party to the Agreement as set forth above, provided however, that no party shall be required to deplete unreasonably its own equipment, resources, facilities, and services, in furnishing such assistance. C. The assisting agency furnishing assistance pursuant to this Agreement, shall bear the loss or damages to such equipment, and shall pay any expense incurred in the operation and maintenance thereof. D. The assisting agency furnishing assistance pursuant to this Agreement, shall compensate its appointees/employees during the time such aid is rendered, and shall defray the actual travel maintenance expenses of such appointees/employees while they are rendering such assistance, including any amounts paid or due for compensation due to personal injury or death while such appointees/employees are engaged in rendering such assistance. E. All the privileges and immunities from liability, exemption from laws, ordinances and rules, and all pension, insurance, relief, disability, worker's compensation, salary, death, and other benefits that apply to the activity of such officers, agents, or employees of any such agency when performing their respective functions within the territorial limits of their respective public agencies, shall apply to them to the same degree, manner, and extent while engaged in the performance of any of their functions and duties extraterritorially under the provisions of this Agreement. The provisions of this section shall apply with equal effect to full time paid, part time, volunteers, and reserve members. F. All employees of a respective agency, while acting in another's jurisdiction in accordance with this Agreement, shall be deemed to be acting within the course of their own agency's employment and shall not be construed to be acting as an employee of any other agency. G. If the Operational Plan fails to set forth the handling of secondary consequences, the policy and procedure of the requesting agency will control, except if the requesting agency's policy conflicts with the individual participant's employing agency, then the individual participant shall follow his/her own employer's policy. Page 4 VOLUNTARY COOPERATIONiMUTUAL AID AGREEMENT GOVERNING THE CITYICOUNTY TRAFFIC ENFORCEMENT UNIT — April 15, 2025 to April 15, 2028. H. If a complaint is lodged against any participant officer/deputy, the complaint will be forwarded to the Agency Head or his/her designee of the participating officer/deputy agency to be handled pursuant to the policy and procedures of the employing agency. I. The requesting agency will not be obligated to reimburse the assisting agencies for rendering assistance as outlined in this Agreement. J. A party will not have any liability because it does not provide services to the other parties to this Agreement. Further, the assisting agency retains the right to withdraw some or all of its resources at any time. Notice of intention to withdraw must be communicated to the requesting agency's designated official as soon as practicable. SECTION IV. INDEMNIFICATION Each party agrees, with respect to any suit or claim for damages resulting from any and all acts, omissions, or conduct of such part's own appointees/employees occurring while engaging in rendering assistance pursuant to this Agreement, to hold harmless, defend, and indemnify the other participating party and its appointees/employees, subject to the provisions of Section 768.28, Florida Statutes, where applicable, and to the extent permitted by law. Any party having a duty to indemnify and defend under this Agreement shall have control of the defense of any suit or claim arising under said duty. Each party shall be responsible for the acts, omissions, or conducts of its own employees. Nothing in this Agreement shall be deemed a waiver of any parry's sovereign immunity. This Agreement is solely for the benefit of the parties hereto. No right, remedy, cause of action or claim shall accrue to the benefit of any third party who is not a party to this Agreement. SECTION V. INSURANCE PROVISIONS Each party shall maintain liability insurance by one or more of the means specified in Section 768.28(16), Florida Statutes, in an amount that is, in the judgment of the governing body of that party, at least adequate to cover the risk to which that party may be exposed. Should the insurance coverage, however provided, of any party be canceled or undergo material change, that party shall notify all parties to this Agreement of such change within ten (10) days of receipt of notice or actual knowledge of such change. Page 5 VOLUNTARY COOPERATIONfMUTUAL AID AGREEMENT GOVERNING THE CITY/COUNTY TRAFFIC ENFORCEMENT UNIT — April 16, 2026 to April 16, 2028. SECTION VI. EFFECTIVE DATE/COUNTERPARTS This Agreement shall be effective as to member agencies upon their execution. The Agreement shall continue in full force and effect until April 15, 2028 unless terminated prior thereto. Under no circumstance may this Agreement be renewed or extended except in writing. This Agreement, may be duplicated for dissemination to the Parties, and such duplicates shall be of the same force and effect as the original. Execution of this Agreement may be signified by properly signing a separate signature page, the original of which shall be returned to and maintained by the Office of Chief Counsel within the Seminole County Sheriffs Office, 100 Eslinger Way, Sanford, Florida 32773 with a copy provided to the Florida Department of Law Enforcement, Mutual Aid Coordinator, P.O. Box 1489, Tallahassee, Florida 32302-1489 by the Sheriff, within 14 days of execution by all parties. SECTION VII. CANCELLATION Any party may cancel/withdraw such parry's participation in this Agreement by providing written notice of such cancellation/withdrawal no less than 30 days prior thereto to the other parties to this Agreement. However, a parry's withdrawal from this Agreement shall be effective only as to that party, and this Agreement shall remain in full force and effect as to those remaining parties hereto who have not provided written notice of withdrawal/cancel lation. SECTION VIII MISCELLANEOUS PROVISIONS A. Conflicts: In the event of a conflict between the provisions of this Agreement and Sections 23.12, F.S., et seq., the Florida Mutual Aid Act, the provisions of the Florida Mutual Aid Act shall control. B. Amendments: This Agreement contains the entire understanding between the parties and shall not be modified except in writing. C. Severability: If any provision of this Agreement shall be declared invalid for any reason, such invalidity shall not affect any of the remaining provisions of this Agreement. Third -Party Beneficiaries : The provisions of this Agreement are for the exclusive benefit of the parties hereto and not for the benefit of any third person, nor shall this Agreement be deemed to have conferred any rights, express or implied, upon any third person unless otherwise expressly provided for herein.
