Inspector Elbon introduced the case, offered testimony on the procedures of notice and the violation, and showed photos from the “Presentation.” The Board accepted the packet as published into evidence without objection. Officer Elbon recommended a compliance date of August 23, 2025 and a fine of up to $250 per day violation if this was not met. Discussion followed on the length of time the violations had existed, lack of communication from the respondent, and safety concerns. Ms. Vicki Horvath Hopper, 803 Kilt Court, Winter Springs was sworn in and testified as a resident of the Highlands. Ms. Hopper testified that the HOA had been unresponsive to safety concerns voiced by herself and other residents and was unwilling to spend money to address the issues. Further discussion followed on safety concerns related to the condition of the walkway and the ability to add additional language to the motion to potentially allow the City to intervene. “I MOVE TO FIND THAT BASED ON THE PHOTOGRAPHS AND TESTIMONY FROM THE INSPECTOR AND FROM THE WITNESSES WHO CAME SHOW THAT THERE ARE MAJOR DISCREPANCIES IN THE SIDEWALKS AND DRIVEWAYS OF THE TRAIL OF THE RESPONDENT, AND THAT RESPONDENT IS IN VIOLATION OF IPMC SECTION 302.3 SIDEWALKS AND DRIVEWAYS.
