Resolution 2025-11: Preserving the City's Status as a Municipal Corporation
SUMMARY
This resolution was requested by Commissioner Caruso under New Business at the
June 23, 2025 Commission Meeting. The attached resolution was prepared by the City
Attorney for consideration by the City Commission.

RESOLUTION NO. 2025-11
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
WINTER SPRINGS, FLORIDA, EXPRESSING THAT THE CITY
COMMISSION IS FIRMLY COMMITTED TO PRESERVING THE CITY’S
STATUS AS A MUNICIPAL CORPORATION IN ORDER TO SAFEGUARD
AND ADVANCE OUR CITIZEN’S CONSTITUTIONAL RIGHT TO SELF -
GOVERNANCE THROUGH HOME RULE; AND PROVIDING AN
EFFECTIVE DATE.
WHERESAS, the Florida Constitution recognizes the importance of municipal home rule
to all its citizens and allows municipalities to exercise powers for municipal governmental,
corporate, or proprietary purposes, unless expressly prohibited by law; and
WHEREAS, pursuant to Chapter 165, Florida Statutes, and the Florida Municipal Home
Rule Powers Act, municipal government exists to allow local communities the ability to exercise
home rule powers and self-determination in matters relating to planning, infrastructure, and
quality of life; and
WHEREAS, the City of Winter Springs was original incorporated as North Orlando in
1959, and the name changed to Winter Springs in 1972; and
WHEREAS, the City of Winter Springs has demonstrated a sustained commitment to
fiscal responsibility, the delivery of essential services , the enhancement of our citizens quality of
life, and adherence to applicable law, reflecting its ongoing viability and sound self -governance;
and
WHEREAS, since its founding, the citizens of City of Winter Springs have continuously
supported the City’s mission, and status as a municipal incorporation, as a reflection of the
community’s distinct identity, civic pride, and long-standing commitment to local control over its
future; and
WHEREAS, the City Commission of the City of Winter Springs wishes to express its
steadfast commitment to remain a municipal corporation of the State of Florida, and expressly
rejects any proposal to the contrary; and
WHEREAS, the City Commission finds that this Resolution is in the best interests of the
citizens of Winter Springs.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, THAT:
Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and
are hereby fully incorporated herein by reference.

Section 2. Preservation of City and Citizen’s Right to Home Rule. The City Commission
hereby states that the City Commission is firmly committed to preserving the City’s status as a
municipal corporation to safeguard and advance our citizen’s constitutional right to self -
governance through home rule.
Section 3. Effective Date. This Resolution shall become effective upon adoption by the
City Commission of the City of Winter Springs.
ADOPTED by the City Commission of the City of Winter Springs, Florida, this 14th day
of July, 2025.
