Or. Jesse Phillips screams his endless tirades are not his imagination, but his and WSCA's
rendition of the truth. On Monday June 30, 2025, three of WSCA's recruited, vetted and
endorsed City Commissioners, approved the illegal transfer of $270,000 of tax payers money to
some past developer. These three Commissioners admitted Ex-Parte," meetings with this
Developer, his attorney, and Ex -mayor Paul Partyka, who has also had a litany of past conflict of
interest challenges while in office, so I'm enclosing a two page document dated January 22,
2011. From this its obvious Phillips and Greenberg's WSCA's agenda, among other matters
today, are but an update of unstated conspiracies still unfolding around Winter Springs.
Reading this document may cause many, including Phillips, Greenberg, and WSCA's disciples, to
have enuresis.
Saying nothing about WSCA's three Commissioners who approved the illegal 270,000 dollar
payment last month, Phillips spreads even more disinformation now. So enclosed too are
Phillip's latest deceits: "Sloppy Legal Work, political spin and no one held accountable?" And
his mendacious: "Do you trust the current city leadership?" The first is what media call kids
with 'infantile tension problems/ while Phillips second, "The Recall of the City Mayor and City
Attorney for cause," while not mentioning his three Commissioners who made it happen: is
obviously an advanced case of enuresis.
In conclusion, this Commission needs to be careful concerning a Mayor and Attorney recall,
when in fact it should probably be the five of you.

OUR CITY; A SPLENDOR IN CENTRAL SEMINOLE COUNTY
I'll start by passing on good news: The present score is the good guys two, Michael
Jones & Paul P. Partyka and Michael Jones & Lein & Lenzini — 0 and I am not
attempting to be facetious.
For some time now we have endured the personal insults, the published half truths,
the false and injurious statements read into the record during public input by a group of
obstructionists whose only apparent purpose is to derail and delay the efforts of this
commission to fulfill the goals set for our great city.
In their rhetoric they charge that we are spending huge amounts of money (false and
unsupported) irresponsibly. This includes monies spent in defending the City Charter and
the right of citizens to set up an assessment district.
The Mayor who has aided and abetted the efforts of this group of people indirectly,
vetoed the 99 budget because of excessive legal expenses while not being politically
correct for it was his actions that precipitated the right of this commission to defend itself
and the City Charter.
The Mayor vetoed the Commercial Parking ordinance after working with the
Commission for six months and ultimately approving the final draft without objection.
The Mayor in order to make a profitable commission as a realtor whose license was only
activated during the late stages of the Town Center codification and agreement sold land
to a non for profit organization (501 c3) in order for them to install a respite center in our
city after being denied a permit in Sanford. This transaction sailed through without the
slightest hint to the Commission that a city official was involved.
The Mayor never voted for or against the beautification assessment district and if one
listens carefully to each and every tape recorded and dealing with that subject one will
learn that there is subtle support for the People for Good Government and their
representatives who filed the infamous law suit against the bond issue; necessary to
proceed with the project.
The Mayor in his smooth and subtle ways supported the Pizza parlor to be opened on
Winter Springs Boulevard; Tuskawilla's center piece, by bringing in his campaign
manager and his other supporter to speak in support of the application while in a sort of
way performing theatrics while chiding the commission.
Our Mayor then proceeds to call on the applicant to make a presentation. Usual
procedure. However and instead of proceeding as usual, the applicant is asked leading
questions by the Mayor in order to reinforce the position of the applicant and further
allows and permits the applicant to make threats against person/s that could be
performing background checks in order to learn if the subject is suitable to do business in
our community.
The Mayor also permitted one of his friends to scald yours truly over a remark made to a
City employee.
Yet, he readily and without hesitation for the third time in the span of one year,
interrupted yours truly when I legitimately was attempting to speak against the restaurant
and needed to speak about the respite center in order to connect and make sense of my
statement.
This is not a political year and there are not any elections pending or seats up for grabs. I
am not making this statement for political reasons.
However, we are supposed to be a team and none of us should be using a group of non-
conformists to harass and obstruct this public body from performing at above expected
level and to achieve the goals approved by the citizens.
A perfect example is the current effort by the People for Bad Government to override the
official duties of the Commission and pursue a referendum consisting of 13 amendments
to the City Charter, most of which are pretentious and ill conceived.This is being done
for the only purpose of satisfying our Mayor quest for power not presently granted by the
City Charter.The Mayor wants to have a vote; totally unnecessary , veto power, which he
already has, and to change our system of government from Manager -Commission strong
to Mayor-strong.When he voluntarily ran for election to the position he now enjoys, he
was perfectly aware of the powers vested in him.
When he was a Commissioner back in 1990-93 he never, ever suggested the then Mayor
be given the powers he now wants, nor suggested the Charter be revised then to achieve
such a notion. During this period he also participated in the approval of the ordinance and
the Agreement that permitted parcel 61 to now be developed as a restaurant and never
argued for a variance.
The bottom line is that once again, and as I did right after my reelection victory am
asking our Mayor to put aside personal differences, to stop lending what the group of
obstructionists take as support and to work with this commission for the health, safety
and welfare of this; our city.

Sloppy Legal Work. Political Spin. And No One
Held Accountable.
The recent controversy over a $277,400 tree mitigation fee exposed more than just disagreement at City
Hall — it exposed a broken system where unclear legal agreements, poor record -keeping, and political
deflection are costing this city real money and real trust.
Let's set the record straight: this was never about whether trees matter. They do. That's not in
question.
The real issue is this: how did our city end up in a situation where a legal agreement —worth
hundreds of thousands of dollars —was so badly written that no one could agree on what it
actually meant?
An Inexplicably Vague Agreement
The City Commission recently voted 3-2 that the developer in question had already paid the required tree
mitigation fee back in 2017, as part of a previously approved development agreement. Several
commissioners read the agreement and believed it was clear.
Others disagreed. They felt the document was ambiguous. And that's exactly the point.
Why was the language so unclear in the first place? And where was the city attorney when this
agreement was drafted, reviewed, and enforced?
This isn't a debate about trees. It's a debate about competence.
Mayor McCann's cynical spin machine
Rather than addressing the City Attorney who drafted a bad agreement, Mayor Kevin McCann did what
he always does when he doesn't get his way — he ran to Facebook and twisted the facts.
Even though he acknowledged during the meeting that no "fee waiver" was being granted, he turned
around and told residents the commission had "removed" a $277,400 fee. This is classic political theater:
• Redirect outrage to protect your friends.
• Ignore the facts.
• Paint yourself as the hero solving the problem you caused.
And while the mayor plays politics, City Attorney Anthony Garganese just shrugs. No public
correctionI No accountability. No responsibility for the poorly written agreement that started this mess.
This isn't the first time his legal work has failed the people of Winter Springs —and it likely won't be the
last.
Patterns We Can't Ignore
City Attorney Garganese has been the legal architect (or silent witness) to some of Winter Springs' worst
failures:
• He defended the city's handling of Veolia —and in doing so, helped shield a contractor
responsible for repeated water quality failures.
• He signed off on dismissive audit responses that downplayed major problems.
• Instead of defending the city's right to enforce its own standards, he gave political cover as
the Mayor abdicated home rule —leaving residents stuck with a public storage monstrosity.
• And now, he's authored or overseen an agreement so vague it cost us a bitter public fight.
Why is he still here?

BACKGROUND: The business climate in Winter Springs has long been
described as burdensome, especially for mom and pop shops looking
to renovate existing space and enhance our community (i.e. old 7M
site in Tuscawilla). Some small businesses looking to re -open existing
locations are being treated like brand new construction by city
planners and engineers, under the direction of Director Terrilyn Rolle,
greatly increasing the cost of renovating vacant spaces.

Dear Mayor McCann, Winter Springs City Commissioners, City Manager, and City Clerk:
This email is to support Mayor McCann's effort to stand strong against the developers in our city,
who want to strip the land of trees and not pay the required arbor/tree ordinance mitigation fees for
the next phase of the project.
Our trees are one of the major factors in keeping City of Winter Springs livable, beautiful, enjoyable,
and free from overdevelopment.
I am all for REASONABLE development in our city. But to continue to tear apart the canopy of trees
reduces property values, takes away natural habitat for wildlife, and makes our city look like any
other generic spot off of an interstate.
Let's keep that from happening in Winter Springs.
We love our city and we love our trees.
Please continue to stand firm against the developers who want to raid our city, take down our trees,
and avoid paying any of the cost to do so.

Mayor McCann, Commissioners and City Staff,
I will be out of town and unable to attend Monday's meeting but wanted to send my public input by email. I was
planning to attend the special meeting on July 7th but it was cancelled.
I will preface my comments with this: I have lived in Winter Springs since June of 2003, having moved to Winter
Springs Village in November of 2012 after 9.5 years in Parkstone. I've been involved with the WSV HOA as a
resident board member when Meritage Homes was still in control of the HOA in 2013. Now in my 5th term as the
HOA President, I've had the opportunity to talk with, meet with and/or email with multiple past city staff members
over many years, as well as current and former commissioners. I have always appreciated the opportunity to
work cooperatively with our city on various topics. Therefore, it saddens me that the overall tone, political culture
and current state of affairs over the last few years has caused the resignations of invaluable city managers / interim
city managers, (i.e., Phil Hursh) and other city personnel our community had been fortunate to know.
Thankful for their dedication, their work ethic and their efforts as genuine public servants, I was once eager to
stay involved with attendance at city meetings and even served, albeit briefly, on the city's code enforcement
volunteer board. Newer candidates for city commission (and unfortunately even one former commissioner
returned) opted to sow the seeds of disinformation campaigns over a period of years - which the public readily
digested from general apathy coupled with a lack of critical thinking. As a byproduct of this culture, we now
have our own city version of political theatre with pervasive grandstanding at most of the city meetings, not at all
reflective of the decorum of former years. For this reason, I find it difficult to stomach attendance at the
meetings. I am thankful that Mayor McCann has brought this item back to the table because it is a critical
vote that will have lasting implications for decades. For the purpose of this email, I will make my
statement regarding the tree provision, Agenda Item 501:
Our community has watched hundreds of units of multi-family housing and commercial retail projects develop
around us since 2012. We are "boxed-in" so to speak, on our parcel of 202 single family homes adjacent to WSHS
and just south of the lake. We are indeed zoned within the WSTC, so

ultimately, we did expect some measure of development. Overall, I feel the Blake turned out to be a decent project
with nice landscaping, as did Seminole Crossing and Hickory Grove Townhomes. That said - there is reasonable
development with smart growth planning within any municipality and then there is reckless development
with consequences. Here in Winter Springs Village, we have lived those consequences since Hurricane Irma
in 2017.
We were invited by Phil Hursh last October to attend a meeting for a presentation on the MBB drainage
improvements. We've been waiting many years for that work, to the point where the water pump we've
affectionately named "Big Blue" has become part of our landscape. We were told the work would be completed by
July of this year, ahead of another peak storm season. The work has not even begun. We are grateful for the
public works employees who check on the pump and keep it running during the rainy months. It was former city
mgr Shawn Boyle who helped us during one of those floods, digging trenches with his pant legs rolled up as
Buckhorn Drive flooded over the sidewalks. While the addition of the large parking lot at the town center added
parking space, that lot, coupled with the multiple developments surrounding us to our west, east and south,
created further impermeable surfaces that exceeded anything we expected, causing extensive flooding of our
streets during a summer downpour, let alone a hurricane. The WSTC drains toward Winter Springs Village.
Wetlands Park's drain outlets have proven unfit for the sheer volume of water coming from the impermeable
surfaces of the town center and now Hickory Grove as well. The drainage turrets along Tuskawilla can't handle the
volume of water so they overflow into Wetlands Park which subsequently drains into WSV. The storm drains fill to
capacity and overflow, flooding Michael Blake, well into Buckhorn Drive & Ginnie Way, with the south end of
Michael Blake flowing into Treehouse Street and the east end of Fanning Drive now a designated flood zone.
Phase 2 of Fanning Drive was not a flood zone when WSV was built.. My own home nearly flooded in Ian.
How can you all help ? TREES HELP PREVENT FLOODING. With another hurricane season bearing down and
daily reports of unprecedented flooding throughout the country, we need our permeable surfaces and our
green spaces protected. I thought that was Victoria Bruce's whole campaign platform ??? Tree mitigation
and support of tree conservation, correct Victoria ?? Yet Victoria's recent vote was one of the 3 votes that gave
a free pass to the developer for the SR 434/MBB project, creating a dangerous precedent for all future development
in the city; creating a free pass for clear-cutting remaining green spaces. I was thankful to see Commissioner
Resnick's and Baker's votes in opposition. For our long-time city attorney to advise against this and yet 3 seated
commissioners voted to let the developer get away with non-payment of $227,000 in mitigation fees is an
egregious misrepresentation of duty to your constituents. The city's tree
giveaway program has been one of the best ideas in the history of WS; yet your vote will cut all funds for any future
free trees at a time when trees are sorely needed. So -- no accountability for this developer to pay the fees they
agreed to pay and an EZ PASS for all future developers to pay ZERO as well.
I urge you - Commissioners Bruce, Diaz and Caruso - to reconsider your vote
and the impacts it will have - not only on our 202 homes in Winter Springs
Village but all city residents for years to come. Much of the public put their
faith in you with their vote for you to do what is best for the city's residents.
Now is your chance to step up. Hold the developer accountable for payment
of fees.

Why are you people so disgusting? I wish someone could explain to me why the tax paying residents
of Winter Springs have to pay Arbor fees to remove a tree from their own yard, but deep pocketed
developers can clear cut land and the commission votes to waive any fees to them. These required
fees have never been waived before for any other developer and opens up the door for past
developers to sue the city for refunds as to why their fees weren’t waived. The city attorney even
heavily advised against waving these fees and yet Commissioner Victoria Bruce, who’s a commercial
land banker, voted to waive this developer’s arbor fund mitigation fees. This is pure corruption folks!!!
Save this as public record. I pray for bad things to happen to all of you.
Get your shit together and stop stealing money from people. Imagine getting above your lazy asses
and actually doing something to help people.

Letter to Winter Springs Residents
Dear Residents of Winter Springs,
I am writing to address recent emails circulated by the Winter Springs Community
Association (WSCA), led by Mr. Phillips, which contain misleading claims and
accusations that demand a response. I am unable to attend in-person this evening. As a
former member of the City staff with over 16 years of service, I feel compelled to share
my insights and urge our community to stand united in preserving the integrity of Winter
Springs as I still have a vested interest in our community.
On the City Attorney, Mr. Garganese
Mr. Phillips has labeled our City Attorney, Mr. Anthony Garganese, as incompetent.
Having worked closely with Mr. Garganese during my tenure, I can attest that this
characterization is baseless. Mr. Garganese has consistently demonstrated diligence,
professionalism, and an unwavering commitment to protecting the interests of Winter
Springs, a city he not only serves but also calls home. His track record speaks for itself,
and such accusations appear to serve external agendas rather than the truth.
Misrepresentation of the "Project" and Developer Interests
The Developer claims that the capitalization of the word “Project” in documentation was
intended to refer to an entire development, not a specific portion, of the project implying
a misunderstanding that could benefit the Developer. From my experience, corporations
rarely prepay fees nearly a decade in advance, as this would be financially imprudent.
This narrative seems designed to confuse residents and advance the interests of
developers over those of our community.
Unfounded Accusations Against Mayor McCann
Mr. Phillips accuses Mayor McCann of protecting personal allies, a claim that lacks
evidence and distorts reality. Let us recall that Mr. Charles Lacey served as Mayor from
2010 until March 2021 When this agreement was made. The only political theater
evident here is that orchestrated by Mr. Phillips, whose accusations appear to deflect
attention from his own motives. Mayor McCann has worked tirelessly for this
community, his love of his community is true leadership.
Concerns About Commissioners’ Priorities
It is disheartening to observe that some Commissioners seem more inclined to align
with the Developers than to advocate for the residents of Winter Springs. This
misalignment of priorities undermines our community’s values and threatens the
character of our city as a cherished bedroom community.
The Flawed WSCA Survey
In a subsequent email, Mr. Phillips cites an alleged 81% survey result in favor of
removing Mr. Garganese as City Attorney. This survey, conducted over just a few days
and primarily responded to by WSCA supporters, lacks credibility. Like many residents,
I often disregard surveys from organizations like WSCA, just as I might skip an Amazon
feedback request. My experience overseeing the annual Waste Pro survey confirms
that such surveys often attract responses from those with grievances, regardless of
relevance to the questions asked. Moreover, the extremely low response rate to
WSCA’s survey further undermines its validity as a reflection of community sentiment.
The Broader Agenda
The WSCA’s emails also allude to an overhaul of the Planning and Development
Department. It is becoming clear that Mr. Phillips and the WSCA seek to exert control
over this critical department, systematically targeting individuals who have dedicated
themselves to preserving Winter Springs as the community we cherish. This agenda
threatens to erode the values that make our city a desirable place to live.
A Call to Action
I urge all residents of Winter Springs to stand firm against the WSCA’s tactics and
emotional grandstanding. We must protect the integrity of our city’s leadership and
institutions. Let us work together to maintain Winter Springs as the vibrant, welcoming
bedroom community we all value.
