JULY 23, 2024
CALL TO ORDER
Vice-Chairperson Art Gallo called to Order the Tuesday, July 23, 2024, Regular Meeting of the
Code Enforcement Board at 5:30 p.m., in the Commission Chambers (City Hall, 1126 East State
Road 434, Winter Springs, Florida 32708.)

A moment of silence was held followed by the Pledge of Allegiance.
Deputy Chief Presley noted no changes to the agenda.
The Clerk, Mr. Gowan, swore in those who would be providing testimony.

Address: 640 Alton Road
Owner: Shirley K Chavista and/or Luz M Chavista
Violations: 2006 IPMC Section 304.2 – Protective Treatment
Note: The Respondent was not present
Officer Elbon gave background on the case, offered testimony on the procedures of notice and
the violation, and showed photos from the “Presentation.” The Board accepted the packet as
published into evidence without objection. Officer Elbon recommended the Board find the
respondent not in compliance with the Order issued by the Code Enforcement Board on
January 23, 2024, and therefore impose a fine of two hundred dollars ($200.00) per day
beginning on April 23, 2024 for the violation of IPMC 204.2 Protective Treatment and
continuing until the violation is corrected. Officer Elbon testified that the violation of IPMC
304.4 Structural Members had come into compliance.
Discussion followed on the notice, communication with the respondent, ownership of the
property, the amount of time the violation had persisted, and an appropriate fine.
I MOVE TO FIND THAT THE PHOTOGRAPHS AND TESTIMONY FROM OFFICER ELBON
SHOW THAT THERE WAS FACTUAL EVIDENCE THAT RESPONDENT WAS STILL IN
VIOLATION OF IPMC 304.2 PROTECTIVE TREATMENT AND THAT THE PENALTY SET FORTH
BY THIS BOARD AT THE JANUARY 23, 2024 MEETING SHALL BE IMPOSED CONSISTENT
WITH THAT ORDER AND THAT BASED ON THE TESTIMONY AND PHOTOGRAPHS OF
OFFICER ELBON, VIOLATIONS OF IPMC 304.4 STRUCTURAL MEMBERS HAVE COME INTO
COMPLIANCE.
MOTION BY BOARD MEMBER MARTIN. SECONDED BY BOARD MEMBER PANKE.

MOTION CARRIED 5-0.
Vice-Chair Gallo noted that this was the last meeting for Board Members Parsons and
Robinson and thanked them for their service.
