CALL TO ORDER
Chairperson Kok Wan Mah called the Monday, September 5, 2024 Planning and Zoning
Board/Local Planning Agency Regular Meeting to Order at 5:30 p.m., in the Commission
Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida
32708.)

A moment of silence was held, followed by the Pledge of Allegiance.
Chairperson Mah asked if there were changes to the agenda and, hearing none, the agenda
was adopted.

Chairperson Mah opened Public Input.
Ms. Leah Weisman, 113 Brookshire court, Winter Springs spoke regarding her understanding
of the proposed changes to the zoning for parcel and expressed cautious due to there being
a creek that runs through the parcel.

400) First Reading of Ordinance 2024-09, Small-Scale Future Land Use Map Amendment
of one (1) parcel of land located at 4301 SR 419.
Mr. Jackson opened the item and gave a brief presentation [Item 400. Presentation] providing
background information and the proposed change for the future land use amendment. The
Board asked for clarification on the small-scale amendment and the transmittal of this
information to the Florida Capital. City attorney Eick responded the forwarding of information
would happen at second reading and not first which is the stage the ordinance is at now.
Further discussion ensued on if the property was sold after the stated changes, water run-off
and the capacity. Staff relayed the engineering will be done later where the water and run-off
will be analyzed.
Continuing, questions regarding the current land use and zoning, the process, timeline, and
project ensued. Mr. Matt Merdian, Park Place Real Estate, Power of Attorney for the
applicants/property owners of 4301 State Road 419 spoke to the board regarding some of the
concerns states. Mr. Merdian states the property owner have zero intention of selling the
property and building of almost any structure would be very difficult due to the restrictions
the power lines and water way have for the property.
Chairperson Mah opened the Public Hearing for Item 400.
Ms. Leah Weisman, 113 Brookshire Court, Winter Springs expressed concern about the
surrounding environment and Gee Creek.
Chairperson Mah closed the Public Hearing for Item 400.
Chairperson Mah gave clarification the item is specifically for the future land use designation
for this parcel and with the property already annexed into the city the land use needs to be
decided. The Board expressed support for the decided proposed land use.
“I WILL MAKE A MOTION FOR THE FIRST READING OF ORDINANCE 2024-09, SMALL-SCALE
FUTURE LAND USE MAP AMENDMENT OF ONE (1) PARCEL OF LAND LOCATED AT 4301 SR
419 RECOMMENDING APPROVAL.” MOTION BY BOARD MEMBER SHAFER. SECONDED BY
BOARD MEMBER FERRANTE. DISCUSSION.
VOTE: MAH (AYE); SPALTHOFF (AYE); SHAFER (AYE); FERRANTE (AYE); HOOD (AYE)
MOTION CARRIED 5-0.
401) First Reading of Ordinance 2024-10, to assign the General Commercial Zoning
District to one (1) parcel of land located at 4301 SR 419.
Mr. Jackson opened the item and gave a brief presentation [Item 401. Presentation] providing
background information and the proposed change to for the zoning. Discussion on special
assessments or if conditional uses would be needed and where the power easement is located.
Staff relayed a conditional use would not be needed. Further discussion ensued on the FAR for
a C-2 land, setbacks for the powerlines, and the overlayed of the access way to the bus yard.
Mr. Merdian gave further clarification on the easement.
Chairperson Mah opened the Public Hearing for Item 401.

Ms. Leah Weisman, 113 Brookshire Court, Winter Springs expressed further concern that
commercial area is unprotected land regarding the surrounding environment and water
ways.
Chairperson Mah closed the Public Hearing for Item 401.
Chairperson Mah addressed the Board hears the concerns and will make sure when the design
and site plan comes before the Board, they will look at those concerns.
“I MOVE THAT WE APPROVE THE FIRST READING OF ORDINANCE 2024-10 TO ASSIGN THE
GENERAL COMMERCIAL ZONING DISTRICT TO ONE (1) PARCEL OF LAND LOCATED AT 4301
SR 419.” MOTION BY BOARD MEMBER HOOD. SECONDED BY BOARD MEMBER SHAFER.
DISCUSSION.

MOTION CARRIED 5-0.

REPORTS
Board Member Shafer asked about dates for the community workshop for the Comp plan
amendments. Ms. Rolle relayed Inspire has not decided any dates yet and further explained
the timeline. Additionally, Ms. Rolle relayed there will be a main community opinion via an
online survey and one of the engagement events will be hometown harvest.

Chairperson Mah opened Public Input.
Ms. Leah Weisman, 113 Brookshire Court, Winter Spring relayed she did not receive a notice
for the changes and suggested other avenues for advertising like emailing out information.
