Inspector Elbon introduced the case, offered testimony on the procedures of notice and the violation, and showed photos from the "Presentation." The Board accepted the packet as published into evidence without objection. Officer Elbon recommended a compliance date of February 12, 2025 and a fine of up to $250 per day per violation if this was not met. Mr. Michael Woods, Cobb Cole, 231 N. Woodland Blvd, Deland representing the respondent testified that there was an open permit on the site, his client wanted to comply with the city, and asked that the respondent be given two weeks to submit a construction site management plan which would allow for certain vehicles to stay on site and include screening requirement. Mr. Darin Lockwood, 613 N Pinto Court, Winter Springs testified that he wanted to come into compliance, noted issues with permitting, and noted the status of the project he was doing. Mr. Rich Murphy, 7884 Copperfield Court, Orlando was present representing the complainant and testified that vehicles remained after the construction of an accessory structure on the building, noted disruptions in the neighborhood and concerns about adverse impact on property values. Further discussion on permit status, the proposed construction site management plan, and the need to deal with the violations before the board. "1 MOVE TO FIND THAT BASED ON THE PHOTOGRAPHS, THE TESTIMONY FROM THE OFFICERS, FROM THE RESPONDENTS AND FROM THE COMPLAINANT, SHOW THATTHERE, WERE ACTUAL VIOLATIONS OF WINTER SPRINGS CODE SECTION 20m434, AUTHORIZED COMMERCIAL VEHICLES IN RESIDENTIAL AREAS AND WINTER SPRINGS CODE SECTION 20-439(A), PARKING AREAS ON RESIDENTIAL LOTS, DESIGN REQUIREMENTS, THE EVIDENCE SHOWS CONCLUSIVELY THAT THOSE ARE STILL THERE AND THAT THE RESPONDENT IS IN VIOLATION OF THE CITY CODE AND BE GIVEN UNTIL FEBRUARY 5, 2025 TO COMPLY, AND IF THE RESPONDENT FAILS TO COMPLY BY THAT DAY, A FINE IN THE AMOUNT OF TWO HUNDRED AND FIFTY DOLLAR ($250.00) PER DAY PER VIOLATION SHALL BE IMPOSED UNTIL COMPLIANCE IS REPORTED TO AND VERIFIED BY THE CITY CODE ENFORCEMENT OFFICER." Officer Elbon recommended a compliance date of 30-60 days, and a fine of up to $250 per day per violation if this was not met. Mr. Kevin West, 535 Saddlewood Lane, Winter Springs, testified admitting to the violation, noting efforts to come into compliance, planned communication with code compliance, and asked for time to address the issue. "I MOVE TO FIND THAT THE PHOTOGRAPHS AND TESTIMONY OF CODE ENFORCEMENT OFFICER CHRIS ELBON SHOW THAT THERE IS SUFFICIENT SUPPORT TO SUBSTANTIATE THE ISSUE PRESENT WITH THE PROPERTY AS IT RELATES TO INTERNATIONAL PROPERTY MAINTENANCE CODE (IPMC) 308.1 ACCUMULATION OF RUBBISH OR GARBAGE AND ORDER THAT THE RESPONDENT BE GIVEN UNTIL MARCH 15, 2025 TO CORRECT THE VIOLATION. Officer Elbon recommended a compliance date of February 27, 2025, and a fine of up to $250 per day per violation if this was not met. PUBLIC HEARINGS: NON-COMPLIANCE CASES 600) Case #2024CE001113 Address: 432 S Hawthorn Cir Respondent(s): Brittany A Greenstone Violation(s): IPMC Section 302.7 - Accessory Structures Note: The Respondent was not present Inspector Elbon gave background on the case, offered testimony on the procedures of notice and the violation, and showed photos from the "Presentation." The Board accepted the packet as published into evidence without objection. Inspector Elbon recommended the Board find the respondent not in compliance with the Order issued by the Code Enforcement Board on September 24, 2024, and therefore impose a fine of one hundred dollars ($100.00) per day beginning on October 10, 2024, for the violation of IPMC 302.7 Accessory Structures and continuing until the violation was corrected. "1 MAKE A MOTION THAT BASED ON THE PHOTOGRAPHS AND TESTIMONY FROM THE CODE ENFORCEMENT OFFICER SHOW THE VIOLATION CONTINUES AND THE RESPONDENT REMAINS IN VIOLATION OF SECTION 302.7, IPMC AND THAT THE PENALTY SET FORTH IN THE BOARD'S PREVIOUS ORDER DATED SEPTEMBER 24, 2024 SHALL BE IMPOSED CONSISTENT WITH THAT ORDER." Deputy Chief Presley noted this information was readily available and that it could be included on future agendas.
