IG NT OF EASEMENT
THIS INDENTURE, made this 16th day of January, A. D. 2001, between SEMINOLE COUNTY
PUBLIC SCHOOLS whose physical address is 400 East Lake Mary Boulevard, Sanford, Florida 32773-
7127, County of Seminole, and State of Florida, party of the first part, and CITY OF WINTER SPRINGS,
FLORIDA, a municipal corporation, which is situated in the County of Seminole, the State of Florida, party
of the second part;
WITNESSETH, that party of the first part, for and in consideration of the sum of one dollar and
other valuable consideration paid by party of the second part, receipt whereof is hereby acknowledged,
grants and conveys to party of the second part, its successors, assigns, licensees, and exclusive
perpetual easement, as described and illustrated below, which is to be under, upon, and across the
Twenty feet of the property situated in or near the City of Winter Springs, Florida, more particularly
described as:

for city services, including but not limited to emergency ingress and egress and city owned utilities,
hereafter on said property, such easement to include the right of free ingress and egress over and across
said property for the purposes of constructing, installing, and maintaining said facilities.
This Grant of Easement shall not be constructed as a grant of right of way and is limited to a City
Services Easement. The party of the first part shall have the right to use the area subject to the
easement granted hereby (the "Easement Area"), including without limitation for parking areas,
driveways, and landscaping, which are not inconsistent with the use of the Easement Areas by the party
of the second part for the purposes granted hereby.
Provided, however, that the party of the first part shall not have the right to grant utility easements
to other parties without the prior written consent of the party of the second part. If the party of the second
part disturbs any landscaping or improvements within the easement area, the party of the second part
shall restore such landscaping or improvements.

ACTION ITEM: CONSOLIDATED SERVICES FACILITY
EASEMENT REQUEST Item Number
1. Superintendent's Recommendation:
That the School Board of Seminole County grant a 30 foot easement to the City of Winter Springs for
the construction of a stabilized emergency access route connecting the Consolidated Services
entrance road with the Parkstone subdivision in exchange for a gravity sewer line stubout to provide
sewer service to SCPS property.
2. Background/Analysis:
Donald W. McIntosh Associates, Inc., engineers for the Parkstone development, have requested that
the School Board assist Centex Homes in complying with the City of Winter Springs' request for
secondary emergency access for Parkstone. The City has also requested that the School Board
provide this connection to provide emergency access for the Consolidated Services complex.
Centex Homes will construct the stabilized path and provide a gate at the property line. Use of the path
will be restricted for emergency use only. Centex will also allow the School Board to access its gravity
sewer line at the Board's east property line.
Pending Board approval, staff will work with the 173 engineer to develop a legal description for
the referenced route and execute the appropriate documents. It is staffs understanding that Centex will
be responsible for any and all costs associated with the easement documents.
Staff has also requested confirmation from the City of Winter Springs that they will acknowledge the
Board's exemption from connection charges and waive any potential connection fees to connect to the
gravity sewer line in Parkstone. Approval of the easement should be contingent upon this confirmation
and assurance.

Ron asked me to fax this to you for your opinion. The question is: Does the
Commission have to approve this or can on approve it.
Kip Lockcuff reviewed it and his comment is he does not generally take easements
granted to us to the Commission, only easements we grant.
