Extension Request - Winter Springs Marketplace Corner Lot Streetscaping
Requirement
SUMMARY
The Fifth Third Bank, located adjacent to the Winter Springs Marketplace, received
approval by the City Commission on January 9, 2023. As part of that approval, a
modification to the Development Agreement for the Winter Springs Marketplace
provided for an extension on the timeframe within which the property owner had to
install the required streetscaping fronting the corner lot located at State Road 434 and
Tuskawilla Road. The timeframe afforded by the Development Agreement has since
expired and the required streetscape has not been installed. Staff previously reached
out to the property owner, Equinox Development, to ask when they intended to fulfill
the required streetscape, and as a result the City Commission approved a six (6)
month extension which expires on September 23, 2024. Mr. Stahl is requesting an
additional six (6) month extension on the requirement to install the streetscape on the
corner lot. Staff recommends approval of the requested extension.

RECOMMENDATION
Staff recommends that the City Commission review the attached request from Ryan
Stahl, Equinox Development, and approve the requested extension of the corner lot
streetscaping requirement for the Winter Springs Marketplace.

Development Area (Extension to Landscaping Requirement)
Dear Esteemed Commission Members:
Pursuant to the First Modification to Development and Property Division Agreement, recorded in Book
10397, Page 628-643, of the Seminole County public records on March 1, 2023, Tuscawilla Property
Investors, LLC (“TPI”) hereby requests an extension to the requirement under section 7.0 to allow TPI
additional time to complete the Trust Property Streetscape.
As shared with Nick Tafelsky via email correspondence on February 23, 2024, and subsequently
approved by the Commission thereafter, TPI is currently in discussions with a retailer who has shown
interest in pursuing this last remaining corner parcel, known as the Trust Property. TPI has recently
held a pre-app meeting with City Staff and anticipates those discussions to be wrapped up shortly.
Accordingly, TPI hereby requests an additional six (6) month extension to complete the Trust Property
Streetscape bringing the date to complete the work to March 23, 2025. As part of this request, TPI
would appreciate the Commission to consider the following:
1) There is currently no irrigation for this parcel since each parcel within the development is
maintained and irrigated individually by the respective retailers, which would make maintaining
the required Streetscape very challenging and costly.
2) TPI has a landscaper under contract to provide regular service to ensure the existing sod is
maintained.
3) TPI has attempted to be a good partner with the City and has always been responsive and
available to staff should any issues arise.
