Roll Call: Chairperson Stephen Gildea, present Vice-Chairperson Art Gallo, present Board Member Debi Panke, present Board Member Howard Parsons, present Board Member Dennis Robinson, present Board Member Harold Thomson, present Board Member Miguel Martin, absent Senior Attorney Jennifer Nix, present Assistant City Clerk Tristin Tarrant, present Also Present: Deputy Chief Kevin Presley, Winter Springs Police Department (WSPD) Mr. Chris Elbon, Code Enforcement Officer, WSPD A moment of silence was held followed by the Pledge of Allegiance. Deputy Chief Presley requested Item 501 be pulled from the agenda due to being in compliance. Mrs. Tarrant swore in those who would be providing testimony. Not Used PUBLIC HEARINGS: REPEAT CASES 400) Case #2024CE000327 Address: 150 N Devon Ave Owner: Michael Rice Violations: WSCO Section 20-439(f) – Parking Areas on Residential Lots 11 CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING – JUNE 25, 2024 PAGE 2 OF 4 Note: The Respondent was present Officer Elbon introduced the case, offered testimony on the procedures of notice and the violation, and showed photos from the “Presentation.” The Board accepted the packet as published into evidence without objection. Officer Elbon recommended a compliance date of August 9, 2024, and a fine of up to five hundred dollars ($500.00) per day if this was not met. Mr. Michael Rice, 150 North Devon Ave, Winter Springs testified the violations were in place before he bought the home and asked for clarification on who should be responsible and what needed to be done to come into compliance Brief discussion ensued on the process to come into compliance for the sited violation and the concerns brought forth by the respondent. “I MOVE TO FIND THE PHOTOGRAPHS AND TESTIMONY OF CODE OFFICER CHRIS ELBON CLEARLY SHOW THERE'S SUFFICIENT SUPPORT TO SUBSTANTIATE THE ISSUES PRESENT WITH THE PROPERTY AS IT RELATES TO A VIOLATION OF WINTER SPRINGS CITY ORDINANCE SECTION 20-439(f) – PARKING AREAS ON RESIDENTIAL LOTS, AND ORDER THAT THE RESPONDENT BE GIVEN UNTIL AUGUST 09, 2024, TO ESTABLISH COMPLIANCE. IN THE EVENT THAT THE VIOLATION IS NOT CORRECTED A FINE IN THE AMOUNT OF $150 SHALL BE IMPOSED PER DAY PER VIOLATION UNTIL COMPLIANCE IS REPORTED TO AND VERIFIED BY CODE ENFORCEMENT.” MOTION BY VICE-CHAIRPERSON GALLO. PUBLIC HEARINGS: NEW CASES 500) Case #2024CE000595 Address: 1217 Trotwood Blvd Owner: Penny A Dolan Violation: WSCO Section 20-438(a) – Parking Vehicles in Residential Front Yards and on Sidewalks Prohibited Note: The Respondent was present Officer Elbon introduced the case, offered testimony on the procedures of notice and the violation, and showed photos from the “Presentation.” The Board accepted the packet as published into evidence without objection. Officer Elbon recommended a compliance date of August 9, 2024, and a fine of up to two hundred and fifty dollars ($250.00) per day per violation if this was not met. 12 CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING – JUNE 25, 2024 PAGE 3 OF 4 Ms. Penny Dolan, 1217 Trotwood Blvd, Winter Springs gave testimony that a permit was pulled previously for residential parking and background on the need for the additional parking. Brief discussion ensued on the previous permit and the Board determined that Staff needed additional time to investigate the additional information given during the respondent’s testimony. “I MAKE A MOTION FOR CONTINUANCE OF CASE NUMBER #2024CE000595 IN THE MATTER OF WINTER SPRINGS 20-43(a) FOR A LATER CODE ENFORCEMENT MEETING TO BE SET BY THE CODE ENFORCEMENT OFFICER.” MOTION BY BOARD MEMBER PARSONS. VOTE: GILDEA (AYE); GALLO (AYE); ROBINSON (AYE); PARSONS (AYE); PANKE (AYE); THOMSON (AYE) MOTION CARRIED 6-0. 501) Case# 2024CE000619 Address: 700 Cottontail Court Owner: Heather S Williams Violations: FBC Section 105.1 – Permits, Required *AS PREVIOUSLY NOTED, THIS AGENDA ITEM WAS REMOVED AND NOT DISCUSSED* PUBLIC HEARINGS: NON-COMPLIANCE CASES 600. Case #2023CE002556 Address: 964 Papaya Lane Owner: Kevin R Burch Violations: 2006 IPMC Section 307.1 – Accumulation of Rubbish or Garbage Note: The Respondent was present Officer Elbon gave background on the case, offered testimony on the procedures of notice and the violation, and showed photos from the “Presentation.” The Board accepted the packet as published into evidence without objection. Officer Elbon recommended the Board find the respondent not in compliance with the Order issued by the Code Enforcement Board on March 26, 2024, and therefore impose a fine of two hundred and fifty dollars ($250.00) per day beginning on April 10, 2024, and continuing until the violation is corrected. Mr. Kevin R. Clarification was asked regarding the responsibility of the owner of the property, change of ownership with a property that has violations on it and a review of the citing process was given.
