CALL TO ORDER
Chairperson Stephen Gildea called to Order the Tuesday, June 25, 2024, Regular Meeting of
the Code Enforcement Board at 5:30 p.m., in the Commission Chambers (City Hall, 1126 East
State Road 434, Winter Springs, Florida 32708.)

A moment of silence was held followed by the Pledge of Allegiance.
Deputy Chief Presley requested Item 501 be pulled from the agenda due to being in
compliance.
Mrs. Tarrant swore in those who would be providing testimony.

Officer Elbon introduced the case, offered testimony on the procedures of notice and the
violation, and showed photos from the “Presentation.” The Board accepted the packet as
published into evidence without objection. Officer Elbon recommended a compliance date of
August 9, 2024, and a fine of up to five hundred dollars ($500.00) per day if this was not met.
Mr. Michael Rice, 150 North Devon Ave, Winter Springs testified the violations were in place
before he bought the home and asked for clarification on who should be responsible and
what needed to be done to come into compliance
Brief discussion ensued on the process to come into compliance for the sited violation and the
concerns brought forth by the respondent.
“I MOVE TO FIND THE PHOTOGRAPHS AND TESTIMONY OF CODE OFFICER CHRIS ELBON
CLEARLY SHOW THERE'S SUFFICIENT SUPPORT TO SUBSTANTIATE THE ISSUES PRESENT
WITH THE PROPERTY AS IT RELATES TO A VIOLATION OF WINTER SPRINGS CITY
ORDINANCE SECTION 20-439(f) – PARKING AREAS ON RESIDENTIAL LOTS, AND ORDER
THAT THE RESPONDENT BE GIVEN UNTIL AUGUST 09, 2024, TO ESTABLISH COMPLIANCE.
IN THE EVENT THAT THE VIOLATION IS NOT CORRECTED A FINE IN THE AMOUNT OF $150
SHALL BE IMPOSED PER DAY PER VIOLATION UNTIL COMPLIANCE IS REPORTED TO AND
VERIFIED BY CODE ENFORCEMENT.” MOTION BY VICE-CHAIRPERSON GALLO. SECONDED

Officer Elbon introduced the case, offered testimony on the procedures of notice and the
violation, and showed photos from the “Presentation.” The Board accepted the packet as
published into evidence without objection. Officer Elbon recommended a compliance date of
August 9, 2024, and a fine of up to two hundred and fifty dollars ($250.00) per day per violation
if this was not met.

Ms. Penny Dolan, 1217 Trotwood Blvd, Winter Springs gave testimony that a permit was pulled
previously for residential parking and background on the need for the additional parking.
Brief discussion ensued on the previous permit and the Board determined that Staff needed
additional time to investigate the additional information given during the respondent’s
testimony.

MATTER OF WINTER SPRINGS 20-43(a) FOR A LATER CODE ENFORCEMENT MEETING TO
BE SET BY THE CODE ENFORCEMENT OFFICER.”

the violation, and showed photos from the “Presentation.” The Board accepted the packet as
published into evidence without objection. Officer Elbon recommended the Board find the
respondent not in compliance with the Order issued by the Code Enforcement Board on
March 26, 2024, and therefore impose a fine of two hundred and fifty dollars ($250.00) per day
beginning on April 10, 2024, and continuing until the violation is corrected.
Mr. Kevin R. Burch, 964 Papaya Lane, Winter Springs testified about his efforts to come into
compliance and requested more time.

THE REDUCED AMOUNT OF ONE HUNDERD DOLLAR ($100.00) A DAY.”
