PUBLIC HEARINGS AGENDA ITEM 400 CITY COMMISSION AGENDA | APRIL 8, 2024 REGULAR MEETING TITLE Second Reading of Ordinance Number 2024-04: 4301 SR 419 - Voluntary Annexation of Real Property SUMMARY This is for the second reading of Ordinance Number 2024-04. The first reading was approved 5-0 (Resnick/Johnson) at the March 25, 2024 City Commission Meeting. The property located at 4301 SR 419 is developed property surrounded by the jurisdictional limits of the City of Winter Springs. The subject property is located in part of an existing enclave of unincorporated area. The proposed annexation is a voluntary annexation pursuant to petition by the private property owner. The statutory criteria for annexation are met as the property is contiguous to surrounding parcels of land that are currently all incorporated within the City of Winter Springs, is compact, eliminates the existing enclave, and is both currently used and anticipated to be used for urban purposes. The proposed land use will add to the commercial tax base of the City of Winter Springs. The elimination of enclaves is consistent with and furthers Policy 1.8.2 of the City's Comprehensive Plan, Land Use Element, which provides that the City shall annex all enclaves, where feasible, in order to reduce land use conflicts and provide efficient public service. The affected property owner will be subject to City of Winter Springs annual business tax receipt to the extent a business is located on the property and City of Winter Springs adopted millage rates for property taxes. The County has been notified in writing by Staff of the voluntary annexation per Florida Statutes, and the voluntary annexation was advertised for two consecutive weeks in the newspaper, evidenced by Exhibit E. Ordinance 2024-04 proposes to annex real property to the boundaries of the City of Winter Springs. FUNDING SOURCE N/A RECOMMENDATION Staff recommends approval of the Second Reading of Ordinance Number 2024-04: 4301 SR 419 - Voluntary Annexation of Real Property 250 CITY OF WINTER SPRINGS COMMUNITY DEVELOPMENT DEPARTMENT 1126 East State Road 434 Winter Springs, Florida 32708 Annexation Report – 4301 SR 419 This report addresses a voluntary annexation request petitioned by Youdali International Investments, LLC; Kira Woods; and Kado Investments LLC (“Petitioners”) pursuant to Section 171.044, Florida Statutes, affecting real property consisting of one tax parcel generally located on the north side of SR 419 just north of SR 434 and legally described in Exhibit B to this Report. The subject property has a street address of 4301 SR 419, Winter Springs, FL 32708 with Tax Parcel ID No. 34-20-30-5AW-0000-0250. Youdali International Investments LLC acquired the property on December 30, 2021, who then conveyed an undivided 50% interest in the land to Kira Woods and KADO Investments LLC on February 11, 2022. The Petitioners’ Power of Attorney, Matt Meridian, has authorized the application for annexation to be submitted. Petitioners intend to use the property for the outdoor storage of recreational vehicles (RVs) and with an existing building to serve as an office in support of the proposed use. Specifically, this Report evaluates whether this request meets the requirements for annexation as outlined in Chapter 171 of the Florida Statutes. Generally, a property owner may request an annexation of real property into the City if the property is contiguous to the municipality’s boundaries at the time the annexation proceeding is begun and reasonably compact, the annexation of the property does not create an enclave, and no part of the area shall be included within the boundary of another incorporated municipality. Further, the property has to be suitable for urban purposes, which is defined as land is used intensively for residential, commercial, industrial, institutional, and governmental purposes, including any parcels of land retained in their natural state or kept free of development as dedicated greenbelt areas. Section 171.031(13), Florida Statutes. The property consists of one (1) parcel, that is currently developed and used for single-family residential purposes. The Annexation Study area is contiguous to the City’s municipal boundaries and is reasonably compact, creating no enclaves, pockets, or finger areas in serpentine patterns. In fact, the proposed annexation will eliminate an existing enclave. The subject property consists of approximately 8.17 acres of land with an existing single-family residence with associated accessory structures. Annexation of this Area is consistent with the City’s Comprehensive Plan, FLU Objective 1.8: Annexation. The City shall pursue a policy of annexation which will provide for the most efficient use of public facilities and services, eliminate areas of jurisdictional problems, and provide for sound growth and development of the City and surrounding area. Subsequent Comprehensive Plan Policies implementing Objective 1.8 are also relevant, in addition to the City’s Code of Ordinances, section 2.03 regarding annexation procedures. The property is located in unincorporated Seminole County on the north side of SR 419 just north of SR 434 (See Exhibit C). It is legally described by metes and bounds in Exhibit B. The property is bounded to the north by Cross Seminole Trial (Seminole County) and Layer Elementary School 251 CITY OF WINTER SPRINGS COMMUNITY DEVELOPMENT DEPARTMENT 1126 East State Road 434 Winter Springs, Florida 32708 (City of Winter Springs); the remainder of the property is enclosed within the City of Winter Springs’ jurisdiction. The property is contiguous to the boundary of the City of Winter Springs and compact. The subject property is in Seminole County Commission District #2, which is currently represented by Commissioner Jay Zembower. If annexed into the City of Winter Springs, the area will be included in City Commission district #4, which is currently represented by City Commissioner Cade Resnick (See Exhibit C). The first reading of Ordinance Number 2023-04 to annex the subject property was approved during the March 25, 2024 City Commission meeting by a vote of 5-0 (Resnick/Johnson). The development pattern within and to the south of the property has been primarily neighborhood commercial. The property is expected to be used for Recreational Vehicle (RV) and boat storage the existing house serving as office space. If the property is annexed, the annexation will not attract or facilitate any other additional voluntary annexations by the City of Winter Springs because the property is bounded by property within the jurisdiction of the City of Winter Springs. The description below provides the current and future land and resource uses for the site as follows: Current land use near the subject property is mixed. Layer Elementary borders the Site to the north. State Road 434 is located south of the Site. Commercial and industrial properties are respectively located north and west of the Site. Property associated with a daycare center that provides services for voluntary pre-kindergarten, before and after school care, and summer/winter camps is located less than 150 feet south of the subject property. Property associated with an elementary school and Seminole County Public Schools Transportation Services is located less than 150 feet north of the subject property. A residential subdivision is located within 1,000 feet east, and property associated with a single-family residence is located within 150 feet southwest of the subject property. Land use designations adjacent to the subject property are not expected to change. The current and reasonably anticipated future land uses for the Site is Commercial. The subject property consists of a single-family residence and associated accessory building(s). The land is zoned Agriculture (A-1) under the Seminole County, Florida Land Development Code, which allows special exceptions for off-street parking lots, as well as limited uses for temporary occupancy of a mobile home or recreational vehicle by a night watchman for a non-residential use. Current and Proposed Future Land Use and Zoning Following annexation, the City of Winter Springs will process comprehensive plan amendments to assign the appropriate City future land use designation for the annexed properties. The proposed future land use designations and zoning classifications presented in this Annexation Report are preliminary and may be modified once a more detailed land use analysis occurs when initiating the necessary comprehensive plan amendments. 252 CITY OF WINTER SPRINGS COMMUNITY DEVELOPMENT DEPARTMENT 1126 East State Road 434 Winter Springs, Florida 32708 Pursuant to Section 171.062 Florida Statutes, Seminole County future land use and zoning regulations will remain in effect until the City of Winter Springs adopts a comprehensive plan amendment and rezoning of the annexed area. Please refer to Exhibit C for utility, land use, and zoning maps. The applicant has requested C-2 General Commercial District zoning and Commercial future land use. Staff will further analyze the requested zoning and future land use classifications against the City’s Comprehensive Plan and land use development regulations and criteria. The applicant’s proposed use of the property is permitted in the C-2 General Commercial zoning district. Provision of Public Facilities and Services The table below provides the current and potential providers that would serve the property if the annexation ordinance were adopted. Exhibit H illustrates the presence (or lack thereof) of the City of Winter Springs sanitary utility lines and stormwater utility lines in the area. Potable Water: The subject property is not served by public potable water services at this time. Potable water service will be provided by the City of Winter Springs upon annexation. Wastewater: The subject property is not served by public wastewater services at this time. Wastewater services will be provided by the City of Winter Springs upon annexation based on availability. Reclaimed Water: There are no reclaimed water lines in place to service the study area with reclaimed water at this time. Reclaimed water services will be provided by the City of Winter Springs upon annexation based on availability. 253 CITY OF WINTER SPRINGS COMMUNITY DEVELOPMENT DEPARTMENT 1126 East State Road 434 Winter Springs, Florida 32708 Electric Service: Electric service is currently provided, and will continue to be provided, by Duke Energy. Solid Waste: Waste Pro, LLC. currently provides solid waste pick up services. Upon annexation, Waste Pro, LLC. will continue to provide service to the subject property. Stormwater Management: There does not appear to be any on-site stormwater management at this time. Stormwater Management services will be provided by the City of Winter Springs upon annexation based on availability. Police Protection: Police service is currently provided by the Seminole County Sheriff’s Office and will be provided by the City of Winter Springs upon annexation. Fire Protection: The subject property is currently serviced by Seminole County Fire. Upon annexation, Seminole County Fire Department will continue to provide service to the subject property. Business Impact Estimate Proposed Business Impact Estimates, through internal and external resources, project the following: Property Tax: Taxable Value: Change from $458, 341 to approximately $900,000 should a commercial zoning designation be applied to the subject property. Utility: Water Impact Fee: $2.15/gal; $0.15gal/sf. Sewer Impact Fee: $10.19/gal; $0.15gal/sf Development & Business: Development Permit and annual Business Tax Receipts shall apply. 254 CITY OF WINTER SPRINGS COMMUNITY DEVELOPMENT DEPARTMENT 1126 East State Road 434 Winter Springs, Florida 32708 Conclusion The addition of the subject property to the boundaries of the incorporated municipality, the City of Winter Springs, satisfies the statutory criteria for annexation as the property is contiguous to surrounding parcels of land that are currently all incorporated within the City of Winter Springs, is compact, eliminates the existing enclave, and is both currently used and anticipated to be used for urban purposes. The proposed land use will add to the commercial tax base of the City of Winter Springs. The City Clerk shall file the revised Winter Springs Charter, Article II, Section 2.01, with the Department of State within thirty (30) days upon said approval and shall provide a copy to the Office of Economic and Demographic Research along with a statement specifying the population census effect and the affected land area. The City Clerk shall also file this Ordinance with the Clerk of the Circuit Court of Seminole County, the Chief Administrator of Seminole County, and the Department of State within seven (7) days of the effective date. Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All ordinances and resolutions or parts of ordinances and resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 4. Severability. Should any section or provision of this Ordinance, or any portion hereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereto as a whole or part thereof to be declared invalid. Section 5. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter. But as he spoke, I was reminded of a not dissimi-lar observation set in a different time and place: when the late Hannah Arendt, the noted Jewish political theorist, wrote in the early 20th century that the Jews of Europe, in particular German Jews, were politically naive and confused, desperately clinging to the Staatspartei, even as polit-ical circumstances deteriorated and their partisan “loyalty at any price” became irrelevant at best, dangerous at worst.Most American Jews today are liberal Democrats clinging to a partisan affiliation dating back to the 1930s New Deal and a political perspective whose roots can be traced to the mid-19th century when “liberalism” promised social emancipa-tion and political freedom.In the 19th and early 20th centuries, when Jews’ most dangerous enemies were concentrated on the political right, it was reasonable and prudent for Jews to seek allies on the left. What once was prudent, however, may have become a matter of “loyalty at any price.”Even the most partisan Democrats in the Jewish community must have noticed by now that nearly all of the voices raised in defense of Hamas and against Israel in the wake of Hamas’s savage murder of 1,200 Israelis in October emanated from the left, often from within the Democratic Party.The attacks are not just from Hamas apologists and fellow travelers in the congressional “squad.” Ten of the 11 senators who signed a Bernie Sand-ers-sponsored resolution in January ques-tioning Israel’s human rights record in the Hamas-initiated war were Democrats.This new anti-Zionism no longer even pretends to distinguish itself from antisemitism.In polite American society, vehement criticism of Israel is often little more than a veiled form of antisemitism.Hamas’s charter, which seems to call for the destruction of all Jews, not just Zion-ists, offers some intellectual clarity on this point.Jewish Democrats need to stop pretending that Hamas and its ilk don’t mean what they say. For many Jews, Democratic Party membership is almost a religious affiliation — and Jews are notoriously averse to conversion.I recently attended religious services at a large Washington congregation where the rabbi said with a condescending tone that he knew a few of his congregants supported the Republicans. He urged members of the congregation to be toler-ant and to try to understand why some Jews might stray into the GOP camp. Roos-evelt (no friend of Jewry) gave America’s Jews what seemed like a political home. Most are reluctant to leave. Since Donald Trump referred to neo-Nazis as “very fine people” in Char-lottesville, Virginia, those same people have found their home within the GOP.In the nearly five months since Hamas’s brutal attack on Israel, there has been a rise of antisemitism within the United States, especially on college campuses.According to a late-November survey conducted by the Anti-Defamation League and Hillel International, 73% of Jewish college students experienced or witnessed antisemitism on campus since the beginning of the 2023-2024 school year. This is a deep concern to all who care about the safety, security and well-being of the next generation of American Jews, as well as Israel’s future.Far too often, however, there is an inclination to equate the normaliza-tion of dangerous right-wing extremism within the Republican Party and the rise of anti-Israel and antisemitic sentiment on the far left. These are two separate phenomena that must be confronted. Still, they cannot be fully addressed without accepting a hard truth — the dangerous antisemitism on the far right has been fueled by Trump, who has legitimized hate and dangerous threats to our democracy within the GOP. Meanwhile, any anti-Is-rael and antisemitism sentiment on the far left is opposed and actively countered by President Joe Biden and every leader in the Democratic Party.Antisemitism found a home in the Republican Party with the political ascent and full embrace of Trump. The organiza-tion I lead, the Jewish Democratic Council of America, was created as a result of the deadly Unite the Right rally in Charlottes-ville — the same event that inspired Joe Biden to launch his campaign to restore the soul of our nation.The specter of neo-Nazis with tiki torches chanting “Jews will not replace us” in Charlottesville and Trump equat-ing them with peaceful protesters was a startling wake-up call for many Americans regarding the danger posed by Trump and the GOP to our safety, security, values and democracy.Trump will soon become the presiden-tial nominee of the Republican Party for the third time. He admires dictators like Vladimir Putin and Viktor Orban and has a long history of antisemitism.Biden entered office with a longer and stronger record on Israel than any president. His proposed $14.3 billion emergency aid package to Israel is unprec-edented, and after Oct. 7, he became the first sitting president to visit Israel during wartime.Republicans in Congress, on the other hand, continue to block security and humanitarian assistance for Israel and Ukraine. They have also tolerated danger-ous extremism and antisemitism. On Jan. 30, House leadership invited a pastor with a record that includes notoriety as a Chris-tian Nationalist, involvement in the Jan. 6 insurrection, and a long history of spew-ing hateful vitriol toward Jews, Muslims and LGBTQ+ individuals to serve as guest chaplain. No Republicans objected.Trump recently said that he opposes all foreign aid and would replace foreign aid with loans — he made no exception for Israel, not even amid a war against Hamas.The American Jewish community has long, deep ties to the Democratic Party, strengthened by Biden’s leadership. Since Oct. 7, Biden and Democrats have stood with Israel and American Jews, which is why Jewish voters will continue to stand with Biden and Democrats at the polls in November.
