SUMMARY Staff is requesting that the City Commission conduct a Public Hearing and Second Reading ordinance 2022-11, amending Chapter 20 of the City Code to regulate self- service storage facilities and allow them as a conditional use in certain zoning districts, provide clarification on the intent of the C-3 Hwy 17-92 zoning district, and provide for additional regulations related to the design and operation of self-service storage facilities. Currently, "indoor public storage" is only permitted in the C-3 Highway 17-92 Commercial District. There is only one small parcel currently zoned C-3 Highway in the City along 17-92. However, this proposed ordinance would permit self-service storage facilities as a conditional use: In the C-1 zoning district for properties with frontage on SR 419. For any property with double frontage on SR 419 and SR 434, the self-service storage facility shall require a 27-foot landscape buffer along SR 434 in accordance with Article VII of the Zoning Ordinance and shall not be accessed from SR 434. In the I- 1 Light Industrial zoning district. Self-service storage will remain a permitted use in the C-3 Highway 17-92 Commercial district. The ordinance provides for certain design and operational regulations for self-service storage facilities. These regulations include, but are not limited to: Individual storage units must be accessed from the interior of a building or from individual storage unit doors that face the interior of the property and are not visible from any right-of-way or neighboring property; Loading bays, entrances, docks and doors shall not be located on any side abutting residential property or a street-facing side of a building;A gate or secured access is required; Buildings shall be surfaced in high-quality materials with 50% of the facade covered by decorative brick, stone, stuccos, textured block or similar decorative materials; Exterior colors shall be muted tones; Facility hours of operation limited to 6 a.m. to 10 p.m.; Outdoor storage is prohibited; self-service storage facilities may not be closer than five-hundred (500)feet from another self-service storage facility; site lighting must not spill over onto adjacent properties. Staff recommends approval of this ordinance to provide for further zoning districts in the City in which self-service storage facilities will be permitted as a conditional use, subject to the conditions described herein.The proposed ordinance language provides for additional regulations on the design of self-service storage facilities as well as their operation. 15 The Planning & Zoning Board reviewed the Ordinance at its November 17, 2022 special meeting. The Board recommended 4 additional changes to the Ordinance which are incorporated into the Ordinance: 500 ft. separation; not to exceed 2 stories in height of occupiable space; exterior lighting adjacent to residential property must avoid spillover; and allowing a dwelling unit on the property for caretaker or security. Recitals. The foregoing recitals are hereby incorporated herein by this 7 reference. 8 9 Section 2. Amendment to Chapter 20,Zoning. The City of Winter Springs Code, 10 Chapter 20,Zoning is hereby amended as follows: (underlined type indicates additions to the City 11 Code and stfikeet type indicates deletions, while asterisks (* * *) indicate a deletion from the 12 Ordinance of text existing in Chapter 20. It is intended that the text in Chapter 20 denoted by the 13 asterisks and set forth in this Ordinance shall remain unchanged from the language existing prior 14 to adoption of this ordinance): 15 16 Chapter 20 Zoning 17 18 * * * 19 ARTICLE I.—IN GENERAL 20 21 Sec. 20-1.—Definitions. 22 23 The following words, terms and phrases, when used in this chapter, shall have the meanings 24 ascribed to them in this section, except where the context clearly indicates a different meaning: 25 26 * * * 27 28 Self-Service Storage Facilities. A fully-enclosed establishment containing separate storage 29 spaces, stalls or lockers with privately-controlled access points that are leased or rented to 30 customers as individual units for storage space of the customer's goods, wares or personal 31 property. The term is synonymous with mini-warehouses, mini-storage, self-storage facilities, 32 and self-storage warehouses. 33 34 * * * 35 Aw 36 ARTICLE III.—ESTABLISHMENT OF DISTRICTS 37 38 * * * 39 40 DIVISION 7.—C-1 NEIGHBORHOOD COMMERCIAL DISTRICT 41 42 * * * 43 44 Sec. 20-234. Conditional uses. 45 City of Winter Springs Ordinance No.2022-XX Page 2 of 8 18 1 * * * 2 3 Self-Service Storage Facilities, provided the property has frontage on State 4 Road 419 and shall be subject to the supplemental design and operational 5 requirements set forth in section 20-423 (b)and c of the City Code. Additionally, 6 for any property with double frontage on State Road 419 and State Road 434, the 7 self-service storage facility shall require a 27-foot landscape buffer along State 8 Road 434 in accordance with Article VII of this Chapter and shall not be accessed 9 from State Road 434. 10 11 * * * 12 13 DIVISION 8.5.—I-1 LIGHT INDUSTRIAL DISTRICT 14 15 * * * 16 Sec. 20-261. —Conditional uses. 17 18 * * * 19 tD Self-Service Storage Facilities subject to the supplemental design and operational 20 requirements set forth in section 20-423 (b) and c) of the Ci1y Code. 21 22 * * * 23 24 DIVISION 15. —C-3 HIGHWAY 17-92 COMMERCIAL DISTRICT 25 i. � f 26 Sec. 20-346. -In general. 27 28 The lands of the "C-3 Highway 17-92 Commercial" District are particularly oriented to a 29 wide variety of commercial and professional office uses which may generate excessive traffic from 30 clientele or capture large volumes of traffic from adjacent thoroughfares. The purpose of this 31 district is to encourage and develop the normal operation of general commercial land uses listed 32 here, under such conditions of operation as will protect abutting residential and other 33 noncommercial uses, and promote aesthetic and architectural harmony, attractiveness, and 34 compatibility within the community, and abide by the performance and development standards of 35 the city, county, state and U.S. government. This district is intended for and limited to lands that 36 are adjacent and have ingress/egress to 37 Highway 17-92 and adaptable to higher traffic generating general commercial uses. Areas of the 38 city for which this zoning category may be appropriate are designated on the future land use map 39 as "commercial." 40 41 Sec. 20-346.1. -Uses permitted. 42 43 Within "C-3 Highway 17-92 Commercial" District, no building, structure,land or water 44 shall be used except for one (1) or more of the following uses: City of Winter Springs Ordinance No.2022-XX Page 3 of 8 19 1 2 * * * 3 (18) Self-Service Storage Facilities subject to the 4 supplemental design and operational requirements set forth in section 20-423 (b) 5 and c) of the City Code. 6 7 8 9 10 ARTICLE V. — SUPPLEMENTAL DISTRICT REGULATIONS 11 12 Division 1. — Generally 13 14 15 16 Sec. 20-423.—Self-Service Storage Facilities. 17 18 19 (a) Intent and Purpose. It is the intent and purpose of this Section to provide 20 minimum design and operational requirements for self-service storage facilities 21 located within the City. Additional requirements may be imposed by the city 22 commission on a project-specific basis by development agreement and/or by 23 conditional use permit to protect the public health, safety and welfare. 24 25 (b) Supplemental Desi,-n Standards. In addition to other applicable design 26 standards set forth in the City Code,the following minimum design standards shall 27 apply to the construction of new self-service storage facilities: 28 29 (1) Storage facilities shall be designed to ensure that access to the individual 30 storage units shall only be gained from the interior of a building(s) or from 31 individual storage unit doors that face the interior of the property and are not visible 32 from any right-of-way or neighboring property_ 33 34 (2) The main office entrance of the storage facility for design purposes shall be 35 located at ground level and oriented towards the street side. The main office 36 entrance foyer shall contain a minimum interior space dimension of at least 12 feet 37 in height and 500 square feet in size. This space shall be used as the main entrance 38 foyer for customers even if the majority of customers using the facili . enter 39 through loading docks,bays, doors or other entrances. However,up to 25%of this 40 space may also be used for storage suply sales and office use to suport the rental 41 of the storage units. 42 43 (3) If the storage facility abuts a residentially zoned property or existing 44 residential development, the facility loading bays, entrances, docks or doors shall 45 not be located on any side abutting the residentially zoned property or residential City of Winter Springs Ordinance No.2022-XX Page 4 of 8 20 I development and shall not be visible from said residential property_ 2 3 (4) Loading bays, docks, entrances to individual storage units or bad. no 4 be located on a street facing side of a building. 5 6 (5) Storage facility access shall be secured such that access to the individual 7 storage units shall only be gained after passing through a gate or entering a building 8 through a secured access point. 9 10 (6) Fences and walls including entry gates shall be constructed of high duality 11 materials and shall be compatible and in harmony with the design and materials of 12 the facilities and site. Decorative metal or wrought iron fences are preferred. 13 Chain-link or similar fences, barbed wire or razor wire fences and walls made of 14 precast concrete are prohibited. Fences or walls are not allowed between the main 15 or front building on the site and the street. 16 17 (7) Storage facility buildings shall be surfaced in high duality materials 18 compatible and in harmony with the site. Unfaced concrete block, painted 19 masonry, tilt-up and pre-cast concrete panels and prefabricated metal sheets are 20 prohibited. Prefabricated buildings are not allowed. 21 22 (8) Exterior colors, including any internal corridors or doors visible through 23 windows, shall be muted tones. 24 25 (9) The facade of the storage facility building shall have exterior vertical 26 surfaces with at least fifty(50) percent of the area covered by a material or 27 combination of materials such as decorative brick veneer, stone, stucco, textured 28 block or similar decorative materials. All materials shall be of high duality. 29 30 (10) Storage facility buildings shall be clad with a mix of durable, low 31 maintenance materials that convey. t�ppearance of high duality. Upon final 32 aesthetic review approval by the City, allowed cladding materials shall include high 33 grade metal composite materials with a factory-applied finish, brick, brick veneer, 34 stone, simulated stone, stucco, cement fiberboard, and concrete masonry units with 35 integrated color,provided the outer surface is either split face or ground faced, or a 36 combination of the two. Prohibited cladding materials include unbacked, non- 37 composite sheet metal products(e.g., standing-seam metal or flat panels that can be 38 easily dented), smooth faced concrete masonry units that are painted or unfinished, 39 board or batten siding, plastic or vinyl siding or unfinished wood. 40 41 (11) Sin lg e-storstege facility buildings shall have a gable or hipped roof. 42 43 (12) Streetscape landscaping required by the City Code shall not be fenced. 44 45 (13) Electrical service to the storage units shall be for lighting and climate City of Winter Springs Ordinance No.2022-XX Page 5 of 8 21 I control only. No electrical outlets are permitted inside individual storage units. 2 Lighting fixtures and switches shall be of secure design that will not allow the 3 tapping of fixtures for other purposes. 4 5 (14) The minimum setbacks shall be as follows for storage facility buildings and 6 these shall take precedence over any other applicable setback requirements in the 7 applicable zoning district and the S.R. 434 Corridor Overlay District: 8 9 i. Front: 50-feet 10 ii. Side and rear: 25-feet 11 12 (c) Operational Requirements. In addition to other applicable operational 13 standards set forth in the Cily Code (e.g., noise and other nuisance standards), the 14 following minimum operational standards shall aply to self-service storage 15 facilities and tenants of individual storage units: 16 17 (1) Individual storage units shall not be used for activities such as residences, 18 offices, workshops, studios, or hobby or rehearsal areas. Further, storage units 19 shall not be used for manufacturing, fabrication or processing of goods, services or 20 repair of vehicles, engines, appliances or other equipment, or any other industrial 21 activity whatsoever. In addition, storage units shall not be used for commercial 22 activi . or places of business of any kind including, but not limited to, retail sales, 23 _garage or estate sales, or auctions. 24 25 (2) Storage of flammable, explosive, perishable or hazardous materials within 26 individual storage units and on site is prohibited. 27 28 (3) The storage of gasoline powered motor vehicles within an individual 29 storage unit is prohibited. 30 31 (4) Keeping of animals is prohibited. 32 33 (5) Storage facilities shall not operate or allow tenant access between the hours 34 of 10:00 p.m. and 6:00 a.m., except for storage facilities that were approved by the 35 City Commission by development agreement, and are operational, prior to the 36 effective date of this subsection. 37 38 (6) All goods and property shall be stored in an enclosed building. Outdoor 39 storage of goods and property shall be prohibited. 40 41 (7) Storage pods or shipping containers are prohibited on the propert. 42 43 (8) Storage facilities shall have security access control to buildings and 44 individual storage units and enhanced electronic video surveillance of the property. 45 City of Winter Springs Ordinance No.2022-XX Page 6 of 8 22 1 (9) Rental agreements shall provide tenants with written notice of the minimum 2 operational standards set forth in this section and any other conditions imposed by 3 the conditional use permit any development agreement approved by the City 4 Commission. 5 6 * * * 7 8 Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior 9 inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior 10 ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. 11 12 Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the 13 Winter Springs City Code and any section or paragraph,number or letter, and any heading may be 14 changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and 15 like errors may be corrected and additions, alterations, and omissions, not affecting the 16 construction or meaning of this ordinance and the City Code may be freely made. 17 18 Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or 19 provision of this Ordinance is for any reason held invalid or unconstitutional by any court of 20 competent jurisdiction,whether for substantive,procedural, or any other reason, such portion shall 21 be deemed a separate, distinct and independent provision, and such holding shall not affect the 22 validity of the remaining portions of this Ordinance. 23 24 Section 6. Effective Date. This Ordinance shall become effective immediately 25 upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to 26 City Charter. 27 ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regular meeting assembled on the day of 52022.
