DORINDA E BLANEY WS CITY ORD. 20-434 COMMERCIAL VEHICLES WS CITY ORD. 13-2(C) OVERGROWN YARD 30 WINTER SPRINGS CITY ORD. 6-195 MAINTENANCE OF FENCES All fences and walls and accessories thereto shall be maintained in good order and in a condition equal to that which was originally approved by the building official at the time a permit was issued.If for any reason the fence or wall was erected without a permit, said wall or fence shall be maintained in accordance with the conditions and requirements necessary for obtaining a fence or wall permit from the building official under this article. Within thirty (30) days receipt of written notice by the city that a wall or fence does not comply with the requirements of this section, a property owner shall bring such fence or wall in compliance with this section within thirty (30) days of receipt of such notice. The thirty-day period may be extended an additional thirty-day period by the city manager or the city manager's designee for good cause shown. 2022CE001193 31 WINTER SPRINGS CITY ORD. 20-438 VEHICLES PARKED IN FRONT YARD a)The parking of any vehicle within the front yard of any residential lot shall be prohibited unless said vehicle is parked on a driveway and/or designated parking area that meet the requirements set forth in section 20-439 of the City Code. (b)The parking of any vehicle on or over any sidewalk adjacent to any residential lot is hereby prohibited. For purposes of this subsection, the term sidewalk shall be as defined in section 316.003, Florida Statutes, and shall include any portion of a sidewalk that traverses a driveway. (c)A violation of this section may be prosecuted before the code enforcement board or special magistrate or shall be classified as class I civil citation violation. 2022CE001193 32 WINTER SPRINGS CITY ORD. 20-434 COMMERCIAL VEHICLES IN RESIDENTIAL AREAS (a) One (1) commercial vehicle per dwelling unit may be parked in residentially zoned districts of the city provided: (1) Said vehicle is not a semi-trailer truck tractor or semi-trailer truck trailer; (2) Said vehicle is not a stake body or flat bed truck; (3) Said vehicle is not construction-related equipment such as a backhoe, front -end loader, utility tractor, etc.; 2022CE001193 33 WINTER SPRINGS CITY ORD. 20-434 (4) Said vehicle is not a vehicle of any type used to transport hazardous materials as defined by law; (5) Said vehicle is not a utility trailer of more than twelve (12) feet in length, inclusive of tool boxes and other storage areas, however exclusive of the tongue hitch; (6) Said vehicle is not a single or dual rear wheeled vehicle in excess of ten thousand eight hundred (10,800) pounds gross vehicle weight, or twenty-two (22) feet in length, or in excess of eight (8) ft. in height. 2022CE001193 34 INTERNATIONAL PROPERTY MAINTENANCE CODE 302.1 SANITATION All exterior property and premises shall be maintained in a clean, safe ad sanitary condition. DORINDA E BLANEY Suggested Findings of Fact / Conclusion of Law Based upon the photo evidence and testimony presented at this hearing I am recommending the respondent be given no more that 30 days (June 25 , 2023) to establish compliance. In the event the violation(s) are not corrected a fine of $250.00 a day be imposed. 43
