Any owner or owner’s authorized agent who intends to construct, enlarge, alter,
repair, move, demolish or change the occupancy of a building or structure, or to
erect, install, enlarge, alter, repair, remove, convert or replace any impact-resistant
coverings, electrical, gas, mechanical or plumbing system, the installation of which is
regulated by this code, or to cause any such work to be performed, shall first make
application to the building official and obtain the required permit.

Carports shall be open on not less than two sides. Carport floor surfaces shall be of
approved noncombustible material. Carports not open on two or more sides shall be
considered to be a garage and shall comply with the provisions of this section for
garages.

Accessory building means a detached, subordinate structure, the use of which is
clearly incidental to, customarily associated with, and related to the principal
structure or use of the land, and which is located on the same lot as the principal
structure or use. Accessory buildings shall include storage buildings, toolhouses,
private, detached garages, bathhouses (used in conjunction with swimming pool) and
similar uses. No more than two (2) accessory buildings shall be allowed on any single
lot. Accessory dwelling units (ADUs) shall be subject to section 6-85 of this Code and
are not subject to the provisions of this section.

A site construction permit shall be required from the building division, community
development department, whenever impervious materials are used to construct a
driveway or designated parking area, or whenever a new designated parking area is
constructed on any residential lot.

December 5, 2023 – CEO Elbon conducted an inspection of the referenced property
based on staff referral from the Winter Springs Police Department. CEO Elbon
observed construction/alteration of the referenced property, to include the
construction of accessory structures without permit(s), electrical work without
permit(s), alteration of the pool enclosure without a demolition permit, alteration of
the carport without permit(s), more than two (2) accessory structures on a single lot,
and construction of a driveway/designated parking area without permit. A permit
check conducted on December 5, 2023, revealed no issued or completed permit(s)
for the construction/alteration activity of the referenced property (Exhibits 1-14).
