HomeMy WebLinkAbout2023 12 11 Public Hearing 404 -Second Reading and Final Adoption of Ordinance 2023-13, Water, Wastewater, Reclaimed and Water Rates, Fees, & ChargesPUBLIC HEARINGS AGENDA ITEM 404 CITY COMMISSION AGENDA | DECEMBER 11, 2023 REGULAR MEETING TITLE Second Reading and Final Adoption of Ordinance 2023-13: Amending the Code Of Ordinances Regarding Water, Wastewater, Reclaimed and Water Rates, Fees, and Charges SUMMARY Raftellis Financial Consulting conducted a utilities rate study on behalf of the City and performed a comprehensive review of the the City's water, sewer, and reclaimed water user rates in order to generate sufficient revenues to meet the future operational and capital improvement needs of the utility system. In accordance with Section 180.136, Florida Statutes, the City of Winter Springs provided public notice in the utility billing process advising customers that the City Commission will be considering the adoption of an ordinance increasing water, sewer, and reclaimed rates, fees and charges. A legal ad was also published in a newspaper advising that the ordinance will be subject to a public hearing. Following the presentation on August 28th, 2023, the City received positive feedback from the Commission. A few questions about the proposed rates inquired if the proposed rates would generate enough funds to address the recent water main breaks and any additional emergencies. Through conversations and calculation updates with the Consultants, the City is proposing an 18% increase for the next 3 years followed by a 10% increase for the remaining 2 years. The topic of the Utility Rate Increase has been open for public input since October 23rd, 2023. FUNDING SOURCE RECOMMENDATION Staff recommends approval and final adoption of Ordinance 2023-13. 582 City of Winter Springs Ordinance No. 2023-13 Page 1 of 12 ORDINANCE NO. 2023-13 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING THE CODE OF ORDINANCES REGARDING WATER, WASTEWATER, RECLAIMED AND WATER RATES, FEES, AND CHARGES; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS; PROVIDING FOR INCORPORATION INTO THE CODE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs, Florida, has determined it to be in the best interest of the safety, health, and welfare of the citizens of the City of Winter Springs to provide for the adoption of Rates, Fees and Charges relating to the water, wastewater and reclaimed water system; and WHEREAS, at the request of the City of Winter Springs, Raftelis Financial Consultants, Inc. conducted a review of the existing water, wastewater, and reclaimed water rates to determine the appropriateness of such rates to meet the anticipated expenditure requirements of each respective utility division; and WHEREAS, the Utilities Director and the City’s rate consultant, upon review of the utilities rates and structure, recommend that a change in rates is appropriate at this time; and WHEREAS, this Ordinance has been duly noticed in a newspaper of general circulation pursuant to Section 166.041, Florida Statutes, and within the City’s utility billing process pursuant to Section 180.136, Florida Statutes and is enacted pursuant to the Florida Municipal Home Rule Powers Act, Chapter 180, Florida Statutes, and other applicable law authorizing a municipality to set rates, fees, and charges for public utility services; and WHEREAS, it is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs to amend the rates, fees, and char ges for water, wastewater, and reclaimed water provided by the City. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby incorporated herein by this reference. Section 2. Amending Sec. 19-102 of the City Code. The City of Winter Springs Code, Section 19-102 is hereby amended as follows (underlined type indicates new text and strikeout text indicates deletions): 583 City of Winter Springs Ordinance No. 2023-13 Page 2 of 16 Sec. 19-102. User charge schedule, general. The following rates and charges shall apply to all systems unless otherwise specifically stated: (1) Monthly water service rates. A service availability charge shall be imposed and levied on all development requesting water and/or wastewater capacity to provide service to their properties and on all properties when structural charges, additions or changes in permitted use shall result in an increase in capacity requirements from the city's water and/or wastewater system. a. The determination of the amount of capacity for the non-residential users shall be based on the flow rates contained in Florida Administrative Code, 64E-6, as may be amended or renumbered from time to time. Separate Laundry Facilities for apartments or multi-family complexes are not included in the per unit flow rates included in (4)b above. 593 City of Winter Springs Ordinance No. 2023-13 Page 12 of 16 d. With respect to the determination of the water and wastewater service availability fees for non-residential development, if no water and wastewater capacity estimates are provided, the city reserves the right to estimate the average dependable daily capacity as referenced in this section and determine the appropriate service availability fee to be charged to such owner or applicant. e. The city reserves the right to review the amount of water and/or wastewater consumption during the first eighteen (18) months of service and shall bill to the owner or applicant any adjustment to the water and wastewater service availability fees for capacity use in excess of amounts which have been paid by the owner or applicant. Any additional service availability fee payments shall be billed to the owner or applicant at the same rate that was initially billed at time of building permit issuance. (5) Miscellaneous charges. a. Disconnection fee for turning service off for nonpayment$20.00 b. Re-connection fee for turning on service during regular business hours after disconnections for nonpayment of bill$20.00 c. Re-connection fee for turning service on outside of regular business hours after disconnection for nonpayment of bill$45.00 d. Fee or charge for actual damages (whichever is greater) for contamination or alteration of a water meter, line or connection, per occurrence$95.00 e. Inspection fee for each connection requested$40.00 f. Fee for all payments returned by bank $20.00 or 5% of the face amount of the payment, whichever is greater, not to exceed$40.00 g. Beginning annually on October 1, 2012 2028 and continuing annually thereafter every October 1, the base facility, volume and service availability charges for water, sewer and reclaimed water shall be adjusted using the CPI for the previous twelve-month period. Section 3. Amending Sec. 19-138 of the City Code. The City of Winter Springs Code, Section 19-138 is hereby amended as follows (underlined type indicates additions and strikeout type indicates deletions): Sec. 19-138. Rates and charges. (1) A rate shall be charged to all the customers on the reclaimed water system in accordance with the following schedule: (a) For nonmetered service for tracts of one-half (½) acre size or smaller, the monthly charge shall be eight dollars and fifty-five cents ($8.55). (b) For nonmetered service for tracts greater than one-half (½) area, an additional monthly fee of eight dollars and fifty-five cents ($8.55) for each additional irrigated one-half (½) acre shall be added to the base charge of eight dollars and fifty-five cents ($8.55). (c) For customers receiving metered service, the monthly charge shall be the sum of the base charge plus a consumptive charge as follows: Bills rendered on or after October 1, 2009 Reclaimed irrigation base facility charge, per ERC$4.10 Commodity Charge (per 1,000 gallons): 0—5,000 gallons0.75 5,001—10,000 gallons0.94 10,001—15,000 gallons1.30 15,001—20,000 gallons1.45 Above 20,000 gallons2.13 595 City of Winter Springs Ordinance No. 2023-13 Page 14 of 16 (d) As nonmetered customers of the reclaimed water system become metered, the newly metered customer shall be subject to the monthly rates and charges as identified in section 19-138(a)(3). Customer shall be subject to charges for metered service effective the next available billing period subsequent to installation of the reclaimed water meter. (e) For wholesale reclaimed water service, the monthly charge shall be fifty-two cents ($0.52) per thousand gallons. (2) The customer shall not be required to pay all costs associated with the purchase and installation of the meter. The public works/utility director or their designee may waive the requirement for a meter where a suitable alternative method exists for the calculation of the water usage and where the customer agrees to pay the metered rate for the calculated amount of water usage. (3) Connection to the reclaimed water system; connection charges. All connections to the reclaimed water system shall be approved by the public works/utility director or their designee. The total connection charge will consist of tapping fee for the reclaimed water service and the fee for installing a backflow prevention device on each potable water line servicing the same tract. (4) A customer whose service has been discontinued may resume reclaimed water service after paying any past due amounts and a reconnection fee. The reconnection fee shall be equal to the actual cost of reconnection but in no case shall be less than forty dollars ($40.00). (5) Where service has been disconnected for a violation of an ordinance or regulation regarding reclaimed water, such service shall not be reconnected until the city manager receives adequate assurance and guarantees that such a violation will not recur. Section 4. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 5. Incorporation Into Code. This ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph number or letter and any heading may be changed or modified as necessary to effectuate the foregoing. Section 6. Severability. Summary of the proposed ordinance and statement of public purpose: (Address the public purpose to be served by the proposed ordinance, such as serving the public health, safety, morals, and welfare of the City of Winter Springs.) This ordinance adopts a new utility rate schedule for water, wastewater, and reclaimed water services provided by the City for the current and next four (4) City fiscal years. The five-year rate schedule was developed in accordance with a rate study prepared by Raftelis Consulting. The new rate schedule is specifically set forth in the ordinance and includes a Consumer Price Index (C.P.I.) increase annually. After the five-year rate schedule the C.P.I. adjustment will be applied. The monthly base and consumption charges for such services will be increased for all customers beginning with bills rendered on or after December 1, 2023, based on the services received by the customers and the new applicable rate schedule. The increased rates will provide additional revenue for operations and capital improvements. The City is engaging in a significant sewer capital upgrades and reinvestment program which will require a focus on obtaining funding for the projects and setting the rates to support the capital improvement program and potential new debt service payments. Part II. Estimate of the direct economic impact of the proposed ordinance on private, for-profit businesses in the City of Winter Springs: (fill out subsections a-c as applicable, if not applicable write “not applicable”) (a) Estimate of direct compliance costs that businesses may reasonably incur if the proposed ordinance is enacted: The proposed ordinance increases the monthly base and consumption charges billed by the City for water, wastewater, and reclaimed water services. Businesses are required to pay for these services on a monthly basis. The direct costs incurred by each business will vary depending on monthly usage and the cost will be calculated by applying the customer’s applicable base charge and volume/usage rate for such services rendered. Generally, for bills rendered on or after December 1, 2023, water rates will be increased 11% and a total of 55% by the end of the five year rate schedule; sewer rates will be increased 15% and a total of 108% by the end of the five year rate schedule; and reclaimed rates will be increased 12% and a total of 61% by the end of the five year rate schedule. (b) Identification of any new charges or fee on businesses subject to the proposed ordinance, or for which businesses will be financially responsible; and The direct costs incurred by each business will vary depending on monthly usage and the 601 cost will be calculated by applying the customer’s applicable base rate and volume/usage rate for such services rendered. The new base rate and volume/usage charges are set forth in the Ordinance. (c) An estimate of the City of Winter Springs’ regulatory costs, including an estimate of revenues from any new charges or fees that will be imposed on businesses to cover such costs. The City’s regulatory costs are $11.67 Million dollars which will increase to $22.77 Million dollars by year 5 due to the increase of debt service as a result of the Capital Improvement Plan (CIP) projects. Non-residential connections make up about 2% of the City’s users. The expected revenue from these connections is $1.06 Million dollars, progressively increasing up to $1.83 Million dollars by year 5. Part III. Good faith estimate of the number of businesses likely to be impacted by the ordinance: The Ordinance impacts all customers of the City’s water, sewer and reclaimed utilities system. There are currently 299 commercial accounts that will be impacted by the Ordinance, and type of services may vary by customer. However, additional vacant land exists within the City that may support additional businesses in the future when the land is developed. Part IV. Additional Information the City Commission may find useful (if any): The City retained Raftelis Consulting to prepare a Utility Rate Study. The Rate Study was presented to the City Commission at a public meeting and is the basis under which the City Commission is considering the adoption of the Ordinance. A public hearing notice for the adoption of proposed utility rate increases was sent to utility customers within the utility billing process in accordance with Chapter 180, Florida Statutes. The Ordinance will be advertised in a newspaper of general circulation prior to adoption in accordance with Section 166.041, Fla. Stat.
