SR-434. The Foundry Church has 290 existing parking spaces. The site would reduce available church parking spaces by 29 spaces, thus yielding 261 available parking spaces to accommodate the proposed and existing uses. The Foundry Church’s Executive Pastor provided written permission on June 16, 2023 to apply for this request which is to use the church’s parking lot area to construct the proposed coffee shop. The proposed use of coffee shop aligns with two permitted uses described in the Settlement Agreement and Amendment to Annexation Ordinance No. 64, The Tuscawilla Planned Unit Development, Master Plan for the Tuscawilla Planned Unit Development and Related Matters, recorded and verified March 25, 1991. The proposed development appears to provide considerations for impervious surface and building footprint reductions, landscape enhancements, expedited service times, aesthetics enhancements, and the ability to activate a site currently utilized as a portion of a church parking lot. SUMMARY The Community Development Department requests that the City Commission hold a Public Hearing to consider the Site Application, Aesthetic Review, and First Modification to the Development Agreement in order for the applicant to construct a ±800 sq. ft. coffee shop with a drive-thru on the subject property. Development Agreement First Modification to Development Agreement | Pending Code Enforcement Not Applicable City Liens Not applicable 314 P U B L I C H E A R I N G S A G E N D A I T E M | M O N D A Y , D E C E M B E R 1 1 , 2 0 2 3 | P A G E 2 O F 1 4 Background: The initial use of the site was as Vistawilla Shopping Center – Retail Center Anchor through Developer’s Agreement Tuscawilla Tract 15 Parcel 1-C recorded January 14, 1999, Book 3574 Pages 0529-541 (Exhibit J) that allowed for a Kash n’ Karry site with development criteria that included two existing ground-mounted signs along State Road 434. Commercial asphalt was added to the site in 1999. Plans submitted to the City of Winter Springs concerning remodeling to a church occurred in August 2005. A Build Out/Remodel Certificate of Occupancy was issued in August 2006 for “Metro Church” (Exhibit J). As of 2018, “The Foundry Church” replaced the entity displayed on the building. The applicant intends to occupy 21 parking spaces that exists on the northwest corner of the existing church parking lot for the development of an Ellianos Coffee Shop. Per, Exhibit J, the Settlement Agreement and Amendment to Annexation Ordinance No. 64, The Tuscawilla Planned Unit Development, Master Plan for the Tuscawilla Planned Unit Development and Related Matters, recorded March 25, 1991 with the Seminole County (Book 2277, Pages 0464-0498), hereby termed “Agreement,” the proposed use of coffee shop aligns with two permitted uses described in “Exhibit B” part one (1) of the Agreement. Those uses are “(ce.) Fast Food Restaurants, Including Drive-Through Services” and “(x.) Confectionary and Ice Cream Stores.” Also, part two of the permitted uses indicate the uses may be free-standing or part of an attached shopping center. The “Confectionary and Ice Cream Stores” classification, according to the North American Industry Classification System (NAICS), through the United States Census Bureau, is associated with NAICS code 722515 (Exhibit H). NAICS Code 722515 entitled Snack and Nonalcoholic Beverage Bars provides a list of related classifications that also includes “Coffee Shops, on Premises Brewing.” Therefore, through the NAICS the allowed and intended use of “Confectionary and Ice Cream Stores” and “Coffee Shops, on Premises Brewing,” respectively, may be related. The applicant seeks approval to construct an 8,644 SF site consisting of an 800 SF building with drive-through services within the existing church’s impervious parking lot area. The Foundry Church has 290 existing parking spaces. The site would result in a reduction of 29 parking spaces. Per submitted Civil Plans, Exhibit C, the site proposes to repurpose 21 spaces for development. Eight parking spaces will be assigned to the proposed development. The proposed business will not allow patrons to enter the building. Therefore, the required off-street parking requirement per Chapter 9, Article IV, Division 6, of the City’s Land Development Code, of one (1) parking space for each one hundred (100) square-feet of floor space for patron use in the building for the Restaurant, Nightclubs, Tearooms or Lunch Counters classification yields zero (800 SF/0 SF) parking spaces. Additionally, of the General Business and Retail Commercial classification, per City code, requiring one (1) parking space for per three hundred (300) square-feet of floor space in the building exclusive of storage space would at 315 P U B L I C H E A R I N G S A G E N D A I T E M | M O N D A Y , D E C E M B E R 1 1 , 2 0 2 3 | P A G E 3 O F 1 4 most require three (3) parking spaces (800SF/300SF=2.67). Submitted plans indicate eight (8) off-street parking spaces which exceeds the parking requirements of both classifications by five (5) parking spaces. The parking lot contains 290 parking spaces. As reflected in Exhibit C, plans depict 21 parking spaces being utilized for development with an additional eight (8) spaces for parking. The addition of the proposed development will decrease available parking from 290 to 261 parking spaces. Further, the church requires 110 general parking spaces (875 church seats at ratio of 1 parking space per 8 seats). The Calculation provided by the applicant is consistent with Article IV, Division 6, Section 9-277(21) and Section 9-277(26) of the Code of Ordinance of Winter Springs, FL as of the date of this report. Thus, 151 parking spaces remain (290 total parking spaces – 110 church parking spaces – 21 development spaces – 8 parking spaces) to accommodate additional parking needs of the parcel, such as to accommodate 1 parking space per church official resident and 0.5 parking spaces per permanent employee (if any). The Foundry Church’s Executive Pastor provided written permission, Exhibit B, on June 16, 2023 that gives Russell Krausmann permission to apply for a permit to use the church’s parking lot area through a ground lease agreement with Crucible Partners, LLC, dba Ellianos Coffee. Since the November 02, 2023 Planning and Zoning Board meeting, the applicant has submitted an updated plan set that adds a walk-up service window, that the applicant proposed to the Board. The plan set shows the walk-up service window along the northern façade of the proposed building. The additions provide enhancements to make the site more accessible for pedestrian travel along State Road 434. Updated interior elevations, civil plans, and the St. Johns River Water Management District permit were submitted after the meeting and are incorporated into the exhibits of this report. Public Notices: Notices were mailed to all owners of real property adjacent to and within approximately five-hundred feet (500) of the subject property and all Homeowner’s Associations within ½ mile (67 notices) Notices for the September 6, 2023 Community Workshop were proofed for mailing on August 18, 2023. The notice incorrectly advertised the meeting location as 126 E State Road 434 Suite 1600, Winter Springs, FL 32708. The correct address, 1126 E State Road 434, Winter Springs, FL 32708, was posted on the door of the advertised location by staff on the meeting date. No interested parties were present at the advertised address to direct to the correct address. Notices for an October 5, 2023 Planning and Zoning Board and October 23, 2023 City Commission Meetings were proofed for mailing on September 25, 2023. These public hearing meeting dates were postponed as a result of newly submitted plans/reports for review. A postponed notice was posted at the door of City Hall Chambers for the 316 P U B L I C H E A R I N G S A G E N D A I T E M | M O N D A Y , D E C E M B E R 1 1 , 2 0 2 3 | P A G E 4 O F 1 4 October 5, 2023 Planning and Zoning Board Meeting and October 23, 2023 City Commission Meeting. Notices aforementioned are provided in Exhibit I. Notices for the November 02, 2023 Planning and Zoning Board and December 11, 2023 City Commission Meetings were issued for mailing on October 18, 2023. Signage was posted on site on October 20, 2023. Analysis of Site and Final Engineering (Sec. 20-33.1) Criteria: The criteria for Site and Final Engineering Plans are listed below: (a) Site and final engineering plans and the subdivision of land shall also be subject to the technical requirements set forth in Chapter 9 of the City Code. It is the intent of this section to apply to applications for site and final engineering plans and to any subdivision of land requiring a plat, if applicable, and does not include review and approval of a lot split application. Please see discussion below regarding technical requirements of Chapter 9. The Final Engineering Plans have been reviewed by the City’s engineer, concluding that the Plans satisfy the technical requirements provided the conditions of approval set forth below are met. (b) Except in situations involving one (1) single-family home, the planning and zoning board shall be required to review all site and final engineering plan and subdivision of land applications and make a written recommendation to the city commission. Such recommendation shall include the reasons for the board's recommendation and show the board has considered the applicable criteria set forth in this section. (c) Upon receipt of the planning and zoning board's recommendation, the city commission shall make a final decision on the application. If the city commission determines that the planning and zoning board has not made a recommendation on an application within a reasonable period of time, the city commission may, at its discretion, consider an application without the planning and zoning board's recommendation. (d) Except in situations involving one (1) single-family home, all site and final engineering plan and subdivision recommendations and final decisions shall be based on whether the site and final engineering plan and subdivision of land complies with all the technical requirements set forth in chapter 9 of the City Code and the following criteria to the extent applicable: (1) Whether the applicant has demonstrated the site and final engineering plan and subdivision of land, including its proposed density, height, scale and intensity, hours of operation, building and lighting design, setbacks, buffers, noise, refuse, odor, particulates, smoke, fumes and other emissions, parking and traffic-generating characteristics, number of persons anticipated using, residing or working under the plan, and other off-site impacts, is compatible and harmonious with adjacent land uses, and will not adversely impact land use activities in the immediate vicinity. 317 P U B L I C H E A R I N G S A G E N D A I T E M | M O N D A Y , D E C E M B E R 1 1 , 2 0 2 3 | P A G E 5 O F 1 4 Analysis: The project proposes a ±8,644 sq. ft. site consisting of a one-story, 800 sq. ft. coffee shop (engineering calculates 820 sq. ft.), with associated drive-throughs, within the existing parking lot through a lease agreement with the landowner. The Foundry Church’s Executive Pastor, J. Douglas Meyers, provided written permission, Exhibit B, on June 16, 2023 to Russel Krausmann to apply for using the church’s parking lot area through a ground lease agreement with Crucible Partners, LLC, to be used for an Ellianos Coffee establishment. The Floor Area Ratio (FAR) for a parcel comparison is 0.002 (8.76 acres); 0.093 (8,644 sq. ft) as a site comparison. Noise, refuse, odor, particulates, smoke, fumes, and other emissions are not expected to be more than typical business operations of a standalone coffee shop, and therefore not projected to become a nuisance. Additionally, the building is proposed to be 20 feet in height, include fiber cement siding with metal trim, incorporate canopy and wall mounted lighting, may have hours of operation ranging from 5:30am – 9:00pm daily (based on other Ellianos Coffee Shop hours of operation within the central Florida region) with staffing numbers varying based on operational demands. The proposed site will be setback approximately 80 feet from the front and side property lines. The parcel’s entire western property line is equipped with trees and hedges that aide in obscuring visibility from the adjacent parcel. Additionally, the Dimension Plan provided in Exhibit C indicates planned landscaping is proposed to obscure visibility of drive-thru pick up windows from surrounding residential properties and right-of-way. This additional landscaping feature satisfies the requirement of Chapter 20, Article VI, Division 2, Section 20-473(k) of the city’s code. A traffic access study report, Exhibit G, was submitted by the applicant, from Buckholz Traffic, indicates all minor movements at all four intersections currently operate at a Level of Service of B or better during the weekday AM peak hour, and at a Level of Service rating of C during the weekday PM peak hour, under existing conditions with minimal queuing and with a volume-to-capacity ratio well less than one. Buckholz Traffic determined this will continue to be the case under 2024 build conditions and that the new development will not change the connection spacing situation along State Road 434 (SR 434). The dual drive-through is proposed to accommodate ten (10) vehicles as per Exhibit D’s vehicle stacking model with an average daily service time of 1.998 minutes per vehicle during the establishment’s peak daily sales. The service time per vehicle was calculated with consideration of vehicles arriving every 2.28 minutes. Theoretically, this yields a 0.282-minute overlap from the time a customer is serviced to the time an additional customer arrives during the highest projected demand proposed to occur between the hours of 08:00 am to 9:00 am amounting to a total of 53 visits. The proposed coffee shop will share a parcel consisting of a church and retail commercial establishments that are located south of the proposed site. The property located to the east is developed county-owned property containing a government office (1495 E SR 434). The property located to the west is zoned Planned Unit Development (PUD) Tuskawilla Tract 15 Parcel 1-C, addressed 440 Courtney Springs Circle, is a 23.86-acre site consisting of luxury apartment homes with a Commercial Future Land Use. The subject site will be located approximately 87 feet away from the 318 P U B L I C H E A R I N G S A G E N D A I T E M | M O N D A Y , D E C E M B E R 1 1 , 2 0 2 3 | P A G E 6 O F 1 4 western property line, and approximately 190 feet from the most adjacent residence. Therefore, the proposed coffee shop is not deemed to adversely impact land use activities in the immediate vicinity. The applicant intends to utilize the existing multi- tenant monument sign located on the northwestern corner of the property. (2) Whether the applicant has demonstrated the size and shape of the site, the proposed access and internal circulation, and the design enhancements to be adequate to accommodate the proposed density, scale and intensity of the site and final engineering plan requested. The site shall be of sufficient size to accommodate design amenities such as screening, buffers, landscaping, open space, off-street parking, safe and convenient automobile, bicycle, and pedestrian mobility at the site, and other similar site plan improvements needed to mitigate against potential adverse impacts of the proposed use. Analysis: The parcel currently provides four (4) points of access for ingress and egress. Two are located along Vistawilla Drive, and two are located along SR 434. The proposed site plan positions the building adjacent to northwestern entryway along SR 434. On-site improvements include landscape screening for dumpster area and western side of drive-thru area with podocarpus shrubs, and the incorporation of canopy/shade and understory trees (Live Oak and Crape Myrtle respectively). Additionally, live oak and crape myrtle trees will be incorporated at focal entry points. Off-street parking is satisfied by the existing parking lot, and the paving and grading plan proposes to make use of existing catch basin(s) for stormwater management. The Dimension Plan provided in Exhibit C indicates planned landscaping is proposed to obscure visibility of drive-thru pick up windows from surrounding residential properties and right-of-way, a requirement of City code. (3) Whether the proposed site and final engineering plan and subdivision of land will have an adverse impact on the local economy, including governmental fiscal impact, employment, and property values. Analysis: The development is not expected to have an adverse impact on the local economy. The proposed development is anticipated to add to the local economy by means of providing residents and visitors alike another option for food and drink. Additionally, like and comparable business commercial service types were researched for proximity to the proposed site. The closest standalone coffee shop within the city, compared to the proposed site, is approximately two (2.0) miles west located at 1220 E SR 434. The closest eastern establishment serving coffee with comparable service within the city is located at 1501 E Sr 434 within a gas station that is less than one mile east from the proposed site. At the time of this report, no additional establishments providing a similar service within a two-mile radius of the subject site within the geographical limits of the city’s jurisdiction was located. Lastly, the proposed site is located is located approximately 0.4 miles from Florida State Road 417 (FL-417) toll road’s entrance/exit ramps. Proximity to this roadway, as well as the closest business of similar service were considered in determining an appropriate search radius of similar business. 319 P U B L I C H E A R I N G S A G E N D A I T E M | M O N D A Y , D E C E M B E R 1 1 , 2 0 2 3 | P A G E 7 O F 1 4 (4) Whether the proposed site and final engineering plan and subdivision of land will have an adverse impact on the natural environment, including air, water, and noise pollution, vegetation and wildlife, open space, noxious and desirable vegetation, and flood hazards. Analysis: The subject parcel is developed. The new development will add vegetation, including trees and shrubs and make use of existing stormwater catch basin(s) that is local to the site. To note, the site as it exists at the time of this report is a parking lot. Therefore, development incorporating additional trees and shrubs to the existing impervious parking lot provides benefits that reduces the existing pavement area and is not deemed to increase any adverse impact on the natural environment than what may currently exist. Additionally, Exhibit L provides the St. Johns River Water Management Distrist’s permit indicating through condition 17, that the District does not foresee adverse water resource-related impacts. (5) Whether the proposed site and final engineering plan and subdivision of land will have an adverse impact on historic, scenic, and cultural resources, including views and vistas, and loss or degradation of cultural and historic resources. Analysis: It is not anticipated that the proposed development will have an adverse impact on any historic, scenic, or cultural resources, including views and vistas, and loss or degradation of cultural and historic resources. It is important to note that the property owner’s indication of approval was provided by the Executive Pastor of the church (owner) on stationary with the following phrase: “May God work in you to create a BETTER YOU and may God work through you to create a BETTER WORLD.” The site, as it exists at the time of this report, is a parking lot. The proposed development enhances and activates the site to become a better use of an existing parking lot. It does so by not only reducing the existing impervious surface area, but also provides space for a revenue generating establishment. The proposed site betters the view of the area by adding Live Oak and Crape Myrtle trees, as well as Podocarpus shrubs, and provides for a revenue generating establishment with a reduced building footprint (800 sq. ft.), as compared to similar establishments that would require more space. (6) Whether the proposed site and final engineering plan and subdivision of land will have an adverse impact on public services, including water, sewer, stormwater and surface water management, police, fire, parks and recreation, streets, public transportation, marina and waterways, and bicycle and pedestrian facilities. Analysis: The proposed development will include the following public services; water, sewer, stormwater management, police, and fire (Seminole County Fire Department). Water and sewer are available on-site and there is sufficient capacity to accommodate the proposed development. The proposed development is not projected to pose an adverse impact. Additionally, the City’s contracted engineering firm calculated the building at 820 sq. ft. with a total flow of 470 GPD. This increases the civil plan calculation by 20 sq. ft. Stormwater plans indicate to make use of existing parking lot catch basin with adjustments to be made for grade. Emergency services 320 P U B L I C H E A R I N G S A G E N D A I T E M | M O N D A Y , D E C E M B E R 1 1 , 2 0 2 3 | P A G E 8 O F 1 4 are proposed to be satisfied via the Fire Safety Plan submitting with Exhibit C that indicates how to maneuver the site along with indication of hydrant placement. The proposed site is located along SR-434 which has a pedestrian sidewalk enhanced with existing landscaping. (7) Whether the site and final engineering plan and subdivision of land, and related traffic report and plan provided by the applicant, details safe and efficient means of ingress and egress into and out of the neighborhood and adequately addresses the impact of projected traffic on the immediate neighborhood, traffic circulation pattern for the neighborhood, and traffic flow through immediate intersections and arterials. Analysis: A traffic access study report, Exhibit G, submitted by the applicant, indicates all minor movements at all four intersections currently operate at a Level of Service of B or better during the weekday AM peak hour, and at a Level of Service rating of C during the weekday PM peak hour, under existing conditions with minimal queuing and with a volume-to-capacity ratio well less than one. (8) Whether the proposed site and final engineering plan and subdivision of land will have an adverse impact on housing and social conditions, including variety of housing unit types and prices, and neighborhood quality. Analysis: The proposed development is not projected to have any adverse impact on housing or social conditions as the intended use is a drive-through coffee shop that provides vegetative enhancements and a revenue generating establishment proposed to be in an existing parking lot that currently lacks such enhancements. (9) Whether the proposed site and final engineering plan and subdivision of land avoids significant adverse odor, emission, noise, glare, and vibration impacts on adjacent and surrounding lands regarding refuse collection, service delivery, parking and loading, signs, lighting, and other sire elements. Analysis: It anticipated that the proposed development will not emit odors, noise, glares, or vibrations that will adversely impact adjacent properties. Adequate parking, lighting, refuse collection, service delivery, and other necessary elements such as dual drive through windows are proposed. Additionally, the proposed building will be utilized for, and wholly contain, the operations of the business. Services shall be rendered via dual drive-through windows. Customers will not enter the building, and not count towards the parking calculation of the site. 321 P U B L I C H E A R I N G S A G E N D A I T E M | M O N D A Y , D E C E M B E R 1 1 , 2 0 2 3 | P A G E 9 O F 1 4 (10) Whether the applicant has provided an acceptable security plan for the proposed establishment to be located on the site and final engineering plan and subdivision of land that addresses the safety and security needs of the establishment and its users and employees and minimizes impacts on the neighborhood, if applicable. Analysis: Elevations and colored renderings, Exhibit E, illustrates that the parking lot and building area will be lit with lighting on site. Additionally, the fire safety plan calls out the proposed route for a fire engine to navigate the site, and the existing fire hydrant that is located south of the proposed site. Additionally, customers will not be entering the building, reducing the potential for user safety issues. (11) Whether the applicant has provided on the site and final engineering plan and subdivision of land an acceptable plan for the mass delivery of merchandise for new large footprint buildings (greater than twenty thousand (20,000) square feet) including the hours of operation for delivery trucks to come into and exit the property and surrounding neighborhood, if applicable. Analysis: The proposed development encompasses approximately 8,644 SF consisting of an 800 SF building. Therefore, this is not proposed to be a large footprint building necessitating mass merchandise delivery. (12) Whether the applicant has demonstrated that the site and final engineering plan and subdivision of land have been designed to incorporate mitigative techniques and plans needed to prevent adverse impacts addressed in the criteria stated herein or to adjacent and surrounding uses and properties. Analysis: The proposed use on the subject site is a drive-through coffee shop developed within an existing parking lot. The proposed site provides the following measures to mitigate adverse impacts: 1. Reduces required impervious surface: a. Reduces parking requirements by not servicing customers within the proposed building. b. Reduces the potential gross square-footage of the site by rendering services only via drive-through windows. The required building consists of 800 sq. ft. (engineering calculates 820 sq. ft.) 2. Provides site enhancements: a. Cape Myrtles, Live Oaks, and Podocarpus shrubs incorporated to beautify and buffer b. Reduces existing impervious surface. 3. Makes use of an existing site a. Tree removal not required. (13) Whether the applicant has agreed to execute a binding development agreement required by city to incorporate the terms and conditions of approval deemed necessary by the city commission including, but not limited to, any mitigative techniques and plans required by City Code. 322 P U B L I C H E A R I N G S A G E N D A I T E M | M O N D A Y , D E C E M B E R 1 1 , 2 0 2 3 | P A G E 1 0 O F 1 4 Analysis: The execution of the binding Modification to the existing Development Agreement is pending. Water and Sewer: The proposed development will utilize an existing water main located on the property just south of the proposed site. Water Concurrency: As proposed by the applicant, the water service for the building shall be potable with an expected 50 gallons per day per 100 sq. ft. of floor space plus 15 gallons per day per employee, at four (4) employees. The rate per minute was calculated using an eight (8) hour day with a peaking factor of 4.0. The wastewater demand was calculated similarly with a peaking factor of 3.35. Parking Analysis: Overall, the addition of the proposed development will decrease available parking from 290 to 261 parking spaces. 151 parking spaces remain to accommodate additional parking needs of the parcel such as to accommodate 1 parking space per church official resident and 0.5 parking spaces per permanent employee (if any). Aesthetic Review: Pursuant to Section 9-603, which sets forth guidelines and minimum standards for Aesthetic Review packages, staff has utilized the below criteria in Section 9-603 to determine the following. The attached Aesthetic Review package includes all of the submittal requirements for aesthetic review as set forth in Section 9-600 through 9- 607 and include the following: (a) a site plan; (b) elevations illustration all sides of structures facing public streets or spaces; (c) illustrations of all walls, fences, and other accessory structures and the indication of height and their associated materials; (d) elevation of proposed exterior permanent signs or other constructed elements other than habitable space, if any; (e) illustrations of materials, texture, and colors to be used on all buildings, accessory structures, exterior signs; and (f) other architectural and engineering data as may be required. The procedures for review and approval are set forth in Section 9-603. Aesthetic Review 1. The plans and specifications of the proposed project indicate that the setting, landscaping, proportions, materials, colors, texture, scale, unity, balance, rhythm, contrast, and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community. Analysis: The proposed exterior color palette provides a modern commercial aesthetic that is dissimilar to the surrounding development. The exterior color palette includes dark tones such as tobacco, black, and dark bronze. Overall, the architectural intent of the proposed project includes architecture that enhances, and is complementary to, the styles of architecture along SR 434. 2. The plans for the proposed project are in harmony with any future development which has been formally approved by the city within the surrounding area. Analysis: The proposed project is similar terms of color palette and overall architectural design. The plans for the proposed project are not excessively similar or dissimilar to any other building, structure or sign which is either fully constructed, permitted but not fully constructed, or included on the same permit application, and facing upon the same or intersecting street within five hundred (500) feet of the proposed site, with respect to one or more of the following features of exterior design and appearance: a. Front or side elevations; b. Size and arrangement of elevation facing the street, including reverse arrangement; or c. Other significant features of design such as, but not limited to: materials, roof line, hardscape improvements, and height or design elements. Analysis: The overall aesthetic of the project provides similar colors to other buildings located on the parcel without being overly similar. The building’s colors are of a darker tone but not identical. The buildings details include fiber cement and metal trim which complement the overall façade. Windows along the on the front facade of the building that will face SR-434 is similar to the existing building on the parcel. The proposed design shares appropriate intent without being too similar or dissimilar to surrounding properties. The proposed building sign is similar to existing signage on the property. 4. The plans for the proposed project are in harmony with, or significantly enhance, the established character of other buildings, structures or signs in the surrounding area with respect to architectural specifications and design features deemed significant based upon commonly accepted architectural principles of the local community. Analysis: The proposed project enhances the character and overall aesthetics of the surrounding area. Design features incorporated into the project, such as the color palette and siding make it similar but not identical to other buildings in the area. 5. The proposed project has incorporated significant architectural enhancements such as concrete masonry units with stucco, wrought iron, columns and piers, porches, arches, planting areas, display windows, and other distinctive design detailing and promoting the character of the community. Analysis: The proposed development is designed to contribute to the quality of architectural styles. Printed copies of this document are not considered signed and sealed and the signature must be verified on any electronic copies. 365 ELLIANOS COFFEE TRAFFIC ACCESS STUDY Page 1 BUCKHOLZ TRAFFIC INTRODUCTION The proposed 820 SF Ellianos Coffee stand with dual drive-thru windows will be located in the parking lot of the commercial center located at 1491 East SR 434 in Winter Springs (Seminole County), Florida. The major tenant of this commercial center is Foundry Church. Access to the development will be provided via two existing right-in-right-out only driveway on East SR 434 and two existing full access driveways on Vistawilla Drive. SR 434 in the vicinity of the site is a four lane divided urban principal arterial with an FDOT access management classification of 3 and a posted speed limit of 50 mph while Vistawilla drive is a two lane undivided local roadway with a 25 mph posted speed limit. The development is expected to be completed and fully functional in 2024. Consequently, 2024 was used as the design year for this study. The proposed site plan is provided in Appendix A and Figure 1 depicts the site location and surrounding road network. EXISTING TRAFFIC VOLUMES Manual turning movement counts were conducted by Buckholz Traffic personnel at the four existing access points during May of 2023 with school in session. The counts were conducted during weekday AM and PM peak periods and are provided in Appendix B. The data was recorded at 15-minute intervals and includes a separate tabulation for trucks. Figures 2 and 3 summarize the weekday AM and PM peak hour traffic flows at the site entrances. Appendix C provides daily traffic volumes from an FDOT annual traffic counting station on SR 434 near the site. The current Average Daily Traffic (ADT) on the portion of SR 434 in the vicinity of the site is about 25,000 vehicles per day. Also included in Appendix C are February of 2022 hourly weekday traffic volumes at this station and FDOT seasonal adjustment factors for Seminole County. TRIP GENERATION Trip generation calculations were carried out using the 11th edition of ITE's Trip Generation Manual and referencing land use code 938 (Coffee/Donut Shop with Drive-Thru Window Only). Attached as Table 1 are the daily, weekday AM peak hour, and weekday PM peak hour trip generation calculations for the proposed development. During an average weekday, the development is expected to generate 358 trips (179 entering and 179 exiting) with 88 trips (44 entering and 44 exiting) occurring during the AM peak hour and 30 trips (15 entering and 15 exiting) occurring during the PM peak hour. Table 2 summarizes the pass- by, diverted and primary trip percentages obtained from a study of three existing Ellianos Coffee sites in Northeast Florida. 366 ELLIANOS COFFEE TRAFFIC ACCESS STUDY Page 2 BUCKHOLZ TRAFFIC SITE TRIP DISTRIBUTION AND TRAFFIC ASSIGNMENT Figures 4 and 5 graphically depict the weekday peak hour site traffic assignments with the supporting calculations provided in Appendix D. The distribution and assignment of primary, diverted and pass-by trips is based on roadway traffic volumes, housing distribution, and engineering judgment using the trip generation values contained in Table 1 and the trip type percentages summarized in Table 2. Diverted trips are assumed to originate from nearby Toll SR 417. FUTURE TRAFFIC VOLUMES The expected weekday AM and PM peak hour background (No Build) traffic volumes and total (Build) traffic volumes along SR 434 and Vistawilla Drive are provided in Figures 6 through 9. The 2024 background traffic volumes were obtained by multiplying the existing traffic volumes by the appropriate FDOT seasonal adjustment factor (0.95) and then by a linear regression derived annual growth rate of 2.3% (see Figure C-1 in Appendix C). The 2024 Build traffic volumes were then calculated by adding the traffic generated by the new development to the 2024 No Build traffic volumes. TURN LANE EVALUATION A formal analysis was made to determine if a right turn lane is warranted on eastbound SR 434 at the West Site Driveway, on northbound Vistawilla Drive at the North Site Driveway, or on southbound Vistawilla Drive at either the North Site Driveway or South Site Driveway. The methodology contained in NCHRP Report 279 was used to conduct this analysis using expected 2024 Build traffic volumes. As is indicated in Figures 10 through 13, right turn volumes will not be high enough to warrant an exclusive right turn lane at any of these locations. These results are supported by NCHRP Report 420. Using expected 2024 Build traffic volumes, a formal analysis was also made to determine if a northbound left turn lane is warranted on Vistawilla Drive at either the North Site Driveway or the South Site Driveway. The methodology contained in a paper written by M.D. Harmelink entitled: "Volume Warrants for Left Turn Storage Lanes at Unsignalized Grade Intersections" was used to conduct this evaluation. The results indicate that future traffic volumes will not be high enough to warrant a left turn lane at either location. The supporting analyses are provided in Figures 14 and 15. 367 ELLIANOS COFFEE TRAFFIC ACCESS STUDY Page 3 BUCKHOLZ TRAFFIC INTERSECTION CAPACITY ANALYSIS The four site drive intersections were analyzed using the two-way stop control methodology contained in the 2023 version of the Highway Capacity Software. The analyses are provided in Appendix E with the results summarized in Tables 3 through 6. All minor movements at all four intersections currently operate at level of service B or better during the weekday AM peak hour under existing conditions with minimal queuing and with a volume-to-capacity ratio well less than one. This will continue to be the case under 2024 Build conditions. ACCESS MANAGEMENT EVALUATION The recommend connection spacing along SR 434 for a class 3 facility with a posted speed greater than 45 mph is 660 feet. Currently there is approximately 350 feet between the East Site Driveway and the West Site Driveway, 210 feet between the East Site Driveway and Vistawilla Drive, and 320 feet between the West Site Driveway and Country Springs Circle. The relationship of the parties to this Agreement is contractual and Developer is an independent contractor and not an agent of the City. Nothing herein shall be deemed to create a joint venture or principal-agent relationship between the parties, and neither party is authorized to, nor shall either party act toward third persons or the public in any manner, which would indicate any such relationship with the other. 15.0 Sovereign Immunity. The City intends to avail itself of sovereign immunity and other applicable limitations on City liability whenever deemed applicable by the City. Therefore, notwithstanding any other provision set forth in this Agreement, nothing contained in this Agreement shall be construed as a waiver of the City’s right to sovereign immunity under section 768.28, Florida Statutes, or other limitations imposed on the City’s potential liability under state or federal law. As such, the City shall not be liable under this Agreement for punitive damages or interest for the period before judgment. Further, the City shall not be liable for any claim or judgment, or portion thereof, to any one person for more than two hundred thousand dollars ($200,000.00), or any claim or judgment, or portion thereof, which, when totaled with all other claims or judgments paid by the State or its agencies and subdivisions arising out of the same incident or occurrence, exceeds the sum of three hundred thousand dollars ($300,000.00). 16.0 City's Police Power. Developer agrees and acknowledges that the City hereby reserves all police powers granted to the City by law. In no way shall this Agreement be construed as the City bargaining away or surrendering its police powers. 17.0 Interpretation. The parties hereby agree and acknowledge that they have both participated equally in the drafting of this Agreement and no party shall be favored or disfavored regarding the interpretation to this Agreement in the event of a dispute between the parties. 18.0 Third-Party Rights. This Agreement is not a third-party beneficiary contract and shall not in any way whatsoever create any rights on behalf of any third party. 19.0 Specific Performance and Enforcement. Strict compliance shall be required with each and every provision of this Agreement. The parties agree that failure to perform the obligations provided by this Agreement shall result in irreparable damage and that specific performance of these obligations may be obtained by a suit in equity. 514 DEVELOPMENT AGREEMENT City of Winter Springs and Metro Church of Christ, Inc. Page 5 of 10 20.0 Attorney's Fees. In connection with any arbitration or litigation arising out of this Agreement, each party shall be responsible for their own attorney’s fees and costs. 21.0 Development Permits. Nothing herein shall limit the City's authority to grant or deny any development permit applications or requests subsequent to the effective date of this Agreement in accordance with the criteria of the City Code and the requirements of this Agreement. The failure of this Agreement to address any particular City, County, State and/or Federal permit, condition, term or restriction shall not relieve Developer or the City of the necessity of complying with the law governing said permitting requirement, condition, term or restriction. Without imposing any limitation on the City’s police powers, the City reserves the right to withhold, suspend or terminate any and all certificates of occupancy for any building, trailer, structure or unit if Developer is in breach of any term and condition of this Agreement. 22.0 Default. Failure by either party to perform each and every one of its obligations hereunder shall constitute a default, entitling the non-defaulting party to pursue whatever remedies are available to it under Florida law or equity including, without limitation, termination of this Agreement, an action for specific performance, and/or injunctive relief. Prior to any party filing any action as a result of a default under this Agreement, the non-defaulting party shall first provide the defaulting party with written notice of said default. Upon receipt of said notice, the defaulting party shall be provided a thirty (30) day opportunity in which to cure the default to the reasonable satisfaction of the non-defaulting party prior to filing said action. 23.0 Termination. The City shall have the unconditional right, but not obligation, to terminate this Agreement, without notice or penalty, if Developer fails to receive building permits and substantially commence vertical construction of buildings, which shall at minimum include building foundations, for the Project within two (2) years of the effective date of this Agreement. The Developer may apply to the City Commission for an extension of this Agreement, which may be granted upon good cause shown. In addition, the City shall have the right, but not obligation, to terminate the Agreement if Developer permanently abandons construction of the Project, provided, however, the City shall first deliver written notice and an opportunity to cure to the defaulting party as set forth in Section 22 above. If the City terminates this Agreement, the City shall record a notice of termination against the Property in the public records of Seminole County, Florida. 24.0 Indemnification and Hold Harmless. Developer shall be solely responsible for designing, permitting, constructing, operating and maintaining this Project. As such, Developer hereby agrees to indemnify, release, and hold harmless the City and its commissioners, employees and attorneys from and against all claims, losses, damages, personal injuries (including, but not limited to, death), or liability (including reasonable attorney’s fees and costs through all appellate proceedings), directly or indirectly arising from, out of, or caused by Developer and Developer’s contractor’s and subcontractor’s performance of design, permit and construction, and maintenance activities in furtherance of constructing the Project and maintaining the improvements of this Project. This indemnification shall survive the termination of this Agreement. 515 DEVELOPMENT AGREEMENT City of Winter Springs and Metro Church of Christ, Inc. Page 6 of 10 25.0 Force Majeure. The parties agree that in the event that the failure by either party to accomplish any action required hereunder within a specified time period (“Time Period”) constitutes a default under the terms of this Agreement and, if any such failure is due to acts of God, acts of government authority (other than the City’s own acts), acts of public enemy or war, riots, civil disturbances, power failure, shortages of labor or materials, injunction or other court proceedings beyond the control of such party, or severe adverse weather conditions (“Force Majeure Event”), then, notwithstanding any provision of this Agreement to the contrary, that failure shall not constitute a default under this Agreement and any Time Period proscribed hereunder shall be extended by the amount of time that such party was unable to perform solely due to the Force Majeure Event. The extended Time Period shall be agreed to in writing by the parties and said agreement shall not be unreasonably withheld by either party. The City Manager shall have the authority to grant an extended Time Period. An extension of any Time Period for reasons of a Force Majeure Event shall be requested solely as provided in this Section. Developer hereby waives and relinquishes the right to notify the City of the intent to exercise the tolling and extension of any permit related to the Project, including Time Periods under this Agreement, development orders, and building permits, available under Section 252.363, Florida Statutes, as the result of a declaration of a state of emergency issued by the Governor for a natural emergency. 26. Notice. Any Notice given as provided herein shall be deemed received as follows: if delivered by personal service, on the date so delivered; and if mailed, on the third business day after mailing. 27.0 Assignment. Prior to completing the construction of the Project and reaching final build-out of the Project, Developer shall not assign this Agreement without the prior written consent of the City. Such assignment shall require the written approval of the City by amendment to this Agreement, which shall not require a public hearing and shall not be unreasonably withheld. However, Developer shall be entitled to assign its rights and obligations under this Agreement to a parent, subsidiary, or affiliated entity in which Developer or its members are members or interest holders without City consent, provided that the City is given notice of such assignment in accordance with Section 26.0 herein. Any assignment authorized by this subparagraph shall require the assignee to be a formal signatory to this Agreement and fully assume all of Developer’s obligations, commitments, representations, and warranties under this Agreement. In any assignment, the rights and obligations contained herein shall be binding on successors in interest to the Property, and the terms and conditions of this Agreement shall bind and inure to the benefit of the parties hereto and any respective successors and assigns. A complete copy of this permit shall be kept at the work site of the permitted activity during the construction phase, and shall be available for review at the work site upon request by the District staff. Unless the permit is transferred under Rule 62-330.340, F.A.C., or transferred to an operating entity under Rule 62-330.310, F.A.C., the permittee is liable to comply with the plans, terms and conditions of the permit for the life of the project or activity. 6. Within 30 days after completing construction of the entire project, or any independent portion of the project, the permittee shall provide the following to the Agency, as applicable: a. For an individual, private single-family residential dwelling unit, duplex, triplex, or quadruplex — “Construction Completion and Inspection Certification for Activities Associated with a Private Single-Family Dwelling Unit” [Form 62-330.310(3)]; or 525 b. For all other activities — “As-Built Certification and Request for Conversion to Operation Phase” [Form 62-330.310(1)]. c. If available, an Agency website that fulfills this certification requirement may be used in lieu of the form. 7. If the final operation and maintenance entity is a third party: a. Prior to sales of any lot or unit served by the activity and within one year of permit issuance, or within 30 days of as-built certification, whichever comes first, the permittee shall submit, as applicable, a copy of the operation and maintenance documents (see sections 12.3 thru 12.3.4 of Volume I) as filed with the Florida Department of State, Division of Corporations and a copy of any easement, plat, or deed restriction needed to operate or maintain the project, as recorded with the Clerk of the Court in the County in which the activity is located. b. Within 30 days of submittal of the as- built certification, the permittee shall submit “Request for Transfer of Environmental Resource Permit to the Perpetual Operation and Maintenance Entity” [Form 62-330.310(2)] to transfer the permit to the operation and maintenance entity, along with the documentation requested in the form. If available, an Agency website that fulfills this transfer requirement may be used in lieu of the form. 8. The permittee shall notify the District in writing of changes required by any other regulatory District that require changes to the permitted activity, and any required modification of this permit must be obtained prior to implementing the changes. 9. This permit does not: a. Convey to the permittee any property rights or privileges, or any other rights or privileges other than those specified herein or in Chapter 62-330, F.A.C.; b. Convey to the permittee or create in the permittee any interest in real property; c. Relieve the permittee from the need to obtain and comply with any other required federal, state, and local authorization, law, rule, or ordinance; or d. Authorize any entrance upon or work on property that is not owned, held in easement, or controlled by the permittee. 10. Prior to conducting any activities on state-owned submerged lands or other lands of the state, title to which is vested in the Board of Trustees of the Internal Improvement Trust Fund, the permittee must receive all necessary approvals and authorizations under Chapters 253 and 258, F.S. Written authorization that requires formal execution by the Board of Trustees of the Internal Improvement Trust Fund shall not be considered received until it has been fully executed. 11. The permittee shall hold and save the District harmless from any and all damages, claims, or liabilities that may arise by reason of the construction, alteration, operation, maintenance, removal, abandonment or use of any project authorized by the permit. 12. The permittee shall notify the District in writing: a. Immediately if any previously submitted information is discovered to be inaccurate; and 526 b. Within 30 days of any conveyance or division of ownership or control of the property or the system, other than conveyance via a long-term lease, and the new owner shall request transfer of the permit in accordance with Rule 62-330.340, F.A.C. This does not apply to the sale of lots or units in residential or commercial subdivisions or condominiums where the stormwater management system has been completed and converted to the operation phase. 13. Upon reasonable notice to the permittee, District staff with proper identification shall have permission to enter, inspect, sample and test the project or activities to ensure conformity with the plans and specifications authorized in the permit. 14. If prehistoric or historic artifacts, such as pottery or ceramics, projectile points, stone tools, dugout canoes, metal implements, historic building materials, or any other physical remains that could be associated with Native American, early European, or American settlement are encountered at any time within the project site area, the permitted project shall cease all activities involving subsurface disturbance in the vicinity of the discovery. The permittee or other designee shall contact the Florida Department of State, Division of Historical Resources, Compliance Review Section (DHR), at (850) 245-6333, as well as the appropriate permitting agency office. Project activities shall not resume without verbal or written authorization from the Division of Historical Resources. If unmarked human remains are encountered, all work shall stop immediately and the proper authorities notified in accordance with Section 872.05, F.S. For project activities subject to prior consultation with the DHR and as an alternative to the above requirements, the permittee may follow procedures for unanticipated discoveries as set forth within a cultural resources assessment survey determined complete and sufficient by DHR and included as a specific permit condition herein. 15. Any delineation of the extent of a wetland or other surface water submitted as part of the permit application, including plans or other supporting documentation, shall not be considered binding unless a specific condition of this permit or a formal determination under Rule 62-330.201, F.A.C., provides otherwise. 16. The permittee shall provide routine maintenance of all components of the stormwater management system to remove trapped sediments and debris. Removed materials shall be disposed of in a landfill or other uplands in a manner that does not require a permit under Chapter 62-330, F.A.C., or cause violations of state water quality standards. 17. This permit is issued based on the applicant’s submitted information that reasonably demonstrates that adverse water resource-related impacts will not be caused by the completed permit activity. If any adverse impacts result, the District will require the permittee to eliminate the cause, obtain any necessary permit modification, and take any necessary corrective actions to resolve the adverse impacts. 18. A Recorded Notice of Environmental Resource Permit may be recorded in the county public records in accordance with Rule 62-330.090(7), F.A.C. Such notice is not an encumbrance upon the property. 19. This permit for construction will expire five years from the date of issuance. 20. This permit does not authorize the permittee to cause any adverse impact to or “take” of state listed species and other regulated species of fish and wildlife. Compliance with state laws regulating the take of fish and wildlife is the responsibility of the owner or applicant associated with this project. Please refer to Chapter 68A-27 of the Florida Administrative Code for definitions of “take” and a list of fish and wildlife species. If listed species are observed onsite, FWC staff are available to provide decision support information or assist in obtaining the appropriate FWC permits. Most marine endangered and threatened 527 species are statutorily protected and a “take” permit cannot be issued. Requests for further information or review can be sent to FWCConservationPlanningServices@MyFWC.com. 21. All wetland areas or water bodies that are outside the specific limits of construction authorized by this permit must be protected from erosion, siltation, scouring or excess turbidity, and dewatering. 22. The operation and maintenance entity shall inspect the stormwater or surface water management system once within two years after the completion of construction and every two years thereafter to determine if the system is functioning as designed and permitted. The operation and maintenance entity must maintain a record of each required inspection, including the date of the inspection, the name and contact information of the inspector, and whether the system was functioning as designed and permitted, and make such record available for inspection upon request by the District during normal business hours. If at any time the system is not functioning as designed and permitted, then within 30 days the entity shall submit a report electronically or in writing to the District using Form 62-330.311(1), “Operation and Maintenance Inspection Certification,” describing the remedial actions taken to resolve the failure or deviation. 23. No surface water impacts are proposed or authorized by this permit. 24. The proposed surface water management system must be constructed and operated according to the plans received by the District on August 18, 2023. 528 Notice Of Rights 1.A person whose substantial interests are or may be affected has the right to request an administrative hearing by filing a written petition with the St. Johns River Water Management District (District). Pursuant to Chapter 28-106 and Rule 40C-1.1007, Florida Administrative Code, the petition must be filed (received) either by delivery at the office of the District Clerk at District Headquarters, P. O. Box 1429, Palatka Florida 32178-1429 (4049 Reid St., Palatka, FL 32177) or by e-mail with the District Clerk at Clerk@sjrwmd.com, within twenty-six (26) days of the District depositing the notice of District decision in the mail (for those persons to whom the District mails actual notice), within twenty-one (21) days of the District emailing the notice of District decision (for those persons to whom the District emails actual notice), or within twenty-one (21) days of newspaper publication of the notice of District decision (for those persons to whom the District does not mail or email actual notice). A petition must comply with Sections 120.54(5)(b)4. and 120.569(2)(c), Florida Statutes, and Chapter 28-106, Florida Administrative Code.
