SUMMARY City staff request approval of the design, permitting and grant services measures required to address bank stabilization located on Gee Creek at Moss Parking in light of Hurricane Ian. Design services led by Pegasus Engineering will also include sub- consultants for survey and geotechnical services. The total fee for these services is $133,700. FUNDING SOURCE The funding source is the Third Generation Penny Sales Tax. All design services and construction costs are 75% reimbursable by the National Resources Conservation Services (NRCS). RECOMMENDATION City staff request approval of the design, permitting and grant services measures required to address erosion located on Gee Creek at Moss Park. All design services and construction costs are 75% by the National Resources Conservation Services (NRCS) Staff requests the Commission authorize the Interim City Manager and City Attorney to prepare and execute a contract and any related documents required with Pegasus Engineering. Interim City Manager City of Winter Springs 1126 East State Road 434 Winter Springs, Florida 32708 Subject:Erosion Control Countermeasures within Gee Creek at Moss Park Reference: Proposal for Final Design, Permitting and Grant Management Services Dear Phil: We are pleased to submit this proposal to provide the City of Winter Springs with professional stormwater engineering services for the above referenced project pursuant to the requirements of the City’s Master Agreement for Continuing Engineering Services – Road and Transportation Facilities, Stormwater Engineering and Flood Control. SECTION I: PROJECT DESCRIPTION AND SCOPE OF WORK Hurricane Ian made landfall on September 28, 2022, just west of Fort Myers near Cayo Costa Island as a powerful Category 4 hurricane with sustained winds of 150 mph. Ian was downgraded to a tropical storm on September 29, 2022, as it tracked inland, re-entering open water on the east coast of Florida near New Smyrna Beach. Rainfall gauges indicate that most of the rainfall from Ian occurred during an approximate 7-hour period between the evening of September 28th and the early morning hours on September 29th, and Doppler radar shows the heaviest rainfall occurred to the north and west of the storm track (refer to Figure 1). Rainfall totals recorded during Hurricane Ian are provided by the National Weather Service (NWS) on a County- by-County basis with two (2) separate locations in Winter Springs as summarized below. ·Winter Springs Location #1 = 15.56-inches total rainfall ·Winter Springs Location #2 = 14.97-inches total rainfall Hurricane Ian rainfall recorded for Winter Springs is between a 500-year and 1,000-year frequency storm of 24- hour duration based on NOAA’s precipitation estimates. 1 1 National Oceanic and Atmospheric Administration (NOAA) Atlas 14 Point Precipitation Frequency Estimates. 214 Erosion Control Countermeasures within Gee Creek at Moss Park Proposal for Final Design, Permitting and Grant Management Services Page 2 Figure 1 Hurricane Ian Total Accumulated Rainfall 7-Day Observed Precipitation City of Winter Springs 215 Erosion Control Countermeasures within Gee Creek at Moss Park Proposal for Final Design, Permitting and Grant Management Services Page 3 Moss Park is a neighborhood park with recreational amenities including basketball courts, playgrounds, pavilions, a small picnic shelter, and restroom facilities (refer to Figure 2). The park is located on South Moss Road near Dolphin Road, with a physical address at 314 South Moss Road and latitude and longitude coordinates of 28.6892°, -81.3046° at the approximate centroid of the park property.2 Gee Creek traverses the park property in the north-south direction, with a foot bridge that provides pedestrian access from the parking lot located east of Gee Creek to the park amenities located west of Gee Creek. At the north end of Moss Park, Gee Creek flows under South Moss Road through double Con Span culverts that are part of Bridge No. 775715 (refer to Figure 3). Table 1 Relevant SJRWMD Permit Approvals Permit Number Project Name 3 Issue Date 1 75648-1 Moss Road Bridge Replacement 11/25/1996 2 35091-1 Moss Park Improvements 11/25/1996 3 120223-1 Gee Creek at Moss Road Erosion Control Project 4/10/2009 4 157171-1 Sediment Removal – Gee Creek at Moss Road 4/24/2019 Several important issues and considerations are summarized below based on a preliminary review of the permits summarized above. ·SJRWMD Permit No. 75648-1 The bridge replacement elevated the profile of South Moss Road approximately 30-inches to mitigate the overtopping potential and replaced the existing triple box culverts having span and rise dimensions of 12-feet x 66-inches with double Con Span culverts having span and rise dimensions of 24-feet x 7- feet, and also. Additional permitting with the U.S. Army Corps of Engineers (USACE) and Florida Department of Environmental Protection (FDEP) was not required because all construction activities occurred within the public right-of-way for South Moss Road. ·SJRWMD Permit No. 120223-1 This project involved improvements on both the east and west sides of South Moss Road, including: removing sediment and other debris from the Gee Creek channel; installing erosion protection on the Gee Creek channel side slopes; re-grading the Gee Creek channel bottom; constructing a concrete flume at the southeast corner of the bridge; and repairing an existing scour hole at the northwest corner of the bridge. A letter from FDEP dated March 2, 2009, indicated that “the proprietary requirements normally applied to State owned lands not apply to this project”. Funding for this project was provided by a grant from the Natural Resources Conservation Service (NRCS) under the Emergency Watershed Protection (EWP) Program pursuant to a disaster declaration for Tropical Storm Fay in August 2008. 3 Project name from SJRWMD e-Permitting. 218 Erosion Control Countermeasures within Gee Creek at Moss Park Proposal for Final Design, Permitting and Grant Management Services Page 6 ·SJRWMD Permit No. 157171-1 This project involved sediment removal and grading improvements on both the east and west sides of South Moss Road. Additionally, rubble riprap was also proposed at the southeast corner of the bridge between an existing concrete flume and the Gee Creek channel bottom. Applications were submitted requesting exemption verifications for three (3) separate projects, including: Gee Creek at Edgemon Avenue; Gee Creek at South Moss Road; and Bear Creek at Winter Springs Boulevard. All three (3) projects were subsequently combined under a single exemption verification, and District staff issued a “No Permit Required” letter on April 24, 2019, pursuant to the exemption requirements outlined in 62- 330.051(7)(a), F.A.C. Funding for this project was provided by a grant from the NRCS under the EWP Program, however, no information was provided in the permit file indicating the applicable disaster declaration. Peak streamflow during and immediately after Hurricane Ian caused significant streambank erosion and other structural damage at numerous locations along Gee Creek. At South Moss Road, the streambanks west of the bridge were eroded, the pedestrian sidewalk was damaged, and additional sediment deposition probably occurred. Figure 4 Eroded Streambanks along Gee Creek at South Moss Road 219 Erosion Control Countermeasures within Gee Creek at Moss Park Proposal for Final Design, Permitting and Grant Management Services Page 7 A professional land surveyor was retained to obtain elevations of “apparent” high water marks at various locations along Soldiers Creek, Gee Creek, Howell Creek, and Bear Gully Creek, including roadway bridges and other locations identified by City staff. Apparent high water marks were surveyed at twelve (12) different locations on October 10, 2022, including Bridge No. 775715 at South Moss Road. The surveyed high water mark indicates that the bridge was overtopped during Hurricane Ian, and comparing this information to FEMA’s published 100-year BFE also confirms that the Hurricane Ian rainfall exceeded the 100-year frequency storm event of 24-hour duration. ·An apparent high water mark was surveyed on the east side of the bridge at elevation 39.97-ft, NAVD. ·A review of the construction plans submitted for SJRWMD Permit 157171-1 indicates that bridge overtopping will occur at approximate elevation 39-ft, NAVD.4 It should be noted that the profile grade line of South Moss Road was raised as part of the bridge replacement project, so roadway overtopping can potentially occur at a lower elevation either north or south side of the bridge crossing at Gee Creek. ·FEMA’s effective 100-year base flood elevation (BFE) for Gee Creek at South Moss Road is elevation 38.3-ft, NAVD just downstream of the bridge and elevation 40.2-ft, NAVD just upstream of the bridge. Table 2 FEMA’s Regulatory Flood Elevations for Gee Creek 4 Although the topographic survey for the previous sediment removal project provides edge of pavement elevations for the bridge, centerline elevations for the roadway profile grade line were not shown. 220 Erosion Control Countermeasures within Gee Creek at Moss Park Proposal for Final Design, Permitting and Grant Management Services Page 8 The scope of work for this proposal pertains specifically to streambank erosion that occurred along Gee Creek within Moss Park, sidewalk damage along the west side of the South Moss Road bridge, and any other deficiencies identified in close proximity to the bridge both east and west of South Moss Road. Based on site inspections conducted by representatives of Pegasus Engineering, proposed improvements will include: ·Erosion control countermeasures in the form of gabion baskets combined with rubble riprap along the streambanks west of the bridge at South Moss Road. Pedestrian safety and vertical drop-off protection will be addressed by installing handrails or fencing along the top of bank behind the gabion baskets. ·The pedestrian sidewalk along the west side of the bridge will be removed and replaced. Chemical grout may be required to infill any voids that were caused below the sidewalk when the bridge was overtopped during high water levels. ·Grading and removal of accumulated sediments from both the channel and the Con Span culverts is also anticipated. SECTION II: TASKS/DUTIES The ENGINEER (Pegasus Engineering) shall provide professional engineering services related to the major task assignments as outlined below. A. Data Collection and Review 1. Data collection and review will focus on the previous projects that have been permitted along Gee Creek near South Moss Road based on the permit and correspondence files maintained by the City of Winter Springs, Seminole County, and the St. Johns River Water Management District (SJRWMD). 2. Information contained within the City’s geographic information system (GIS) will be reviewed and evaluated with a specific focus on identifying any utility issues or other complications relative to engineering design and construction. B. Field Reconnaissance 1. Site visits will be conducted with City staff to observe existing conditions, to confirm the content and sufficiency of the preliminary survey deliverable, and to identify site-specific issues germane to both design and construction of the proposed improvements. C. Sub-consultants 1. Coordinate with the survey sub-consultant tasked with preparing a topographic survey suitable for the engineer’s use in developing construction plans for the proposed improvements. In addition to the existing site features and topography, the topographic survey will also show the location of existing trees that are 8-inches in measured diameter at breast height (DBH). 2. Coordinate with the geotechnical sub-consultant tasked with preparing a sub-subsurface exploration and report summarizing the geotechnical investigation. 3. Perform sufficiency reviews of the preliminary sub-consultant deliverables and issue comments prior to submitting final deliverables. 221 Erosion Control Countermeasures within Gee Creek at Moss Park Proposal for Final Design, Permitting and Grant Management Services Page 9 D. Engineering Design and Evaluation of Erosion Control Countermeasures 1. Erosion control countermeasures and/or structural improvements will be evaluated for the identified problem area. The possible factors or combination of factors that are causing, or contributing, to the observed erosion and slope failures will be comprehensively evaluated to properly design the proposed improvements. 2. In the event that site conditions at the time of final design differ from the conditions that were previously observed, final design will encompass additional improvements if necessary to the greatest extent practicable. The approximate limits for the topographic survey were defined to address this possibility. E. Construction Plans 1. A complete set of construction plans will be prepared that is suitable for public bid and ready to award for construction. All design parameters, surveys, and construction plans will be prepared and submitted in English standard units. At this time, preparation of the construction plans is anticipated to include the following sheets: ü Cover Sheet ü General Notes ü Overall Plan ü Topographic Survey (by others) ü Horizontal Control and Site Plan ü Cross Sections ü Flow Diversion Plan* ü Temporary Erosion Control Plan ü Pollution Control Details ü Jurisdictional Wetland and Surface Water Impacts ü Miscellaneous Details 2. Construction plans will be prepared to scale on 24” x 36” sheet size. 3. Sixty percent (60%), ninety percent (90%) and one hundred percent (100%) plans will be submitted for review and comment. 4. Final construction plans will be submitted that encompass all of the technical review comments as well as any changes or revisions related to permitting. *It should be noted that the Flow Diversion Plan is intended to specify the minimum requirements for water bypassing during construction, including the peak flow rates that can be anticipated for various storm events. However, the Flow Diversion Plan will not dictate the Contractor’s “means and methods” of performing the required work. 222 Erosion Control Countermeasures within Gee Creek at Moss Park Proposal for Final Design, Permitting and Grant Management Services Page 10 F. Engineer’s Estimate of Probable Construction Cost 1. Cost estimates will show quantity breakdowns and pay items using the Florida Department of Transportation (FDOT) numbering system to the greatest extent practicable. 2. Cost estimates will be submitted for review and comment along with each progress submittal of the construction plans. 3. A final cost estimate will be submitted that encompasses all of the technical review comments and reflects the final quantity takeoffs and any unit cost changes based on best available information. G. Specifications 1. The construction contract will be governed by FDOT Standard Specifications for Road and Bridge Construction (latest English edition) to the greatest extent practicable. ü Technical Special Provisions will be prepared (if necessary) to modify, clarify, delete, or supplement the General Conditions of the construction contract. ü Supplemental Specifications will be prepared (if necessary) to clarify and more specifically define any work items that are encompassed by the FDOT Standard Specifications. ü Additional technical information will be presented within Special Bid Items (SBIs) to specifically address unique or a-typical work items that are not a part of the FDOT Standard Specifications or Supplemental Specifications thereto. H. Permitting 1. Pursuant to conversations with SJRWMD representatives as part of developing the scope of work for this proposal, it appears that a permit will not be required to implement the proposed stabilization and restoration activities. ü A “Field Emergency Authorization Form” will be submitted using the District’s ePermit portal. ü Because the District’s field emergency authorizations are good for ninety (90) days, the form will be submitted at a late stage of the project just before the project is advertised for bid. 2. Pursuant to information obtained from the permit file for the Gee Creek at Moss Road Erosion Control Project (SJRWMD Permit No. 120223-1), FDEP’s proprietary requirements normally applied to State owned lands should not apply to this project and permitting issues related to Sovereign Submerged Lands (SSL) should not be applicable. 3. An Individual Permit (IP) and/or Nationwide Permit from the U.S. Army Corps of Engineers (USACE) or FDEP for construction (dredge and fill activities) and operational activities pursuant to Section 404 of the Clean Water Act has been included within the scope of work as a separate permitting task that may or may not be required.5 5 The project location appears to be FDEP jurisdiction for State 404 Program permitting. 223 Erosion Control Countermeasures within Gee Creek at Moss Park Proposal for Final Design, Permitting and Grant Management Services Page 11 I. Post-design Services 1. Prepare for and attend the pre-bid meeting. Meeting minutes will be prepared by others. 2. Coordinate with City staff to provide technical responses for up to five (5) requests for information (RFIs) received from potential bidders. 3. Prepare conformed drawings and provide signed and sealed sets to the Contractor, CEI consultant, and City staff. 4. Prepare for and attend the pre-construction meeting. Meeting minutes will be prepared by others. 5. Review and process shop drawings. It is envisioned that six (6) shop drawing submittals will be reviewed that encompass the following major elements: ü 1 – Flow diversion plan(s). ü 2 – Temporary erosion control plan and pollution control details. ü 3 – Concrete mix designs. ü 4 – Gabion baskets. ü 5 – Rubble riprap. ü 6 – Handrail or fence. 6. This scope of work assumes that reviewing and approving revised shop drawings will be limited to three (3) re-submittals. 7. Coordinate with City staff and/or the City’s CEI consultant to address the Contractor’s RFIs during construction. 8. Prepare for and attend four (4) on-site progress meetings during construction. Additional engineering inspections may be conducted if necessary to monitor certain aspects of construction, with a specific focus on completing various certifications after construction is complete. 9. Prepare for and participate in the substantial completion inspection and provide "punch-list" items to the CEI consultant for submittal to the Contractor. 10. Prepare for and participate in the final inspection to confirm that the “punch-list” items have been adequately addressed. 11. Review the signed and sealed as-built drawings provided by the Contractor's surveyor and issue comments (if necessary). 12. Prepare an Engineer’s Certification of Completion. 224 Erosion Control Countermeasures within Gee Creek at Moss Park Proposal for Final Design, Permitting and Grant Management Services Page 12 J. Grant Management Services 1. Limited grant management services related specifically to the Natural Resources Conservation Service (NRCS) Emergency Watershed Protection (EWP) Program are itemized below. ü Attend the pre-design kick-off meeting with City staff and the NRCS program manager. ü Prepare bi-weekly progress reports for the NRCS program manager. ü Coordinate with NRCS representatives to obtain review and concurrence on the design, construction plans and specifications prior to a public bid advertisement. A copy of the final signed and sealed construction plans and specifications shall be provided to NRCS. ü Provide certification to NRCS that any permits and licenses required in accordance with local, state and Federal laws, along with real property rights (land and water), have been acquired prior to commencing construction. An attorney’s opinion must be provided to support this certification. ü Prepare and submit a Quality Assurance Plan (QAP) for NRCS review and concurrence prior to a public bid advertisement. The QAP shall outline technical and administrative expertise required to ensure the EWP project measures are installed in accordance with the plans and specifications, identify individuals with the expertise, describe items to be inspected, list equipment required for inspection, outline the frequency and timing of inspection (continuous or periodic), outline inspection procedures, and record keeping requirements. A copy of the final QAP shall be provided to NRCS prior to commencement of construction. ü Provide limited construction inspections in accordance with the Final QAP. ü Prepare and submit an Operation and Maintenance (O&M) Plan for NRCS review and concurrence prior to commencement of construction. The O&M Plan shall describe any activities that must be performed to ensure the project performs as designed. ü Provide copies of all permits, licenses, and other documents required by Federal, state, and local statutes and ordinances to NRCS prior to bidding for installation of the EWP project measures. All modifications to the plans and specifications shall be reviewed and concurred on by NRCS. ü Provide the NRCS program manager with a copy of the bidding documents, including, but not limited to: invitation to bid and/or bid advertisement; bid documents; bid evaluation; and notice of award. ü Participate in a final inspection with NRCS representatives to confirm that all work was performed in accordance with contractual requirements. Certification that the project measures were installed in accordance with the approved plans and specifications will be provided by a registered professional engineer. ü Provide signed and sealed as-built drawings and quantities for the project to the NRCS program manager. 225 Erosion Control Countermeasures within Gee Creek at Moss Park Proposal for Final Design, Permitting and Grant Management Services Page 13 ü Assist City staff with preparing and submitting a SF-270, “Request for Advance or Reimbursement” form to the NRCS program manager with all documentation to support the request. The final payment request shall be submitted within ninety (90) calendar days of completion of the EWP project measures. ü Assist City staff with submitting a final report to the NRCS program manager to officially close- out the project. K. Meetings and Other Project Administration 1. This scope of work assumes a total of four (4) in-person progress meetings and/or video conferences will be conducted with City staff and NRCS representatives during the course of final design. 2. Two (2) additional meetings with City staff, NRCS representatives, and/or other parties of interest have been included as a contingency allowance. L. Basis of Proposal, Conditions and Assumptions 1. This proposal assumes that the City possesses “Sufficient Real Property Interest” in, or control over, the land upon which the activities are proposed to occur. Although the activities proposed west of South Moss Road will occur entirely within Moss Park (owned by the City of Winter Springs) or the public right-of-way for South Moss Road, any activities proposed east of South Moss Road are assumed to occur within existing easements on private property. Depending on the current alignment of Gee Creek east of South Moss Road, the proposed activities may or may not be entirely located within the platted drainage easement for The Seasons (Plat Book 50, Page 25). 2. City staff will coordinate directly with any affected property owners and obtain any legal rights for ingress and egress necessary during both design and construction. 3. Since the proposed construction activities are anticipated to result in less than 1-acre of disturbed land, a National Pollutant Discharge Elimination System (NPDES) construction permit application from the Environmental Protection Agency (EPA) should not be required. Therefore, a Stormwater Pollution Prevention Plan (SWPPP), a Notice of Intent (NOI), or a Notice of Termination (NOT) should be applicable for this project. 226 Erosion Control Countermeasures within Gee Creek at Moss Park Proposal for Final Design, Permitting and Grant Management Services Page 14 4.FEMA’s effective Flood Insurance Rate Map (FIRM) identifies a Zone “AE” special flood hazard area (SFHA) along Gee Creek that encompasses both the main channel and some overbank area. FEMA also identifies an adopted regulatory floodway that varies in width, with widened segments upstream (south) of Murphy Road and downstream (north) of South Moss Road. Although any proposed encroachment or alteration within the adopted regulatory floodway is a significant consideration relative to FEMA permitting requirements and/or potential compliance issues related to FEMA’s National Flood Insurance Program (NFIP), the current scope of work does not include a floodway encroachment hydraulic analysis, a No-Rise Certification, or FEMA permitting of any kind. This proposal does not include the following professional services. In the event that any of these services are required in the future, it is assumed that an amendment will be processed to encompass those additional services. ü Modification or relocation of existing utility systems. ü Legal sketches and descriptions for easement acquisition. ü Ecological assessments and wetland mitigation. Delineation of wetlands and other surface waters for this project will be based on the “apparent top of bank” in lieu of field flagging by an ecological sub-consultant. ü SJRWMD permit applications. ü Permit application fees. ü Stormwater modeling. ü Floodway analysis and Federal Emergency Management Agency (FEMA) No-Rise Certification. ü Maintenance of Traffic (MOT) operations and Traffic Control Plans (TCP). ü Bid documents above and beyond the specifications and bid schedule. This assumes that the City of Winter Springs will prepare the front-end bid document. ü Construction Engineering and Inspection (CEI) services. The site is approximately 0.8 acres in area and is currently developed with a roadway, residential development, and a park. Vegetation on the property is comprised of a dense tree line on the eastern portion of the property and varying grasses along the creek bed. The site topography can be described approximately as ranging from +45 feet along the roadway to +40 feet in the creek bed, NGVD. 243 GEC Proposal No. 11574G 2 Proposal for Geotechnical Engineering Services Pegasus Engineering, LLC Project Description We understand that project plans for this site include the installation of Gabion Baskets, removal of sediments, and the repair of damaged infrastructure. In preparing this scope of services, we have assumed structure loads are typical for this building type. Scope of Services Based on the project information provided, our experience, and the local standard of care, we recommend the following scope of services: •Stake boring locations at the site. •Clear utilities at the boring locations. •Mobilize 2-man soil survey crew •Mobilize Truck-mounted drilling equipment and personnel. •Perform 2 Standard Penetration Test (SPT) borings to a depth of 30 feet for the proposed Gabion Baskets. This depth of boring is estimated to be within the stress influence of shallow foundations for this structure. •Perform 0.5 days of manual probes in the project area to obtain standing water and muck/ loose sediment depth measurements. •Perform routine laboratory soil classification tests to enhance visual soil classification of samples obtained. •Issue a geotechnical engineering report signed and sealed by a Geotechnical Engineer licensed in Florida that will address the following topics: o Subsurface conditions at the boring locations o Measured and estimated seasonal high groundwater depths o Site preparation o Fill selection, placement and compaction o Foundation design recommendations o Muck probe information at the probe locations o Measured surface water heights and muck depths Cost The cost to provide the scope of services is a lump sum fee of $8,950.00.
