REGULAR AGENDA ITEM 500 CITY COMMISSION AGENDA | SEPTEMBER 11, 2023 REGULAR MEETING TITLE Non-Binding Presentation: Pulte Group - Winter Springs Golf Course Development Proposal SUMMARY This is a unique nonbinding presentation requiring feedback from the City Commission regarding a public conservation easement conveyed to the City of Winter Springs in December 1984 (amended November 1998). The public conservation easement covers approximately 133 acres. The subject property is commonly known as the Los Lagos Property (better known as Winter Springs Golf Course) located on the north side of West State Road 434; between Fountaintree Drive to the west and Sheoah Boulevard to the east. The current property owner and Pulte Homes are presently in contractual discussions for the potential sale of the property. Pulte Homes desires to develop the property. However, Pulte Homes and the property owner fully understand that the subject property is encumbered by the public conservation easement and that the City Commission will have to determine, in its sole discretion, whether all or a portion of the conservation easement should be released to facilitate any development project on the subject property. Due to the pendency of their contract negotiations with the owner, Pulte Homes requested to present their very preliminary conceptual development plan to the Commission for consideration and direction at the September 11th meeting. A detailed initial development agreement between the City and property owner and Pulte Homes will need to be negotiated by the parties before any release of the public conservation easement is determined. Only the City Commission can decide to release any portion of the public conservation easement, and presumably the release would only happen if the City Commission determined the proposed project would be in the public's best interests. Given the City's important property interests in the public conservation easement, Staff does not want to invest time in negotiating and drafting a development agreement unless the City Commission gives clear direction to do so at a public meeting. Absent a willingness by the Commission to consider releasing a portion of the conservation easement, this proposed project, or any other project for that matter, will not proceed. Generally, the preliminary conceptual plan proposes to preserve the old fairway “fingers” and lakes as conservation, open space/passive recreational, denotes the conveyance of 10 acres for the expansion of the City’s sewer plant, maintains the commercial frontage, and does not include apartments. The plan proposes 209 approximately 490 individual owned lots consisting of townhouses, rear loaded bungalows, and urban single family units. Whether this conceptual plan is acceptable or not is for the Commission to decide. Furthermore, if an initial development agreement was reached, the proposed project would then proceed through the City's normal development review process and will require a comprehensive plan amendment, PUD zoning, additional development agreement, and Plat. In essence, the City Commission would control the adoption of unique development standards to support any proposed project on the property. On September 4, 2023, Staff provided the Mayor and City Commission, as well as the Highlands Homeowner's Association, an advance copy of Pulte Homes' PowerPoint presentation due to the sensitivity and importance of this matter to the citizens and surrounding area. FUNDING SOURCE RECOMMENDATION Staff's recommendation is for the City Commission to consider the Pulte Homes presentation and provide feedback regarding the presentation. Additionally, in the context of the proposed presentation, the City Commission should provide direction to the City Manager as to whether the Commission is willing to consider negotiating, in the form of an initial development agreement, a release of a portion of the public conservation easement to facilitate the development of the project or some variation thereof based on the City Commission's comments about the proposal. If the Commission expresses a willingness to consider negotiating an initial development agreement, authorize the City Manager and City Attorney to negotiate, with the property owner and Pulte Homes, a draft initial development agreement which will be presented at a subsequent meeting for the City Commission's consideration. 210 l I d 0 ! Florida, and. because of such public benefits, the Grantee wishes to maintain its ability to utilize portions of the Protected Property for such public purposes, all in a manner consistent with maintaining the character of the Protected Property and the Conservation Easement granted herein. IN FURTHERANCE OF the foregoing affirmative rights. hereby granted to the Grantee. the Grantor hereby makes the following covenants. on behaif of itself. its successors and assigns. which covenants shall run with and bind the Protected Property in perpetuity: COVENANTS ANO PROHIBITED ACTIVITIES (1) There shall be no construction or placing of buildings, camping or other accommodations. fenc£s. signs, billboards or other advertising materia: on or above the ground on the Protected Property. except such shelters. fences. signs. or the like normally and customarily utilized in connection with the operation of a golf course. ( 2) There ~hall be no filling, excavating. dredging • removal of loam, peat, topsoil. sand, gravel or rock. nor any material change in the topography of the Protected Property in any manner except as may be reasonably required to maintain and improve, remodel and relocate roads. golf cart paths. foot trails. tees, greens, fairways. sand traps and other topographical features normally associated with a golf course. There shall be no mining or drilling or removal of minerals in such manner as to affect the surface; ( 3) There shal I be conducted no activity or use on the Protected Property, other than that associated with a golf course, that is detrimental to drainage. flood control. water conservation, erosion control, soil conservation, fish. wildlife or habitat preservation; ( 4) There shall be no operation of dune buggies or mot?rcycles. or other loud. destructive or offensive recreational vehicles, excepting golf carts, on the Protected Property except as they may be used for the purpose of ingress or egress, inspection. maintenance or fire protection; and ( 5) There shall be no dumping or placing of soil or other substance or material as landfill, or dumping or placing of trash, waste, or unsightly or offensive materials on the Protected Property. The transmission. storage and spraying of effluent shall be in accordanc~ with the existing contract therefor between the Grantor und the Grantee and. upon such contract's expiration or termination. such terms and conditions as the Grantor and the Grantee shall agree. TO HAVE ANO TO HOLD the said C:onservation Easement and Restriction unto the said Grant4'e. its successors and assigns forever. subject to the condition that the Grantee and its successors and assigns may not transfer said Conservation Easement and Restriction. with or without consideration, unless: ( 1 ) the Grantee as 3 condition of the transfer requires that the conservation purposes continue to be carried out and (2) the transferee is an eligible donee as that term is defined in the Internal Revenue Code and regulations issued thereunder. NEVERTHELESS AND NOTWITHSTANDING. any of the foregoing provisions to the contrary, except as expressly limited herein, the Grantor reserves for itself. its successors and assigns. all rights c:s owner of the Protected Property. including the right to use the property for all purposes not inconsistent with this grant. provided , however. that the Grantor, and its successors and assigns shall not exercise any reserved right hereunder without first giving reasonable written notice to the Grantee. its successors and assigns.
