CALL TO ORDER
Chairperson Maurice Kaprow called to Order the Tuesday, August 30,
2022 Regular Meeting of the Code Enforcement Board at 5:30 p.m., in the
Commission Chambers of the Municipal Building (City Hall, 1126 East
State Road 434, Winter Springs, Florida 32708.

Chairperson Kaprow opened nominations for Vice- Chairperson of the
Code Enforcement Board for remainder of calendar year 2022.
Board Member Gildea nominated Board Member Michael Burns to be
the Vice-Chairperson. Board Member Parsons seconded the nomination
and Board Member Burns accepted the nomination, No other
nominations were made.

shared safety concerns , and noted that he didn’t think the pond was
necessary.
Discussion followed on appropriate timelines for compliance, the
permit process, and the possibility of continuing the item to hear from
additional City staff.
Mr. Shawn Boyle, City Manager, offered testimony noting that the City
would need a minimum of 90 days to properly address the issue.

Mr. Jerry Van Kirk. 212 Birch Terrace, Winter Springs offered testimony
regarding the POD permit, difficulties with a contractor that he was
pursuing litigation against, and the replacement of the fence after
previous storm damage.
Attorney Nix sought clarification about the violations being cited and
after brief discussion Ms. Sanchez noted she would pull the violation
related to Winter Springs City Ordinance 6-195, Maintenance of Fences.
Discussion followed on sufficient time to address the issues and the
respondent noted he was amenable to the thirty-day suggestion.

WS CITY ORD. 13-2(C)The existence of excessive accumulation or untended growth of weeds, undergrowth
or other dead, or living plant life; or stagnant water, rubbish, garbage, refuse, debris,
trash, including but not limited to household furnishings, and all other objectionable,
unsightly or unsanitary matter upon any lot, tract or parcel of land within this city be
it uncovered or under open shelter, to the extent and in the manner that such lot,
tract or parcel of land is or may reasonably become infested or inhabited by rodents,
vermin or wild animals, or may furnish a breeding place for mosquitoes, or threatens
or endangers the public health, safety, or welfare, or may reasonably cause disease,
or adversely affects and impairs the economic welfare of adjacent property, or any
other objectionable, unsightly substance or material tending by its existence and/or
accumulation to endanger or adversely Effect of health, safety, lives, and/or welfare
of the citizens of the city, is hereby prohibited and declared to be a public nuisance
and unlawful.
IPMC 304.2 Protective treatment. All exterior surfaces, including but not limited to, doors, door
and window frames, cornices, porches, trim, balconies, decks and fences shall be
maintained in good condition. Exterior wood surfaces, other than decay- resistant
woods, shall be protected from the elements and decay by painting or other
protective covering or treatment. Peeling, flaking and chipped paint shall be
eliminated and sur- faces repainted. All siding and masonry joints as well as those
between the building envelope and the perimeter of windows, doors, and skylights
shall be maintained weather resistant and water tight. All metal surfaces subject to
rust or corrosion shall be coated to inhibit such rust and corrosion and all surfaces
with rust or corrosion shall be stabilized and coated to inhibit future rust and
corrosion. Oxidation stains shall be removed from exterior surfaces. Surfaces
designed for stabilization by oxidation are exempt from this requirement.

Sanitation. All exterior property and premises shall be maintained in a clean,
safe and sanitary condition. The occupant shall keep that part of the exterior

other dead, or living plant life; or stagnant water, rubbish, garbage, refuse, debris, trash,

unsanitary matter upon any lot, tract or parcel of land within this city be it uncovered or
under open shelter, to the extent and in the manner that such lot, tract or parcel of land is or
may reasonably become infested or inhabited by rodents, vermin or wild animals, or may
furnish a breeding place for mosquitoes, or threatens or endangers the public health, safety,
or welfare, or may reasonably cause disease, or adversely affects and impairs the economic
welfare of adjacent property, or any other objectionable, unsightly substance or material
tending by its existence and/or accumulation to endanger or adversely affect of health,
safety, lives, and/or welfare of the citizens of the city, is hereby prohibited and declared to be
a public nuisance and unlawful.

304.2 PROTECTIVE TREATMENT
Protective treatment. All exterior surfaces, including but not limited to, doors, door and
window frames, cornices, porches, trim, balconies, decks and fences shall be maintained in
good condition. Exterior wood surfaces, other than decay resistant woods, shall be protected
from the elements and decay by painting or other protective covering or treatment. Peeling,
flaking and chipped paint shall be eliminated and sur faces repainted. All siding and masonry
joints as well as those between the building envelope and the perimeter of windows, doors,
and skylights shall be maintained weather resistant and water tight. All metal surfaces
subject to rust or corrosion shall be coated to inhibit such rust and corrosion and all surfaces
with rust or corrosion shall be stabilized and coated to inhibit future rust and corrosion.
Oxidation stains shall be removed from exterior surfaces. Surfaces designed for stabilization
by oxidation are exempt from this requirement.

drainage shall be adequate to prevent dampness or deterioration in the walls or
interior portion of the structure. Roof drains, gutters and downspouts shall be
maintained in good repair and free from obstructions. Roof water shall not be
discharged in a manner that creates a public nuisance.
