Regular Meeting of the Code Enforcement Board at 5:30 p.m., in the
Commission Chambers of the Municipal Building (City Hall, 1126 East

Ms. Mariah Quinn, Code Enforcement Specialist, Winter Springs Police
Department introduced the case, offered testimony on the procedures
of notice and the present violations, and showed photos from the
“Presentation.” The Board accepted the packet as published into
evidence without objection. Ms. Quinn recommended a compliance
date of August 26, 2022 and a two-hundred and fifty dollar ($250) per day
fine if this was not met.
Officer Tracy Fugate, Winter Springs Police Department was called as a
witness and offered testimony about the condition of the inside of the
residence. Officer Fugate and Ms. Quinn detailed efforts to connect the
respondent with resources and assistance which had been refused.
Ms. Jennifer Nix, Senior City Attorney sought to clarify if Ms. Quinn was
also seeking the Board to consider Section 13-4, City Code authorizing
the City to complete necessary work or contract work to bring the
property into compliance. Ms. Quinn noted she was seeking
consideration of Section 13-4.

Discussion followed on the work that would need to be completed.
Captain Kevin Presley, Winter Springs Police Department noted that the
City would have to contract any work that would be required. Further
discussion followed on an appropriate fine.
“I MOVE TO FIND THE RESPONDENT IN VIOLATION OF THE CITY CODE
AS CITED IN THE NOTICE OF VIOLATION BASED ON THE EVIDENCE
PRESENTED INCLUDING PHOTOS AND TESTIMONY FROM STAFF, THAT
WE ACCEPT THE FINDINGS OF THE CODE ENFORCEMENT OFFICER AS
PRESENTED, AND ORDER THAT RESPONDENT BE GIVEN UNTIL AUGUST
26, 2022 TO CORRECT THE VIOLATION. IN THE EVENT THE RESPONDENT
FAILS TO COMPLY BY THIS DATE A FINE IN THE AMOUNT OF TWO-
HUNDRED AND FIFTY DOLLARS ($250) A DAY SHALL BE IMPOSED FOR
EACH DAY THE VIOLATION CONTINUES THEREAFTER. FURTHER IF
RESPONDENTS FAIL TO REPAIR OR SECURE THE PROPERTY AND THUS

Ms. Terri Sanchez, Code Enforcement Specialist, Winter Springs Police
Department introduced the case, offered testimony on the procedures
of notice and the violation, and showed photos from the “Presentation.”
The Board accepted the packet as published into evidence without
objection. Ms. Sanchez recommended a compliance date of September
24, 2022 and a two-hundred and fifty dollar ($250) per day fine if this
was not met.
Ms. Shirley Chavista, 640 Alton Road, Winter Springs offered testimony
and noted that Luz Chavista had passed away, there had been a water
leak and fire which necessitated the tarp, and that legal proceedings
were coming to a close and a settlement had been reached. Ms.
Chavista noted she could quickly remedy issues related to yard trash
and debris but requested six (6) months to address the garage.
Discussion followed on a reasonable timeline. Ms. Chavista noted that
she was waiting on the money from the settlement agreement and
was most concerned about the time to find a contractor and have the
work completed.

Ms. Sanchez noted that the gutters had been cleaned as of July 6, 2022
but that the tarp and sandbags were still present.
Mr. Armando J. Davila, 203 Arrowhead Court, Winter Springs offered
testimony and noted that the roof was damaged in a 2018 hailstorm,
that he was in litigation currently, and that he could remove the tarp
but was uncertain about the timeline to repair the roof and may have
to replace the tarp.

WS City Ord. 8-33 (a) Establishment of permit. A development permit shall be obtained before construction or
development begins within any area of special flood hazard established in section 8-5.
(1) New developments. When new development proposals include lands designated as areas of
special flood hazard, the aforementioned development permit shall not be issued until all
applicable requirements of chapter 9 of this Code have been fulfilled. Specifically, the procedures
outlined in section 9-101(a)(2) shall be required. In addition, the provisions of section 9-241 which
exceed the provisions of this chapter, shall apply and be prerequisites to issuance of the
development permit.
(2) Construction in existing developments. Already developed lands within or including areas of
special flood hazard in this city for which building permits are requested shall be subject to the
provisions of this chapter, as shall lands described in (a) above. After land development is
completed no construction of any nature, neither buildings, nor site preparation, nor modification

of existing roads, utilities, drainage systems or other nonstructural improvements shall be allowed
within areas of special flood hazard until the development permit herein required has been issued.
(b) Application for permit. Application for a development permit shall be made on forms furnished
by the floodplain administrator and may include, but not be limited to, plans in triplicate drawn to
scale showing the nature, location, dimensions, and elevations of the area in question; existing or
proposed structures, fill, storage of materials, drainage facilities, and the location of the foregoing.
Specifically, the following information is required with application for the development permit:
(1) Elevation in relation to mean sea level of the proposed lowest floor (including basement) of all
structures.
(2) Elevation in relation to mean sea level to which any nonresidential structure will be
floodproofed.
(3) Certification from a registered professional engineer or architect that the nonresidential
floodproofed structure meets the floodproofing criteria in section 8-52(2).
(4) Description of the extent to which any watercourse will be altered or relocated as a result of
proposed development.
WS City Ord. 9-241 (a) The design concept for drainage systems in proposed developments shall be approved by the
city engineer. All drainage systems shall have a positive outlet or overflow unless documented as
being unnecessary by geohydrologic investigation based on a twenty-five-year design storm.
(b) All drainage facilities shall be designed for a rainfall of a twenty-five-year/twenty-four-hour
return period using an SCS Type II Modified rainfall distribution. The twenty-five-year/twenty-four-
hour storm is the "design storm".
(c) The drainage system for each subdivision shall include a sufficient facility to remove
stormwater without flooding any lot in the proposed subdivision or in the surrounding territory.
All residential floor elevations shall be elevated to a minimum of eighteen (18) inches above base
flood elevation.
All nonresidential finished floor elevation shall be elevated to a minimum of eighteen (18) inches
above the base flood elevation unless flood proofed in accordance with section 8-52(2) of the
Flood Damage Prevention Code.
(d) Retention/detention ponds.
(1) Dry bottom ponds. All dry bottom retention/detention ponds will have a pond bottom elevation
of no less than one (1) foot (twelve (12) inches) above the seasonal high ground water elevation,
which is to be determined by a registered professional engineer in the State of Florida with an
expertise in soils. The side slopes of all dry bottom retention/detention ponds shall not be steeper
than two and one-half (2½) horizontal to one (1) vertical. All dry bottom ponds with no exceptions,
in which the side slopes are steeper than four (4) horizontal to one (1) vertical shall require a
green vinyl chainlink fence with a minimum height of four (4) feet. All fences must meet setback
requirements in section 6-193, buildings and building regulations.
(2) Wet bottom ponds. All wet bottom ponds must have side slopes no steeper than four (4)
horizontal to one (1) vertical measured from the top of the berm down to at least three (3) feet
below the normal water level, measured vertically. This is the side slope transition point. Side
slopes may then transition, from the transition point, to no steeper than two (2) horizontal to one
(1) vertical down to the pond bottom. Wet bottom pond side slopes steeper than these values are
not allowed. If a fence is used, it must be of the same specifications as the fence for dry bottom
ponds.
(3) All ponds. Retention, detention, percolation, and treatment of stormwater are required by the
city. Stormwater regulations, criteria and requirements of the State of Florida, St. Johns River
Water Management District and the Department of Environmental Protection, as they may exist

and be modified from time to time, are to be the regulations, criteria, and requirements which the
city shall utilize for review of stormwater facilities. All city stormwater requirements shall also
apply in addition to any federal and state requirement. If there is a conflict between requirements,
the stricter requirement will apply. All ponds shall have a minimum ten (10) foot wide stabilized
maintenance berm capable of supporting a maintenance vehicle. There shall be a minimum ten
(10) foot wide easement to each pond dedicated to the city and the homeowners' association (if
planned). All fenced ponds must have a locked gate with ten-foot wide gate opening.
(e) Flow quantities off-site are not to exceed that prior to development. The stormwater runoff
volume and rate from the "design storm", for the post development condition, shall not exceed
that for the pre-development condition.
(f) The city encourages the preservation of existing swamp areas, ponds (including intermittent
ponds), wetlands and wet areas, and bayheads for water storage and conservation purposes.
Existing flood storage quantities shall not be reduced by development from that which existed on-
site prior to development. Pre and post-development volume must be adhered to with additional
compensating storage for all floodwater displaced by development below the elevation of the
hundred-year flood as defined by the Federal Emergency Management Agency on the latest
official panel of the flood insurance rate map. Compensating storage is to be calculated between
the hundred-year flood elevation and the seasonal high water table. The seasonal high water
table shall be established by a registered professional engineer in the State of Florida with
expertise in geotechnical engineering based on recent soil borings on the subject site. There must
be at least one (1) soil boring per pond, performed at the proposed location of the pond.
(g) The development of each phase of a development shall be capable of standing on its own if
subsequent areas planned for development are not developed.
(h) Inlet spacing. Inlets shall be spaced in such a manner as to accept one hundred (100) percent
of runoff. Typically, the maximum allowable gutter run will be seven hundred fifty (750) feet on
streets with curbs, unless specifically excepted by the city engineer. On streets other than streets
with curbs, the actual required spacing will depend on the characteristics of each particular site.
Calculations will be provided to show the hydraulic grade line (water level) in all inlets and storm
water manholes when the pond reaches its maximum stage water elevation during the design
storm. At no time will the hydraulic grade line be allowed to be higher than the edge-of-pavement
at inlets and at no time be higher than the manhole rim at storm water manholes. See
subsection 9-300 for standard curb inlet. Florida Department of Transportation (FDOT) inlets may
be used at the discretion of the city engineer.
(i) Lot grading. To facilitate proper stormwater surface runoff from residential lots, the minimum
residential lot line slope that can be accepted is one and one-quarter (1.25) percent. This will only
be allowed in areas that have good percolation of rainfall into the soils. In areas that do not have
good percolation of rainfall into the soils, the minimum lot line slope that can be accepted is one
and one-half (1.50) percent.
The determination of good percolation of soils will be made by the city engineer based on a recent
soils report by a registered professional engineer in the State of Florida with an expertise in soils.
The soils report may have to include the results of a recent soil permeability test if required by the
city engineer.

I sent you an email earlier on this. We only have an building alteration permit from

2020. We don’t have anything in regards to a site plan modification to a Stormwater
Pond at this subject property. Unfortunately, since this isn’t a building, our BO can’t
issue it.
I suggest we send out Code and have them do a stop work (if work is occurring) and
submit to the City and St. Johns for the alleged work. This might also have to include
FDOT if they are filling the pond and dumping the water into the SR434 system.

I wanted to loop you both in on this.
Mr. Voska owned and developed this lot and still owns some of the blocks (815 & 835). He said the
City required him to build the retention pond and ditch and he did so for about $100K about 40
years ago.
I know he inquired about permits with our permitting department. He was told there are no current
permits on the property.
Mr. Voska was here on Wednesday and again this morning expressing concern that his issue has not
been responded to.
Kevin Monser contacted SJRWMD and was told there are no permits.
I sent this e-mail to Code Enforcement earlier. I am not sure if they can do anything.
Mr. Voska’s cell number is 407-341-4808. This is a better number to contact him.

Hello Officer Quinn,
Just touching base with you I have been out of town since last Thursday, I just wanted to let you know I
had went to the winter springs police department, they had sent me to the winter springs town hall ( I
spoke to ladies at permit/building office and utilities area ) and then I was sent to court house in Sanford
none of these places had any information on helping me pay the fine as well as the information i was
trying to relay to you regarding the area at the batting cages. I did speak to the ladies at the building
department and they were very helpful. So I'm just trying to stay in contact with you that I have been
trying to pay any fine if there is one ( no one had record of it ) Also that I had an engineer come out to the
property and access the location, He is sending me over the report next Tuesday or Wednesday. Im not

proceeding to do anything further at this time with the filling of the hole and the engineer is sending a
report that the hole is more than sufficient as is and does not need to be removed or filled in any further .

STORMWATER MANAGEMENT
(a)The design concept for drainage systems in proposed developments shall be approved by the city
engineer. All drainage systems shall have a positive outlet or overflow unless documented as being
unnecessary by geohydrologic investigation based on a twenty-five-year design storm.
(b)All drainage facilities shall be designed for a rainfall of a twenty-five-year/twenty-four-hour return
period using an SCS Type II Modified rainfall distribution. The twenty-five-year/twenty-four-hour storm
is the "design storm".
(c) The drainage system for each subdivision shall include a sufficient facility to remove stormwater without
flooding any lot in the proposed subdivision or in the surrounding territory.
All residential floor elevations shall be elevated to a minimum of eighteen (18) inches above base flood
elevation.
All nonresidential finished floor elevation shall be elevated to a minimum of eighteen (18) inches above the
base flood elevation unless flood proofed in accordance with section 8-52(2) of the Flood Damage
Prevention Code.

STORMWATER MANAGEMENT
(2) Wet bottom ponds.All wet bottom ponds must have side slopes no steeper than four (4) horizontal to one (1)
vertical measured from the top of the berm down to at least three (3) feet below the normal water level,
measured vertically. This is the side slope transition point. Side slopes may then transition, from the transition
point, to no steeper than two (2) horizontal to one (1) vertical down to the pond bottom. Wet bottom pond side
slopes steeper than these values are not allowed. If a fence is used, it must be of the same specifications as the
fence for dry bottom ponds.
(3) All ponds.Retention, detention, percolation, and treatment of stormwater are required by the city.
Stormwater regulations, criteria and requirements of the State of Florida, St. Johns River Water Management
District and the Department of Environmental Protection, as they may exist and be modified from time to time,
are to be the regulations, criteria, and requirements which the city shall utilize for review of stormwater facilities.
All city stormwater requirements shall also apply in addition to any federal and state requirement. If there is a
conflict between requirements, the stricter requirement will apply. All ponds shall have a minimum ten (10) foot
wide stabilized maintenance berm capable of supporting a maintenance vehicle. There shall be a minimum ten
(10) foot wide easement to each pond dedicated to the city and the homeowners' association (if planned). All
fenced ponds must have a locked gate with ten-foot wide gate opening.

Any owner or owner's authorized agent (hereinafter "applicant") who intends to
undertake any development activity within the scope of this chapter, including
buildings, structures and facilities exempt from the Florida Building Code, which is
wholly within or partially within any flood hazard area shall first make application to

All fences and walls and accessories thereto shall be maintained in good order and in a
condition equal to that which was originally approved by the building official at the time a
permit was issued. If for any reason the fence or wall was erected without a permit, said wall
or fence shall be maintained in accordance with the conditions and requirements necessary
for obtaining a fence or wall permit from the building official under this article. Within thirty
(30) days receipt of written notice by the city that a wall or fence does not comply with the
requirements of this section, a property owner shall bring such fence or wall in compliance
with this section within thirty (30) days of receipt of such notice. The thirty-day period may
be extended an additional thirty-day period by the city manager or the city manager's
designee for good cause shown.

Please take notice that at 5:30 P.M. on August 30, 2022 the Code Enforcement Board will hold a hearing to determine whether
you are in violation of the City Code as follows. The hearing will be held at Winter Springs City Hall located at 1126 East State
Road 434, Winter Springs, Florida.

The Code Enforcement Board will receive testimony and evidence at said hearing regarding the violation(s) occurring upon the property
of the Respondent(s) as set forth in the Notice of Violation, attached hereto, and shall make a determination as to whether such violation(s)
is/are corrected pursuant to Section 162.06, Florida Statues.
If the Code Enforcement Board finds your property in violation of the City Code(s) you can be fined up to $250.00 per day for each day
the violation continues and up to $500 per day for each day a repeat violation continues. You may also be charged for the costs that are
incurred by the city in prosecuting the case. In the event violation fines and the costs are not paid within a reasonable time there can be
a lien filed against the property and upon any other real or personal property owned by the violator in accordance with Section 162.09,
Florida Statutes.
The hearing is conducted within guidelines of City of Winter Springs Code 2-60 and Chapter 162, Florida Statutes. You may appear in
person and are entitled to testify and present evidence and witnesses in defense at the hearing. Since the proceedings of the Code
Enforcement Board are legal in nature, you may wish to have legal counsel attend the above-referenced hearing. If you choose to not
attend the hearing you can lose your right to present facts in this case. The Code Board will subpoena witnesses on your behalf upon
written request to the Code Board through the City of Winter Springs Clerk’s Office.
An aggrieved party, including the City of Winter Springs, may appeal a final administrative order of the Code Enforcement Board to the
Circuit Court as provided by the general law of the State of Florida. Any such appeal must be filed within thirty (30) days of the execution
of the order to be appealed. In the event that you appeal the Order of the Code Enforcement Board, you will be required to have an
official record of the proceedings. You may, at your own expense, arrange for the official transcript of the testimony and evidence
presented at the hearing.

6-195 MAINTENANCE OF FENCES
All fences and walls and accessories thereto shall be maintained in good order and in a
condition equal to that which was originally approved by the building official at the time a
permit was issued. If for any reason the fence or wall was erected without a permit, said wall
or fence shall be maintained in accordance with the conditions and requirements necessary
for obtaining a fence or wall permit from the building official under this article. Within thirty
(30) days receipt of written notice by the city that a wall or fence does not comply with the
requirements of this section, a property owner shall bring such fence or wall in compliance
with this section within thirty (30) days of receipt of such notice. The thirty-day period may
be extended an additional thirty-day period by the city manager or the city manager's
designee for good cause shown.

Definition: For purposes of this section, "temporary storage structure" shall mean a structure designed and used
primarily for storage of building materials, household goods, and other such material; and that is not intended for
permanent installation.
(b)A supplier of a temporary storage structure shall obtain a permit issued by the building department prior to supplying
and installing or allowing to be installed a temporary storage structure within the City of Winter Springs. The permit
shall be limited to a specific address and shall allow the installation at such address for a maximum of seventy -two (72)
consecutive hours. Permits shall also be limited to a maximum of two (2) per any twelve-month period for any specific
address. A permit fee shall be required by resolution of the city commission and collected by the city. The permit shall
contain the date and time of issuance, the name of the person to whom the temporary storage structure is supplied,
and the address at which the temporary storage structure will be installed. Notwithstanding the foregoing seventy-two
hour time limit, the city may permit the use of a temporary storage structure, on a property that currently contains a
commercial use, for the entire time period beginning October 15 and ending January 31 of the immediately following
calendar year if such temporary storage structure is used to store seasonal deliveries and golf carts utilized by seasonal
delivery personnel as authorized by section 316.2126(3)(a) Florida Statutes.

All fences and walls and accessories thereto shall be maintained in good order and in a
condition equal to that which was originally approved by the building official at the time a
permit was issued. If for any reason the fence or wall was erected without a permit, said wall
or fence shall be maintained in accordance with the conditions and requirements necessary
for obtaining a fence or wall permit from the building official under this article. Within thirty
(30) days receipt of written notice by the city that a wall or fence does not comply with the
requirements of this section, a property owner shall bring such fence or wall in compliance
with this section within thirty (30) days of receipt of such notice. The thirty-day period may
be extended an additional thirty-day period by the city manager or the city manager's
designee for good cause shown.

AND ORDER (FIRST VIOLATION)
THIS CAUSE having come on for consideration, after being duly noticed, before the Code
Enforcement Board of the City of Winter Springs, Florida, on July 26, 2022 to determine whether any
violations of the City of Winter Springs Code of Ordinances("City Code")exist or existed on the Property.
The Board, having heard the arguments of the parties and the evidence and testimony presented, and
having reviewed the record and being otherwise fully advised, issues the following Findings of Fact and
Conclusions of Law which are incorporated into this Order as set forth herein.
Findings of Fact and Conclusions of Law
Based upon the evidence and testimony presented at this hearing, the Code Enforcement Board
finds:
1.That the property at issue in this matter is located at 885 Benchwood Drive, Winter
Springs, Florida 32708 ("Property") and is assigned the following Parcel ID# 12-21-30-505-0000-3360.
The Property is owned by SFR JAVELIN BORROWER LP ("Respondent").
2. That the Respondent was provided a Notice of Violation in accordance with Sections 2-60
and 2-61 of the City Code and consistent with sections 162.06 and 162.12, Florida Statutes. Such Notice
of Violation alleged violations of Section(s) 6-186 Permit Required, City Code, and required corrective
actions relating to the Property including that a permit is needed for the new vinyl 6-foot privacy fence.
3. That the Respondent was provided a reasonable time to correct said violations prior to this
hearing.

4. That the Respondent either failed or refused to correct such violations within the reasonable
time period provided in the Notice of Violation.
5.That the Respondent was provided a Notice of Hearing before the Code Enforcement
Board,in accordance with the City Code and consistent with sections 162.06 and 162.12,Florida Statutes.
The Respondent was not present at the hearing.
6. The City's power point presentation, photographs, notices, additional case
information, and other evidence presented are admitted into evidence. City code enforcement
officers provided sworn testimony and photographs relative to the violations, including photographs of
the new fence and that the fence was erected without a permit (Photos 1, 2, 3, 4, 5).
Conclusions of Law
7.That based on the testimony and evidence presented, including testimony and photographs
presented by the Code Enforcement Officer relating to a newly installed fence erected without a permit
Sec. 6-186 City Code), which remains beyond the compliance date set forth in the Notice of Violation,
Respondent violated Sections 6-186 Permit Required, City Code.
BASED UPON THE FOREGOING FACTS AND CONCLUSIONS, IT IS HEREBY
ORDERED:
1.The Respondent be given until August 26,2022 to correct the violation(s)of the City Code
on the Property. The Respondent shall be responsible to provide notice of such violations being corrected
to the Code Enforcement Officer.
2.If the Respondent fails to correct the violations within the time period set forth herein, the
Code Enforcement Officer shall schedule a compliance hearing before the Code Enforcement Board and
Respondent shall be duly noticed and given an opportunity to appear and present evidence as to the status
of the violations on the Property. Upon a finding by the Code Enforcement Board that the Property remains
in violation, a fine will be entered in the amount of TWO HUNDRED AND FIFTY DOLLARS
250.00) per day beginning on August 26, 2022 and continuing to accrue daily until the violation is
brought into compliance. The Respondent shall be responsible to provide notice of such violation
being corrected to the Code Enforcement Officer.
3.The Clerk of the Code Enforcement Board may be directed to record a certified copy of
this Order in the public records for Seminole County, Florida, which shall constitute notice to any
subsequent purchasers, successors in interest, or assigns of the subject property, and the findings herein
shall be binding upon the Respondent, any subsequent purchasers, successors in interest, or assigns. If
this Order is recorded and is complied with by the date specified herein, an Order acknowledging
compliance shall likewise be recorded in the public records. A hearing is not required to issue such an
order acknowledging compliance with the original order.
4.Any and all future recurrence(s) of any violation(s) addressed herein, after same have been
corrected, shall necessitate further proceedings before the Board. While the Code Enforcement Officer

shall give the Respondent notice of the repeat violation, the Code Enforcement Officer is not required to

repeat violation(s)exist(s),may impose a fine not to exceed Five Hundred Dollars ($500.00) for each day
the repeat violation continues, beginning with the date the repeat violation is found to have occurred by
the Code Enforcement Officer.
5. The Code Enforcement Board hereby reserves the right to take further necessary action
against the Respondent to enforce this Order in accordance with Section 162.09,Florida Statutes,and City
of Winter Springs Code, Chapter 2,Article III, Division 2.

police department officers provided sworn testimony and photographs relative to the violations, including
that an overabundance of cat feces, filth, contamination and an overwhelming odor in the home caused
unsanitary conditions (Photo 1) and prompted the building official to post the property as unsafe for
occupancy due to toxic fumes and prohibit the occupancy thereof on or about November 20, 2021 (Photos
3, 5); interior air quality measurements prompted the Seminole County Fire Department Hazmat Unit to
deem the interior of the residence unsafe for short term exposure (Photos 2,3); an accumulation of trash
and garbage was present throughout in the interior and exterior of the property(Photos 4, 5); a main water
supply line to the residence was broken (Photo 6); and significant amounts of miscellaneous junk and
trash existed on the porch outside of the residence (Photos 7, 8).
Conclusions of Law
7.That based on the testimony and evidence presented, including testimony and photographs
presented by the code enforcement and police department officers depicting unsanitary conditions inside
the home to include an overabundance of cat feces, filth, contamination, overwhelming odor, and toxic
fumes (Sec. 108.1.3, IPMC); interior air quality measurements causing the home to be deemed unsafe for
short term exposure and posted as unfit for and prohibiting occupancy (Sec. 109.1, IPMC); the
accumulation of trash and garbage in the interior and exterior of the property(Sec. 307.1,IPMC); a broken
main water supply line to the residence (Sec. 504.1, IPMC); and significant amounts of junk and trash
outside of the residence (Sec. 13-2(b), City Code), all of which remains beyond the compliance date set
forth in the Notice of Violation, Respondent violated Sections 108.1.3 Structure Unfit for Human
Occupancy, IPMC; 109.1 Imminent Danger (Toxic Fumes), IPMC; 307.1 Accumulation of Rubbish or

BASED UPON THE FOREGOING FACTS AND CONCLUSIONS, IT IS HEREBY
ORDERED:
1.The Respondent be given until August 26, 2022 to correct the violations of the City Code
on the Property. The Respondent shall be responsible to provide notice of such violations being corrected
to the Code Enforcement Officer.
2.If the Respondent fails to correct the violations within the time period set forth herein, the

Code Enforcement Officer shall schedule a compliance hearing before the Code Enforcement Board and
Respondent shall be duly noticed and given an opportunity to appear and present evidence as to the status
of the violations on the Property.Upon a finding by the Code Enforcement Board that the Property remains
in violation, a fine will be entered in the amount of TWO HUNDRED AND FIFTY DOLLARS
250.00) per day beginning on August 26, 2022 and continuing to accrue daily until the violations are
brought into compliance. Further, following the August 26, 2022 date specified for correction, the Code
Enforcement Board authorizes the City to, in accordance with Section 13-4, City Code, correct the
violations by performing or contracting for the necessary work to be performed to secure the Property or
render it safe, and to impose a lien for the costs and expenses incurred.
3. The Clerk of the Code Enforcement Board may be directed to record a certified copy of
this Order in the public records for Seminole County, Florida, which shall constitute notice to any
subsequent purchasers, successors in interest, or assigns of the subject property, and the findings herein
shall be binding upon the Respondent, any subsequent purchasers, successors in interest, or assigns. If
this Order is recorded and is complied with by the date specified herein, an Order acknowledging
compliance shall likewise be recorded in the public records. A hearing is not required to issue such an
order acknowledging compliance with the original order. The Respondent shall be responsible to
provide notice of such violations being corrected to the Code Enforcement Officer.
4. Any and all future recurrences) of any violation(s)addressed herein, after same have been
corrected, shall necessitate further proceedings before the Board. While the Code Enforcement Officer
shall give the Respondent notice of the repeat violation, the Code Enforcement Officer is not required to
provide Respondent a reasonable time to correct such repeat violation(s). The Board, upon finding such
repeat violation(s)exist(s),may impose a fine not to exceed Five Hundred Dollars ($500.00) for each day
the repeat violation continues, beginning with the date the repeat violation is found to have occurred by
the Code Enforcement Officer.
5. The Code Enforcement Board hereby reserves the right to take further necessary action
against the Respondent to enforce this Order in accordance with Section 162.09,Florida Statutes,and City
of Winter Springs Code, Chapter 2,Article III,Division 2.

[A] 109.1 Imminent danger. When, in the opinion of the code official, there is imminent
danger of failure or collapse of a building or structure which endangers life, or when any
structure or part of a structure has fallen and life is endangered by the occupation of the
structure, or when there is actual or potential danger to the building occupants or those in
the proximity of any structure because of explosives, explosive fumes or vapors or the
presence of toxic fumes, gases or materials, or operation of defective or dangerous
