Roll Call: Chairperson Kok Wan Mah, present Vice-Chairperson Michael Ferrante, present Board Member Mark Gordon, present Board Member Kenneth Spalthoff, present Assistant City Attorney Kristin Eick, present City Clerk Christian Gowan, present A moment of silence was followed by the Pledge of Allegiance. No changes were made to the Agenda. AWARDS AND PRESENTATIONS 100. Not Used INFORMATIONAL AGENDA 200. Not Used PUBLIC INPUT Chairperson Mah opened Public Input. No one addressed the Board. Chairperson Mah closed Public Input. CONSENT AGENDA 300)Approval of the Thursday, June 2, 2022 Planning and Zoning/Local Planning Agency Regular Meeting Minutes. "MOTION TO APPROVE THE MINUTES OF JUNE 2, 2022 AS PRESENTED." MOTION BY VICE-CHAIRPERSON FERRANTE. SECONDED BY BOARD MEMBER GORDON. DISCUSSION. VOTE: SPALTHOFF (AYE); GORDON(AYE); FERRANTE(AYE); MAH (AYE) MOTION CARRIED 4-0. Brief discussion about typographical errors in the roll call and motion. Mr. Gowan noted that the changes would be made. "MOTION TO APPROVE SEPTEMBER 1, 2022 PLANNING AND ZONING/LOCAL PLANNING AGENCY REGULAR MEETING MINUTES WITH CORRECTIONS TO TYPOGRAPHICAL ERRORS." MOTION BY BOARD MEMBER GORDON. SECONDED BY BOARD MEMBER SPALTHOFF. DISCUSSION. VOTE: SPALTHOFF (AYE); GORDON (AYE); FERRANTE (AYE); MAH (AYE) MOTION CARRIED 4-0. PUBLIC HEARINGS AGENDA 400)Consideration of Ordinance 2022-04 amending Section 20-323 of the City Code to amend the list of permitted uses in the Town Center District Code, specifically in the T4 and TS Transects. Mr. Nick Tafelsky, Senior City Planner, Community Development Department introduced the item and noted he was available for questions. Discussion followed on overnight boarding prohibitions and the possibility of including language that would permit overnight holding for medical observation. Attorney Eick reviewed the definition of boarding and opined about clarifying language that would specify indoor holding for the purposes of medical observation. Brief discussion followed on enforceability. Chairperson Mah opened the Public Hearing Mr. Talbert Jackson, 244 Holiday Lane, Winter Springs noted the importance of emergency planning for veterinary clinics if evacuations were ever needed. Chairperson Mah closed the Public Hearing MOTION TO RECOMMEND APPROVAL OF ORDINANCE 2022-04 TO THE CITY COMMISSION WITH PROPOSED RECOMMENDATIONS REGARDING OVERNIGHT BOARDING. MOTION BY BOARD MEMBER GORDON. SECONDED BY VICE- CHAIRPERSON FERRANTE. DISCUSSION. VOTE: SPALTHOFF (AYE); GORDON (AYE); FERRANTE (AYE); MAH (AYE) MOTION CARRIED 4-0. REGULAR AGENDA 500. Not Used CITY OF WINTER SPRINGS,FLORIDA MINUTES PLANNING AND ZONING BOARD/LOCAL PLANNING AGENCY REGULAR MEETING-OCTOBER 6,2022 PAGE 3OF3 REPORTS Chairperson Mah noted he was grateful for the City's fast response and work continuing to be done related to the recent hurricane, asked for a Sunshine Law review to be conducted when a fifth Board Member was appointed, and asked the Attorney if a review of different hearing types and permitted considerations could be reviewed at a future meeting. PUBLIC INPUT Chairperson Mah opened Public Input. No one addressed the Board. Chairperson Mah closed Public Input.
