HomeMy WebLinkAbout2023 04 10 City Commission Workshop Minutes CITY COMMISSION Incorporated 1959 WORKSHOP '' MINUTES MONDAY, APRIL 109 2023 AT 5:30 PM CITY HALL- COMMISSION CHAMBERS 1126 EAST STATE ROAD 434, WINTER SPRINGS, FLORIDA CALL TO ORDER Mayor Kevin McCann called the City Commission Workshop of Monday, April 10.2023 to order at 5:33 PM in the Commission Chambers of the Municipal Building (City Hall,1126 East State Road 434,Winter Springs, Florida 32708). Roll Call: Mayor Kevin McCann, present Deputy Mayor Rob Elliott, present Commissioner Matt Benton, present Commissioner Victoria Colangelo, present Commissioner Ted Johnson, present Commissioner Cade Resnick, present Interim City Manager Phil Hursh, present City Attorney Anthony A. Garganese, present City Clerk Christian Gowan, present A moment of silence was held followed by the Pledge of Allegiance. There were no changes made to the agenda. PUBLIC INPUT Mayor McCann opened Public Input Ms. Iris Mennens, 7457 Creekside Circle, Winter Springs noted a letter she sent requesting assistance and the financial burden the cost share was to HOAs. Ms. Mennens noted that she appreciated the Commission's consideration. Mr. Tim Harper, 7459 Creekside Circle, Winter Springs thanked the Commission for their attention to this issue and Staff, thought communication was important and could be improved. Mayor McCann closed Public Input. DISCUSSION ITEMS 1) NRCS Sheet Pile Wall Update Interim Manager Hursh introduced Mr. David Hamstra, Pegasus Engineering to provide a Stormwater Briefing update and review NRCS projects. Mr. Hamstra reviewed funding,focusing on the 25% local match divided currently among the City and HOA/Homeowners, noted meetings held with HOAs, and briefly reviewed Hazard Mitigation Grant Program (HMGP) projects. Mr. Hamstra noted there was a competing public purpose, explained the City match for NRCS would be about$482,713 compared to $987,290 from HOAs and homeowners. For FEMA and the HMGP projects,the City would be responsible for, $1,872,500 and $1,157,123 would be required from private homeowners. Mr. Hamstra noted NRCS projects focused on prevention of sedimentation within Howell Creek and noted FEMA (HMGP) projects were focused on prevention of structural flooding, sanitary sewer back-up, and protection/safety of First Responders and City Staff. Discussion followed on the public purpose and benefit of the proposed projects. Attorney Garganese explained the City does not expend public dollars for private interests and spoke about the need for an identifiable public interest involved. Further discussion followed on the timeline associated with obtaining NRCS funding,the CITY COMMISSION MINUTES I WORKSHOP . . responsibility of the Commission to make a determination regarding public purpose, alternatives to the proposed sheet pile walls, and the potential of obtaining easements along the waterways. In response to questions from the Commission, Mr. Hamstra noted that alternative methods to the sheet wall existed, but explained that the grant funding impacted what solutions were considered and a focus on longevity. Regarding easements,Attorney Garganese noted the process and potential impacts on the timeline. Further discussion followed on maintenance liability, how sheet walls improve the functioning of stormwater,the need for a watershed approach and approaching Seminole County for assistance, appropriate use of federal funds, and potential partners. Mr. Hamstra reiterated the timeline for decisions to be made and noted final decision would be needed within 4-6 weeks. Further discussion about discussions with County Commissioners,the possibility of creating an assessment district,the amount of time the assessment district process required, and upcoming meetings with the St.Johns River Water Management District (SJRWMD) and other groups. Mayor McCann encouraged the Commission to continue to work on this issue and find solutions. Discussion followed on other large projects occurring in the City, difficulty explaining the public good of projects, creek maintenance, and general maintenance responsibilities. PUBLIC INPUT Mayor Kevin McCann opened Public Input. Ms. Gina Shafer, Winter Springs Village, Winter Springs noted communication with County Commissioner, thought stormwater fees could be used for these projects, and spoke about easement leasing options. Ms. Marie Cashion, 7529 Woodsglen Drive, Winter Springs spoke about her neighborhood in Chelsea Parc, steep drop-offs, and erosion concerns. Mr.Joe Wallace, 227 President Howell Creek HOA, noted his experience working with SJRWMD and encouraged reaching out early to determine what was needed should the projects move forward. Mr. Tim Lansbury, Treasurer, Howell Creek HOA spoke about maintenance and repair considerations and shared concerns about the wall and property values. Mr.Art Gallo, 799 Nandina Terrace, Winter Springs spoke about the public match and didn't think the HOA or homeowners were required to contribute. Mr. Kevin Cannon, PO Box 795447, Winter Springs spoke about the possibility of establishing an MSBU or stormwater fee modification to fund these projects. Mayor Kevin McCann closed Public Input.
