A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, REQUESTING
THAT THE FLORIDA DEPARTMENT OF TRANSPORTATION
REDUCE THE SPEED LIMIT TO 45 MPH ALONG A STRETCH OF
STATE ROAD 434 FROM STATE ROAD 419 TO STATE ROAD 417
CONSISTENT WITH THE EXISTING POSTED SPEED LIMIT OF 45
MPH ALONG THE OTHER PORTIONS OF STATE ROAD 434
LOCATED WITHIN THE JURISDICTIONAL LIMITS OF THE CITY OF
WINTER SPRINGS, FLORIDA; PROVIDING FOR THE REPEAL OF
PRIOR INCONSISTENT RESOLUTIONS, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS,the City is granted the authority,under§2(b),Art.VIII of the State Constitution,
to exercise any power for municipal purposes, except when expressly prohibited by law; and
WHEREAS, portions of State Road 434 traverse though the jurisdictional limits of the City
of Winter Springs and serve as the City's main east-west corridor (hereinafter "SR 434"); and
WHEREAS, the existing speed limit established by the Florida Department of
Transportation (hereinafter "FDOT") for SR 434 within the jurisdictional limits of Winter Springs
are inconsistent, in that the eastern and western portions of the City have a posted speed limit of
45 MPH and the portion generally located within the center of the City from SR 419 to SR 417 has
a posted speed limit of 50 MPH; and
WHEREAS, a major portion of SR 434 with the higher speed limit of 50 MPH actually
traverses through the City's Town Center which in accordance with the City's Comprehensive Plan
is intended and designed to be more pedestrian friendly; and
WHEREAS, the existing 50 MPH speed limit within the Town Center is inconsistent with
the City's Town Center goals and polices set forth in the Comprehensive Plan; and
WHEREAS, the inconsistent and higher speed limit of 50 MPH along portions of SR 434
within the jurisdictional limits of the City is also a serious traffic safety concern for the City
Commission and citizens of Winter Springs, and causes confusion with drivers and law
enforcement; and
WHEREAS,the City Commission strongly desires that the speed limit along SR 434 within
the jurisdictional limits of the City be consistent and any existing areas posted as 50 MPH should
be immediately lowered to 45 MPH to achieve consistency and improve safety; and
WHEREAS, City Commission deems that this Resolution is in the best interests of the
public health, safety, and welfare of the citizens of Winter Springs.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY

OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, THAT:
Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and
correct and are hereby fully incorporated herein by reference.
Section 2. Reduce SR 434 Speed Limit to 45 MPH. For the reasons expressed in
the recitals, the City Commission hereby respectfully requests that the posted speed limit along
State Road 434 from State Road 419 to State Road 417 be reduced from 50 MPH to 45 MPH.
The speed limit along State Road 434 within the jurisdictional limits of the City of Winter Springs
should be a consistent to the lowest existing speed limit of 45 MPH.
Section 3. Distribution. The City Clerk is hereby instructed to provide an executed
copy of this Resolution to the FDOT District 5 Secretary, John E. Tyler, 719 South Woodland
Boulevard, Deland, Florida 32720, State Representative David Smith, 1151 E. State Road 434,
Suite 2001 #266, Winter Springs, Florida 32708, and State Senator Jason Brodeur, 922 Williston
Park Point, Suite 1300, Lake Mary, Florida 32746, and such other persons deemed appropriate by
the City Manager.
Section 4. Severability. If any section, subsection, sentence, clause, phrase, word,
or portion of this Resolution is for any reason held invalid or unconstitutional by a court of
competent jurisdiction, whether for substantive or procedural reasons, such portion shall be
deemed a separate, distinct, and independent provision, and such holding shall not affect the
validity of the remaining portions of this Resolution.
Section S. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts
of resolutions in conflict herewith are hereby repealed to the extent of the conflict.
Section 6. Effective Date. This Resolution shall become effective immediately upon
its adoption by the City Commission of the City of Winter Springs, Florida.
ADOPTED UNANIMOUSLY by the City Commission of the City of Winter Springs, Florida,
in a regular meeting assembled on this 14" day of November, 2022.
