SUMMARY The applicant, Equinox Development, is proposing a ± 9.88 acre commercial retail project located at the SW corner of S.R. 434 and Tuskawilla Road (former Pinch A Penny Site). The subject property currently holds a Future Land Use (FLU) Designation of Town Center and a Zoning District of Town Center (T5). The proposed commercial project includes six (6) buildings, ranging from 2,325 sq. ft. to 19,209 sq. ft.. The total commercial square footage will be ± 58,000 square feet. The commercial retail shall include a grocer, a gym, fast food, office, and general commercial. The commercial retail project will be designed per Town Center Code while utilizing design elements from the recently constructed Town Center Starbucks. At this time, the applicant intends to meet all applicable Town Center code provisions. An incomplete application will not be processed and will be returned to the applicant. The application shall be reviewed per Chapter20—Zoning See.20-28.1.1. The sufficiency review shall be completed within thirty(30)calendar days. Applicants are advised that an optional preliminary review is intended to be an initial non-binding, courtesy review process. The Non-binding preliminary review process is not subject to appeal because no final action is taken by the City. In addition, the City Commission reserves the unconditional right not to enter into a development agreement and such decision is not subject to appeal. This non-binding and preliminary review shall not be relied upon by the applicant as a final decision and shall not be construed in any manner as creating any vested right or entitlement for the development of the subject property. By requesting and participating in the optional preliminary review process, the applicant shall be deemed to have read and agreed to this code provision and to hold the city and its officials harmless for any future actions they may have taken based on the results of a preliminary review pursuant to this section.
