HomeMy WebLinkAbout2021 12 13 Regular 500 - Non-Binding Preliminary Review for Lake Emma Properties, LLC • REGULAR AGENDA ITEM 500 ,n m=ared CITY COMMISSION AGENDA I DECEMBER 13, 2021 REGULAR MEETING 1959 TITLE Non-Binding Preliminary Review for Lake Emma Properties, LLC SUMMARY Lake Emma Properties, LLC is proposing a ± 10.11 acre residential development located northwest of Tree Swallow Drive and east of Michael Blake Boulevard, Winter Springs. The proposed project is bordered on the south by the Cross Seminole Trail and the north by Winter Springs Village. The proposed development includes forty (40) attached rear-loaded and front- loaded garage townhomes. The concept plan illustrates six (6) buildings, ranging from four (4) units up to eight (8) units and a proposed community recreation area. The subject property currently holds a Future Land Use (FLU) designation of Town Center and a zoning designation of Town Center (T3). An incomplete application will not be processed and may be returned to the applicant.The application shall be mvieweid perQuipter 20—Zimigg Sec.24-28.1.1. The sufficiency review shall be completed within thirty(30)business days. Once the application is found sufficient, it may be scheduled for the City Commission. The Non-Binding Preliminary Review shall be scheduled a minimum of fourteen (14)days prior the City Commission. Applicants are advised that an optional preliminary review is intended to be an initial non-binding, courtesy review process. The Non-binding preliminary review process is not subject to appeal because no final action is taken by the City_ In addition, the City Commission reserves the unconditional right not to enter into a development agreement and such decision is not subject to appeal. This non-binding and preliminary review shall not be relied upon by the applicant as a final decision and shall not be construed in any manner as creating any vested right or entitlement for the development of the subject property. By requesting and participating in the optional preliminary review process, the applicant shall be deemed to have read and agreed to this code provision and to hold the city and its officials harmless for any future actions they may have taken based on the results of a preliminary review pursuant to this section.
