CALL TO ORDER
Deputy Mayor Ted Johnson called the Regular Meeting of Monday, March 22, 2021 of
the City Commission to order at 6:30 p.m. in the Commission Chambers of the
Municipal Building (City Hall, 1126 East State Road 434, Winter Springs,
Florida 32708).

AWARDS AND PRESENTATIONS
100) New Wastewater Plant Presentation
March Commission Presentation - New WWTP
Mr. Rob Nicholas, Veolia, presented on upcoming decisions related to a new
wastewater plant, showed a schedule and noted the City was currently finalizing a
facility plan and preparing to do a rate study. Mr. Nicholas noted thatthe Commission
had the procurement of a preliminary engineer on the Consent Agenda. Continuing,
Mr. Nicholas presented several site decision options and noted that the existing
plants must be kept running. A sequencing plan was presented to show efforts to
avoid issues and control odors. Mr. Nicholas noted that preliminary engineering
reports on potential lift station replacement, reuse expansion, and increasing
pressure would help inform decisions going forward.
Mr. Dale Smith, Director, Public Works and Utilities noted that Veolia is not involved
in construction and they would only be partners in operating the plants.
Manager Boyle noted that this process would be an advertised, public bid process in
accordance with state statutes that would likely draw many national firms.

101) Best Foot Forward Presentation
Best Foot Forward Presentation
Mr. Christopher Schmidt, Director, Community Development Department
introduced Ms. Emily Hanna, Executive Director, Bike Walk Central Florida to discuss
Best Foot Forward.
Ms. Hanna reviewed the mission, partnerships, and projects that the organization has
completed, noted a report listing the Orlando area as the most dangerous
Metropolitan Statistical Area (MSA), and reviewed low-cost engineering changes
identified through observation, data collection efforts, crosswalk audits, and online
resources.
Discussion followed on the involvement of the Winter Springs Police Department.
Chief Chris Deisler, Winter Springs Police Department noted the agency had
participated with Best Foot Forward previously and that they planned to remain
actively involved with the program.
Further discussion followed on the possibility of expanding the focus of the program
to look at enforcement on bike trails and the possibility of interactive education
experiences.
102)Stormwater Action Plan Presentation
Stormwater Action Plan
Mr. Schmidt and Mr. Kevin Monser, Stormwater Manager, Community Development
Department presented on the Stormwater Action Plan.
Mr. Schmidt reviewed permit inspection requirements and noted the City was in
compliance with MS4 permit requirements. Continuing, Mr. Schmidt showed City
pollution control boxes, major outfalls, grass swales, inlets and catch basins, and
outfall structures and noted the City's utilization of GIS for asset management.
Mr. Monser discussed projects that have been completed by the City stormwater
team. Mr. Schmidt noted that in the future, equipment may come before the
Commission to increase efficiency and allow for even more to be done.
Manager Boyle noted previous discussions about comprehensive reviews of
departments and assessing needs and commended the stormwater team.
Further discussion followed on the savings achieved by doing this work in-house and
other projects happening around the City.

103)Senior Center Reopening Plan
Ms. Casey Howard, Director, Operations Department reviewed Senior Center
renovations and detailed fluid plans for reopening. Ms. Howard noted that staff was
in constant communication with Seminole County and State officials and noted that
a Phase 1 opening was slated for mid-April. Ms. Howard noted that Senior Center
Manager Julie Trujillo had been in contact with the Senior Center Association and
that a reopening would include limited capacity, and free swim time slots and noted
that safety remained the primary concern.
Ms. Trujillo showed photos of work completed over the last year at the Senior Center.
Further discussion followed on coordination with instructors, in-house renovations,
and safety measures that would be in place upon reopening. The Commission
complimented the great work and renovations done at the Senior Center
ADD ON 1041 Update on Marketplace Project
Mr. Schmidt noted previous approval of the Winter Springs Marketplace project,
requirements for certain studies related to endangered species, and noted that no
bald eagles were noted on the site.

200) Employee Service Awards

PUBLIC INPUT
Mr. Jim Thompson, 931 Ginnie Way, Winter Springs noted he had lived in Winter
Springs 23 years, seen lots of change, noted involvement during Blake Apartments
project and that he thought the current Commission was doing a great job.
Rowa//s, 7232 Orange Ave, Winter Springs asked about a lot clearing that was
happening near his house, noted he had seen no signs, and asked if he was allowed
to cut trees without a permit.
Discussion followed with Mr. Schmidt noting that Code Enforcement was aware of
this issue and he explained that no application was active on this site to his
knowledge.

Further discussion followed on the possibility of a stop-work order being issued and
Attorney Garganese noted that this was theoretically possible under the tree
ordinance.
Mr. Phillip Kaprow, 7005Antelope Trail, Winter Springs noted that the Oviedo-Winter
Springs Capitol Connection Trip was occurring and asked if any Commissioners were
interested in attending. Mr. Kaprow also mentioned recent bylaw changes, which
now allowed governing bodies to determine attendees as ex-officio members.
Discussion followed about previous attendance and handicap accessibility.
Mr. Maurice Kaprow, PO Box 795233, Winter Springs thanked the Commission for
their work and noted his long attendance at Commission meetings and his
involvement on City Boards. Mr. Kaprow discussed changes over the years and said
he believed the Commission listened to residents and this Commission has been
addressing residents concerns. Lastly, Mr. Kaprow asked everyone to pull together
and back the Commissioners or run in the next election.
Mr. Ken Spalthoff,337 Wooded Vine Drive, Winter Springs, agreed with Rabbi Kaprow,
- congratulated Winter Springs on their report card (A), noted review of budget and
looking good. Mr. Spalthoff thanked Manager Boyle for his work and the City Staff
and noted seeing Commissioners out in the community.
Ms. Gina Shafer, Winter Springs Village, Winter Springs was saddened by mean
comments going around, noted she had attended a lot of meetings and that she felt
listened to by this Commission, not disrespected. Ms. Shafer said she believed past
officials did not respect water or trees and that voters made their decision in last
election.
Ms Dolly Ames, 750 Third Street, Winter Springs thanked the Commissioners for
doing an outstanding job as elected officials.

Discussion followed on the great aspects of Winter Springs, comments on social
media and in the Orlando Sentinel, and efforts to meet and listen to residents.
Continuing, the discussion turned to the attempted temporary moratorium on high-
density development that was vetoed, visioning sessions and working to enact the
will of the residents.
Commissioners asked that the community ignore negative comments, disavow
falsehoods, and remain engaged.

Further discussion followed on concerns about campaign contributions from

2018 campaign finance reports from former Mayor Charles Lacey and asked that they
be included in the minutes.

501)Waste Pro Contract Renewal

Solid Waste Renewal
Ms. Maria Sonksen, Director, Finance Department provided an update on the Waste
Pro contract negotiations, noted no change in terms, and showed comparison to
other Seminole County cities in rates paid to Waste Pro. Ms. Sonksen noted that
Longwood was closest in terms of service. Ms. Sonksen discussed other cities that
went out for bid and recommended staying with Waste Pro.
Ms. Sonksen noted that Staff would suggest a five (5) year term with three (3) one-
year renewal options.
Discussion followed on the rates enjoyed by Winter Springs residents and the
Commission agreed that Staff should move forward with negotiating a long-term
contract.

Resolution 2021-02 Vacancy Mayor Lacey Resignation .
Deputy Mayor Johnson asked Attorney Garganese for guidance on Resolution 2021-
02 and the process going forward.
Attorney Garganese noted Former Mayor Lacey's resignation created a vacancy and
that per the City Charter, the City Commission had two (2) meetings to make an
appointment to serve the remaining portion of the term, scheduled to expire in 2022.
Attorney Garganese noted there would be no need to hold a Special Election as it
would coincide with the normal election of the Mayor. Attorney Garganese then
reviewed past processes, noting the Commission had received and accepted
resignations thus beginning the clock for when an appointment must be made.
Attorney Garganese note that Resolution 2021-02 proposed to officially recognize
Former Mayor Lacey's resignation and declare a vacancy in the Office of the Mayor.
It was noted that the City Commission had discretion on how to proceed and
Attorney Garganese noted that in previous situations the City had published a notice
and attempted to seek qualified candidates to submit applications to be reviewed
and decided upon by the Commission.
Discussion followed on the process followed in 2018, including advertising the
vacancy and requiring interested individuals to submit an application. Attorney
Garganese noted the City Clerk's Office would go through ha qualifying period to
determine eligibility to serve but that the ultimate decision would be with the City
Commission.
Further discussion followed on the number of meetings to fill the vacancy. Attorney
Garganese noted the Charter is silent on when the clock begins to fill the vacancy
and reiterated that previously the Commission has accepted a resignation, declared
the vacancy, and two (2) meetings from when that occurred would be the deadline.
Discussion then followed on the ability to speak with applicants and the
establishment of a deadline for applications.
The Commission agreed that applications would be accepted from Tuesday, March
23, 2021 at 12PM Noon to Thursday, April 1, 2021 at 12 PM Noon and that applications
should be forwarded, upon verification of residency and voter status, to the
Commission for their review.
Clerk Gowan asked about the swearing-in of the individual that would be chosen and
if it would occur at the same meeting. Commissioners suggested swearing-in the
appointee at the end of the meeting so that they could have some time to get
familiar with processes.

Further discussion followed including the section of the City Charter, Section 4.05,
which details the duties of the Mayor so that applicants could review this
information.

600)City Manager Shawn Boyle
• Noted the City's Arbor Day Tree Giveaway had received over 600 requests to
date and encouraged residents to sign up.
• Recognized Board of Trustees Members and noted that the pension earned 8.5
million dollars in last 60 days and that these returns would take the burden off
the taxpayer. Manager Boyle noted the pension would be 100% funded for the
first time in the history of Winter Springs.

• Thanked the residents for showing up and noted that she would continue to
serve to the best of her ability.
• Noted appreciation for City Staff
• Noted the upcoming Easter Egg Hunt on Saturday, March 27, 2021 and noted
that it was already sold out.

• Expressed appreciation for positive comments shared today.
• Noted he would be in attendance at the egg hunt on Saturday.
PUBLIC INPUT
Mr. Kevin McCann, 1109 Pheasant Circle, Winter Springs noted that he was President
of theTuscawilla Homeowners Association other involvement which started because
he had seen things he didn't like. He noted there was a lot to be proud of and
commended the Commissioners and expressed appreciation. Lastly, he asked
people to work together and to turn the page on negative comments.
Ms. Gina Shafer, Winter Springs Village, Winter Springs thought Waste Pro did a
great job, noted appreciation for the Commission approving the continuation of
partnering with them. Ms. Shafer noted the Public Works team quickly addressed a
sidewalk issue and thanked Manager Boyle. Finally, Ms. Shafer encouraged people to
shop local.
Mr. Ron Ligthart, 1036 Winding Waters Circle, Winter Springs noted he is not on social
media, that he has seen some concerns over the years he has been a resident, and
said he didn't think it was fair to address people that didn't have a chance to respond.
Mr. Michael Radka, 423Sandringham Court, Winter Springs said he wouldn't be
filing an application to be Mayor, thanked the Commissioners for their work, and
noted that he had just signed up to receive his tree.

Please read the following comment during the first public input related to the resignation of
Mayor Lacey(item 503):
While itis the prerogative of the city commission to steer the process of selecting an interim
mayor, in light of the recent failures of the commission and growing distrust in its leadership
among residents, we strongly encourage the City to engage in a fully transparent and
deliberative selection process. We ask each commissioner to pledge not to appoint
themselves as Mayor, nor anyone who has recently held office or run for office or with
known political or professional ties to a commissioner. We need a fresh voice and new
direction. Given our City's failures with water quality, unprecedented environmental damage
resulting in the fish kill, odor issues, 13 DEP violations since the Flint Water company took
over,traffic and development concerns, toxic work environment in city Hall and persistent
talent drain among staff,we need an outside perspective now more than ever. I emailed this
request to each commissioner and as of 2pm, did not receive a even a courtesy reply or
acknowledgement of receipt.

My name is Dr. Kurt Miericke and I have been a resident of Winter Springs since July 1997. 1 am the past
President and a current Director of the Chelsea Woods Home Owners Association. I am Vice-President
of the Tuscawilla Home Homeowners Association and have been a Director since 2007. 1 am also a
member of the Winter Springs Rotary Club. I would like to thank Mayor Lacey for his years of service to
our community. However I do want to go on record that I strongly support the current Winter Springs City
Commissioners and the direction that they are leading our wonderful community. They each were
elected to serve after listening to the needs and concerns of our community. We are fortunate to have
them.

To Whom It May Concern
I am David Price, a resident of Winter Springs since 2011. My
wife and I moved here because it is, and has, a small-town
friendly atmosphere of predominately single-family homes.
The rise of condos/apartments in Winter Springs, along 434 as
an example, is concerning! Many of the past city
commissioners obviously supported the buildup. Thanks to the
practical and future looking current Commissioners a stop to the
large apartment and condo development has stopped. They now
have focused on what is important to the residents, clean water
and "up to standard" wastewater treatment plants.
Charles Lacey's article in today's Orlando Sentinel, March 22,
is almost laughable. Lacey has not been a leader but a puppet
for the likes of Greenberg, who desperately wanted to be elected
again on the council. Lacey's comments reflect an individual
who is bitter and no longer interested in working with the
council members, nor interested in doing what is right for the
Winter Spring residents.
Our current Commissioners were elected by large margins. This
should have been a message to Mr. Lacey and his supporters that
an uncontrolled building development is not acceptable to the
Winter Springs residents!

My name is Beverly Egan I am a resident of Hacienda Village and I am also the board president of
Hacienda Village. We as a community of over 400 homes have been extremely happy with the
representation we have from the current commissioners especially Ted Johnson. I know that if we
need anything or have any questions I can call Ted and he will return my call or stop by to discuss
or needs. I have talked with him and several of the past and newer commissioners about how I
feel Winter Springs should handle future growth. We should concentrate more on single family
homes, condos and townhomes. Developments that promote home ownership because the past
city officials seemed to concentrate on larger apartment developments that are rental properties.
These larger properties are a strain on our facilities such as water and sewer services, roads and
schools. Good business developments with some commercial type of industries as well as some
type of technology or medical type of industries should also be pursued. I believe the
commissioners we have are listening to the people who wants us as a city to be more restrictive
and selective as to how we develop our community.Thank you for listening.

To Whom It May Concern:
Due to a previously scheduled client engagement, I cannot attend this evening's Commission meeting. Otherwise, I
would, because I'd certainly like to gain a better understanding about the nature of apparent discord between current
and/or former City leadership. In the interest of full disclosure, I currently serve the City of Winter Springs as Chairman
of the Board of Trustees(Pension Advisory Board).
Of late, meaning the past two months, I've received several unsolicited emails from a self-described community
association which highlights what it perceives as shortcomings in the priorities and abilities of the current City of Winter
Springs administration and the City Commissioners. I don't know this association's founders personally, but on some
level I appreciate that a group of citizens cares enough about what is happening in the City to produce a newsletter on
its own. However,the tone of the recent communications has a sharp edge that moves well beyond simply highlighting
issues and appears to be as much about attacking City leadership as it is to inform and opine. This is counter-
productive. I have no problem with genuine disagreements about City priorities—in fact,they are healthy—but there
are more appropriate and effective forums for meaningful reconciliation of these disagreements.
I was surprised by Mayor Lacey's recent resignation. He,too, has been very vocal recently about issues that he says
made it necessary to take this step. While I don't know him well, I've met him on several occasions and generally have a
favorable opinion of his service to the City, and because of that I listened to his comments with interest. I was struck by
the tone of his rhetoric and personal attacks on certain individuals. Whether one agrees with his assertions or not,there
are more appropriate forums and ways to articulate those concerns.
I moved to Winter Springs in 2004 and chose this area for the same reasons as many of you: good schools, low crime,
and overall good quality of life. Over the years,as I've availed myself of City services,gotten to know my local
representatives,and eventually volunteered time to serve on the Board of Trustees, I have gained an understanding
about how the City is run,and I must tell you it is run very well. City leadership with whom I work closely(including the
City Manager)and certain Commissioners whom I know well, are very focused on the operational issues and how they
affect the citizenry. Are there legitimate disagreements between various groups about priorities,funding,
etc? Sure. That is the nature of running any organization of size. But I am confident in saying that whatever the nature
of the disagreements, it isn't because current leadership doesn't care, isn't capable,and can't think independently. To
either insinuate or outright state otherwise is highly irresponsible.
As a citizen of Winter Springs, I'd like this to look a lot less like the municipal equivalent of the old television show
Survivor,where tribalism is the key to winning,and a lot more like an Amish barn-raising. People of good faith and
candor can come together to discuss their perspectives about what's best for the City and not resort to personal attacks
on those trying to make it better. We've got some important decisions to make that have long-term fiscal and
operational implications and it demands a cooperative approach. I respectfully ask those doing the attacking to be part
of the solution and leave the incendiary communications behind.
