+ , PUBLIC HEARINGS AGENDA ITEM 400 CITY COMMISSION AGENDA I JUNE 13, 2022 REGULAR MEETING TITLE The City Attorney and City Manager request that the City Commission consider accepting the Districting Commission's recommendation regarding an update of the City Commission voting district boundaries pursuant to Section 4.02 of the City Charter, and conduct First Reading of Ordinance No. 2022-05 approving the recommendation. SUMMARY Section 4.01(a) of the City Charter provides that there shall be a governing body composed of the mayor and five (5) commission members elected by the voters of the city as provided in this Charter. Not more than one (1) commission member shall reside in each of the five (5) commission districts provided for in Section 4.02 (a) of the Charter. The mayor shall be elected at large and may reside anywhere within the city. Section 4.02 of the City Charter requires that the City Commission appoint a Districting Commission for purposes of examining whether adjustments must be made to the City Commission voting district boundaries. On January 10, 2022, the City Commission appointed a Districting Commission pursuant to Resolution No. 2022-01. Further, the City retained the services of the East Central Florida Regional Planning Council (ECFPC) to assist City staff with providing technical assistance to analyze the population and voting age population within the existing five City Commission districts, and to prepare a report and related maps. The City Attorney provided legal guidance. On May 5, 2022 the Districting Commission timely examined the map prepared by the ECFPC and conducted a public hearing related to a proposed new City Commission Voting District Map. The Districting Commission recommended a revised City Commission Voting District Map which is attached as Exhibit"A"to Ordinance No. 2022-05. The proposed new map makes several adjustments to the boundaries of the existing City Commission Districts to account for population and voting age population changes since the last Districting Commission process in 2019. Based on legal guidelines regarding voting districts, the existing City Commission voting district boundaries are in essence being adjusted to rebalance population and voting age populations more equally within the five districts. A 2022 Redistricting Report explaining the process, methodology and boundary adjustments is attached to the Agenda Item for the City Commission's consideration. 1 The City Commission shall adopt the redistricting ordinance at least one hundred twenty (120) days before the next city election, which is November 8, 2022. If the City Commission fails to either accept or reject the redistricting ordinance recommended by the Districting Commission, the report of the Districting Commission shall go into effect and have the same effect of an ordinance. The proposed redistricting ordinance may not be rejected for any reason except for failure to comply with the specifications listed in Section 4.02 (c) of this Charter or failure to comply with other local, state or federal law. Section 4.02 provides: Section 4.02. - Commission districts; adjustment of districts. (a) Number of districts. The city commission of the City of Winter Springs, Florida, shall by separate ordinance divide the city into five (5) geographical commission districts. (b) Districting commission. By the first day of February, 1991, the first day of February, 1992, and every three (3)years thereafter, the city commission shall appoint seven (7) city electors determined from the registration of the last regular election, one (1)to be appointed by each commissioner from their respective district, and two (2) appointed by the mayor from the city at large, who shall comprise the districting commission. Electors chosen shall not be employed by the city in any other capacity. The initial districting commission, creating and establishing the first commission districts, shall be appointed by each commissioner and the mayor from the city at large. (c) Report;specifications. The districting commission shall file with the official designated by the city commission a report containing a recommended plan for establishment or adjustment of the commission district boundaries. The initial districting commission, creating and establishing the first commission districts, shall file such report within ninety(90) days of appointment. Thereafter, such reports shall be filed within one hundred twenty(120) days of appointment to the districting commission. The commission district boundaries shall comply with the following specifications: (1) Each district shall be formed of compact, contiguous territory, and its boundary lines shall follow the center lines of streets insofar as practical or possible, or other boundaries available. (2)The districts shall be based upon the principle of equal and effective representation as required by the United States Constitution and as represented in the mathematical preciseness reached in the legislative apportionment of the state. (3)The report shall include a map and description of the districts recommended and shall be drafted as a proposed ordinance. Once filed with the designated official, the report shall be treated as an ordinance introduced by a commissioner 2 (d) Support. It shall be the responsibility of the city manager to provide staff assistance and technical data to the districting commission. (e) Procedure. The procedure for the city commission's consideration of the report shall be the same as for other ordinances, provided that if a summary of the ordinances is published pursuant to this Charter and general law, it must include both the map and a description of the recommended districts. (f) Failure to enact ordinance. The city commission shall adopt the redistricting ordinance at least one hundred twenty(120) days before the next city election. If the city commission fails to either accept or reject the redistricting ordinance, the report of the districting commission shall go into effect and have the same effect of an ordinance. The proposed redistricting ordinance may not be rejected for any reason except for failure to comply with the specifications listed in Section 4.02 (c) of this Charter or failure to comply with other local, state or federal law. (g) Effect of enactment. The new commission districts and boundaries as of the date of enactment shall supersede previous commission districts and boundaries for all purposes; provided all incumbent commissioners shall continue to hold office for the entire term to which elected notwithstanding any change in commission district and boundaries. RECOMMENDATION The City Attorney and City Manager recommend that the City Commission consider accepting the recommendation made by the Districting Commission and pass Ordinance No. 2022-05 on First Reading. 3 ORDINANCE NO. 2022-05 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, ADOPTING THE MAP AND DESCRIPTION OF THE RECOMMENDED COMMISSION DISTRICTS FILED WITH THE CITY COMMISSION BY THE DISTRICTING COMMISSION PURSUANT TO SECTION 4.02 OF THE WINTER SPRINGS CITY CHARTER; PROVIDING FOR SEVERABILITY, REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS, AND AN EFFECTIVE DATE. WHEREAS, the City of Winter Springs City Charter requires that the City be divided into five(5)geographic voting districts for purposes of electing a City Commissioner from each district; and WHEREAS, in accordance with Section 4.02 of the City Charter, the City Commission is required to periodically appoint a districting commission to redraw the voting districts based on population and acceptable constitutional voting rights principals; and WHEREAS,the Districting Commission is required by City Charter to recommend a voting district map to the City Commission for consideration; and WHEREAS,the City Commission of the City of Winter Springs,Florida,hereby finds that the voting district map recommended by the Districting Commission on May 5, 2022 is acceptable and also finds that it is in the best interests of the citizens of Winter Springs to approve said map. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS,AS FOLLOWS: Section 1. Recitals. The foregoing recitals are true and correct and are fully incorporated herein by this reference. Section 2. Voting District Map. Pursuant to Section 4.02 of the Winter Springs City Charter, the City Commission hereby approves the voting district map recommended by the Districting Commission. Said Voting District Map is attached hereto as Exhibit "A" and hereby fully incorporated herein by this reference. Section 3. Future Elections. The Voting District Map approved hereunder shall be used by the City for all City Commission municipal elections occurring after the effective date of this ordinance. Section 4. Filing of Voting District Map with City Clerk. The Voting District Map City of Winter Springs Ordinance No. 2022-05 Page 1 of 2 4 shall not be codified into the City Charter or Code. However, a copy of the Voting District Map shall remain on file with the City Cleric's office for public inspection and/or copying. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction,whether for substantive,procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 6. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission,or parts ofprior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 7. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter. Pursuant to the City Charter, the City Commission shall have until July 11, 2022, which is one-hundred- twenty(120) days prior to the next city election, to adopt or reject a redistricting ordinance. SECTION IV. The Districting Commission's report shall be governed by the applicable provisions of the City Charter and other applicable law including,but not limited to,the provisions of the Voting Rights Act of 1965. In general and taking into account the current commission district boundaries,the City Charter requires that the commission district boundaries shall comply with the following specifications: (1) Each district shall be formed of compact, contiguous territory, and its boundary lines shall follow the center lines of streets insofar as practical or possible, or other boundaries available. (2) The districts shall be based upon the principle of equal and effective representation as required by the United States Constitution and as represented in the mathematical preciseness reached in the legislative apportionment of the state. (3) The report shall include a map and description of the districts recommended and shall be drafted as a proposed ordinance. Once filed with the designated official, the report shall be treated as an ordinance introduced by a commissioner. Additionally,to account for changes in population generated by new residential development since the 2020 U.S. Census, the technical assistance provided under Section V of this Resolution and the Districting Commission's recommendation shall be guided not by the issuance of development permits, but rather by the actual number of certificates of occupancy granted by the City for new residential dwelling units not previously accounted for by the U.S. Census. SECTION V. To the extent deemed reasonably necessary by the City Manager, the City Manager, City Clerk, and City Attorney, and their respective designees, shall provide technical assistance to the Districting Commission. SUMMARY On January 10, 2022, the City Commission adopted Resolution 2022-01 appointing members of the 2022 Districting Commission. Per the City Charter, the redistricting report must be filed within 120 days of the Districting Commission's appointment. For 2022, the report must be filed by May 10, 2022. Upon approval by the Districting Commission, the report must be presented to the City Commission in the form of an ordinance. The Commission must adopt the redistricting ordinance at least 120 days prior to the next city election. The next city election will take place on Tuesday, November 8, 2022, therefore the Commission must adopt the ordinance by July 11, 2022. Pursuant to federal law (see White v. Register, 412 U.S. 755, 764 [1973], and Brown v. Thomas, 462 U.S. 835, 842 [19831), voting districts must be nearly equivalent in population, with a deviation of no more than 10% in population (and voting age population) between the largest and smallest districts within a jurisdiction. Moreover, districts cannot be 5% larger or smaller than the "optimal" district population, as described later in this report. An overall range of less than 10% is considered an acceptable "minor deviation". Because it is 2022 and the Decennial Census was just completed one year late due to the COVID pandemic, it was an opportune time to use the latest Census tallies to reset the baseline population values. After each Decennial Census, population is tabulated, and the geographical distribution of a city may change. The Census Bureau adjusts the Census Block boundaries to reflect growth in the intervening years between the 10- year surveys. These boundaries are based on American Community Survey interim population estimates and the current Census Block boundaries were redrawn in 2019 for all parts of the country. With that, Winter Springs adopted Resolution No, 2022-01 to update the District boundaries. This resolution set the date of the adoption of new boundaries to July 11, 2022. The resolution restates the guiding principals of the City Charter which follows: SECTION Ill. The Districting Commission shall have until May 10, 2022, one-hundredtwenty(120)days from the effective date of this Resolution, to file with the City Manager a report containing a recommended plan for adjustment of the commission district boundaries. Pursuant to the City Charter, the City Commission shall have until July 11, 2022, which is one-hundredtwenty(120)days prior to the next city election, to adopt or reject a redistricting ordinance. SECTION IV. The Districting Commission's report shall be governed by the applicable provisions of the City Charter and other applicable law including, but not limited to, the provisions of the Voting Rights Act of 1965. In general and taking into account the current commission district boundaries, the City Charter requires that the commission district boundaries shall comply with the following specifications: (1) Each district shall be formed of compact, contiguous territory, and its boundary lines shall follow the center lines of streets insofar as practical or possible, or other boundaries available. 1 29 (2) The districts shall be based upon the principle of equal and effective representation as required by the United States Constitution and as represented in the mathematical preciseness reached in the legislative apportionment of the state. (3) The report shall include a map and description of the districts recommended and shall be drafted as a proposed ordinance. Once filed with the designated official, the report shall be treated as an ordinance introduced by a commissioner. Additionally, to account for changes in population generated by new residential development since the 2020 U.S. Census, the technical assistance provided under Section V of this Resolution and the Districting Commission's recommendation shall be guided not by the issuance of development permits, but rather by the actual number of certificates of occupancy granted by the City for new residential dwelling units not previously accounted for by the U.S. Census Methodology First and foremost, official current district boundaries must be obtained as a starting point. This GIS layer was gathered from the previous 2019 data report and contained the district boundaries and the district identification for each boundary. The 2020 Decennial Redistricting Data (PL 94-171) was recently released which was downloaded and processed into tabular format to link up with the 2020 Census Block boundaries provided by the Census TIGER GIS data. Before each Decennial Census, the current Blocks are assessed by the Census Bureau for new development and roads to determine if existing Blocks can be further divided. The Blocks are subdivided on physical features like roads and water bodies, as well as political features like city boundaries. As the City must update the district boundaries every three years, the methodology each time may be different. Currently, however, the recent Census survey data is timely and the most sought-after method to redraw district boundaries. The previous update in 2019 used residential parcels to redraw the district boundaries. By doing so, it is easier to draw boundaries based on population per household. However, the drawback is the boundaries may stray from road boundaries and water features, which Census Blocks follow. You can end up having a residential parcels being included individually on the other side of a street. This update resets the boundaries to only include Census Block boundaries which population has been accounted for. 2 30 After the districts were realigned in 2019, the voting age population distribution can be seen in the following table below. The ideal population number per district would have been 5776 and the deviations from that ideal are shown as well. District 1 and District 4 are over the 5% limit. This is determined by total city population divided by the number of districts. This 'ideal population' is the number that each district should be closest to. One unique aspect of Winter Springs redistricting, which may be a result of the required boundary analysis every three years, is the use of Certificates of Occupancy (CO) to determine population in the intervening years between the Census surveys. This was established in Resolution 2019-01. Going forward, it may be prudent to use these Certificates along with Census Bureau's American Community Survey (ACS), which occurs yearly. The American Community Survey (ACS) is an ongoing survey that provides vital information on a yearly basis about our notion and its people. Information from 4 32 the survey generates data that help determine how more than $675 billion in federal and state funds are distributed each year. Through the ACS, we know more about jobs and occupations, educational attainment, veterans, whether people own or rent their homes, and other topics. Public officials, planners, and entrepreneurs use this information to assess the past and plan the future. When you respond to the ACS, you are doing your part to help your community plan for hospitals and schools, support school lunch programs, improve emergency services, build bridges, and inform businesses looking to add jobs and expand to new markets, and more. The difference with the ACS survey is the counts are provided by Block Groups, which are larger than Blocks. However, along with CO data, a more accurate count can be established. This year, Certificates of Occupancy were gathered with dates after January of 2021. The reason for this is that the Census Survey was delayed by the COVID pandemic, which resulted in a shift of the surveys and completion data. A table was created from the Certificates and then they were geocoded from the addresses, which created points that can be overlaid onto other map layers. These points were aggregated into the new Census Blocks making up the City of Winter Springs. Because Blocks are subsets of Block Groups, 2020 ACS data could be used to determine the average household population in the Block Groups, instead of using one average for the whole city. Since the precedent has been set to use voting population in the city, the population '18 or over' was used to calculate the final CO number by Block Group and subsequently by Blocks. It also clearly shows the individual Census Block boundaries, which will not be split until just before the next decennial survey. As long as the district population deviation remains under 5%, keeping boundaries contiguous and as compact as possible, adhering to the Voting Rights Act, and maintaining equal and effective representation, the resulting changes can be accepted. The consultant and the City worked together to obtain the most even distribution while resulting in minimal boundary adjustment. To aid in creating effective and mathematically unbiased district boundaries, specialized software for this purpose was used. The software, iRedistrict by Zillionlnfo, uses algorithms to slice up geography into multiple district redraw scenarios that follow population equality and compactness. Factors can be addressed as input to alter the outcome of the new boundaries, such as geographic continuity, equal population, respect existing boundaries, preserve communities of interest, and compactness. The software uses multiple algorithms to derive equality, and the Polsby-Popper Index to maintain compactness. This can be summarized by saying it is 6 34 the ratio between the district area and the area of a circle that has the same perimeter. One criterion is that the residences of the commissioners has to remain in their own district. District boundaries also have to be contiguous so there is no isolated portion of a district without continuous access to the rest of the district. To get to an equal district distribution by population, Census Blocks had to be exchanged or traded amongst adjacent districts to satisfy the 5% deviation requirement. While there were multiple alternative scenarios if the existing districts were not kept close to their existing shape but that started to take away from the compactness or would deviate greatly from existing boundaries. District Changes Here we will enumerate the changes that took place during the proposed district re- alignments. The map below highlights the changes from the 2019 District Map. The 35 numbers indicated show addition or subtractions from previous district. This image shows how the previous boundaries are not bounded by streets, as is defined in the Charter: 0 8 36 The new alignment automatically adheres to Charter because the Census Block boundaries use streets, water bodies, and jurisdictional boundaries. Because the 2022 district boundaries were redrawn using the new geographical boundaries of the 2020 Census Blocks established by the Census Bureau (which were slightly different from the 2010 Census Blocks and parcels used in drawing the 2019 District boundaries), it is not necessary to note the changes in population by Census Block resulting from changing a Census Block from one District to another District because the change was required to adhere to the traditional districting principle of using whole Census Blocks to configure the overall boundaries of each District. The table below uses the abbreviation "GEO" to denote a Census Block population change from one District to another District. What it also tells us is there is not a whole lot of wiggle room for shifting districts across current district boundaries. District 5 has the vast majority of large Census Blocks. The Census Bureau will not split up Blocks until there is more development between now and the next Decennial Census survey. There does appear to be enough development in the northern part of District 5 to warrant a Block split in the future. That could be the opportunity to keep District 5 from going over the 5% mark in the future.
