TITLE
Lake Jesup Reclaimed Plant Investigation
SUMMARY
The City Commission approved Resolution 2021-09 on July 12, 2021
authorizing, pursuant to Section 4.11 of the City Charter, an investigation
related to the City's Consumptive Use Permits issued by St.Johns River Water
Management District and the multi-phase expansion of the City's Reclaimed
Augmentation Plant at Lake Jesup and related distribution system(s) identified
and proposed in the September 20, 2005 Reclaimed Water Augmentation
Study.
On August 9, 2021, the City Commission voted to approve a list of individuals
to be provided administrative subpoenas. Subpoenas were approved and
sent out to the following individuals:
Mr. Brian Fields, Former Community Development Director
Mr. Kip Lockcuff, Former Public Works and Utilities Director
Mr. Kevin Smith, Former City Manager
Mr. David Gierach, CPH Engineering
Mr. Terry Zaudtke, CPH Engineering
Mr. Rick Brown, Former Commissioner*
Mr. Ken Greenberg, Former Commissioner
Mrs.Jean Hovey, Former Commissioner
Mrs.Joanne Krebs, Former Commissioner
Mr. Charles Lacey, Former Mayor
Mr. Cade Resnick, Former Commissioner
A special meeting was held on September 20, 2021 at which Mr. Brian Fields
and Mr. Kevin Smith appeared and provided testimony. Also in attendance
was the legal representative for all former Commissioners, former Mayor
Charles Lacey, and former Public Works Director Kip Lockcuff. The
representative informed the Commission he had advised his clients not to
appear and provided written answers to questions provided by Mr. Lockcuff.
Prior to the September 20th meeting, City Attorney Anthony Garganese

received a letter from CPH's representatives that Mr. Gierach and Mr. Zaudtke
would be unable to attend and that they would work with the City to schedule
a new date. City Staff and the City Attorney worked with CPH and Mr. David
Gierach appeared and offered testimony on January 31, 2022.
At the January 31 st meeting, the Commission asked the City Attorney to
attempt to schedule the appearance of Mr. Terry Zaudtke and Mr. Goucher
from CPH by the end of February and noted that they would discuss next
steps at the February 28, 2022 City Commission Regular Meeting.
RECOMMENDATION
Staff recommends the Commission provide direction on next steps they
would like to take in regards to the investigation and the Lake Jesup
Reclaimed Water Augmentation Plant.
