Chairperson Matthew Criswell called to Order the Tuesday, February 22,
2022 Regular Meeting of the Code Enforcement Board at 5:30 p.m., in the
Commission Chambers of the Municipal Building (City Hall, 1126 East
State Road 434, Winter Springs, Florida 32708.

include that the respondent admitted renting the property between
December 28th and January 3rd.

Note: The Respondent was present.
Deputy Chief Matt Tracht, Winter Springs Police Department offered
testimony on the procedures of notice and the violation. Deputy Chief
Tracht also showed photos from “Presentation” and invited Ms. Jennifer
Kenast to provide testimony.
Ms. Jennifer Kenast, 36 Jackson Circle, Winter Springs entered 18
photographs into the record and offered testimony regarding a long-
standing dispute with her neighbor and the impact of her neighbor’s
lights which she noted illuminated her yard and her bedroom and
which were on for long periods of time.
Ms. Yesenia Newman, 34 Jackson Circle, Winter Springs entered 23
photos into the record and offered testimony regarding the long-
standing dispute and noted safety concerns for her family, related to
her neighbors and wildlife, as the reason the lights were needed.
Deputy Chief Tracht recommended a fine of two-hundred and fifty
dollars ($250) a day if the respondent did not adjust the lights within six
(6) calendar days, February 28, 2022.
Discussion followed with Board Members asking about light placement
and the ability to adjust the lights to minimize impact onto
neighboring properties.

HARASS THE ADJACENT PROPERTY OWNER AND HAVE REFUSED TO
REMEDY THIS NUISANCE DESPITE REPEATED ENCOUNTERS WITH THE
WINTER SPRINGS POLICE DEPARTMENT AND REQUESTS TO DO SO. I
ASK THAT THIS BOARD ORDER THE HOMEOWNER TO ADJUST ALL
LIGHTING AS TO NOT SHINE ANYWHERE WITHIN REASON ONTO 36

Department introduced the case, offered testimony on the procedures
of notice and the violation, and showed photos from the “Presentation.”
Ms. Sanchez recommended a compliance date of February 28, 2022 and
a two-hundred and fifty dollar ($250) per day fine if this was not met.
Mr. Jeff Williams, 700 Cottontail Court, Winter Springs offered testimony
regarding contractor issues, admitted to the violations, and asked for at
least 90 days to try to correct the situation.
Discussion followed on necessary time and the Board asked if six (6)
months would be sufficient time to remedy the situation. Mr. Williams
was confident that six (6) months would be sufficient.

•This case originated on November 14,2021.
•This complaint came from a neighbor who was
concerned that the fence was installed without
permits.
•A written warning was left at the property and a
Notice of Violation was sent certified mail on
November 15,2021. The notice was delivered on
November 22,2021 and the green card returned.
•I spoke to the new tenant on January 24, 2022
about the fence not being permitted and he said
he would let the landlord know that I stopped by.

fence permit has been applied for.
•March 07,2022 Notice of Code Board Hearing
mailed Certified Mail, First Class, posted at the
property and City Hall.

•Date verified complaint: November 17, 2021.
•Actions taken: Started the case with a door hanger written warning regarding seeing the shingles piled on the roof. No permit was showing in system.
•December 7, 2021 I checked property and it appeared that all of the shingles had been replaced.
•December 14, 2021 I sent a Notice Of Code Violation to the owner of property.
•January 25, 2022, the letter was returned.
•February 4, 2022, I posted the property with the Notice Of Code Violation.
•February 7, 2022, Edward the tenant called advising Code Officer Quinn that the roof company told him since it was less than 25 percent of roof did not need a permit.

THIS CAUSE having come on for consideration, after being duly noticed, before the Code
Enforcement Board of the City ofWinter Springs, Florida,on January 25, 2022 to determine whether any
violations of the City of Winter Springs Code of Ordinances("City Code")exist or existed on the Property.
The Board, having heard the arguments of the parties and the evidence and testimony presented, and
having reviewed the record and being otherwise fully advised, issues the following Findings of Fact and
Conclusions of Law which are incorporated into this Order as set forth herein.
Findings of Fact and Conclusions of Law
Based upon the evidence and testimony presented at this hearing, the Code Enforcement Board
finds:
1. That the property at issue in this matter is located at 674 Venture Court, Winter Springs,
Florida 32708 ("Property") and is assigned the following Parcel ID# 01-21-30-5JJ-0000-6000. The
Property is owned by Michael T. Boulet("Respondent").
2. That the Respondent was provided a Notice of Violation in accordance with Sections 2-60
and 2-61 of the City Code and consistent with sections 162.06 and 162.12, Florida Statutes.

and that Respondent was further provided a reasonable time to correct said violation(s): Section(s) 6-195
Maintenance of Fences, City Code.
4.That the Respondent either failed or refused to correct such violations within the reasonable
time period provided in the Notice of Violation.
5.That the Respondent was provided a Notice of Hearing before the Code Enforcement
Board,in accordance with the City Code and consistent with sections 162.06 and 162.12,Florida Statutes.
No respondent was present to provide sworn testimony at the hearing.
6.That based on the testimony and evidence presented, the Respondent violated the City
Code,to wit: Section(s) 6-195 Maintenance of Fences, City Code.
7.That said violations exist or existed within the City of Winter Springs and that such
constitutes violations of the City Code.
BASED UPON THE FOREGOING FACTS AND CONCLUSIONS, IT IS HEREBY
ORDERED:
1.The Respondent be given until February 28, 2022 to correct the violation(s) of the City
Code on the Property.
2.If the Respondent fails to correct the violations within the time period set forth herein, the
Code Enforcement Officer shall schedule a compliance hearing before the Code Enforcement Board and
Respondent shall be duly noticed and given an opportunity to appear and present evidence as to the status
of the violations on the Property.Upon a finding by the Code Enforcement Board that the Property remains
in violation, a fine will be entered in the amount of TWO HUNDRED AND FIFTY DOLLARS
250.00) per day beginning on February 28, 2022 and continuing to accrue daily until the violation(s)
come(s) into compliance. The Respondent shall be responsible to provide notice of such violations
being corrected to the Code Enforcement Officer.
3.The Clerk of the Code Enforcement Board may be directed to record a certified copy of
this Order in the public records for Seminole County, Florida, which shall constitute notice to any
subsequent purchasers, successors in interest, or assigns of the subject property, and the findings herein
shall be binding upon the Respondent, any subsequent purchasers, successors in interest, or assigns. If
this Order is recorded and is complied with by the date specified herein, an Order acknowledging
compliance shall likewise be recorded in the public records. A hearing is not required to issue such an
order acknowledging compliance with the original order.
4.Any and all future recurrence(s)of any violation(s)addressed herein, after same have been
corrected, shall necessitate further proceedings before the Board. While the Code Enforcement Officer
shall give the Respondent notice of the repeat violation, the Code Enforcement Officer is not required to
provide Respondent a reasonable time to correct such repeat violation(s). The Board, upon finding such
repeat violation(s)exist(s),may impose a fine not to exceed Five Hundred Dollars($500.00) for each day
the repeat violation continues, beginning with the date the repeat violation is found to have occurred by
the Code Enforcement Officer.

The owner was found to be in violation, and a corrective

During my re-inspection, the residence was still in

notice of hearing at property and City Hall. I also sent

Timeline of Events
On January 25, 2022 I presented this case to the board.
The owner was found to be in violation, and a corrective
action date of February 28, 2022 was afforded. If not
corrected, a fine of 250.00 per day would be assessed.
During my re-inspection, the residence was still in
violation. On March 8, 2022 I posted the non compliance
notice of hearing at property and City Hall. I also sent
certified notice to the owner.

Recommendations
•In regards to this case, I recommend the original order from
the Board be imposed as a 250.00 fine per day until all the
violations are in compliance.
