A RESOLUTION OF THE CITY COMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY,
FLORIDA, AMENDING THE SOLID WASTE RATE
TABLES ADOPTED PURSUANT TO RESOLUTION
2006-06, AS AMENDED BY RESOLUTIONS 2006-08
AND 2006-16; PROVIDING FOR REPEAL OF PRIOR
INCONSISTENT RESOLUTIONS, SEVERABILITY, AND
AN EFFECTIVE DATE.
WHEREAS,the City is granted authority, under Section 2(b),Article VIII, of the State Constitution,
to exercise any power for municipal purposes, except when expressly prohibited by law; and
WHEREAS, the City Commission adopted solid waste rates pursuant to Resolution 2006-06, as
amended by Resolutions 2006-08 and 2006-16;and
WHEREAS, the City Commission adopted solid waste rates pursuant to Resolution 2006-06, as
amended by Resolutions 2006-08 and 2006-16,and such rates have been increased since 2006 due to CPI
adjustments as permitted by the Solid Waste Franchise Agreement adopted pursuant to Ordinance 2006-
01; and
WHEREAS,WastePro of Florida, Inc. has requested and is entitled to increase the applicable rates
included in the attached table due to the increase in disposal costs upon changes in land fill tipping fees
adopted by Seminole County, pursuant to Section 5.2 of the Solid Waste Franchise Agreement adopted
pursuant to Ordinance 2006-01, ; and
WHEREAS, Seminole County has increased its land fill tipping fees via Resolution 2021-R-116 on
August 10, 2021, which shall be a one-hundred percent pass through cost pursuant to the Solid Waste
Franchise Agreement; and
WHEREAS, the City Commission of the City of Winter Springs, Florida hereby deems that it is in
the best interest of the public health, safety, and welfare of the citizens of Winter Springs to amend the
solid waste rate table as set forth herein.
NOW THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, HEREBY
RESOLVES,AS FOLLOWS:
Section 1. Amendment to Solid Waste Tables. The solid waste rate table II adopted under Resolution
2006-16 is hereby repealed and substituted with a new table II that is attached hereto. The attached solid
waste rate table II is hereby fully incorporated herein by this reference. The solid waste rate tables I, III,
IV, and V adopted under Resolution 2006-06 and 2006-16 shall remain in full force and effect.
Section 2. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this
Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
whether for substantive, procedural, or any other reason, such portion shall be deemed a separate,
distinct and independent provision,and such holding shall not affect the validity of the remaining portions
of this Resolution.
Section 3. Effective Date. This Resolution shall become effective on April 11, 2022•
ADOPTED by the City Commission of the City of Winter Springs, Florida,this 11t"day of April, 2022.

Front-Load Additional Charges: Wheels on Containers: $19.69 per month; Locks&Locking Bars:
$19.69 per month;Gates Opening&Closing: $19.69 per month.
(2) Commercial Cart Rates are stated per pick-up, per month.
(3) Beginning March 1, 2007 an annual CPI adjustment not to exceed 2.5%will be applied to the
Contractor Collection Rate upon request of the Contractor.
(4) Disposal Rates are 100% pass through and shall be adjusted accordingly upon changes in Landfill
Tipping fees.
(5) Customer Rates may be amended from time to time as required.
