Commission Chambers of the Municipal Building (City Hall, 1126 East

Please take notice that at 5:30 P.M. on January 25, 2022 the Code Enforcement Board will hold a hearing to determine why you should
not be found in violation of the City Code as follows. The hearing will be held at Winter Springs City Hall located at 1126 East State
Road 434, Winter Springs, Florida.

The cited violation follows: CITY ORDINANCE 20-207 & 20-142
If the Code Enforcement Board finds your property in violation of the above referenced City Code (s) you can be fined up to $250.00
per day for each day the violation continues and you can be charged for the costs that are incurred by the city in prosecuting the case.
In the event violation fines and the costs are not paid within a reasonable time there can be a lien filed against the property in
accordance with Florida State Statute Section 162.09.
The hearing is conducted within guidelines of City of Winter Springs Code 2-60 and Florida State Statutes Chapter 162. You may
appear in person or by an authorized representative. If you choose to not attend the hearing you can lose your right to present facts in
this case. You have the right to present evidence, exhibits, written and oral testimony. The Code Board will subpoena witnesses on
your behalf upon written request to the Code Board through the City of Winter Springs Clerk’s Office.
In the event that you appeal the Order of the Code Enforcement Board, you will be required to have an official record of the
proceedings. You may, at your own expense, arrange for the official transcript of the testimony and evidence presented at the hearing.

We are in receipt of your partial production of our records request-specifically, the email of August 02,
2021, by Anthony A. Garganese to Matt Tracht-copied to Christopher Schmidt and Shawn Boyle.
Of import here, the homeowner, Lisa Rembert nor an agent thereof, do not stay at the house while the
party leasing the property is present. Apparently, everyone except the homeowner, is missing or
ignoring, that critical definition in Anthony’s email. It is apparent that Anthony too, was not given this
important distinction prior to offering his legal opinion.
The definitions provide by your own Counsel confirm our insertions that we are not in violation of city
zoning code-in pertinent part:
“Boarding house or lodging house is a dwelling having one (1) kitchen and used for the purpose of
providing meals or lodging or both for compensation to persons other than members of the family
occupying such dwelling.” See, email dated August 02, 2021 4:45pm from Anthony A. Garganese to
Matt Tracht.
The key phrase to qualify as a “Boarding or Lodging house” is the occupying of the house, at the
sometime. Once again, that is not the case at our vacation rental property in question. Continuing. “A
guest tourist home” is a private dwelling in which transient sleeping accommodations are provided for
compensation.” Id.
In this case, the term transient is defined: A “vacation rental” is a “condominium or” a “house of
dwelling unit” rented on a transient basics. See, e.g., City of Miami v. AIRBNB, 260 So. 3d 478 “Fla. 3rd
DCA 2018”.
Neither of these definitions qualify our property as violators of any current city zoning code for leasing
our property as a vacation rental.
In point of fact, the City’s attempt to do verbal gymnastics with definitions knowingly violates Section
§509.032 Florida Statues which preempts local authority, regarding “vacation rentals”, from prohibiting
or regulating the duration or frequency of rental of vacation rentals.
Should you care to test our resolve on this matter, Notice have been given. You are in violation of
statutory constraints prohibiting this action. Govern Accordingly.

We would expect upon review of the aforementioned insights, that the City, as well as the Code Board,
would be best suited to take Matt Tracht’s advice and “hold off on these.”
We await your response affirming the cancelation of all pending hearings and related alleged violation(s)
concerning our property.

This firm represents the property owner of multiple properties located in Dunmar Estates and
the Enclave at Dunmar Estates—Dale A. Burket, as Trustee of various trusts (the “Trustee”). The Trustee
is the owner of the real property located at 545 Julie Lane, Winter Springs, FL, and 575 Dunmar Circle,
Winter Springs, FL, together with other properties located in the Dunmar Estates community. The
foregoing properties may be found on the Property Appraiser’s website as follows:

A member of the Dunmar Estates community, Lisa Rembert (“Property Owner”), is operating the
Violation Property as a short-term rental (i.e. Airbnb and VRBO), which is in violation of Code Section 20-
142 of the Winter Springs, Florida Municipal Code (the “Code”), as set forth below. This is evidenced by
the listing of the Property on Airbnb, which can be viewed at the following link:

21&unitId=2159022. The websites indicate that the Property is rented out to guests through Airbnb and
VRBO for a majority of the time from now until January of 2022. Per Section 20-142 of the Code, buildings
zoned R-CI may be used only (1) as a single-family dwelling; (2) for horses and ponies; and, (3) for home
occupations. Unlike Section 20-207 of the Code, which defines the permitted uses for buildings in R-3
zoning districts, Section 20-142 of the Code does not permit “Boarding and/or lodging homes” or “Guest
and tourist homes.” According to the Winter Springs Planning and Zoning Quick Reference Guide,

Dunmar Estates and the Property are zoned R-CI. Therefore, short-term rentals are not permissible in
Dunmar Estates under the Code.
We reached out to officials the City of Winter Springs who agreed with this interpretation of the
Code. As such, we respectfully request that the Code Inspector take all acceptable and necessary actions
to prohibit the Property Owner from continuing to operate the Violation Property in violation of Section
20-142 of the Code.

On 5/10/20, at approximately 0140 hours, I responded to 530 Julie Lane in reference to a verbal altercation between weekend
renters and the homeowner. Upon arrival, I made contact with the caller Lisa Rembert. Lisa advised me of the following:
She rented the residence on Booking.com and saw on her cameras that there were more than the agreed upon ten people at the
residence. Due to this she went to the residence and attempted to make contact with the patrons. At which time she was greeted
by unhappy party goers who made unfounded comments about damaging the residence. The party goers left the residence prior
to law enforcement arrival. Lisa advised me she was ok with the remaining patrons to remain at the residence for the remainder of
the reservation.
I then made contact with the customer, Spencer Woodruff, who advised me of the following:
He rented the residence for mother’s day weekend to celebrate. Then a few additional peopled were invited, who then invited
additional people causing the get together to get out of hand. He advised there would be no one else coming to the residence and
that he would clean up the residence.
While leaving the neighborhood I was stopped by a security guard who advised me she has seen several vehicles in the
neighborhood that are not normally in the area. While speaking to her I observed the caller, Lisa, in her red four door vehicle drive
towards the entrance off of Bird Road. Lisa then returned to the area, following two more vehicles, and headed towards Julie Lane
as if she allowed them to enter the neighborhood. Around the same time the Seminole County Sheriff’s Office was conducting a
crash investigation in the area of Tuskawilla Road and East Lake Drive (20201310209) where the subjects involved left the area on
foot.
I then exited the neighborhood and observed a vehicle traveling north on Bird Road at a high rate of speed. I estimated the vehicle
to be traveling at 45mph in the 25mph zone and activated my department issued Genesis II (G2S23888) radar unit and received a
target vehicle speed of 43mph and a clear Doppler tone. Due to the excessive speed and the proximity to both events I attempted
to conduct a traffic stop on the vehicle as it pulled into the entrance to Dunmar Estates. I was unable to see the license plate on
the vehicle due to how it was positioned. When I activated my emergency equipment the vehicle, a dark colored newer model
Chevrolet Malibu with dark tinted windows, fled the area going south on Bird Road. I called this out on the radio and turned off my
emergency equipment and stopped my vehicle, which was facing north. There was a heavy set white or Hispanic male with a
slight beard in the vehicle, but I was not able to tell which seat he was in. I then heard Seminole County unit P3712 (Deputy Morel),
who was on the perimeter of the county event at East Lake Drive and Bird Road called on the radio that a vehicle crashed into the
electric pole at his location and the vehicle was smoking. Due to the vehicle smoking, I went towards the crash. Once on scene I
observed a similar vehicle, which appeared to have gone through the fence around the retention pond and had power lines on the
vehicle. Once additional Seminole County units and the Seminole County Fire Department arrived on scene I left the area.
This concludes my involvement in the case.

On 05/11/2020 at 0304 hours, I arrived at 530 Julie Ln, Winter Springs in reference to a vehicle that was reported stolen. Upon
arrival, I observed a large gathering taking place inside the residence. Eventually, I was able to make contact with a man who was
inside of the residence.
I informed the man that the reason for my visit was a call a 911 call in which someone stated that their vehicle was stolen. I asked
the man if anyone inside of the residence placed the call. The man went inside to find out who placed the call and returned shortly
after to inform me that none of the people inside of the residence placed such a call.
I informed dispatch that the complainant was not at the residence and asked them to make contact again to retrieve the caller’s
location. Dispatch made contact with the complainant and informed me that they were at the intersection of Bird Rd and Lake
Drive on the scene of a traffic accident involving their vehicle.
I arrived at the intersection of Bird Rd and Lake Drive and made contact with Shayeeda Daniels who advised that her vehicle was
stolen and that it was the vehicle involved in the accident. Deputies who were already on scene advised me that Shayeeda arrived
on scene in a black passenger vehicle a few minutes earlier. I asked Shayeeda how she knew where to find her vehicle and she
stated that she was driving around in the area and found it. Shayeeda initially stated that the vehicle was stolen from 530 Julie
Lane but later recanted and stated that it was stolen in Orlando.
Shayeeda’s vehicle was severely damaged due to the traffic crash and was occupied by a man who was later identified as Michael
Green. Shayeeda stated that she did not know who the man was numerous times.
Michael was trapped inside of the vehicle and the Seminole County Fire Department was in the process of removing him from the
vehicle as I stood by on scene. Eventually, Michael was removed from the vehicle and I was able to gather his name shortly
before he was loaded into a rescue vehicle and transported to the Orlando Medical Center.
Due to Michael’s size and the state he was found, I determined that he was not the driver of Shayeeda’s vehicle. Shayeeda again
stated that she was unaware of who took her vehicle. Shayeeda could not provide me with a reasonable explanation of how she
found her vehicle so I asked her to complete a sworn statement. Shayeeda began working on the sworn statement and I advised
her that providing a false statement was a crime. Shayeeda became uneasy and started making phone calls rather than working
on providing me with a sworn statement.
As I was assessing the vehicle, I noticed that Shayeeda climbed into a silver passenger vehicle and drove away with the clipboard
and paperwork that was provided to her. Deputy Morel was able to make contact with Shayeeda at the intersection of Williams
Road and Fisher Road. Shayeeda advised me that she no longer wanted to provide me with a sworn statement and returned my
clip board. Shayeeda stated that the vehicle was stolen in Orlando and I advised her that she needed to report it stolen with the
Orlando Police Department. Shayeeda stated that she understood and left the scene.
It should be noted that in 2017, Michael was the passenger in a separate stolen vehicle (201750001180). Due to Michael’s medical
condition I was unable to ask him any questions about the circumstances surrounding this event. I was only able to identify him
and ask who was driving the vehicle. Michael stated that he did not know who was driving the vehicle.

On 05/11/2020, I made contact with Lisa Rembert regarding this incident. I explained to Ms. Rembert that the reason for my call
was to discuss the renting of her property was in violation of Executive Order 20-87.
Ms. Rembert stated that she did not believe that she was in violation because she was only renting to individuals under the

at this time and addressed this again under Executive Order 20-112. Ms. Rembert advised that since the incident she has taken
the rental off of the site.
I explained to Ms. Rembert that this was an issue and that she cannot rent out her property moving forward. I also provided Ms.
Rembert the Executive Order for her records. Based upon my conversation with Ms. Rembert, I added a supplemental narrative to
the report outlining my conversation with her.

extent and in the manner that such lot, tract or parcel of land is or may reasonably become infested or inhabited by rodents, vermin or wild animals, or may furnish a breeding place for mosquitoes, or threatens or endangers the public health, safety, or welfare, or may reasonably cause disease, or adversely affects and impairs the economic welfare of adjacent property, or any other objectionable, unsightly substance or material tending by its existence and/or accumulation to endanger or adversely effect of health, safety, lives, and/or welfare of the citizens of the city, is hereby prohibited and declared to be a public nuisance and unlawful.
WS City Ord. 13-2 (b) (b) It shall be unlawful for any person to cause or permit junk, scrap metal, scrap lumber, wastepaper products, discarded building materials, or any unused abandoned vehicle, or abandoned parts, machinery or machinery parts, garbage, trash or other waste materials to be in or upon any yard, garden, lawn, outbuildings or premises owned, rented, leased or otherwise occupied by him/her in the city unless in connection with a business enterprise lawfully situated and licensed for the same.
WS City Ord. 12-53 (a) No person in charge or in control of any property, public or private within the city, whether an owner, tenant, occupant, lessee, or otherwise, shall allow any derelict, disabled or abandoned vehicle to be placed or remain on any roadway, street, alley, highway, private property, public property, public right-of-way or easement unless such vehicle is within a completely enclosed building, or is on the premises of an automotive repair or storage business for which the owner of the business has a current city occupational license and zoning approval. However, a disabled vehicle may not remain on the premises of an auto repair business or storage business in excess of one hundred eighty (180) days. A vehicle covered with a car cover does not constitute enclosure or storage of disabled vehicle.
(b) Evidence. A vehicle will be in violation of this section if it is in a state of evident disuse, neglect or abandonment. Evidence may include, but not limited to, factors such as: at the same location for forty-eight (48) consecutive hours, vehicle being wrecked, and/or inoperative as evidenced by vegetation underneath as high as the vehicle body or frame, refuse or debris collected underneath or the vehicle being used solely for storage purposes, if it is partially dismantled, having no engine, transmission, or other major and visible parts, having major and visible parts which are dismantled, having no valid license tag, or being in any physical state rendering it inoperable or unsightly to the neighborhood.
(c) Interpretation of this requirement. Nothing in this part shall be construed as permitting the disassembling, the tearing down or scrapping of a vehicle or to permit one vehicle to be scavenged or stripped for parts for use on another vehicle.
(d) Responsibility for compliance. The owner, agent and/or tenant of the property on which the violation occurs and the owner of the disabled vehicle shall be jointly and individually responsible for compliance with the requirements of this section.
(e) Enforcement. When a disabled or abandoned vehicle is found to be in violation of this section:
(1) The code inspector shall place a written notice on the vehicle's window indicating that it is in violation of this section and that it must be removed within ten (10) calendar days or it will be subject to removal by the city. The code inspector shall make every reasonable attempt to ascertain the owner of the vehicle and the owner of the property, and shall notify such owner(s) with a written notice delivered by personal service or mail at their current address, last known address or the address appearing on the certificate of title for the vehicle. Such notice on a vehicle window shall not be less than eight (8) inches by ten (10) inches and shall be fluorescent orange in color, sufficiently weatherproofed to withstand normal exposure to the elements.
(2) Within the ten (10) calendar day period specified in the notice, the owner of the vehicle or the owner of the property or an authorized agent may appeal to the director of code enforcement or his/her designee. The director of code enforcement or his/her designee shall determine the validity of the violation and may for good cause extend the time for compliance or removal. If such an appeal is made, no removal shall be required until after said appeal has been finally determined.

(3) The property or vehicle owner(s) may appeal the director's or his/her designee's final decision to the code enforcement board or special magistrate for a determination as to whether the property is subject to removal.
(4) If no appeal is made and the disabled vehicle remains in violation after the ten (10) calendar day period, the director or his/her designee shall cause such vehicle to be removed to a storage facility approved by the city commission and thereafter disposed of in accordance with applicable state law or city ordinance.
(5) The authorization in this section for towing of abandoned and disabled vehicles shall not be construed so as to negate the authority of the code enforcement board or special magistrate to hear and adjudicate appropriate cases.
(f) Vehicle on public property. Not withstanding any of the foregoing, all vehicles which are located on public property shall be towed and disposed of in accordance with notice and sale requirements of Florida Statute 705, as revised in the 1987 legislative session. To the extent that this section 12-53 conflicts with any portion of Florida Statute 705, the latter shall control as to any vehicles located on public property.
WS City Ord. 20-411 (b) Campers, camp trailers and boats and trailers may be parked temporarily in the driveway of residential zone areas for a period of time not to exceed forty-eight (48) hours within any ten (10) consecutive day time period for the limited purposes of loading, unloading and general maintenance. For purposes of this section, "driveway" shall mean the private access area designed and approved for the parking of private vehicles.
WS City Ord. 20-438 (a) The parking of any vehicle within the front yard of any residential lot shall be prohibited unless said vehicle is parked on a driveway and/or designated parking area that meet the requirements set forth in section 20-439 of the City Code.
(b) The parking of any vehicle on or over any sidewalk adjacent to any residential lot is hereby prohibited. For purposes of this subsection, the term sidewalk shall be as defined in section 316.003, Florida Statutes, and shall include any portion of a sidewalk that traverses a driveway.
(c) A violation of this section may be prosecuted before the code enforcement board or special magistrate or shall be classified as class I civil citation violation.
WS City Ord. 6-87 (a) Definition: For purposes of this section, "temporary storage structure" shall mean a structure designed and used primarily for storage of building materials, household goods, and other such material; and that is not intended for permanent installation.
(b) A supplier of a temporary storage structure shall obtain a permit issued by the building department prior to supplying and installing or allowing to be installed a temporary storage structure within the City of Winter Springs. The permit shall be limited to a specific address and shall allow the installation at such address for a maximum of seventy-two (72) consecutive hours. Permits shall also be limited to a maximum of two (2) per any twelve-month period for any specific address. A permit fee shall be required by resolution of the city commission and collected by the city. The permit shall contain the date and time of issuance, the name of the person to whom the temporary storage structure is supplied, and the address at which the temporary storage structure will be installed. Notwithstanding the foregoing seventy-two hour time limit, the city may permit the use of a temporary storage structure, on a property that currently contains a commercial use, for the entire time period beginning October 15 and ending January 31 of the immediately following calendar year if such temporary storage structure is used to store seasonal deliveries and golf carts utilized by seasonal delivery personnel as authorized by section 316.2126(3)(a) Florida Statutes.

(c) In the event of a tropical storm or hurricane watch issued by the National Weather Service, the city shall have the right to order the supplier to remove the temporary storage structure by providing the supplier at least twenty-four (24) hours' notice of removal. In the event of a tropical storm or hurricane warning issued by the National Weather Service, the temporary storage structure shall be immediately removed by the supplier after the warning being issued. In such situations, the city shall have the right to enter the property and remove the temporary storage structure if the supplier does not remove the temporary storage structure as required by this subsection. The supplier shall be liable for all removal costs incurred by the city and failure to pay said costs, upon demand by the city, shall constitute a code violation and shall result in a lien being imposed pursuant to Chapter 162, Florida Statutes, in the amount of said costs.
(d) For good cause shown by the owner of the property at which the temporary storage structure will be supplied, the time periods set forth in subparagraph (b) may be extended by the city manager. The duration of the extension shall be reasonably related and proportionate to the cause shown but shall not exceed more than thirty (30) days per extension. Good cause shall be limited to emergencies and situations where there exists a reasonable risk or threat to life and property damage.

•Date you verified complaint: March 2, 2021
•Actions taken: Notice of Code Violation was sent to the owner of the property.
March 22, 2021 the letter was received per
tracking receipt.
•March 24, 2021 I received a call from Connie Mcinturffrequesting an extension due to her husband passing and the funeral was that weekend. We agreed on extension date of April 6, 2021.
•May 12, 2021 the fence had been fixed. The grass had been cut and debris cleaned up. The tarp was still on the roof.
•June 30, 2021 I attempted to call Mrs. Mcinturff to get an update since the roof due date was approaching and left a message.

•July 2, 2021 I received a call back from Mrs.
Mcinturff advising she was waiting on funds from
insurance company. She requested another extension
until August 9, 2021.
•August 4 & November 5, 2021 I attempted to call Mrs.
Mcinturff no answer and left messages.
•December 8, 2021 I posted the property and City Hall
with the notice of Code Board hearing. I also sent
certified letter same day.
•USPS website advises letter still in transit since
December 17, 2021
•There has been no further contact from Mrs.
Mcinturff.

was cleaned up and the van had been cleaned off. The

•December 30, 2021 I posted the property and City Hall with notice of Code Board. I also sent the certified letter to owner. While posting property I
noticed all of the items still piled by the sliding
glass door. The van appeared to not have been moved
debris all over the outside of it.

AND ORDER(FIRST VIOLATION)
THIS CAUSE having come on for consideration, after being duly noticed, before the Code
Enforcement Board of the City of Winter Springs, Florida, on April 27, 2021 to determine whether any
violations of the City of Winter Springs Code of Ordinances("City Code")exist or existed on the Property.
The Board, having heard the arguments of the parties and the evidence and testimony presented, and
having reviewed the record and being otherwise fully advised, issues the following Findings of Fact and
Conclusions of Law which are incorporated into this Order as set forth herein.
Findings of Fact and Conclusions of Law
Based upon the evidence and testimony presented at this hearing, the Code Enforcement Board
finds:
1. That the property at issue in this matter is located at 207 Bennett Street, Winter Springs,
Florida 32708 ("Property") and is assigned the following Parcel ID# 34-20-30-509-0400-0170. The
Property is owned by Kathleen M. Thomas - Trustee("Respondent").
2.That the Respondent was provided a Notice of Violation in accordance with Section 2-59,
2-60 and 2-61 of the City Code and consistent with sections 162.06 and 162.12, Florida Statutes.
3. That violations ofthe following sections ofthe City Code exist or existed upon the Property
and that Respondent was further provided a reasonable time to correct said violation(s): Sections 20-434

4. That the Respondent either failed or refused to correct such violations within the reasonable
time period provided in the Notice of Violation.
5. That the Respondent was provided Notice of Hearing before the Code Enforcement Board,
in accordance with the City Code and consistent with sections 162.06 and 162.12, Florida Statutes. The
Respondent was present and provided sworn testimony at the hearing. Respondent admitted the existence
of the violations upon the Property. A new mailing address was confirmed during hearing for purposes of
notice to Respondent.
6.That based on the testimony and evidence presented, the Respondent violated the City
Code, to wit: Sections 20-434 Authorized Commercial Vehicles in Residential Areas, City Code and 20-
438 Parking Vehicles in Residential Front Yards and on Sidewalks Prohibited, City Code.
7.That said violations exist or existed within the City of Winter Springs and that such
constitutes violations of the City Code.
BASED UPON THE FOREGOING FACTS AND CONCLUSIONS, IT IS HEREBY
ORDERED:
1. The Respondent be given until April 29, 2021 to correct the violation(s) of the City Code
on the Property.
2.If the Respondent fails to correct the violations within the time period set forth herein, the
Code Enforcement Officer shall schedule a compliance hearing before the Code Enforcement Board and
Respondent shall be duly noticed and given an opportunity to appear and present evidence as to the status
of the violations on the Property. Upon a finding by the Code Enforcement Board that the Property
remains in violation,a fine will be entered in the amount of TWO HUNDRED AND FIFTY DOLLARS
250.00) per day beginning on April 29, 2021 and continuing to accrue daily until the violation(s)
come(s) into compliance. The Respondent shall be responsible to provide notice of such violations
being corrected to the Code Enforcement Officer.
3. The Clerk of the Code Enforcement Board may be directed to record a certified copy of
this Order in the public records for Seminole County, Florida, which shall constitute notice to any
subsequent purchasers, successors in interest, or assigns of the subject property, and the findings herein
shall be binding upon the Respondent, any subsequent purchasers, successors in interest, or assigns. If
this Order is recorded and is complied with by the date specified herein, an Order acknowledging
compliance shall likewise be recorded in the public records. A hearing is not required to issue such an
order acknowledging compliance with the original order.
4.Any and all future recurrence(s) of any violation(s)addressed herein, after same have been
corrected, shall necessitate further proceedings before the Board. While the Code Enforcement Officer
shall give the Respondent notice of the repeat violation, the Code Enforcement Officer is not required to
provide Respondent a reasonable time to correct such repeat violation(s). The Board, upon finding such
repeat violation(s) exist(s),may impose a fine not to exceed Five Hundred Dollars($500.00) for each day

used solely for storage purposes, if it is partially dismantled, having no engine,
transmission, or other major and visible parts, having major and visible parts which
are dismantled, having no valid license tag, or being in any physical state rendering
it inoperable or unsightly to the neighborhood.
c) Interpretation of this requirement. Nothing in this part shall be construed as
permitting the disassembling, the tearing down or scrapping of a vehicle or to permit
one vehicle to be scavenged or stripped for parts for use on another vehicle.
d) Responsibility for compliance. The owner, agent and/or tenant of the property on
which the violation occurs and the owner of the disabled vehicle shall be jointly and
individually responsible for compliance with the requirements of this section.
e) Enforcement. When a disabled or abandoned vehicle is found to be in violation
of this section:
1) The code inspector shall place a written notice on the vehicle's window
indicating that it is in violation of this section and that it must be removed within ten
10) calendar days or it will be subject to removal by the city. The code inspector
shall make every reasonable attempt to ascertain the owner of the vehicle and the
owner of the property, and shall notify such owner(s) with a written notice delivered
by personal service or mail at their current address, last known address or the
address appearing on the certificate of title for the vehicle. Such notice on a vehicle
window shall not be less than eight (8) inches by ten (10) inches and shall be
fluorescent orange in color, sufficiently weatherproofed to withstand normal
exposure to the elements.
2)Within the ten (10) calendar day period specified in the notice, the owner of the
vehicle or the owner of the property or an authorized agent may appeal to the
director of code enforcement or his/her designee. The director of code enforcement
or his/her designee shall determine the validity of the violation and may for good
cause extend the time for compliance or removal. If such an appeal is made, no
removal shall be required until after said appeal has been finally determined.
3) The property or vehicle owner(s) may appeal the director's or his/her designee's
final decision to the code enforcement board or special magistrate for a
determination as to whether the property is subject to removal.
4) If no appeal is made and the disabled vehicle remains in violation after the ten
10) calendar day period, the director or his/her designee shall cause such vehicle
to be removed to a storage facility approved by the city commission and thereafter
disposed of in accordance with applicable state law or city ordinance.
5) The authorization in this section for towing of abandoned and disabled vehicles
shall not be construed so as to negate the authority of the code enforcement board
or special magistrate to hear and adjudicate appropriate cases.
f) Vehicle on public property. Not withstanding any of the foregoing, all vehicles
which are located on public property shall be towed and disposed of in accordance
with notice and sale requirements of Florida Statute 705, as revised in the 1987
legislative session. To the extent that this section 12-53 conflicts with any portion of
Florida Statute 705, the latter shall control as to any vehicles located on public
property.

WS City Ord.20-431 In order to protect and promote the public health, safety and welfare, and among
other purposes, to provide light, safety from fire, safety from other damages and to
protect property owners from certain general nuisances associated with the
unregulated parking, storage or maintenance of certain vehicles, the parking,
storage or maintenance of certain vehicles as herein specified in the areas herein
specified are prohibited except as herein provided:
1) Prohibitions:
a. Except as provided in section 20-434 below, no person owning, renting or leasing
real property in a residential zoned district shall cause or allow to be parked on any
residential property a commercial vehicle as defined in section 20-432.
b. No person owning, renting, leasing or otherwise being in control of the use of any
lot, parcel or piece of real property located in a residentially zoned district or living
thereupon shall cause or allow any vehicles as enumerated in (1)a. above to be
parked, stored or maintained upon such property.
c. No recreational vehicles shall be occupied as temporary living quarters while
such recreational vehicle is parked or stored within a residentially zoned district in
the city. No recreational vehicle parked or stored in the city shall have its wheels
removed except for repair or maintenance.
d. No recreational vehicle shall be parked in such a way that it shall obstruct the
view of traffic or impede the vision of vehicular traffic.
e. No more than one (1) recreational vehicle shall be parked on an owner's property
at any one (1) time.
f. All recreational vehicles and boats parked or stored in a residentially zoned
district, or upon any property containing a residential use, shall be parked or stored
behind the front building line. No recreational vehicle in excess of twenty-eight (28)
feet in length or boat in excess of twenty-three (23)feet in length, shall be parked or
stored in a residentially zoned district, or upon any property containing a residential
use, without a permit issued by the city manager or the city manager's designee. A
permit shall not be issued unless the following criteria are met:
1. The recreational vehicle, boat or boat trailer shall be parked or stored behind the
front building line and parked on a paved parking surface, provided, however, that a
permit may be issued for a boat which, as of the effective date of this code section
July 28, 2014], has regularly been parked on an unpaved parking surface behind
the front building line for at least sixty (60) days.
2. The recreational vehicle, boat or boat trailer shall be located in the driveway area
permitted for the parking of passenger cars provided such driveway area is located
behind the front building line. There must remain sufficient area in the driveway for
the off-street parking of two (2) passenger cars without blocking the sidewalk area.
3. The recreational vehicle or boat shall not be used as a living unit when parked in
a residential district or upon any property containing a residential use.
4. A recreational vehicle, boat or boat trailer must be inspected to ensure it is in a
state of good repair with respect to exterior appearances. Recreational vehicles
shall have a valid registration and license plate. Boats and boat trailers must be
registered in accordance with Florida law. Prior to a permit being issued, the

property owner shall grant the City access to the recreational vehicle, boat or boat
trailer for purpose of this inspection.
5. The recreational vehicle, boat or boat trailer must be screened on all sides with a
minimum six-foot wall, opaque landscaping, or opaque fence. If landscaping is used
for screening, said landscaping must be maintained in a manner to provide
adequate screening. The area where the recreational vehicle. boat or boat trailer is
parked must be maintained in such a manner as to prevent the growth of high
weeds and the presence of garbage and other debris.
6. The recreational vehicle, boat or boat trailer shall be owned by a person residing
on the subject property.
The city manager shall be permitted to impose reasonable special conditions on
permits issued under this subsection to the extent required to ensure compliance
with the aforementioned criteria. In addition. permits approved under this subsection
shall specify and be limited to the recreational vehicle, boat or boat trailer set forth
in the permit application, and shall contain a description of the approved parking
location on the subject property. Any permit issued under this subsection shall
automatically expire twelve (12) months after issuance. Application may be made to
renew such permit subject to all of the criteria, terms and conditions set forth in this
subsection.
g. It shall be a violation of this chapter to park any vehicle enumerated in (1)a.
above or to park any recreational vehicle, boat or boat trailer within the right-of-way
of any city street, alley, lane, way, drive or other thoroughfare overnight.
2) Exceptions. The parking. storage or maintenance of certain vehicles will be
permitted in residentially zoned districts as exceptions to (1)a. through (1)h. above
as follows:
a. Recreational vehicles may be occupied during parking or storage if a permit has
been issued in accordance with section 20-412.
b. A combination of boat trailer with boat and a recreational vehicle is permissible as
an exception to (1)e. above.
c. Any person owning, renting, leasing or otherwise being in control of the use of
any lot, parcel or piece of real property located in a residentially zoned district and
contiguous to the parcel upon which that person's residence is located may use
such contiguous lot as if it were a separate piece of owners property for the parking
of vehicles subject to the restrictions set forth in this section. Provided, however,
that no vehicle owned, operated or under the direct control by other than the person
owning, renting, leasing or otherwise being in control of the use of such lot, parcel
or piece of real property shall be parked thereupon.
d. Commercial vehicles as described in section 20-431 shall be allowed on public
streets or within privately owned driveways or on residential property for the limited
and temporary purpose of loading or unloading goods or materials for the property
owner upon whose property or adjacent to whose property the commercial vehicle is
parked.
3) Definitions. As used in this section, the following words are to be interpreted as
having their commonly accepted meanings as well as the following specific

definitions. If the two (2) definitions are in conflict, the definition provided herein is to
prevail:
Boat trailer. A trailer designed to carry a boat is a boat trailer with or without a boat
thereon. If with a boat, then both boat and trailer will be measured.
b. Camping trailer. A vehicular portable structure mounted on wheels, constructed
with collapsible partial side walls of fabric, plastic or other material, for folding
compactly while being drawn by another vehicle, and when unfolded at the site or
location providing temporary living quarters, and the primary design of which is for
recreation, camping or travel use.
c. Travel trailer. A vehicular portable structure built on a chassis designed to be
pulled by an automobile or truck and to be used as a dwelling for recreation, travel
or living purposes. The vehicle shall be equipped with tanks for storage of water and
for holding of sewerage and shall have an interior light system operable from a
source of power from within the vehicle.
d. Motor home. A structure, built on and made an integral part of a self-propelled
motor vehicle chassis primarily designed to provide temporary living quarters for
recreation, camping or travel use.
e. Occupy. To reside in or use as owner, tenant or occupant for the purpose of
eating, sleeping, bathing, entertaining or such other activities.
f. Overnight. A period commencing at 7:00 p.m. on one (1) day and terminating at
7:00 a.m. on the day immediately following or any period therein contained of more
than seven (7) hours.
g. Owner's property. The property of owners of the parked or stored vehicle. This
section only applies to property in residentially zoned districts.
h. Recreational vehicle. Camping trailer, truck camper, motor home, house trailer or
other such vehicle designed or modified to provide temporary living quarters or
designed or modified to facilitate recreation, camping or travel by accommodating
the needs for temporary quarters.
i. Residentially zoned districts. Any residential district as identified in sections 20-
101, 20-121, 20-141, 20-161, 20-181, and 20-206. Such districts to include but not
be limited to: R-U, R-1AAA, R-C1, R-1AA, R-1A, R-1 and R-3.
j. State of good repair. The vehicle must be functional, usable and in such a state as
it may be used without further repair or alteration for the purpose for which it is
intended.
k. Temporary living quarters. Any vehicle used on a temporary basis for the purpose
of eating, sleeping, bathing, resting, entertaining or other such activities normally
associated with residential property or recreational vehicles.
I. Truck camper. A portable structure, designed to be loaded onto, or affixed to, the
bed or chassis of a truck, constructed to provide temporary living quarters for
recreation, camping or travel use.

4) Penalty.
a. It is unlawful for any person to violate this division or fail to comply with any of its
4,1 requirements. The judge shall consider the costs incurred in enforcing this division
in determining the amount of any fine assessed.
b. The owner or tenant of any building, structure, premises or part thereof, and any
other person who commits, participates in, assists in, or maintains such violation
may each be found guilty of a separate offense and suffer the penalties herein
provided.
c. Nothing herein contained shall prevent the city from taking such other lawful
action as is necessary to prevent or remedy any violation or nuisance.
