Definitions • Respondent 2 – Respondent’s Trial Brief and Memorandum of Law The following individuals provided testimony: Ms. Lisa Rembert, 530 Julie Lane, Winter Springs offered testimony regarding her interpretation of several legal definitions within the City Code, and admitted renting or leasing the property via vacation rental sites such as VRBO and Air BnB to others as a vacation rental. The respondent further testified that she has rented the Property as a vacation rental on multiple occasions in the last twelve months and she estimated having rented the Property four times for less than seven days, and having rented the Property three or four times for more than 6 CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING –JANUARY 25, 2022 PAGE 4 OF 8 one week. Respondent further testified that she currently has one pending ten-day vacation rental booking. Mr. Christopher Schmidt, Director, Community Development Department offered testimony regarding permitted and prohibited uses within the RC-1 Zoning District, in which the respondent lives. Deputy Chief Matt Tracht, Winter Springs Police Department offered testimony on the procedures of notice and the violation. Deputy Chief Tracht also showed photos from “Presentation” and provided evidence of several listings of the Property for lease/rent on multiple vacation rental sites. Deputy Chief Tracht recommended a fine of two-hundred and fifty dollars ($250) a day if the respondent did not cancel remaining reservations and stop bookings on the property by 5:00 PM on January 27, 2022. Extensive discussion occurred among Board Members regarding homestead status of the property, restrictions on rentals, guest limitations, and average lengths of stays. Mr. Smith offered closing remarks for the City, noted that Ms. Rembert admitted to renting the property as a vacation rental on numerous occasions and was still accepting reservations in violation of the City Code. Mr. Ford offered closing remarks on behalf of Ms. Rembert. The Board asked what their options were regarding fines. Attorney Nix reviewed City Code Section 162.09(2)(c) and noted that this offered the Board guidance on their ability to reduce any potential fines. Further discussion followed on the respondent’s plans to evict her tenant, timelines for the proceedings, and the status of the property currently. Upon my arrival I was met with, Jennifer Lynn Kenast, she advised the following; She took her dog out to use the restroom and the dog went onto her neighbor, Joseph David Newman, property. She went to retrieve the dog and her neighbor got very upset. Her daughter, Peyton Lynn Kenast, started to videotape the interaction between them. Jennifer’s daughter showed me the video. Jennifer advised she wanted her daughter to record because there is an investigation about Joseph stalking her daughter. After watching the video I went to speak with the neighbors at 34 Jackson Circle. Upon my arrival I was met with, Yesenia Rivera Newman, she advised the following; Her husband noticed the dog around the fence separating their property. She advised he noticed that the daughter was filming him from around the corner of the fence. While speaking with Yesenia, Joseph walked out of the home and wanted to tell me what happened. He advised the following; He noticed the dog by the fence and saw the daughter videotaping him. He walked over and started to film her. He did not know why she was filming him. He stayed by the fence until he walked away to go inside and Jennifer called the police. After reviewing both parties’ videos I determined that there was no crime committed. While speaking with Joseph he pointed out there were BB gun marks and BB’s ammunition on the ground. He showed me the marks on the house and told me they were new. After looking at the side of the house I determined that this would be criminal mischief and pulled a new case number and a new report would be done to discuss the damage. No further information. No law enforcement video. She stated that Joseph stayed on the public road and walked in front of her home yelling at her about her vehicle lights hitting his home. She wanted the event documented. I then made contact with Joseph who stated he had a video of this event. In this video Joseph exited his home, it appeared that Jennifer’s vehicle is in the road as she is pulling into her driveway. Upon arrival, I made contact with Jennifer Lyn Kenast, who advised me of the following: She rode in a separate vehicle to dinner and when she returned home with her family, she observed her neighbor, Joseph David Newman, yelling at her husband. Joseph stated he would get a gun and shoot him (her husband) if he keeps yelling at him. She advised that they have been gone all night. After speaking with Jennifer, I made contact with her husband, James Charles Kenast, who said that when he got home and was unloading his truck, Joseph started yelling at him and accusing him of shooting a BB gun at him. James said he didn’t own a BB gun and did not shoot anything. He did yell back and used profanity. After speaking with James, I made contact with Joseph, who said while he was standing outside with his dog, his neighbor started yelling at him for no reason and then heard what he said to be a BB gunshot whiz by in the air. He then started yelling at his neighbor and stated that he would hit him with a rock if he came to his property. Joseph brought me to the side of his house and showed me his gutter, where he said it was shot with a BB gun. After looking at the marks, it did not appear to be from a BB gun. He also stated that he knows that he should have reported the incident earlier when it happened. I advised both parties to refrain from going onto each other’s property, and this incident will be documented. Both parties agreed to try and maintain the peace. I provided both parties a business card with the case and event numbers. On 06/25/2021, at approximately 1833 hours, I made contact with Joseph who advised he had no further evidence to submit. I explained to Joseph I created a report for Criminal Mischief and provided him with the new case number. No police video available No further information at this time. She advised the following; Her husband, Joseph David Newman, was pulling weeds about a week ago and saw two blue/green BBs on the ground. He looked up and saw new damage to their home from the BBs coming in contact with the window on the side of the home. She advised they had reported previous damage done from BB`s coming in contact with their home. Yesenia let me know that the damage her husband noticed was new. She advised the only way that the BBs could have come in contact with her home is if they were shot from her neighbors at 36 Jackson Circle. Yesenia let me know that the neighbors do not like the floodlight they have. The damage is relatively close to the floodlight. Joseph did not want to fill out a statement form. Yesenia filled out a sworn written statement and wishes to press charges. I provided Yesenia with a victims rights brochure and nondisclosure form I placed a CD with pictures of the damage on the windows in property and evidence under PDM1 Based on gathering all the facts someone committed Criminal Mischief under 200 dollars and under. Upon arrival I made contact with Jennifer Kenast who advised me of the following: Jennifer and her new neighbor at 34 Jackson Circle, have been having issues since the new neighbor started building their new home. Jennifer said, the new neighbor has crossed over to her property multiple times and has not stayed on their side of the property. Jennifer had to build a $10,000 dollar fence to keep the new neighbor’s equipment off her property. Jennifer also informed me, the new neighbor has been rude to her and her husband and they constantly argue. Jennifer has kids that live with her and mentioned that the new neighbor does not go the speed limit on the road and almost hit one of their sons. Jennifer recently spoke to Officer Chavez about the situation via cellphone and was advised to maintain the peace. If the dispute happened again to contact the Winter Springs Police. Jennifer completed a sworn written statement. I made contact with the new neighbor who I identified as Joseph David Newman by his Florida driver license and he advised me of the following: Joseph bought the land and is trying to build his new home without any issues. Jennifer at 36 Jackson Circle, has been interfering with his work. Joseph informed to me, Jennifer and her husband have been complaining about everything they do from the time he starts work on the home, until the time he leaves for the day. Joseph has tried to communicate with her nicely and tried to keep the peace, but Jennifer continues to argue about the property line and the equipment being on her side. Joseph believes Jennifer is the one crossing property lines and has been over multiple times on his side to remove materials from her property. Yesenia, Joseph’s wife has been watching the incident unfold. Yesenia has attempted multiple times to remove her husband from the situation, but Jennifer continues to antagonize the verbal dispute. Upon my arrival I was met with, Yesenia Rivera Newman, she advised the following; Her husband noticed the dog around the fence separating their property. She advised he noticed that the daughter was filming him from around the corner of the fence. While speaking with Yesenia, Joseph walked out of the home and wanted to tell me what happened. He advised the following; He noticed the dog by the fence and saw the daughter videotaping him. He walked over and started to film her. He did not know why she was filming him. He stayed by the fence until he walked away to go inside and Jennifer called the police. After reviewing both parties’ videos I determined that there was no crime committed. While speaking with Joseph he pointed out there were BB gun marks and BB’s ammunition on the ground. He showed me the marks on the house and told me they were new. After looking at the side of the house I determined that this would be criminal mischief and pulled a new case number and a new report would be done to discuss the damage. No further information. I have a neighbor who resides at 34 Jackson Circle who has not only turned the security light on his home to point towards mine but has added 2 additional lights on a trees. He leaves the house light on all night at times. I have purchased 2 trees and blackout curtains for my bedroom, but need to buy additional trees to still block the light. The 2 lights he added to 2 trees come on every time I pull into my driveway. Those 2 lights literally only light up a few feet of his property and mostly on mine. This is being done out of spite due to past issues with him. I am just wondering why the code of ordinances only talks about in pool lighting crossing a property line and not other forms of lighting. I have addressed this with the Winter Springs Police department and Code Enforcement and they tell me since it lights up a portion of his yard there is nothing they can do since there is nothing on the codes so I would like to find a way to include home/additional lights like Sec 6-222 talks about the pool lighting. This was regarding his outdoor lights that were point towards 36 Jackson Circle. Upon arrival, I observed the generator running in the back of his pickup truck. It had a power cord feed to an air compressor that was closer to his garage. I knocked on the door and was met by Mr. Newman. I informed him of why I was there and inquired to when this would stop. He was adamant that he wanted it to end, and live peacefully amongst neighbors. He invited me inside where she showed me that we were working in the bedroom closet installing shelves. I observed the air house running into the closet with a nail gun attached to it. I gave him suggestions on light placement as to not shine into the neighbor`s property. Additionally, I instructed him to call our non-emergency line if he believes that the neighbors light was shinning onto his property. When I left Mr. Newman had a good understanding that any further issues the courts will be deciding the outcome and that they needed to find a way to live in a civil manner as adults. When I got on scene I could hear the generator going. It was 830 when I got out of my truck. I made contact with the complainant and advised her I would take a reading. I measured 25 feet from the fence line and put the tripod at the location near the front yard. I got out my instrument to do the wind speed and temperature. The temperature was 76.1. Humidity showed 72.3 with 0 wind speed. I used the calibration device to calibrate the sound machine. When finished I attached the microphone to the meter and started the reading. I then slowing moved the tripod neck so that is was 5 feet from the ground to do the reading. If I did it before I would not be able to see the screen. I stepped back by the garage for 10 minutes. The whole time conducting the investigation I hear no change in the sound of the generator. I heard no equipment being used. I did hear a radio playing as well. When finished I collected my reading. It was 27.9 LAeq and 33.9 LCeq it ended at 0910 hours. The noise was not a violation at that time. The complainant also told me about the shed in the back of the neighbors property that had no permit. I advised her I couldn`t see it from where I was. I walked further into her yard. There were holes in the fence that I could see into the neighbors yard. I saw a shed. A saw on the ground and a large radio playing in the garage. It did not appear to have any cords. I advised the complainant I would look into the shed complaint. When I left I could see the generator on the the back of the a truck pulled near the fence. I also saw a compressor several feet away. I did not see anyone working. He is building a home so he is using the generator, there is plenty of room for him to put his generator but due to argument last week over him placing items on our fence he now backs up a trailer with his generator inside to directs the noise onto my property up and until the disagreement the generator for the past year has been in the back of the home. No matter where the generator is I can hear and understand he can run it, but my question is he allowed to direct the fumes and noise at my property. I work from home and will have children learning from home in a few weeks and I can tell you its a lot louder in my home now that he is directing at my house. I don`t want an officer out at my home because it will cause him to more angry if he allowed to do so, but if not then we will take that step of having someone come out if that is needed. I spoke to an officer last week and he said he can run the generator but wasn`t sure about intentional directing the noise on to my property. I have read the code enforcement codes online but still unsure since it specially doesn`t state. The meter was set up approximately 30 feet from her property line away from the generator. I conducted a wind, temperature and humidity reading, conducted a calibration test and conducted the 10 minute sound reading. This reading was recorded on a noise investigation field sheet. The results of the LAS/LCS are 64.2 & 70.9. The allowable permitted level of sound in a residential area for 0700-2200 is 60/70. The sound is occurring as a result of a new house construction project located next door at 34 Jackson Circle. During this test, the owner came to the property line and started yelling while i was taking the reading. Apparently this neighbor feud has been going on some time and this is just the latest call for service regarding the two. while still at 36 Jackson Cir. dispatch received a call from 34 Jackson Cir in regards to filling a harassment complaint against his neighbors. Mr. Newman (owner) requested a police response. Once done with 36 Jackson, i drove over to 34 and met with Mr. Newman. I listened to his side, told him why I was there, and that he was in violation of the noise ordinance. Mr. Newman finally moved the generator away from the property line to which he admitted he did intentionally. I took another 10 minute reading form 36 and obtained levels of 60.9/69.3. At that time in informed him that he was still over slightly and he agreed to move the generator a little further away. Furthermore I told him that he would be getting a letter in mail outlining the violation at hand, to which he acknowledged. I will follow up on this case. The neighbor victim, is at a point that she is willing to prosecute. Probable Cause exists for Violation of Florida State Statute 784.048 (2). Over the past year the documented reports of Joseph David Newman constantly berating the victim, purposely putting a running generator on his tailgate of his truck and getting as close to the property as possible, and now putting a light on his house and pointing it at the victim`s house is causing distress of the victim. Joseph David Newman has been and continues to be unwilling to stop the behavior even after many discussions and reports written. Victim, outlines in her sworn statement and detailed documentation that the harassment has been ongoing for almost two years. It had intensified after 7/28/2020 after Joseph David Newman started screaming at her after she called the police because he leaned building materials on the victim’s fence. Victim, has also provided many photographs and video as supporting documentation which were entered into property and evidence under DWS1. A duplicate copy has been submitted to the State Attorney. Joseph David Newman continuously puts a running generator on the tailgate of his truck and backs the truck up to as close as possible to the property line (see attached photograph). This is done even though he has current connected electricity being supplied to the residence. Victim works from home and the generator can be constantly heard in the background as a disruption. Holes have been mysteriously appearing in the fence that belongs to the victim between the two properties that otherwise would not be there (see attached photograph). The constant stress of the situation between neighbors is now causing health issues of the victim. The recent issue, which is currently pending Code Enforcement, is Joseph David Newman has installed residential spotlights on his property and pointed them at the victim’s residence. She said that same day that he started using his generator a loudly again, and coincidently was the day the mug was shown as ordered on Amazon.
