HomeMy WebLinkAbout2021 03 23 Code Enforcement Board Regular Meeting Minutes CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING MARCH 23, 2021 CALL TO OR®ER Chairperson Matthew Criswell called to Order the Tuesday, March 23, 2021 Regular Meeting of the Code Enforcement Board at 5:30 p.m., in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708. Roll Call: Chairperson Matthew Criswell, present Vice-Chairperson Maurice Kaprow, present Board Member Michael Burns, present Board Member Stephen Gildea, present Board Member Carole Giltz, present Board Member Dennis Robinson, present Senior City Attorney Jennifer Nix, present City Clerk Christian Gowan, present Captain Matt Tracht informed the Board that Items 500 and 502 would be pulled as they were in compliance. The Board agreed to the changes and no further agenda changes were made. City Clerk Christian Gowan swore in all those offering testimony - Code Officer Terri Guerra and Respondents. Senior City Attorney Nix noted that the Forms would be incorporated into the Minutes upon approval. CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING-MARCH 23,2021 PAGE 3OFS Code Officer Guerra introduced the case and distributed supplemental information to be included in the record. Code Officer Guerra then testified, "I verified the complaint on December 10, 2019 and Notice of Code Violation was sent to the owner of the property. December 26, 2019 the letter was received. December 26, 2019 1 received a call from the property owner requesting an extension. They advised there was issues with the insurance company and they should be sending the check soon. On June 26, 2020 1 attempted to call the owner with no answer. I left a message. On March 3, 2021 the Code Board Notice was posted at the property and City Hall. First class and certified letter was also sent to the owner on record. On March 5, 2021 the notice was received per the certified receipt." Photos of the property were shown from "Presentation." Code Officer Guerra continued, "As of this hearing, I askthatyou find the homeowner in violation of ordinances that I've given testimony to and would extend up to August 31, 2021, or at the Board's discretion, to come into compliance. If no compliance is met after that additional time I would ask that a fine of two hundred and fifty dollars ($250.00) per day be imposed." Mr. John KPendarvis, 55HayesRoad, Winter Springs i ntrod uced himself and Mrs Christine Pendarvis, 55 Hayes Road, Winter Springs testified, "Not to contradict, I am a FedEx courier and I am not able to answer my phone while driving, I did call her [Code Officer Guerra] back and I told her again we were in a serious debate with our insurance company and she said to let her know if there was any more information. Unfortunately since that time there has not been more information. They've done everything in their power to make it difficult for us to replace our roof because COVID hit, then their lawyer quit, the hearing was pushed back and there was additional time needed to re-inspect so they tried to get the date pushed back. We have had multiple inspectors on our roof and all of them but their personal inspector came back with a report that we need a new roof. Our lawyer has been corresponding with them regularly, we have stopped corresponding with them because it is beyond our means." Mr. Pendarvis said, "We did send additional documents to the inspector and have a case filing with the County. We also have a civil remedy filed with County." Provided documents for the record. "Were trying to do everything we can to get the tarp off. We don't want a tarp on our roof." Discussion followed on reasonable timelines for the necessary work to be done. "I MOVE TO FIND THE RESPONDENT IN VIOLATION OF THE CITY CODE AND ORDER THAT PEPSPONDENT BE GIVEN UNTIL SEPTEMBER 30,2021 TO COPDECTTHE VIOLATION. IN THE EVENTTHE RESPONDENT FAILS TO COMPLY BYTHIS DATE A FINE IN THE AMOUNT OF TWO HUNDRED AND FIFTY DOLLARS ($250.00) SHALL BE IMPOSED FOR EACH DAY THE VIOLATION CONTINUES THEREAFTER."
