Roll Call: Chairperson Matthew Criswell, present Vice-Chairperson Maurice Kaprow, present Board Member Carole Giltz, present Board Member Colleen Murphy, absent - excused Board Member Dennis Robinson, absent - excused Board Member Michael Burns, present Senior City Attorney Jennifer Nix, present City Clerk Christian Gowan, present Item 501 were removed from the agenda because of coming into compliance. Captain Matthew Tracht first began with introducing a new employee to the board Ms. Mariah Quinn the newest Code Enforcement Officer. Captain Tracht informed the Board that the only violation that would be reviewed for the property would be Winter Springs City Ordinance 13- 2(b) Junk and Debris due to the other violations coming into compliance by the meeting. Captain Tracht offered testimony; “This came in as an anonymous email complaint. – It came in on September 11th. On September 14th I went and observed the violation found a lot of junk and debris, excessive grass and weeds, and the address had no building numbers, couldn’t identify the house. I left a written door hanger, a warning door hanger on the door with a correction date of September 18th that came and went with no 5 CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING – OCTOBER 27, 2020 PAGE 3 OF 4 corrections what so ever. Upon re-inspection the door hanger with still hanging on the door. We also drafted a notice of Code Violation, was mailed to the address on file with the Property Appraisers website with the correction date of October 15th. Captain Tracht continues, “Several times, not just on the [September] 30th I have spoken with the owner Mr. Gary and he has been very cooperative, very forth coming, he wants compliance. The guy, Roosevelt [Davis], that he has renting is an elderly male that is trying to fix all of these things himself on his own time and doesn’t understand the concept of compliance dates. So, Mr. Gray went over there and did a lot of those things, he probably just needs a couple more days and he will be in full compliance. [We] did mail out Code Board Notices when those compliance dates weren’t met. So he is aware that it is coming to Code Board tonight.” Photos shown from "Related Case Information." Captain Tracht gave his recommendation as, “As of this hearing I find that you find the home owner in violation of Winter Springs City Ordinance 13-2(b), to be only that I have given testimony to. I am asking for an additional 15 days, I truly believe working with Mr. Gray that within those 15 days he will be at full compliance. However, if not, then a fine of two hundred and fifty dollars ($250.00) per day be imposed.” Discussion. "I MOVE TO FIND THE RESPONDENT IN VIOLATION OF THE CITY CODE AND ORDER THE RESPONDENT MAKE REPAIRS TO THE PROPERTY BY NOVEMBER 11, 2020. IF HE SHOULD FAIL TO DO THAT THEN A FINE OF TWO HUNDRED AND FIFTY DOLLARS ($250.00) A DAY SHOULD BE FOR EACH DAY THE VIOLATION REMAINS." MOTION BY VICE- CHAIRPERSON KAPROW. SECONDED BY BOARD MEMBER BURNS. DISCUSSION. The letter came back in the mail. March 19, 2020 I posted the property with NCV. I had several conversations with Mrs. Callaghan regarding getting house under control She has many issues with her husband being ill. Officer Tracy Fugate also reached out them to assist with getting violations corrected and she refused. 23 Code Enforcement Division Timeline of Events •January 5, 2021 I sent the owners a certified and first class letter regarding Code Board. I also posted the property and City Hall. If no compliance is met after that additional time, I ask that a fine of $250.00 per day. •At this time I’m available for any questions that you may have. 31
